This Industrial Dispute coming on this day before

records, after having stood over till this day, this Court

delivered the following:-

ORDER

This Industrial Dispute arises out of the reference

made by the Government of Puducherry vide G.O. Rt.

No. 180/AIL/LAB/T/2017, dated 27-11-2017 of the

Labour Department, Puducherry, to resolve the

following dispute between the Petitioner and the

Respondents, viz.,

(a) Whether the dispute raised by the Petitioner

Mahatma Gandhi Maruthuvakalloori Mattrum

Aaraitchi Niruvana Oppantha Thozhilalargal

Vazhvurimai Sangam, Puducherry, No. 87, 4th Cross

Street, Moogambigai Nagar, Reddiyarpalayam,

Puducherry, against the Management of M/s. Mahatma

Gandhi Medical College and Research Institute,

Puducherry and M/s. IG Enterprises, Puducherry,

over charter of demands and reinstatement of

suspended/terminated employees, is justified or not?

If justified, what is the relief entitled to?

(b) To compute the relief if any, awarded in terms

of money if, it can be so computed?

2. Today when the case came up for enquiry, Counsel

for Petitioner present and represented no instruction.

Petitioner not present. Inspite of several adjournments

and posting this case as last chance otherwise further

orders will be passed. Hence, this Court is inclined to

close this reference. In the result, this reference is

closed for non-prosecution.

This Industrial Dispute coming on 06-07-2023 before

me for hearing in the presence of Thiruvalargal

M. Veerappan and V.R. Aroumougam, Counsels, for the

Petitioner, Thiruvalargal L. Swaminathan and

I. Ilankumar, Counsels, for the Respondents and the

Respondent remained ex parte, upon hearing the

Petitioner sides, after perusing the case records, after

having stood over till this day, this Court delivered the

following:-

ORDER

This Industrial Dispute arises out of the reference

made by the Government of Puducherry vide G.O. Rt.

No. l05/AIL/Lab./T/2020, dated 14-10-2020 of the Labour

Department, Puducherry to resolve the following

dispute between the Petitioner and the Respondents,

viz.,

(a) Whether the dispute raised by the Petitioner

Union NRTUC, Thilarshpet. Puducherry, against the

Management of M/s. The Pondicherry Co-operative

Milk Producers’ Union Limited, No. P1, Kurumampet,

Puducherry, over promotion to the post of Operator

for Thiru T. Ambalatharasu, Dairy Helper Grade-I is

justified or not? If justified, what relief the Union

workmen are entitled to?

(b) To compute the relief if any, awarded in terms

of money if, it can be so computed?

2. Brief facts of the case of the Petitioner averred

in the claim petition:

The Petitioner was appointed as casual worker on

28-02-2005 and from the inception of joining the

Respondent Management, he was working as Plant

Operator and he possessed requisite qualifications

and experience to hold the post of Operator in the

Respondent Management. The Petitioner was

appointed on regular basis as Dairy Helper in the

year 2011. Since, he possessed requisite qualifications

and experience to hold the post of operator in the

Respondent Management, he raised objection for

being appointed as Dairy Helper and made

representations to the Respondent Management to

appoint him as Operator instead of appointing him

as Dairy Helper.

(ii) As per the office circular issued by the

Respondent the seniority of the employee was fixed

with the name of the employees and the said

document was also filed along with the claim

statement and it is found the Petitioner is the senior

than other employees namely, the respondents as

stated above.

(iii) Again in the year 2016, instead of giving

opportunity to him and consider him for the post of

Operator the Respondent Management promoted and

appointed some of his juniors working as Dairy

Helper below him as Operators, but, at the same time

again he was promoted and posted as Dairy Helper

Grade-I which is below the rank of Operator post and

also attract lesser Pay Scale and therefore, he

immediately made representations to the Respondent

Management about his promotion at the lower cadre,

but, no action was taken nor justified reason was

explained by the Respondent Management about the

denial of proper post to him.

(iv) As on date of promotion to him as Dairy

Helper in the year 2016, there was at least 11 post of

Operator vacant due to the reason that 11 employees

who were working as Operators were promoted to the

post of Operator Grade-I and out of the said

vacancies, he is entitled to get the post of Operator.

(v) It is clear that the Respondent Management

adopted unfair labour practice as he is the senior

employee in the cadre of Dairy Helper, but, the

Respondent Management promoted the Respondents

Nos. 2 to 9 as per the name cited above as Operators

and it is clear that the Respondent Management has

indeed violated the seniority of the employees for

considering for promotion to the highest post.

