NOTIFICATION

The 3rd June,2021

No. G.S.R. 52/P.A.1/1914/S.58/Amd.(3)/2021.– In exercise of the

powers conferred by section 58 of the Punjab Excise Act, 1914 (Punjab Act

No. 1 of 1914), and all other powers enabling him in this behalf, the Governor

of Punjab is pleased to make the following rules further to amend the Punjab

Intoxicants Confiscation Rules, 1955, namely:-

RULES

1.

These rules may be called the Punjab Intoxicants Confiscation (First

Amendment) Rules, 2021.

2.

In the Punjab Intoxicants Confiscation Rules, 1955, in rule 3,-

(a)

for item (ii) , the following shall be substituted, namely:-

“(ii) Liquor contained in sealed bottles (along with the bottles),

shall be sold by a committee as notified by the State Government

headed by the Collector, Incharge of the zone, through e-auction

to the distilleries only for re-distillation of spirit in liquor. The

reserve sale price shall not be less than by fifty percent of the

issue price of Extra Neutral Alcohol. Issue price of Extra

Neutral Alcohol shall be determined by taking mean of average

sale price of Extra Neutral Alcohol in the preceding three

months from 3 distilleries. In case auction is not successful,

then in second attempt the reserve price shall be reduced by

fifty percent i.e. reduced to twenty five percent of the issue

price of Extra Neutral Alcohol. In case auction is not successful

in second attempt, then in the third and last attempt, there

shall be no restriction of reserve price.

Explanation.- The value of the Extra Neutral Alcohol shall be

determined by the quantity of Extra Neutral Alcohol in

each case of liquor as derived from its strength."; and

(b)

for item (iv), the following shall be substituted,namely:-

“(iv) If the seized or confiscated liquor or intoxicant is not disposed

of by way of auction as specified in item (ii), the Committee

can recommend its destruction after taking permission from

the District Magistrate concerned. The District Magistrate

shall after satisfying himself that efforts have been made to

auction the liquor in an open and transparent manner as per

due process prescribed by rules, order such destruction.".
