भारत गणराज् िे निहत्तरवप वषव मप राजस्थान राज् धविान-मण्डय ननम्नसयखित अधिनन म
बनाता हैः-
ांक्षिप् नां और रस्ारंभ - (1) इस अधिनन म िा नाम राजस् थान स् वास् ् धव्ान
धव् वधव् ाय (सांिोिन) अधिनन म, 2025 है।
(2) ह 26 ज याई, 2025 िो और से प्रवृत्त समझा जा ेगा।

धव्ान धव् वधव् ाय अधिनन म, 2005 (2005 िा अधिनन म सां. 1) िी िारा 6 मप,-

(i) उर-िारा (2) िे िण् ड (ि) मप, धव् मान असभव् क्त “स् वा त् त होना” िे र् चातऔ और
धव् मान असभव् क्त “ ा उसे किसी भी अन् धव् वधव् ाय ” से रूवव, असभव् क्त “ ा
राज् सरिार ्वारा िाससत होना” अांत:स् थाधरत िी जा ेगी; और
(ii) धव् मान उर-िारा (3) िे र् चातऔ, ननम् नसयखित न ी उर-िारा जोडी जा ेगी, अथावतऔ:-
“(4) इस अधिनन म मप अांतधववष् ट किसी बात िे होते ह ए भी, राज् सरिार
धव् वधव् ाय िे ररामिव से, राजरत्र मप प्रिासित अधिसूचना ्वारा, धव् वधव् ाय िे
घटि ा उसिे ्वारा स्थाधरत किसी महाधव् ाय िो सरिारी महाधव् ाय होना
घोधषत िर सिेगी। ऐसी घोषणा होने रर ऐसे महाधव् ाय िा प्रिासननि नन ांत्रण
और समस् त भूसम, भवनों, प्र ोगिायाओां, उरस् िर, र स्तिों सदहत समस् त सकस्त ाां
राज् सरिार मप ननदहत हो जा पगी और ऐसे महाधव् ाय ( ों) िे अधििारी, अध् ारि
और िमवचारी, राज् सरिार ्वारा गदित स्रीननांग ससमनत ्वारा स् रीननांग िे माध् म
से उर ्त रा े जाने रर, और ऐसे ननबांिनों और ितों, जो अधिसूचना मप अधििधथत
िी जा प, िी रूनतव िरने रर, राज् सरिार िे अधििारी, अध् ारि, ा थाकस्थनत,
िमवचारी समझे जा पगे।”।

2025 (2025 िा अध् ािेि सां. 1) इसिे ्वारा ननरससत कि ा जाता है।
(2) ऐसे ननरसन िे होने रर भी, उ् त अध् ािेि िे अिीन िी ग ी समस् त बातप, िी ग ी
िारवाइ ाां ा कि े ग े सिेि इस अधिनन म िे अिीन कि े ग े समझे जा पगे।

उद्दग् ोंऔरकारणोंकाकथन
राजस्थान राज् मप धचकित्सा र वटन िे बढ़ने िे अरार अवसर हैं। वतवमान रररदृ् मप, एि
ऐसे धचकित्सा सांस्थान िी सव् िता महसूस िी जा रही है जो धचकित्सा उन् न न िा रथ प्रििवि
हो सिे तथा राजस्थान राज् मप धचकित्सा सिक्षा, अन सांिान एवां रोगी िेिभाय िे सयए उत्िृष्टता िा
िेन्द्र बन सिे। इसी िारण, म ख् मांत्री महोि ने ह घोषणा िी है कि राजस्थान राज् मप अनत
धवसिष् ट धचकित्सा उरचार िो न े स ाम िेने िे रम मप अखिय भारती स धवव्ान सांस्थान
(एम्स), नई दिल्यी िी तजव रर एि सांस् थान, राजस्थान स धवव्ान सांस्थान (ररम्स), िे नाम से
स् थाधरत कि ा जा ेगा।
घोषणा िो सािार िरने िे सयए, राजस्थान स्वास्् धव्ान धव् वधव् ाय अधिनन म,
2005 मप, उन महाधव् ाय ( ों) िो, जो राजस्थान स्वास्् धव्ान धव् वधव् ाय िे घटि
महाधव् ाय रहे हैं, सरिारी महाधव् ाय िा िजाव प्रिान कि े जाने हेत सरिार िो सि् त बनाने
िे सयए, सांिोिन कि े जाने सव् ि हैं, और कजससे कि सरिार िो धव् वधव् ाय िे घटि
महाधव् ाय ों मप से एि, सर ूएचएस धचकित् सा धव्ान महाधव् ाय िो, भधवष् िे धचकित्सा
सांस्थान िे रूर मप, धविससत िरने िे सयए साम् विारी बना ा जा सिे।
अत:, सरिार िो, धव् वधव् ाय िे घटि ा उसिे ्वारा स्थाधरत महाधव् ाय ों िो
सरिारी महाधव् ाय ों िे रूर मप घोधषत िरने िे सयए सि् त िरने हेत राजस्थान स्वास्् धव्ान
धव् वधव् ाय अधिनन म, 2005 िी िारा 6 मप, सांिोिन प्रस्ताधवत कि ा ग ा है।
चूांकि राजस्थान धविान सभा सत्र मप नहीां थी और ऐसी रररकस्थनत ाां धव् मान थीां कजनिे
िारण राजस्थान िे राज् राय िे सयए त रन्त िारवाई िरना सव् ि हो ग ा था, इससयए, उन्होंने
26 ज याई, 2025 िो राजस् थान स् वास् ् धव्ान धव् वधव् ाय (सांिोिन) अध् ािेि, 2025 (2025
िा अध् ािेि सां. 1) प्रख् ाधरत कि ा जो राजस्थान राजरत्र, असािारण, भाग 4 (ि) मप दिनाांि 1
अगस् त, 2025 िो प्रिासित ह स।

