संÉया रा.ͪव.ͪव. आयोग/सͬचव/ͪवǓनयम/ 164:- ͪवÙयतु अͬधǓनयम 2003 (2003 का 36वां
अͬधǓनयम) कȧ धारा 61, धारा 86 सपǑठत धारा 181 Ùवारा Ĥदƣ ् शिÈतयɉ और उस Ǔनͧमत
उसे समथ[ बनाने वालȣ समèत शिÈतयɉ का Ĥयोग करते हयेु, राजèथान ͪवÙयतु ͪवǓनयामक
आयोग, पव[ू Ĥकाशन के पæचात् एतÙÙवारा Ǔनàनͧलͨखत ͪवǓनयम बनाता है, अथा[त्:

लघशीष[क
ु
, Ĥारàभण तथा ĤयोÏयता कȧ सीमा:
1.1. ये ͪवǓनयम ‘‘राजèथान ͪवÙयतु ͪवǓनयामक आयोग (बैटरȣ ऊजा[ भंडारण
Ĥणालȣ) ͪवǓनयम, 2026’’ कहलायɅगे।
1.2. ये ͪवǓनयम शासकȧय राजपğ मɅ इनके Ĥकाशन कȧ Ǔतͬथ से Ĥवƣृ् हɉगे।
1.3. ये ͪवǓनयम सभी लाइसɅसधाǐरयɉ, राÏय Ĥसारण उपयोͬगता (एसटȣयू), राÏय भार
Ĥेषण
कɅ ġ
(एसएलडीसी),
ऊजा[
उ×पादन
कंपǓनयाँ,
नवीकरणीय
ऊजा[
ͪवकासकता[ओं, एĒीगेटरɉ, बैटरȣ ऊजा[ भंडारण Ĥणालȣ (बीरइएसएस
्
) सेवा Ĥदाताओं,
उपभोÈताओं/ĤोÏयमरɉ
ु
तथा राजèथान राÏय के भीतर बैटरȣ ऊजा[ भंडारण
Ĥणाͧलयɉ कȧ योजना, Đय, पǐरǓनयोजन, संचालन या उपयोग मɅ शाͧमल अÛय
संèथाओं पर लागू हɉगे।
1.4. ĤौÙयोͬगकȧ तटèथता : ये ͪवǓनयम बैटरȣ ऊजा[ भंडारण Ĥणालȣ ĤौÙयोͬगकȧ के
ĤǓत तटèथ होने के ͧलये अͧभĤेत हɇ और यह उन सभी Ĥकार कȧ बैटरȣ ऊजा[
भंडारण Ĥणाͧलयɉ पर लागू हɉगɅ जो आवæयक तकनीकȧ और Ĥदश[न मानकɉ को

