ORDER

Whereas, land to several extent under various Re-Survey numbers was acquired in four phases at Kalapet

and Pillaichavady Revenue Villages by the Directorate of School Education, Puducherry, under the Land Acquisition

Act, 1894 for establishment of Central University;

2. And whereas, some extent of the acquired land was leased out to Pondicherry University for a period of

99 years at a nominal licence fee vide G.O. Ms. No. 12, dated 29-02-1996 of the Chief Secretariat (Education),

Puducherry. Further, some extent of the remaining acquired lands at Pillaichavady Revenue Village was licensed to

Pondicherry Engineering College Society for a period of 99 years vide Licencing Agreement, dated 4th April,1986,

executed between the Secretary to Government, Education Department, Puducherry and M/s. Pondicherry Engineering

College Society, Puducherry, for establishment of Pondicherry Engineering College;

3. And whereas, the following portion of land, falling within the acquired land which has been leased/

licenced by the Directorate of School Education to Pondicherry University and Puducherry Engineering College

Society, in the following sub-divided Re-Survey numbers was requested to be transferred to National Highways

Division, Public Works Department, Puducherry, under the provisions of rules 309, 310(1) and 310(2) of the General

Financial Rules, 2017 on ‘no profit no loss’ basis, for widening the western side of the East Coast Road to maintain

3 meters width from Ch.139/700 kms. to Ch.141/030 kms. (Pillaichavady) in front of Pondicherry Engineering College

4. And whereas, the land at R.S.No. 170/3 falling within the land leased to PIPDIC by the Education

Department, Puducherry, for setting up of Software Technology Park is also now free from any encumbrance

consequent to the expiry of 19 years Licencing Agreement which expired on 30-09-2018;

5. And whereas, the Directorate of School Education has proposed to effect the transfer of the said land

subject to the following conditions;

(i) The proposed land shall be used only for the widening of East Coast Road and not for any other

purpose;

(ii) If, the land is not utilised by the Public Works Department (National Highways), Puducherry, for the

specific purpose for which the land is vested, the same shall be returned to the Directorate of School

Education;

(iii) As agreed by the Public Works Department, Puducherry, the reconstruction of the compound wall/

gateways on the boundary of the land to be transferred covering Pondicherry University/Pondicherry

Engineering College shall be done prior to demolishing of the existing wall/gateways and taking possession

of the said land. Further, the transformer provided for the State Data Centre (SDC), which has been established

on the said land shall be shifted by the Electricity Department, Puducherry. The said works shall be done

under the funds of the Public Works Department, Puducherry;

(iv) There shall not be any hindrance to the students or neighbouring public due to the proposed transfer

of the land or formation of road therein.

6. Now, therefore, in exercise of the powers conferred under rules 309 and 310 of the General Financial

Rules, 2017, sanction of the Lieutenant-Governor, Puducherry, is hereby accorded for transfer of the said land

belonging to the Directorate of School Education to the Public Works Department (National Highways), Puducherry,

on ‘no profit no loss’ basis for widening the western side of the East Coast Road to maintain 3 meters width from

Ch.139/700 kms. to Ch.141/030 kms. (Pillaichavady) in front of Pondicherry Engineering College (Puducherry

Technological University) and Pondicherry University.

This has the concurrence of the Finance Department, Puducherry vide their I.D.No. 732/FC/FD/ A4/2022-23,

dated 29-08-2022.
