NOTIFICATION
Pursuant to the recommendations of the National Human Rights
Commission, New Delhi vide D.O.No. L-19/12/2022-Law, dated 02-05-2022
of National Human Rights Commission, New Delhi and Case No. L-19/12/
2022-Law, dated 06-09-2023 of National Human Rights Commission,
New Delhi, the Lieutenant-Governor, Puducherry, is pleased to formulate
the Policy for payment of compensation on account of death of prisoners
confined in the Jails in the Union territory of Puducherry.

2. Compensation shall not be admissible in cases of natural deaths
including due to illness.
3. Compensation shall not be admissible in the following cases of
unnatural deaths:
(i) If, the death occurs during escape from Jails or from lawful
custody outside the Jails.
(ii) If, the death occurs due to any natural disaster/calamity.
4. Compensation shall be paid to the next of kin or legal heirs of
prisoners on account of unnatural deaths, in the following cases:

5. The Superintendent of Jail/Deputy Superintendent of Jail
concerned shall send detailed report alongwith a copy of the Magisterial
enquiry report, postmortem report, final cause of death, medical history,
at the time of admission in Jail and details of medical treatment, if any,
given to the prisoner prior to his custodial death to the Inspector-General
of Prisons, Puducherry, through proper channel for onward submission
to the Government for grant of appropriate compensation, as per para 4
as stated above.
6. At least 50 percent of the compensation paid in cases of torture/
beating by prison staff may be deducted from the salary of the erring
officer(s)/official(s). Exact percentage of deduction and the ratio to be
applied on the delinquent individual officer(s)/official(s) (if, they are
more than one) will be determined by the Inspector-General of Prisons.

7. This Policy shall be applicable, as admissible, in respect of
prisoners who suffer unnatural deaths in the Jails of Union territory of
Puducherry, on or after the date of notification of this Policy.
8. The Secretary to Government (Home), Puducherry, shall be
authorized to sanction the compensation as per para 4 stated above.
9. The payment of compensation shall be incurred under the Object
Head “(49) - Other Revenue Expenditure (Charged)”.
10. This issues with the concurrence of Finance Department,
Puducherry vide their I.D.No.E.Comp No. l4015/FD/F5/FC/A3/24-25, dated
19-02-2025.
