साधारण Ǔनवा[चन, 2023 आयोिजत ͩकया गया था; और
यतः, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ धारा 78 के अनसार

, ͩकसी Ǔनवा[चन मɅ, Ǔनवा[चन
लड़ने वाला Ĥ×येक अßयथȸ, Ǔनवा[ͬचत अßयथȸ के Ǔनवा[चन कȧ तारȣख से 30 Ǒदनɉ के भीतर अपने
Ǔनवा[चन åयय का लेखा िजला Ǔनवा[चन अͬधकारȣ के पास दाͨखल करेगा जो उÈत अͬधǓनयम कȧ धारा
77 के अंतग[त उसके Ùवारा या उसके Ǔनवा[चन अͧभकता[ (एजɅट) Ùवारा रखे गए लेखे कȧ एक स×य
ĤǓत होगी; और
यतः, राजèथान राÏय के 80-राजाखेड़ा ͪवधान सभा Ǔनवा[चन ¢ेğ के साधारण Ǔनवा[चन का
पǐरणाम ǐरटǓनɍग ऑͩफसर Ùवारा Ǒदनांक 3 Ǒदसàबर 2023 को घोͪषत ͩकया गया था और इस Ĥकार
Ǔनवा[चन åयय के लेखे दाͨखल करने कȧ अिÛतम तारȣख 02 जनवरȣ 2024 थी; और
यतः, Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 89 के उप-Ǔनयम (1) के अंतग[त, िजला
Ǔनवा[चन अͬधकारȣ, धौलपरु कȧ ǐरपोट[ Ǒदनांक 11.01.2024 जो मÉय Ǔनवा[चन अͬधकारȣ

Įी ͪवनय ͧसकरवार जो 80-राजाखेड़ा ͪवधान सभा Ǔनवा[चन ¢ेğ से Ǔनवा[चन लड़ने वाले अßयथȸ हɇ,
ͪवͬध के अंतग[त यथापेͯ¢त रȣǓत से अपने Ǔनवा[चन åययɉ का लेखा दाͨखल करने मɅ असफल रहे हɇ;
और
यतः, िजला Ǔनवा[चन अͬधकारȣ कȧ उÈत ǐरपोट[ के आधार पर भारत Ǔनवा[चन आयोग Ùवारा
Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 89 के उप-Ǔनयम (5) के अंतग[त Įी ͪवनय ͧसकरवार
को अपने Ǔनवा[चन åयय के लेखे Ĥèतत नहȣं करने के ͧलए कारण बताओ नोǑटस

/2023/सी.ई.एम.एस.-1 Ǒदनांक 28 फरवरȣ, 2024 को जारȣ ͩकया गया था; और
यतः, उपय[Èत कारण बताओ नोǑटस के जǐरए और Ǔनवा[चनɉ का संचालन Ǔनयम

, 1961 के
Ǔनयम 89 के उप-Ǔनयम (6) के अनसार
ु
Įी ͪवनय ͧसकरवार को लेखा Ĥèतत न ͩकए जाने संबंधी
ु
कारणɉ को èपçट करते हएु, आयोग को अपना अßयावेदन ͧलͨखत Ǿप मɅ Ĥèतत करने और नोǑटस के
ु
ĤाÜत होने कȧ तारȣख से 20 Ǒदनɉ के भीतर िजला Ǔनवा[चन अͬधकारȣ, धौलपरु को अपने Ǔनवा[चन åयय
का लेखा Ĥèतत करने का Ǔनदेश Ǒदया गया था
ु
; और
यतः,
िजला Ǔनवा[चन अͬधकारȣ,
धौलपरु से Ǒदनांक 22.03.2024
के पğ सं0-
Ǔनवा[/लोसआचु/ईवीएम/2024/839 के Ùवारा सͬच

