NOTIFICATION
Whereas, on examination of samples of Colour Cotton Candy or Candy
Floss or Hard Candy sample seized from some of the Street Vendors of Union
territory of Puducherry, it was found that ‘Rhodamine – B’ has been added to the
food items as additive;
2. And whereas, the colour ‘Rhodamine – B’ is a chemical compound
and a dye and is not a permitted food additive and should not be present in food.
Food safety risk persists in the food item;
3. And whereas, the production, storage, distribution, sale of Colour Cotton
Candy or Candy Floss or Hard Candy or any food items containing ‘Rhodamine – B’
as “ingredients” were banned in the whole of the Union territory of Puducherry
for a period of one year vide Notification No. 45, dated 5th November, 2024 and
published in the Official Gazette of Puducherry, No. 142, dated 7th November, 2024;

4. And whereas, the validity period of the abovesaid Notification expired
on 4th November 2025;
5. And whereas, section 18(l)(a) of the Food Safety and Standards Act, 2006,
stipulates that, the Central Government, the State Governments, the Food Safety
Authority and other Agencies as the case may be, while implementing the
provisions of the Act shall guided by the following principles namely:-
“endeavours to achieve an appropriate level of protection of human life
and health and the protection of consumer’s interest, including fair
practices in all kinds of food trade with reference to food safety
standards and practices”;
6. And whereas, section 26(l)(2)(i)(ii) & (v) of the Food Safety and
Standards Act, 2006, further stipulates that, “no food business operators shall
himself or by any person on his behalf, manufacture, store, sell or distribute any
article of food, which is unsafe for public consumption”;
7. Now, therefore, in exercise of the powers conferred by clause (a) of
sub-section (2) of section 30 of the Food Safety and Standards Act, 2006 (Central
Act 34 of 2006), the Commissioner of Food Safety, Union territory of Puducherry,
having taken note of the interest of public health, hereby prohibits production,
storage distribution or sale of Colour Cotton Candy or Candy Floss or Hard Candy
or any food items containing ‘Rhodamine – B’ in the Union territory of Puducherry,
for a further period of one year commencing from 5th November, 2025.