पराू करती हɇ, िजससे यह सǓनिæचत
ु
हो सके ͩक यह ढांचा ĤौÙयोͬगकȧ के
ͪवकास के साथ Ĥासंͬगक बना रहे।
बशतȶ ͩक आयोग के आदेश Ùवारा इन ͪवǓनयमɉ को अÛय ऊजा[ भंडारण
ĤौÙयोͬगͩकयɉ पर यथावæयक पǐरवत[नɉ के साथ तब तक ͪवèताǐरत ͩकया जा
सकता है जब तक ͩक आयोग Ùवारा ऐसी ĤौÙयोͬगͩकयɉ के ͧलए ͪवͧशçट
ͪवǓनयमɉ को अͬधसͬचत
ू
नहÈ कर Ǒदया जाता है।
2.
पǐरभाषायɅ
(1) इन ͪवǓनयमɉ मɅ, जब तक ͩक संदभ[ Ùवारा अÛयथा अपेͯ¢त न हो :
(क) ‘अͬधǓनयम’ से अͧभĤाय ͪवÙयतु अͬधǓनयम, 2003 (2003 का 36वां) से है;
(ख) “एĒीगेटर (रɉ) ” या “ͪवतǐरत ऊजा[ संसाधन एĒीगेटर या डीईआरए” से
अͧभĤाय ऐसी संèथा से है जो ͪवतरण लाइसɅसधारȣ के साथ पंजीकत
ृ है जो
लाइसɅसधारȣ ¢ेğ के भीतर मांग ĤǓतͩĐया सेवाओं, ͪवतǐरत उ×पादन, ऊजा[
भंडारण आǑद सǑहत एक या अͬधक सेवाओं का एĒीगेशन Ĥदान करती है;
(ग) “सहायक सेवाएं” या “एएस” से अͧभĤाय समय-समय पर यथा संशोͬधत
कɅ ġȣय ͪवÙयतु Ǔनयामक आयोग (सहायक सेवाएं) ͪवǓनयम, 2022 के अधीन
सेवाओं से है;
(घ) “बैटरȣ ऊजा[ भंडारण Ĥणालȣ” या “बीईएसएस” से अͧभĤाय ͪवÙयतु Ĥणालȣ
से संबÙध िèथर Ĥणालȣ से है िजसका उपयोग ͪवÙयतु रासायǓनक पदाथɟ के
माÚयम से ͪवÙयतु ऊजा[ को संĒǑहत करने के ͧलए ͩकया जाता है और इसमɅ
आमतौर पर बैटरȣ, ͪवÙयतु Ǿपांतरण Ĥणालȣ और बैटरȣ Ĥबंधन Ĥणालȣ
(बीएमएस) शाͧमल होती है;
(ड़) “बैटरȣ ऊजा[ भंडारण Ĥणालȣ ͪवकासक” या “बीईएसएसडी” या “ͪवकासक”
से अͧभĤाय उस इकाई से है जो इन ͪवǓनयमɉ के अधीन ͪवÙयतु कȧ आपूÆत या
भंडारण सेवाओं के Ĥावधान के ͧलए बीईएसएस सͪवधा
ु
का èवाͧम×व और/या
संचालन करती है;
(च) “आयोग” से अͧभĤाय राजèथान ͪवÙयतु ͪवǓनयामक आयोग से है;
(छ) “ͪवतरण लाइसɅसधारȣ”, “Ĥसारण लाइसɅसधारȣ”, “उ×पादन कंपनी” और “
एसएलडीसी” का वहȣ अͧभĤाय होगा जो अͬधǓनयम के अधीन उÛहɅ Ǒदया गया
है;
(ज) “नोडल एजɅसी” से अͧभĤाय राÏय भार Ĥेषण कɅ ġ (एसएलडीसी) से है, जो
राÏयाÛतग[त èतर पर सहायक सेवाओं के काया[Ûवयन के ͧलये उ× तरदायी होगा;
(झ) “ऊजा[ भंडारण Ĥणालȣ का èवाͧम×व” से अͧभĤाय बैटरȣ ऊजा[ भंडारण Ĥणालȣ
सǑहत ऊजा[ भंडारण Ĥणालȣ को ͪवÙयतु मंğालय (एमओपी) Ùवारा समय-समय

