NOTIFICATION

Endst.No.07/15/2019-1BR3(4BR3)/2499.-The SDM, Dhuri was appointed Land Acquisition Collector
for acquisition of land for Rajpura-Bathinda Double Line Project of Ambala Division of Northern Railways vide
letter no.07/15/2019-1BR3/1446508/1, dated 25.03.2019. The Preliminary notification under section 11 of Right
to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act. 2013 was
issued on dated 05.08.2020. The declaration under Section 19 of the Act was required to be made within 12
months from the date of preliminary notification as per provisions of sub-section 7 of Section 19 of the Act,
which was to expire on 04.08.2021. However, before the declaration under Section 19 could be issued, the
LAC Dhuri vide order dated 20.11.2020 announced the award and took possession of land. The LAC disbursed
money to some land owners for the acquired land and construction on the project has also started. The remaining
land owners are yet to be paid for the acquired land as per award. Keeping in view the above facts legal advice
was sought from Legal Remembrancer, Punjab. The LR vide U.O. No.234/Op.31/2023, dated 13.04.2023
adviced as under:
"only recourse with the Administrative Department is to extend the period of twelve months if in
its opinion circumstances exist justifying the same and the said decision to extend the period shall
have to be recorded in writing. "

Keeping in view above legal advice, matter was considered in consultation with Revenue Department.
As detailed above, circumstances exist justifying the extension in time period of twelve months for a further
period of 24 months.