त ͩकया है ͩक उÈत कारण बताओ नोǑटस ͪवͬधवत
Ǿप से Įी ͪवनय ͧसकरवार कȧ बहन (कमारȣ माधरȣ
ु
ु) को Ǒदनांक 12.03.2024 को तामील ͩकया गया
था; और
यतः, िजला Ǔनवा[चन अͬधकारȣ, धौलपरु ने पğ सं0- प.37/Ǔनवा[/लेखा/2025/120 Ǒदनांक
13.02.2025 के Ùवारा Ĥèतत कȧ गई अन
ु
ुपरक ǐरपोट[ मɅ यह बताया है ͩक
ू
Įी ͪवनय ͧसकरवार ने
Ǔनवा[चन åयय का लेखा Ĥèतत नहȣं ͩकया है। इसके अǓतǐरÈत
ु
, उÈत नोǑटस कȧ पावती के उपरांत, Įी
ͪवनय ͧसकरवार ने ͪवͬध के अंतग[त यथा ͪवǑहत लेखा दाͨखल करने मɅ अपनी असफलता के ͧलए
भारत Ǔनवा[चन आयोग को न तो कोई कारण बताया है और न हȣ कोई èपçटȣकरण Ǒदया है; और
यतः, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ धारा 10क मɅ यह उपबंͬधत ͩकया गया है ͩकः
“यǑद Ǔनवा[चन आयोग का समाधान हो जाता है ͩक कोई åयिÈत
(क) Ǔनवा[चन åययɉ का लेखा उस समय के भीतर और उस रȣǓत मɅ जैसी इस अͬधǓनयम के
Ùवारा या अधीन अपेͯ¢त है, दाͨखल करने मɅ असफल रहा है, और
(ख) उस असफलता के ͧलए कोई अÍछा कारण अथवा Ûयायोͬच×य नहȣं रखता है
तो Ǔनवा[चन अयोग, शासकȧय राजपğ मɅ Ĥकाͧशत आदेश Ùवारा उसको ǓनरǑह[त घोͪषत
करेगा और ऐसा åयिÈत उस आदेश कȧ तारȣख से तीन वष[ कȧ कालावͬध के ͧलए ǓनरǑह[त होगा।“
यतः, तØयɉ और उपलÞध ǐरकाडɟ के आधार पर आयोग का यह समाधान हो गया है ͩक Įी
ͪवनय ͧसकरवार अपने Ǔनवा[चन åयय के लेखे दाͨखल करने मɅ असफल रहे हɇ और उनके पास ऐसा
करने मɅ असफल रहने के ͧलए कोई भी उͬचत कारण अथवा औͬच×य नहȣं है; और
अतः, अब, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ धारा 10क के अनसरण मɅ भारत Ǔनवा[चन
ु
आयोग एतÙवारा घोषणा करता है ͩक ͪवधान सभा के साधारण Ǔनवा[चन, 2023 मɅ राजèथान राÏय के
80-राजाखेड़ा ͪवधान सभा Ǔनवा[चन ¢ेğ से Ǔनवा[चन लड़ने वाले अßयथȸ Įी ͪवनय ͧसकरवार, Ǔनवासी-
बोथपराु, तह0 मǓनयां, िजला धौलपरु, राजèथान, इस आदेश कȧ तारȣख से तीन वष[ कȧ अवͬध के ͧलए
भाग 5 (घ) राजè थान राज-पğ, जनवरȣ 02, 2026 477
संसद के ͩकसी भी सदन अथवा राÏय अथवा संघ राÏय ¢ेğ कȧ ͪवधानसभा अथवा ͪवधान पǐरषद का
सदèय चने जाने अथवा होने के ͧलए ǓनरǑह[

ORDER
WHEREAS, the General Election to Legislative Assembly of Rajasthan, 2023 for 80-
Rajakhera Assembly Constituency was held in pursuance of the Election Commission of
India Notification No. 464/RJ-LA/2023, dated 30th October, 2023; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate at an election shall, within 30 days from the date of election of the
returned candidate, lodge with the District Election Officer an account of his election expenses
which shall be true copy of the account kept by him or his election agent under Section 77 of
the said act; and
WHEREAS, the result of the above-mentioned election from 80-Rajakhera
Assembly Constituency of Rajasthan, 2023 was declared by the Returning Officer on 3rd
December, 2023 and hence the last date for lodging the account of Election Expenses was
02nd January, 2024; and
WHEREAS, as per the report submitted DEO, Dholpur report 11.01.2024 forwarded
by
the
Chief
Electoral
Officer,
Rajasthan
vide
his
letter
no.
F.3(1)(5)EEM/ELECTION/Candidates’ Exp./433 dated 16.01.2024, under sub-rule (1) of Rule
89 of the Conduct of Election Rules, 1961 Sh. Vinay Sikarvar, a contesting candidate from
80-Rajakhera Assembly Constituency of state of Rajasthan has failed to lodge the account of
election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Dholpur a
Show-Cause Notice No.76/RJ-LA/80/2023/CEMS-I, dated 28th February, 2024 was issued

under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election
Commission of India to Sh. Vinay Sikarvar, for not lodging of the account of Election
Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of
Rule 89 of the Conduct of Elections Rules, 1961, Sh. Vinay Sikarvar, was directed to submit
representation in writing to the Commission explaining the reasons for not lodging the account
and also to lodge account of election expenses with the District Election Officer, Dholpur
District within 20 days from the date of receipt of the notice; and
WHEREAS,
the District Election Officer,
Dholpur vide his letter no.
Ele./LSGE/EVM/2024/839 dated 22.03.2024 has informed that the notice was duly served and
received by Sh. Vinay Sikarvar’s Sister (name Kumari Madhuri), on 12.03.2024; and
WHEREAS, the District Election Officer, Dholpur in his Supplementary Report, vide
its letter no. 37/Elec./Account/2025/120 dated 13.02.2025 has reported that Sh.Vinay
Sikarvar has not submitted account of election expenses. Further, after receipt of the said
notice, Sh.Vinay Sikarvar has neither furnished any reason nor explanation to the Election
Commission of India, for failure to lodge the account of his election expenses as prescribed
under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides
that:-
“If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from the date
of the order.”
WHEREAS, on the basis of facts and available records, the Commission is satisfied
that Sh. Vinay Sikarvar, has failed to lodge account of election expenses and has no good
reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the
Peoples Act, 1951, the Election Commission of India hereby declares Sh.Vinay Sikarvar,
residence of Bothpura, Tehsil- Maniya, District Dholpur, Rajasthan, a contesting
candidate from 80-Rajakhera Assembly Constituency of Rajasthan in General Election to
Legislative Assembly, 2023 to be disqualified for being chosen as and for being a member of
either House of the Parliament or the Legislative Assembly or the Legislative Council of a
State or Union Territory for a period of three years from the date of this order.
