NOTIFICATION
Whereas, on examination of the Colour Cotton Candy/Candy Floss or
Hard Candy sample seized from some of the Street Vendors of Puducherry
Union Territory, it was found that Rhodamine-B has been added to the food items
as additive.
And whereas, the colour Rhodamine-B is a chemical compound and a dye
and is not a permitted food additive and should not be present in food. Food safety
risk persists in the food item;

And whereas, section 18(l)(a) of the Food Safety and Standards Act, 2006,
stipulates that, the Central Government, the State Governments, the Food Safety
Authority and other Agencies as the case may be, while implementing the
provisions of the Act shall guided by the following principles namely:-
“endeavours to achieve an appropriate level of protection of human life
and health and the protection of consumer’s interest, including fair
practices in all kinds of food trade with reference to food safety
standards and practices”;
And whereas, section 26(l)(2)(i)(ii) & (v) of the Food Safety and Standards
Act, 2006, further stipulates that, “no food business operators shall himself or by
any person on his behalf, manufacture, store, sell or distribute any article of food,
which is unsafe for public consumption”;
Now, therefore, in exercise of the powers conferred by clause (a) of
sub-section (2) of section 30 of the Food Safety and Standards Act, 2006 (Central
Act 34 of 2006), the Commissioner of Food Safety, Union territory of Puducherry,
having taken note of the interest of public health, hereby prohibits production,
storage and sale of Colour Cotton Candy/Candy Floss or Hard Candy or any food
items containing Rhodamine-B in the Union territory of Puducherry, for a period of
one year from the date of issue of order.
