NOTIFICATION

The 10th August, 2021

No. G.S.R.104/C.A.27/1996/Ss. 40 and 62/Amd.(2)/2021.-In

exercise of the powers conferred by sections 40 and 62 of the Building and

Other Construction Workers (Regulation of Employment and Conditions of

Service) Act, 1996 (Central Act No. 27 of 1996), and all other powers enabling

him in this behalf, the Governor of Punjab, after consultation with the expert

committee, is pleased to make the following rules further to amend the Punjab

Building and Other Construction Workers (Regulation of Employment and

Conditions of Service) Rules, 2008, namely:-

RULES

(1)

These rules may be called the Punjab Building and Other

Construction Workers (Regulation of Employment and Conditions

of Service) (First Amendment) Rules, 2021,

(2)

They shall come into force on and with effect from the date of

their publication in the official Gazette.

In the Punjab Building and Other Construction Workers (Regulation of

Employment and Conditions of Service) Rules, 2008 (hereinafter referred to

as the said rules), in rule 260,-

(i)

in sub-rule (4), for the words "an application", the words "an

online application" shall be substituted; and

(ii)

after sub-rule (4), the following shall be inserted, namely:-

“(4A) If a registered construction worker wants to make

amendments in the particulars of his/her details as provided by

him/her in form XXVIII, he may do so by filling the form

XXVIII(A)”.

In the said rules, for Form No. XXVIII, the following Forms shall be

substituted namely:-

The 10th August, 2021

No. G.S.R. 105/C.A.37/1970/S.35/Amd.(11)/2021.-With reference

to the Government of Punjab, Department of Labour (Labour Branch),

Notification No.11/01/2019-2L/791, dated the 15th June, 2021, published in the

Punjab Government Gazette (Extraordinary), dated the 15th June, 2021 and in

exercise of the powers conferred by section 35 of the Contract Labour

(Regulation and Abolition) Act, 1970 (Central Act No. 37 of 1970), and all

other powers enabling him in this behalf, the Governor of Punjab is pleased to

make the following rules further to amend the Punjab Contract Labour

(Regulation and Abolition) Rules, 1973, namely:-

RULES

These rules may be called the Punjab Contract Labour (Regulation

and Abolition) (Second Amendment) Rules, 2021.

In the Punjab Contract Labour (Regulation and Abolition) Rules, 1973,

for rule 78, the following shall be substituted, namely:-

“78. Registers and Records to be maintained.- (a) Register of Muster

Roll, Fines, Damages and losses, Over-Time, Wages and Advances

under these rules shall be such as may be prescribed under the Minimum

Wages Act, 1948 and the rules made there under;

(b)

Every contractor shall, where the wage period is one week or

more, issue wage slips in Form XIX, to the worker at least a day prior

to disbursement of wages;

(c)

Payment shall be made in manner prescribed under the Payment

of Wages Act, 1936 and the rules made there under.’’.

(Central Act No. 30 of 1979), and all other powers enabling him in this behalf,

the Governor of Punjab is pleased to make the following rules further to amend

the Inter-State Migrant Workmen (Regulation of Employment and Conditions

of Service) (Punjab) Rules, 1983, namely:-.

RULES

These rules may be called the Inter-State Migrant Workmen

(Regulation of Employment and Conditions of Service) (Punjab) Second

Amendment Rules, 2021.

In the Inter-State Migrant Workmen (Regulation of Employment and

Conditions of Service) (Punjab) Rules, 1983, for rule 52, the following shall be

substituted, namely:-

“52. Registers and Records to be maintained- (a) Register of Muster

Roll, Fines, Damages and losses, Over-Time, Wages and Advances

under these rules shall be such as may be prescribed under the Minimum

Wages Act, 1948 and the rules made there under.

(b)

Payment shall be made in manner prescribed under the Payment

of Wages Act, 1936 and the rules made there under.’’
