NOTIFICATION

In exercise of powers conferred under clause (a) of sub-section (2)

of section 38 of the Puducherry Village and Commune Panchayats Act,

1973 (No. 10 of 1973) and all other powers enabling her in this behalf,

the Lieutenant-Governor, Puducherry, is hereby pleased to make the

following Amendments to the Puducherry Village Panchayats

(Registration of Electors) Rules, 1974, namely:-

1. Short title, extent and commencement.— (1) These rules may

be called the Puducherry Village Panchayats (Registration of Electors)

(Amendments) Rules, 2023.

(2) They shall extent to the whole of the Union territory of

Puducherry.

(3) They shall come into force with immediate effect.

2. Amendment of rule 2.— In the Puducherry Village Panchayats

(Registration of Electors) Rules, 1974, in rule 2, after sub-rule (f), the

following sub-rule shall be inserted, namely:-

“(g) “Aadhaar Number” mean, the Unique Identification Number

issued by Unique Identification Authority of India (UIDAI).”

3. Amendment of rule 5(5).— In the said rules, in rule 5, sub-rule (5),

for the words “his wife”, the words and figure “his/her spouse” shall be

substituted.

4. Amendment of rule 5(6).— In the said rules, in rule 5, sub-rule (6),

for the words “his wife”, the words and figure “his/her spouse” shall be

substituted.

5. Amendment of rule 7(1).— In the said rules, for the word “he”

the words and figure “he/she” shall be substituted.

6. Amendment of Forms 1 to 4 under rule 7.— In Forms, 1, 2, 3,

and 4 after the words “my wife”, the word “husband” shall be inserted.

7. Amendment of rule 8.— In the said rules, after the words

“furnish the information” the following may be inserted, namely:-

“which may include Aadhaar Number issued by the Unique

Identification Authority of India" the rest of the words shall be deleted.”

After the rule 8, the following sub-rules shall be inserted, namely:-

(1) The Registration Officer may, for the purpose of establishing

the identity of any person require that such person may furnish the

Aadhaar Number issued by the Unique Identification Authority of India

(UIDAI) as per the provisions of the Aadhaar (Targeted Delivery of

Financial and Other Subsidies, Benefits and Services) Act, 2016:

Provided that the Registration Officer may also require the

Aadhaar number from persons already included in the electoral roll for

the purposes of authentication of entries in electoral roll and to identify

registration of name of the same person in the electoral roll of more than

one constituency or more than once in the same constituency.

(2) Every person whose name is included in the electoral roll

may intimate his/her Aadhaar number to such authority in Form-20

appended to this rule.

(3) No application for inclusion of name in the electoral roll shall

be denied and no entries in the electoral roll shall be deleted for inability

of an individual to furnish or intimate Aadhaar number due to such

sufficient causes may be prescribed:

Provided that such individual may be allowed to furnish such

other alternate documents as may be prescribed.

Explanation – For the purpose of this rule, the expression

“Aadhaar number” shall have the same

meaning as assigned to it in clause (a) of

section 2 of the Aadhaar (Targeted Delivery of

Financial and other Subsidies, Benefits and

Services) Act, 2016 and sub-section 8(3), 8(4)

of the said Act shall apply mutatis mutandis

here.

8. Amendment of rule 26.— In the said rules, after sub-rule (2),

the following sub-rules shall be inserted, namely:-

“(3) The details of Aadhaar of electors as issued by the Unique

Identification Authority of India (UIDAI) may be linked with Electoral

Roll by making an application in Form-20 with proof by the electors as

given in rule 8 which shall apply mutatis mutandis here.

(4) The details of Aadhaar or other details for identification of

new applicants who submit application for inclusion of name in the

electoral roll and application for transposition of entries, etc., shall also

be given in the prescribed Forms 7 and 10, respectively.”

9. Amendment of Form – 7 under rule 13(1).— In the said rules,

for the existing Form 7, the following Form 7 shall be substituted

namely:-