पर जारȣ ͩकए गये ǑदशाǓनदशɉ

के अनसार
ु
èवाͧम×व से है, जो लागू काननɉ
ू और
ͪवǓनयमɉ के अधीन ͪवतरण लाइसɅसधाǐरयɉ, Ĥसारण लाइसɅसधाǐरयɉ, उ×पादन
कंपǓनयɉ, èवतंğ ͪवÙयतु उ×पादकɉ, उपभोÈताओं, एĒीगेटरɉ और ततीय
ृ
प¢
Ǔनवेशकɉ को अनमत
ु
है;
(¥) “राउंड-ǑĚप द¢ता” से अͧभĤाय बीईएसएस से उÛमÈत
ु
कȧ गयी कल
ु
ͪवÙयतु
ऊजा[ और बीईएसएस को चाज[ करने के ͧलये आपǓत[
ू
कȧ गयी कल
ु
ͪवÙयतु
ऊजा[ के अनपात
ु
से है, िजसे यथा ĤǓतशत के åयÈत ͩकया जाता है;
(ट) “èटɇडअलोन बैटरȣ ऊजा[ भंडारण Ĥणालȣ (बीईएसएस)” से अͧभĤाय ऐसी ऊजा[
भंडारण Ĥणालȣ से है जो ͩकसी भी उ×पादन èटेशन या उपभोÈता भार के साथ
सह-िèथत नहÈ है, और यह ͩकसी ͪवͧशçट जनरेटर या उपभोÈता के ͧलये
समÆपत नहÈ है और जो ͪवÙयतु बाजारɉ, सहायक सेवाओं मɅ भाग ले सकती हɇ,
या दȣघ[काͧलक या अãपकाͧलक åयवèथाओं के अधीन अनबंͬधत
ु
कȧ जा सकती
हɇ;
(2) उपय[Èत
ु
के अǓतǐरÈत और जब तक संदभ[ या ͪवषयवèतु के ͪवपरȣत न हो,
अÛयथा आवæयक न हो, इन ͪवǓनयमɉ मɅ ĤयÈत
ु
शÞद और अͧभåयिÈतयाँ, जो
यहाँ पǐरभाͪषत नहÈ है, लेͩकन समय-समय पर संशोͬधत अͬधǓनयम मɅ, या राÏय
ͬĒड कोड/आईईजीसी (यथा ĤयोÏय) मɅ, या आयोग/सीईआरसी/सीईए के ͩकसी
अÛय ͪवǓनयम/आदेश मɅ पǐरभाͪषत ͩकया गया है, वहȣं अथ[ होगा जो उनमɅ
समनदेͧशत
ु
हɇ।
3.
उÙदेæय
इन ͪवǓनयमɉ के Ĥाथͧमक उÙदेæय Ǔनàनͧलͨखत हɇ:
(क) उ×पादन, Ĥसारण और ͪवतरण पǐरसंपǂयɉ के भाग के Ǿप मɅ बीईएसएस के
पǐरǓनयोजन और उपयोग को स¢म बनाना;
(ख) सहायक सेवाओं और ऊजा[ बाजारɉ मɅ बीईएसएस कȧ भागीदारȣ को सगम
ु
बनाना;
(ग) ͬĒड िèथरता, आवͪƣ
ृ Ĥबंधन और नवीकरणीय ऊजा[ एकȧकरण का समथ[न करने
वाले लागत Ĥभावी ऊजा[ भंडारण समाधानɉ का उÛनयन करना;
(घ) ͪवÙयतु बाजार मɅ भाग लेने हेतु एĒीगेटरɉ और ततीय
ृ
-प¢ बीरइएसएस
्
ͪवकासकता[ओं के ͧलये आधारभतू संरचना èथाͪपत करना;
(ड़) सभी ¢ेğɉ मɅ बैटरȣ ऊजा[ भंडारण Ĥणाͧलयɉ के बाजार ͪवकास और अपनाने को
स¢म बनाना।
4.
èवाͧम×व और åयावसाǓयक मॉडल
4.1. बीईएसएस का ͪवकास, èवाͧम×व, पÒटा या संचालन कɅ ġ सरकार Ùवारा समय-
समय पर जारȣ ͩकए गये Ǒदशा-Ǔनदशɉ