(vi) The Petitioner has made several representations

on 08-06-2012, 05-07-2012, 24-09-2012, 24-07-2014,

18-05-2015, 02-03-2026 and on 14-12-2016 to the

Respondent Management to consider his case for

promoting to the post of Operator as his many

juniors were already promoted to the post of

Operator by giving preference to them without

following seniority and choosing the juniors

overlooking his seniority clearly attracted the

violation of service conditions by the Respondent

Management and also comes under the terms of

unfair labour practices adopted by the Respondent

Management.

(vii) The Petitioner has sent several representations

to the Respondent Management, but, the 1st Respondent

failed and neglect to take action on the said petitions.

Hence, the Petition.

3. Notice served to both the Petitioner and

Respondents. Petitioner appeared and engaged an

Advocate to represent him. Though the Respondent has

engaged his Advocate, but, not chosen to file its

counter after sufficient time given by this Court.

Neither Respondent Management appeared nor

represented by its Counsel. Hence, the Respondent

Management was set ex parte on 24-04-2023. Claim

Petition filed by the Petitioner.

4. Respondent remained ex parte as counter not

filed. Proof affidavit of Petitioner filed, he himself

examined as PW1. Ex.P1 to P1 2 were marked.

5. On perusal of case records, it is found that this

reference has been made with regard to the dispute

raised by the Petitioner for promotion to the post of

Operator. The records reveals that the Petitioner has

filed claim statement, but, the Respondent has remained

ex parte. The records further reveals that the Petitioner

was examined in Chief and it is at this stage the Counsel

for Petitioner has filed a letter stating that the

Respondent has decided to give promotion to the

Petitioner and therefore, the Petitioner wants to

withdraw the claim statement. Today the Petitioner

present and endorsed that he is withdrawing the claim

statement. Hence, on recording the above this Court is

inclined to dismiss the claim petition.

In the result, the reference is disposed and the claim

petition is hereby dismissed as withdrawn.

Whereas, the Government is of the opinion that an

industrial dispute has arisen between the management

of M/s. Hindustan Unilever Limited, Detergent Factory,

Vadamangalam, Puducherry and Hindustan Unilever

Patali Thozhirsangam, over reinstatement of

Thiru M. Karthikeyan with back wages, continuity of

service and attendant benefits in respect of the matter

mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is

necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated

vide G.O. Ms. No. 20/9/Lab./L, dated 23-5-1991, of the

Labour Department, Puducherry, to exercise the powers

conferred by clause (c) of sub-section (1) of section 10

of the Industrial Disputes Act, 1947 (Central Act XIV

of 1947), it is hereby directed by the Secretary to

Government (Labour) that the said dispute be referred

to the Labour Court, Puducherry, for adjudication. The

Labour Court, Puducherry, shall submit the Award

within 3 months from the date of issue of reference as

stipulated under sub-section (2-A) of section 10 of the

Industrial Disputes Act, 1947 and in accordance with

rule 10-B of the Industrial Disputes (Central) Rules,

1957. The party raising the dispute shall file a statement

of claim complete with relevant documents, list of

reliance and witnesses to the Labour Court, Puducherry,

within 15 days of the receipt of the order of reference

and also forward a copy of such statement to each one

of the opposite parties involved in the dispute.

ANNEXURE

(i) Whether the dispute raised by the Hindustan

Unilever Patali Thozhirsangam, against the management

of M/s. Hindustan Unilever Limited, Detergent Division,

Vadamangalam, Puducherry, over reinstatement of

Thiru M. Karthikeyan along with back wages,

justified or not? If, justified, give appropriate

directions?

(ii) To compute the relief if any, awarded in terms

TENDER-CUM-AUCTION NOTICE

Sealed tenders are invited by the undersigned for

sale of unserviceable/obsolete articles (e-waste) items

in a single lot system belonging to this E.S.I. Hospital

in “as-is-where-is” condition.

2. Only Government authorized e-waste Dismantling

Units are eligible to participate in the tenderer. The

intending tenderers may inspect the items in the office

of the undersigned between 10.30 a.m. and 11.30 a.m.

from 11-12-2023 to 18-12-2023 with the prior permission

of the officer concerned. The sale of Tender Form is

issued on payment of ` 100 (Rupees one hundred only)

plus GST as admissible (non-refundable) from 11-12-2023

to 18-12-2023 up to 12.30 p.m.

