2. Ǔनयम 3 का संशोधन.- राजèथान ͪवधान सभा भतपव[ सदèय और कटंब पɅशनर

) Ǔनयम, 2010, िजसे इसमɅ इसके पæ चात उÈ त

Ǔनयमɉ के Ǿप मɅ ǓनǑद[ç ट ͩकया गया है, के

Ǔनयम 3 के ͪवÙयमानखंड (क) के è थान पर Ǔनà नͧलͨखत ĤǓतè थाͪपत ͩकया जायेगा, अथा[त्:-

"(क) 50,000/- ǽपये ĤǓतवष[ कȧ अͬधकतम खच[ सीमा तक, िजसमɅ 5,000/- ǽ. ĤǓतवष[ तक

आरजीएचएस के अधीन सचीबÙध

ू

जांचɅ (पैथोलोिजकल, बैÈ टैǐरयोलोिजकल, रेͫडयोलोिजकल और अÛ य)

सिà म ͧलत हɇ, बाéय उपचार के मामले मɅ एलोपैͬथक ओषͬधयां, औषध, वेÈ सीन, सीरा, अÛ य ͬचͩक×सा

पदाथ[ आरजीएचएस के अधीन माÛ यता ĤाÜ त फामा[ è टोर/ई-फामा[ è टोर से ͧलये जा सकɅ गे। यǑद

सरकारȣ अè पताल मɅ जांच उपलÞ ध नहȣं है तो सरकारȣ अè पताल से अनपलÞ ध

3. Ǔनयम 4 का ĤǓतè थापन.- उÈ त Ǔनयमɉ के ͪवÙयमान Ǔनयम 4 के è थान पर Ǔनà नͧलͨखत

ĤǓतè थाͪपत ͩकया जायेगा, अथा[त्:-

“4. Ǔनयम 3 के अधीन खच[ सीमा मɅ ͧशͬथलȣकरण.- (1) Ĥमख सͬचव

(रेनल) रोग के उपचार के संबंध मɅ ĤǓतवष[ 2,00,000/- ǽपये कȧ सीमा तक,

Ǔनà नͧलͨखत से ͧमलकर बनी सͧमǓत कȧ ͧसफाǐरश पर और जहां आवæ यक समझी जाये, दसरȣ

Ùवारा अनमोǑदत ͩकया जायेगा।

Jaipur, May 05, 2026

G.S.R.12 .-In exercise of the powers conferred by section 11 read with

sub-section (2) of section 4-A of the Rajasthan Legislative Assembly (Officers

and Members Emoluments and Pension) Act, 1956 (Act No. 6 of 1957), the State

Government hereby makes the following rules further to amend the Rajasthan

Legislative Assembly Ex-Members and Family Pensioners (Medical Facilities)

Rules, 2010, namely:-

1. Short title and commencement.- (1)These rules may be called the

Rajasthan Legislative Assembly Ex-Members and Family Pensioners (Medical

Facilities) (Amendment) Rules, 2026.

(2) They shall come into force with immediate effect.

2. Amendment of rule 3.- The existing clause (a) of rule 3 of the

Rajasthan Legislative Assembly Ex-Members and Family Pensioners (Medical

Facilities) Rules, 2010, hereinafter referred to as the said rules, shall be

substituted by the following, namely:-

"(a) Allopathic drugs, medicines, vaccines, sera, other therapeutic substances can

be taken from pharma store/ e-pharma store recognized under the RGHS in

case of outdoor treatment upto the cost ceiling of Rs. 50,000/- per annum,

which includes the listed tests (pathological, bacteriological, radiological

and other) under RGHS upto Rs 5000/- per annum. NAC is required from

Government hospitals in case the test is not available in the Government

hospitals:

Provided that medicines to the indoor patients shall be made available

irrespective of the cost ceiling.

Provided further that vitamins, minerals and anti-oxidant shall be made

available upto the limit of Rs 3000/- per annum for the pensioners who have

attained the age of 75 years or above in the case of following treatment/

diseases:-

(i) Cancer, (ii) Chronic Liver Disease, (iii) Kidney Failure, (iv) Major

Organ Transplant (i.e. Kidney, Lungs, Liver and Bone Marrow Transplant)

and (v) Strokes resulting in permanents symptom/ Parkinsons disease.

The payment of Vitamins, Minerals and Anti-oxidant prescribed by

authorized medical attendant shall be made to Pharma stores/e-pharma

stores on RGHS rates."

3. Substitution of rule 4.-The existing rule 4 of the said rules shall be

substituted by the following, namely:-

"4. Relaxation in cost ceiling under rule 3.-(1) The Principal Secretary

may extend the cost ceiling for medicines specified in rule 3 upto Rs. 1,00,000/-

per annum in all deserving cases and in respect of treatment of cancer, kidney

failure and renal disease upto limit of Rs. 2,00,000/- per annum through RGHS

portal on the recommendation of the committee consisting of the following and

after obtaining second medical opinion where it is felt necessary, namely:-

1. Principal Secretary

- President

2.Medical Officer of the Government Hospital

of the Rajasthan Vidhan Sabha

- Member

3.Financial Adviser/Chief Accounts officer/

Senior Accounts officer

- Member Secretary

Note: For the listed tests (pathological, bacteriological, radiological and other)

under RGHS, there is ceiling of Rs 5000/- per annum. The extension in

cost ceiling of the listed tests shall be approved by the Principal Secretary

within cost ceiling extended under sub-rule (1).

(2) The extension of cost ceiling of drugs and medicines in case of outdoor

treatment above Rs. 1,00,000/- per annum in all deserving cases and in respect of

treatment of cancer, kidney failure and renal diseases above the limit of Rs.

2,00,000/- per annum shall be decided by the following competent level:-

1. Additional CEO/Joint CEO, Rajasthan State Health Assurance Agency

as authorized by medical and health department (above Rs. 1,00,000/- in

all deserving cases)

2. Chief Executive Officer, Rajasthan State Health Assurance Agency

(above Rs. 2,00,000/- and upto Rs. 7,00,000/-)

3.Administrative Department- Medical and Health Department (above Rs.

7,00,000/-)