èपçटȣकरण: “उपभोÈताओं/ĤोÏयमरɉ
ू
” मɅ वे उपभोÈता शाͧमल हɇ जो नेट
मीटÇरग/नेट ǒबͧलंग/Ēपु नेट मीटÇरग/वच[अल
ु
नेट मीटÇरग ĥेमवक[ या
हǐरत उजा[ खला
ु
अͧभगम, जो भी लागू हो, के अधीन भाग ले रहे हɇ।
बशतȶ ͩक एसएलडीसी, यथा नोडल एजɅसी के, इन ͪवǓनयमɉ के अनसार
ु
Ĥणालȣ
संचालन कायɟ का Ǔनव[हन करेगी।
बशतȶ यह भी ͩक इन ͪवǓनयमɉ मɅ ͩकसी भी बात से ͩकसी भी कैिÜटव उ×पादन
संयंğ, कैिÜटव उपयोगकता[(ओं), या समहू कैिÜटव åयवèथा कȧ िèथǓत/पाğता को
Ǔनधा[ǐरत या संशोͬधत करने हेतु åयाÉया नहȣं कȧ जायेगी। ऐसा कोई भी Ǔनण[य
लागू कैिÜटव ढांचे और संबंͬधत ͪवǓनयमɉ/Ǔनयमɉ/आदेशɉ Ùवारा शाͧसत होगा।
4.2. बीरइएसएस
्
को नवीकरणीय ऊजा[ एवं पारंपǐरक जनरेटरɉ के साथ सह-िèथत,
ͬĒड-संबÙध èटɇडअलोन भंडारण, ͪवतरण या Ĥसारण नेटवक[ मɅ अंत:èथाͪपत,
मीटर के पीछे (उपभोÈता èतर), या वाहन-से-ͬĒड (वी2जी) सेवाओं के ͧलये
ͪवÙयतु वाहन (ईवी) अवसंरचना के साथ एकȧकत
ृ के Ǿप मɅ पǐरǓनयोिजत ͩकया
जा सकेगा।
4.3. बैटरȣ ऊजा[ भंडारण Ĥणालȣ का उपयोग या तो èटɇडअलोन बैटरȣ ऊजा[ भंडारण
Ĥणालȣ के Ǿप मɅ या उ×पादन, Ĥसारण या ͪवतरण Ĥणालȣ के भाग के Ǿप मɅ,
या मीटर के पीछे èथाͪपत नवीकरणीय ऊजा[ İोतɉ के साथ सहिèथत या èवतंğ
Ǿप से उपभोÈता के भार को एकȧकत
ृ करते हयेु ͩकया जायेगा।
4.4. बैटरȣ ऊजा[ भंडारण Ĥणालȣ कȧ ͪवͬधक िèथǓत उसके èवामी कȧ ͪवͬधक िèथǓत
के समान होगी:
बशतȶ ͩक यǑद ऐसी बैटरȣ ऊजा[ भंडारण Ĥणालȣ कȧ ͪवͬधक िèथǓत उ×पादन
केÛġ या लाइसɅसधारȣ या उपभोÈता के साथ सह-िèथत नहÈ है परÛतु उसके
èवाͧम×व और संचालन मɅ है, तो ͪवͬधक िèथǓत तो माͧलक कȧ हȣ रहेगी, परÛतु
अनसचन
ुू
, Ĥेषण और अÛय मामलɉ के Ĥयोजन हेतु, इसे अलग भंडारण इकाई के
समान åयवǿत ͩकया जायेगा।
बशतȶ यह भी ͩक:
(1) èटɇडअलोन बीईएसएस यथा पथक
ृ
भंडारण त×व के Ǔनधा[ǐरत कोरइ् भी गैर-
सह-िèथत बीईएसएस, ĤयोÏय ͬĒड कोड तथा एसएलडीसी ĤͩĐयाओं के
अधीन अनसचन
ुू
, मीटÇरग, टेलȣमेĚȣ तथा Ĥेषण आवæयकताओं का अनपालन
ु
करेगा।