3. Sealed tenders in the prescribed Tender Form

addressed to the Medical Superintendent, E.S.I. Hospital,

Gorimedu, Puducherry, superscripted as “Tender for

purchase of unserviceable/obsolete articles (e-waste)”

should reach this office on or before 21-12-2023 at 12.00

noon. Each tenderer shall enclose a Demand Draft for

an amount of ` 10,000 (Rupees ten thousand only)

drawn in favour of the Medical Superintendent, E.S.I.

Hospital, Gorimedu, Puducherry, as earnest money deposit.

4. Tenders will be opened on 21-12-2023 at 3.30 p.m.

in the office of the undersigned in the presence of the

tenderers who are present at the time of opening

tenders.

5. If, the highest tender amount offered by the

tenderer is found to be not acceptable by the

undersigned, the public auction will be conducted on

the spot, keeping the highest tender amount as

minimum bid.

6. The following self-attested photocopy of the

documents/certificates must be enclosed along with the

tender-

(a) Valid GST Registration Certificate

(b) PAN Card

Government.

(d) Aadhaar Card/Valid Family Ration Card/

Valid Driving Licence.

Tenders without these certificates/documents will be

rejected.

7. Individual/partner of a firm who have/has been

punished under Criminal Procedure Code or any criminal

case is under process is not eligible for participating in

the tender-cum-auction. Any false representation is

found during the tender process, the tender offered by

him/her/them will be cancelled and his/her/their earnest

money deposit will be forfeited.

8. If, any misbehaves noticed during the tender

process, the tenderer(s)/bidders will be removed from

the place of tender/auction also his/her/their tender(s)

will be rejected and the earnest money deposit will be

forfeited.

9. The earnest money deposit of the successful

tenderer/bidder will be adjusted against the sale

proceeds and the earnest money deposit of the

unsuccessful tenderers/bidders will be discharged/

returned.

10. Persons other than the tenderer/bidder will not be

admitted at the time of opening the tender-cum- auction.

11. Acceptance of the tender/bid will be intimated

to the successful tenderer/bidder after finalization of the

tender/auction. Successful tenderer/bidder or his/her

authorized person will be allowed to clear/remove the

materials.

12. The successful tenderer/bidder should pay the

cost of articles plus applicable GST and make his/her

own arrangement to clear/remove the articles

immediately at his/her own cost. Otherwise, the earnest

money deposit will be forfeited.

13. The applicable GST on the sale proceeds may be

paid by the buyer (i.e., recipient) directly to the GST

accounts on reverse charge basis as per the notification

vide G.O. Ms. No. 4/2017-Puducherry GST (Rate), dated

29-06-2017 and G.O. Ms. No. 36/2017- Puducherry GST

(Rate), dated 24-10-2017.

14. The Government authorized e-waste recyclers

who is buying the X-ray equipment should necessary

perform the dismantling of the equipment according to

the Government guidelines.

15. The Government authorized e-waste recyclers

has to dismantle the equipment and dispose of it

appropriately thus removing the dismantled equipment

from the premises of E.S.I. Hospital. The Government

authorized e-waste recyclers has to handle the logistic

of transporting the dismantled equipment out of E.S.I.

Hospital to the appropriate disposal site. (welding/any

kind of machine should not be used for cutting of

materials inside the E.S.I. Hospital premises).

16. This Office will not be in any way held responsible

for the safe custody or any loss of the sold articles.

Once the tender is finalized, no claim on the quantity

and quality of the materials will be entertained.

17. The undersigned reserves the right to reject any

or all tenders without assigning any reason thereof and

the decision of the undersigned in this regard will be

the final and binding on all the tenders.

Sealed tenders are invited for disposal of e-waste

items in a single lot system belonging to NCC Group

Headquarters, Puducherry, under the control of the

Directorate of Sports and Youth Affairs, Puducherry,

from the authorised e-waste collection centre/recycle/

dismantler (valid licence holders) in “as-is-where-is”

condition.

2. The tenders in sealed covers should be addressed

to the Office of the Administrative Officer, NCC Group

Headquarters, Lawspet, Puducherry, duly superscripted

on the envelope as “Tender for e-wate materials” and

to reach the undersigned on or before 28-12-2023. The

tenders will be opened on the same day at 12.00 noon in

the presence of the Superintendent, NCC Group

Headquarters, Puducherry and the tenderers or their

authorised representatives who are present at the time

of opening of tenders. If, the tender opening date

happens to be a public holiday, the same will be opened
