कȧ ĤǓतयां जनता को 23.12.2025 को उपलÞ ध करा दȣ गयी थीं,
से 21 Ǒदवस के अवसान से पव[ू, आ¢ेप और सझाव
ु
आमंǒğत करते हएु राजè थान म× è य अͬधǓनयम,
1953 (1953 का अͬधǓनयम सं.16) कȧ धारा 5 कȧ उप-धारा (1) कȧ अपे¢ानसार
ु
, राजè थान राजपğ
ͪवशेषांक भाग 4 (ग) उप-खÖ ड (झ) Ǒदनांक 23.12.2025 को Ĥकाͧशत ͩकये गये थे;
और यत:, राÏ य सरकार को कोई भी आ¢ेप और सझाव
ु
ĤाÜ त नहȣं हएु हɇ;
अब, अत:, राजè थान म× è य अͬधǓनयम, 1953 (1953 का अͬधǓनयम सं.16) कȧ धारा 5 Ùवारा
Ĥदƣ शिÈतयɉ का Ĥयोग करते हएु राÏ य सरकार, राजè थान म× è य Ǔनयम, 1958 को और संशोͬधत
करने के ͧलए इसके Ùवारा, Ǔनà नͧलͨखत Ǔनयम बनाती है, अथा[त्:-
1. संͯ¢Üत नाम और Ĥारंभ.- (1) इन Ǔनयमɉ का नाम राजèथान म×èय (संशोधन) Ǔनयम,
2026 है।
(2) ये राजपğ मɅ इनके Ĥकाशन कȧ तारȣख से Ĥवƣृ हɉगे।
2. Ǔनयम 5 का संशोधन.- राजèथान म×èय Ǔनयम, 1958, िजÛ हɅ इसमɅ इसके पæ चात् उÈ त
Ǔनयमɉ के Ǿप मɅ ǓनǑद[ç ट ͩकया गया है, के Ǔनयम 5 का ͪवÙयमान उप-Ǔनयम (5) हटाया जायेगा।
3. Ǔनयम 5क का ĤǓतè थापन.- उÈ त Ǔनयमɉ के ͪवÙयमान Ǔनयम 5क के è थान पर
Ǔनà नͧलͨखत ĤǓतè थाͪपत ͩकया जायेगा, अथा[त्:-
“5क. जनजाǓत मछआरा
ु
सहकारȣ सोसाइटȣ को जलाशय का आबंटन.– उन ¢ेğɉ को छोड़कर,
जो नगरपाͧलका Ùवारा Ĥशाͧसत होते हɇ, भारत के संͪवधान के अनÍ छे
ु
द 244 के खÖ ड (1) मɅ यथा
ǓनǑद[ç ट राजè थान के अनसͬचत
ुू
¢ेğɉ मɅ अविèथत जलाशय, Ǔनयम 5 के उप-Ǔनयम (1) के खÖड (ख)
के अधीन अवधाǐरत आरͯ¢त कȧमत पर रिजè Ěȣकत
ृ
जनजाǓत मछआरा
ु
सहकारȣ सोसाइटȣ को आबंǑटत
ͩकये जा सकेगɅ। ख Ĥवग[ के जलाशय का Ǔनदेशक, म× è य Ùवारा, और ग तथा घ Ĥवग[ के जलाशय का
संबंͬधत िजले के म× è य अͬधकारȣ Ùवारा, आबंटन ͩकया जायेगा।”

4. Ǔनयम 6 का संशोधन.- उÈ त Ǔनयमɉ के Ǔनयम 6 मɅ, ͪवÙयमान अͧभå यिÈत “पंचायती
राज संè थाओं को अÛ तǐरत जलाशयɉ के मामले मɅ, िजला पǐरषɮ का मÉ य
ु
काय[पालक अͬधकारȣ या,
यथािèथǓत, पंचायत सͧमǓत का ͪवकास अͬधकारȣ”, जहां कहȣं भी आयी हो, हटायी जायेगी।

NOTIFICATION
JAIPUR, January 21, 2026
G.S.R.143 .-Whereas, the draft rules further to amend the Rajasthan Fisheries Rules,
1958, was published in the Rajasthan Gazette Extraordinary, Part 4 (ga) up-khand(I) dated
23.12.2025 as required by sub-section (1) of section 5 of the Rajasthan Fisheries Act, 1953
(Act No. XVI of 1953), for inviting objections and suggestions from all persons likely to be
affected thereby, before the expiry of 21 days from the date on which the copies of the said
notification as published in Rajasthan Gazette were made available to the people on
23.12.2025;
And whereas, no objections and suggestions have been received by the State
Government;
Now, therefore, in exercise of the powers conferred by section 5 of the Rajasthan
Fisheries Act, 1953 (Act No. XVI of 1953), the State Government hereby makes the
following rules further to amend the Rajasthan Fisheries Rules 1958, namely:-
1. Short title and commencement.- (1) These rules may be called the Rajasthan
Fisheries (Amendment) Rules,2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.Amendment of rule 5.- The existing sub-rule (5) of rule 5 of the Rajasthan
Fisheries Rules 1958, hereinafter referred to as the said rules, shall be deleted.
3. Substitution of rule 5A.-The existing rule 5A of the said rules shall be substituted
by the following, namely:-
"5A. Allotment of water to the Tribal Fisherman Co-operative Society.-Waters,
situated in Scheduled areas of the Rajasthan as referred in clause (1) of Article 244 of the
Constitution of India except those areas which are administered by a municipality, may be
allotted to the Registered Tribal Fisherman Co-operative Society on reserve price determined
under clause (b) of sub-rule (1) of rule 5. Allotment of the B category water shall be made by
the Director, Fisheries and C and D category water shall be made by the Fishery Officer of
district concerned."
4. Amendment of rule 6.- In rule 6 of the said rules,the existing expression "and in
case of waters transferred to Panchayati Raj Institutions, Chief Executive Officer of Zila

Parishad or Vikas Adhikari of Panchayat Samiti as the case may be,", wherever occurring,
shall be deleted.
