आदेश
यतः, भारत निवााचि आयोग की अधधसूचिा सां. 464/राज-वव.स./2023 दििाांक 30
अक्टूबर, 2023 के अिुसरण में 146-ससरोही ववधाि सभा निवााचि क्षेत्र के शलए राजस्र्ाि
ववधाि सभा का साधारण निवााचि, 2023 आयोप्जत ककया गया र्ा; और
यतः, लोक प्रनतनिधधत्व अधधनियम, 1951 की धारा 78 के अिुसार, ककसी भी निवााचि में निवााचि
लड़िे वाला प्रत्येक अभ्यर्ी, निवााधचत अभ्यर्ी के निवााचि की तारीख से 30 दििों के भीतर अपिे निवााचि
व्यय के लेखे प्जला निवााचि अधधकारी के पास िाखखल करेगा जो उक्त अधधनियम की धारा 77 के अांतगात
उसके द्वारा या उसके निवााचि अशभकताा द्वारा रखे गए लेखे की एक सत्य प्रनत होगी; और
यतः, राजस्र्ाि के 146-ससरोही ववधाि सभा निवााचि क्षेत्र के शलए निवााचि, 2023 का पररणाम,
ररटनििंग अधधकारी द्वारा 03 दिसमबर, 2023 को घोवित ककया गया र्ा और इस प्रकार निवााचि व्यय के लेखे
िाखखल करिे की अप्ततम तारीख 02 जिवरी, 2024 र्ी; और
यतः, निर्ााचिों का सांचालि नियम, 1961 के नियम 89 के उप-नियम (1) के अांतगात, मुख्य निवााचि
अधधकारी, राजस्र्ाि से उिके दििाांक 16.01.2024 के पत्र सां. F3(1)(5)EEM/ELECTION/Candidates’
Exp./433 के तहत प्रातत प्जला निवााचि अधधकारी, ससरोही की दििाांक 08.01.2024 की ररपोटा के अिुसार श्री
40 राजस् र्ाि राज-पत्र, जुलाई 23, 2025 भाग 5 (घ)
भंर्र लाल, जो राजस्र्ाि के 146-ससरोही ववधाि सभा निवााचि क्षेत्र, 2023 से निवााचि लड़िे वाले अभ्यर्ी हैं,
ववधध के अांतगात यर्ा अपेक्षक्षत निवााचि व्यय का लेखा िाखखल करिे में असफल रहे हैं; और
यतः, प्जला निवााचि अधधकारी, ससरोही की उक्त ररपोटा के आधार पर, भारत निवााचि आयोग द्वारा
निवााचिों का सांचालि नियम, 1961 के नियम 89 के उप-नियम (5) के अांतगात श्री भंर्र लाल को अपिे निवााचि
व्यय लेखे प्रस्तुत िहीां करिे के शलए कारण बताओ िोदटस सां. 76/राज-वव.स./146/2023/सीईएसएस-1 दििाांक
28.02.2024 को जारी ककया गया र्ा; और
यतः, उपयुाक्त कारण बताओ िोदटस के जररए और निर्ााचिों का सांचालि नियम, 1961 के नियम 89
के उप-नियम (6) के अांतगात श्री भंर्र लाल को लेखा िाखखल ि ककए जािे सांबांधी कारणों को स्पष्ट करते हुए
आयोग को अपिा अभ्यावेिि शलखखत रूप में प्रस्तुत करिे और िोदटस के प्रातत होिे की तारीख से 20 दििों के
भीतर प्जला निवााचि अधधकारी, ससरोही प्जला को अपिे निवााचि व्यय के लेखे प्रस्तुत करिे का नििेश दिया
गया र्ा; और
यतः, मुख्य निवााचि अधधकारी, राजस्र्ाि पत्र सां. F.3(1)(5)EEM/ELECTION/Candidates’
Exp.2023/489 दििाांक 27.01.2025 के तहत प्रातत प्जला निवााचि अधधकारी, ससरोही के पत्र दििाांक
25.01.2025 में सूधचत ककया है कक उक्त कारण बताओ िोदटस श्री भंर्र लाल को दििाांक 16.04.2024 को तामील
ककया गया र्ा; और
यतः, प्जला निवााचि अधधकारी, ससरोही िे अपिी अिुपूरक ररपोटा पत्र दििाांक 26.12.2024 एवां पत्र
दििाांक 27.05.2025 द्वारा अग्रेवित जो कक मुख्य निवााचि अधधकारी, राजस्र्ाि के पत्र क्रमशः सां. F.3(1)(5)
EEM/ELECTION/Candidates’Exp.2023/48 दििाांक 03.01.2025 एवां क्रमाांक F.3(1)(5)EEM/ELECTION/
Candidates’Exp.2023/2818 दििाांक 23.06.2025 द्वारा प्रातत हुई है, उसमें सूधचत ककया है कक श्री भंर्र लाल िे
निवााचि व्यय के लेखे का कोई वववरण प्रस्तुत िहीां ककया है। इसके अनतररक्त, उक्त िोदटस ममलिे के उपराांत,
श्री भंर्र लाल िे ववधध के अांतगात यर्ा-ववदहत लेखे िाखखल करिे में अपिी असफलता के शलए भारत निवााचि
आयोग को ि तो कोई कारण बताया है और ि ही कोई स्पष्टीकरण दिया है; और
यतः, लोक प्रनतनिधधत्व अधधनियम, 1951 की धारा 10क में यह उपबांधधत ककया गया है ककः-
“यदि निवााचि आयोग का समाधाि हो जाता है कक कोई व्यप्क्त
(क) निवााचि व्ययों का लेखा उस समय के भीतर और रीनत में जैसी इस अधधनियम के द्वारा या अधीि
अपेक्षक्षत है, िाखखल करिे में असफल रहा है;, और
(ख) उस असफलता के शलए कोई अच्छा कारण या तयायोधचत्य िहीां रखता है,
तो निवााचि अयोग शासकीय राजपत्र में प्रकाशशत आिेश द्वारा उसको निरदहात घोवित करेगा और
ऐसा व्यप्क्त उस आिेश की तारीख से तीि विा की कालावधध के शलए निरदहात होगा।“;
यतः, तथ्यों और उपलब्ध ररकार्डों के आधार पर, आयोग का यह समाधाि हो गया है कक श्री भंर्र लाल
अपिे निवााचि व्यय के लेखे िाखखल करिे में असफल रहे हैं और उिके पास ऐसा करिे में असफल रहिे के शलए
कोई भी उधचत कारण अर्वा औधचत्य िहीां है; और
अतः, अब, लोक प्रनतनिधधत्व अधधनियम, 1951 की धारा 10क के अिुसरण में, भारत निवााचि आयोग
एतद्द्वारा घोिणा करता है कक राजस्र्ाि के 146-ससरोही ववधाि सभा निवााचि क्षेत्र के शलए साधारण निवााचि,
2023 में निवााचि लड़िे वाले अभ्यर्ी, श्री भंर्र लाल, निवासी- नं. 66, कलामो का मौहल्ला, बरेठा तहसील
रानीर्ाड़ा, जजला जालोर, राजसथान, इस आिेश की तारीख से तीि विा की अवधध के शलए सांसि के ककसी भी
भाग 5 (घ) राजस् र्ाि राज-पत्र, जुलाई 23, 2025 41