THE RAJASTHAN UNIVERSITY OF HEALTH SCIENCES (AMENDMENT) BILL,
2025
(As introduced in the Rajasthan Legislative Assembly)

further to amend the Rajasthan University of Health Sciences Act, 2005.
Be it enacted by the Rajasthan State Legislature in the Seventy-sixth Year of the
Republic of India, as follows:-
1. Short title and commencement.-(1) This Act may be called the Rajasthan
University of Health Sciences (Amendment) Act, 2025.
(2) It shall be deemed to have come into force on and from 26thJuly, 2025.
2. Amendment of section 6, Rajasthan Act No. 1 of 2005.- In section 6 of the
Rajasthan University of Health Sciences Act, 2005 (Act No. 1 of 2005),-
(i) in the clause (b) of sub-section (2), after the existing expression “is required
to be self-governing” and before the existing expression “or to be
associated with”, the expression “or to be governed by the State
Government” shall be inserted; and
(ii) after the existing sub-section (3), the following new sub-section shall be
added, namely:-
“(4) Notwithstanding anything contained in this Act, the State
Government may, in consultation with the University, by notification
published in the Official Gazette, declare any college, constituent to or
established by the University, to be a government college. Upon such
declaration, the administrative control of such college and all assets
including all land, buildings, laboratories, equipment, books shall vest in
the State Government and the officers, teachers and employees of such
college(s) after being found suitable through screening by a screening
committee constituted by the State Government and on fulfilling such
terms and conditions as may be laid down in the notification, shall be
deemed to be the officers, teachers, or, as the case may be, employees of
the State Government.”.
3. Repeal and savings.- (1) The Rajasthan University of Health Sciences
(Amendment) Ordinance, 2025 (Ordinance No. 1 of 2025) is hereby repealed.
(2) Notwithstanding such repeal, all things done, actions taken or orders made
under the said Ordinance shall be deemed to have been done, taken or made under this
Act.

STATEMENT OF OBJECTS AND REASONS
There are immense opportunities for medical tourism to grow in the State of
Rajasthan. In the present scenario, a need is being felt for such a medical institute which
would pioneer medical advancements and will become a centre of excellence for medical
education, research, and patient care in the State of Rajasthan. For this reason, Chief Minister
made an announcement that an Institute namely, the Rajasthan Institute of Medical Sciences
(RIMS) shall be established on the pattern of All India Institute of Medical Sciences
(AIIMS), New Delhi in order to give new dimensions to super specialty medical treatment in
Rajasthan State.
To bring the announcement to reality, amendments in the Rajasthan University of
Health Sciences Act, 2005 are required to empower the Government to grant the status of
Government College to the college(s) which are constituent college of the Rajasthan
University of Health Sciences and thus, enabling the Government to develop the RUHS
College of Medical Sciences, one of the Constituent college of the University, as a future
medical institute.
Hence, amendment has been proposed in section 6 of the Rajasthan University of
Health Sciences Act, 2005 to empower the Government to declare colleges constituent to, or
established by, the University as Government Colleges.
Since the Rajasthan State Legislative Assembly was not in session, and circumstances
existed which rendered it necessary for the Governor of Rajasthan to take immediate action,
he, therefore, promulgated the Rajasthan University of Health Sciences (Amendment)
Ordinance, 2025 (Ordinance No. 1 of 2025) on 26thJuly, 2025, which was published in
Rajasthan Gazette, Part IV(B), Extraordinary, dated 01stAugust, 2025.
The Bill seeks to replace the aforesaid Ordinance.
