under the proviso to rule 121 of the Rules of Procedure and Conduct of

Business in the Punjab Vidhan Sabha (Punjab Legislative Assembly):-

REGULATION) AMENDMENT BILL, 2021

further to amend the Punjab Infrastructure (Development and

Regulation) Act, 2002.

BE it enacted by the Legislature of the State of Punjab in the

Seventy-second year of the Republic of India as follows:-

This Act may be called the Punjab Infrastructure (Development

and Regulation) Amendment Act, 2021.

It shall come into force on and with effect from the date of its

publication in the Official Gazette.

In the Punjab Infrastructure (Development and Regulation) Act,

2002 (hereinafter referred to as the principal Act), after section 25, the following

section shall be inserted, namely:-

“25-A.

Notwithstanding anything contained in this Act, the State

Government may also levy Special Infrastructure

Development fee on petrol, diesel and immovable property

at such rate, as the State Government may, by notification,

direct, for the purpose of which a special head shall be created under which

the accrued Special Infrastructure Development fee shall be collected and

deposited directly into the Development Fund constituted under section 27.”.

In the principal Act, in section 27, in sub-section (2), for the words

“The amount of fee charged and collected under this Act”, the words and

signs “The amount of fee, except Special Infrastructure Development fee,

charged and collected under this Act” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

Punjab Infrastructure (Development and Regulation) (Amendment) Bill,

2021 proposes to impose the Special Infrastructure Development Fee to

accelerate the pace of Infrastructure Development in the State and creating

additional Revenue streams for the purpose.

This Bill seeks to establish a regulatory framework for imposition of Special

Infrastructure Development Fee under the Punjab Infrastructure (Development

and Regulation) Act, 2002.

FINANCIAL MEMORANDUM

The Punjab Infrastructure (Development and Regulation)

(Amendment) Bill, 2021 is being introduced to accelerate the pace of

Infrastructure Development in the State by imposing the Special Infrastructure

Development Fee which shall generate Rs. 216 crores per annum

approximately.

The Governor has, in pursuance of clause (1) and (3) of Article

207 of the Constitution of India, recommended to the Punjab Legislative

Assembly, the introduction and consideration of the Bill.