सिि अर्वा राज्य अर्वा सांघ राज्य क्षेत्र की ववधाि सभा अर्वा ववधाि पररिि का सिस्य चुिे जािे अर्वा
होिे के शलए निरदहात होंगे।

ORDER
WHEREAS, the General Election to Legislative Assembly of Rajasthan, 2023 for
146-Sirohi Assembly Constituency was held in pursuance of the Election Commission of
India vide Notification No. 464/RJ-LA/2023, dated 30th October, 2023; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate at an election shall, within 30 days from the date of election of the
returned candidate, lodge with the District Election Officer an account of his/her election
expenses which shall be a true copy of the account kept by him or his election agent under
Section 77 of the said act; and
WHEREAS, the result of the election for 146-Sirohi Assembly Constituency of
Rajasthan, 2023 was declared by the Returning Officer on 3rd December, 2023 and hence the
last date for lodging the account of Election Expenses was 02nd January, 2024; and
WHEREAS, as per the report dated 08.01.2024 of the DEO, Sirohi under sub-rule (1)
of Rule 89 of the Conduct of Election Rules, 1961, received through the CEO, Rajasthan vide
his letter no. F.3(1)(5)EEM/ELECTION/Candidates’ Exp.2023/433; dated 16.01.2024, stating
that Sh. Bhanwar Lal, a contesting candidate from 146-Sirohi Assembly Constituency of
Rajasthan in General Election to Legislative Assembly, 2023 has failed to lodge the account
of his election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Sirohi a
‘Show-Cause Notice’ No.76/RJ-LA/146/2023/CEMS-I, dated 28th February, 2024 was
issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election
Commission of India to Sh. Bhanwar Lal, for not lodging of the account of Election
Expenses; and
WHEREAS, through the above said ‘Show Cause Notice’ and under sub rule (6) of
Rule 89 of the Conduct of Election Rules, 1961, Sh. Bhanwar Lal, was directed to submit
representation in writing to the Commission explaining the reasons for not lodging the
account and also to lodge the account of his election expenses with the District Election
Officer, Sirohi District within 20 days from the date of receipt of the notice; and

WHEREAS,
the
CEO,
Rajasthan
vide
his
letter
No.
F.3(1)(5)EEM/ELECTION/Candidates’ Exp.2023/489, dated 27.01.2025 enclosing the
District Election Officer’s Sirohi letter dated 25.01.2025 reported that the ‘Show Cause
Notice’ was served to Sh. Bhanwar Lal, on 16.04.2024; and
WHEREAS,
the
CEO,
Rajasthan
vide
his
letter
No.
F.3(1)(5)EEM/ELECTION/Candidates’ Exp.2023/48, dated 03.01.2025 and letter No.
F.3(1)(5)EEM/ELECTION/Candidates’ Exp.2023/2818, dated 23.06.2025 forwarded the
District Election Officer’s Sirohi letter dated 26.12.2024 and dated 27.05.2025 respectively
wherein it has been reported that Sh. Bhanwar Lal, has not submitted any representation of a
statement of correct account of election expenses duly signed alongwith original vouchers etc.
Further, after receipt of the said notice, Sh. Bhanwar Lal, has neither furnished any proper
reason nor explanation to the Election Commission of India, for failure to lodge the account as
prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides
that:-
“If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare
him to be disqualified and any such person shall be disqualified for a period of
three years from the date of the order.”
WHEREAS, on the basis of facts and available records, the Commission is satisfied
that Sh. Bhanwar Lal has failed to lodge account of his election expenses and has no good
reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the
Peoples Act, 1951, the Election Commission of India hereby declares Sh. Bhanwar Lal,
resident of No. 66, Kalamo ka Mouhalla, Baretha, Tehsil Raniwada, District Jalore,
Rajasthan and a contesting candidate from 146-Sirohi Assembly Constituency of Rajasthan
in General Election to Legislative Assembly, 2023, to be disqualified for being chosen as and
for being a member of either House of the Parliament or the Legislative Assembly or the
Legislative Council of a State or Union Territory for a period of three years from the date of
this order.