(2) ऐसे बीईएसएस के ͧलये अनसची
ुू
से ͪवचलनɉ का Ǔनपटान इस संबंध मɅ
समय-समय पर यथा संशोͬधत यथावæयक पǐरवत[नɉ के साथ सीईआरसी के
लागू ͪवǓनयमɉ/आदेशɉ/ĤͩĐया के Ĥावधानɉ के अनसार
ु
ͩकया जायेगा, जब
तक ͩक आयोग Ùवारा इस संबंध मɅ ͪवǓनयम जारȣ नहÈ ͩकये जाते।
(3) इंटरकनेÈशन Çबदु पर चाÉजग आहरण और ͫडèचाÉजग इंजेÈशन को èपçट
Ǿप से अͧभͧलͨखत करने के ͧलये मीटÇरग एसईएम या एसएलडीसी Ùवारा
यथा ǓनÆदçट ऐसी अÛय åयवèथा के माÚयम से होगी।
5.
Ǔनयोजन एवं अͬधĤािÜत:
5.1. समĒ Ĥणालȣ आवæयकताएं, िजनमɅ ͪवͧभÛन सबèटेशनɉ पर Ǔनàन से उÍच
वोãटेज कȧ ओर ͪवपरȣत ͪवÙयतु Ĥवाह का Ĥबंधन, उÍच नवीकरणीय ऊजा[ के
उपयोग से जड़ी
ु चनौǓतयɉ
ु
को कम करते हयेु Ĥसारण या ͪवतरण नेटवक[
संकलन
ु
का समाधान और वोãटेज या आवͪƣ
ृ िèथरता संबंधी मÙदɉ
ु
का समाधान
सिàमͧलत है, लेͩकन इÛहÈ तक सीͧमत नहÈ होकर ͪवतरण/Ĥसारण लाइसɅसधाǐरयɉ
Ùवारा ͪवतरण Ĥणालȣ या Ĥसारण Ĥणालȣ मɅ बीरइएसएस
्
èथानɉ को अंǓतम Ǿप
देने का मानदंड होगा।
5.2. अÛय Ĥासंͬगक कारकɉ के साथ-साथ तकनीकȧ पहलओं
ु
, ͧसèटम कȧ
ͪवæवसनीयता, भार आवæयकताओं, उÍचतम Ĥबंधन, संकलन
ु
से राहत, नवीकरणीय
ऊजा[ एकȧकरण और सहायक सेवाओं और ऐसे अÛय Ĥासंͬगक कारकɉ को Úयान
मɅ रखते हयेु ͪवतरण लाइसɅसधारȣ और राÏय Ĥसारण उपयोͬगता (एसटȣयू)
एसएलडीसी के परामश[ से अपने-अपने पǐरचालन ¢ेğɉ के भीतर ऊजा[ भंडारण
¢मता कȧ आवæयकता कȧ योजना बनायɅगे। भंडारण योजना तैयार करते समय,
ͪवÙयतु Đय लागत से बचाव, èथͬगत पǐरवहन एवं ͪवकास पंजीगत
ू
åयय,
हाǓनयɉ मɅ कमी और कटौती, लेͩकन इÛहÈ तक सीͧमत नहÈ होकर Ĥासंͬगक
कारकɉ से Ĥ¢ेͪपत एआरआर बचत पर उͬचत Úयान Ǒदया जायेगा।
बशतȶ यह ͩक भंडारण योजना राÏय कȧ नवीकरणीय ऊजा[ नीǓत, ऊजा[ भंडारण
लêयɉ, राÏय Ĥसारण योजना और समय-समय पर राÏय सरकार या आयोग
Ùवारा जारȣ ͩकये गये ͩकसी भी Ǔनदȶश के अनǾप
ु
होगी।
बशतȶ यह भी ͩक एसटȣयू Ĥसारण और ͪवतरण संबंधी बाधाओं को Úयान मɅ
रखते हयेु समेͩकत राÏयाÛतग[त भंडारण योजना (अनशंͧसत
ु
èथानɉ/वोãटेज èतरɉ
सǑहत) तैयार करेगा, और इसे ͪवतरण लाइसɅसधाǐरयɉ, Ĥसारण लाइसɅसधाǐरयɉ,
एसएलडीसी और अÛय सभी संबंͬधत संèथाओं के साथ अͬधĤािÜत/काया[Ûवयन
पर सहमǓत के ͧलये साझा करेगा।
बशतȶ यह और भी ͩक ऐसी योजना और Đय, जहां तक लागू हो, ͪवÙयतु
मंğालय/कɅ ġȣय ͪवÙयतु Ĥाͬधकरण Ùवारा अͬधसͬचत
ू
Ĥचͧलत संसाधन पया[Üतता

योजना/ǑदशाǓनदशɉ

होगी। Ĥèताͪवत भंडारण योजना मɅ नेटवक[
संवध[न, मांग-प¢ उपाय या लचीला उ×पादन जैसे ͪवकãप सǑहत संबोͬधत
पया[Üतता कȧ कमी, बीरइएसएस

कȧ अपेͯ¢त ¢मता योगदान और लागत

का उãलेख ͩकया जायेगा।
बशतȶ यह और भी ͩक यǑद कोई ͪवतरण लाइसɅसधारȣ या Ĥसारण लाइसɅसधारȣ
या उपरोÈत योजना मɅ सिàमͧलत उ×पादन कंपनी ͪवæवसनीयता, संकलऩ
ु
Ĥबंधन,
वोãटेज समथ[न या नेटवक[ संवध[न के èथगन सǑहत, लेͩकन इÛहÈ तक सीͧमत
नहÈ, बीरइएसएस
्
के ͧलये ͪवǓनयͧमत नेटवक[ /ͬĒड-आधार परसà पǓत (संबंͬधत
सहायक बǓनयादȣ
ु
ढांचे सǑहत) के Ǿप मɅ Ĥèताͪवत करती है तो आयोग, उͬचत
Ǔनयामक ĤͩĐया का पालन करते हयेु एआरआर/टैǐरफ के माÚयम से ऐसे Ǔनवेश
और लागत वसलȣ
ू
का अनमोदन
ु
कर सकता है िजसके ͧलये आयोग उपयÈत
ु
Ǿप से सीईआरसी मानदंडɉ/काय[Ĥणालȣ और लागू होने वालȣ Ĥचͧलत बाजार
िèथǓतयɉ, जैसा लागू हो, पर भी ͪवचार कर सकता है, जब तक ͩक आयोग
Ùवारा ऐसे मानदंडɉ/काय[Ĥणालȣ को ǓनÆदçट नहÈ ͩकया जाता है।
बशतȶ यह और भी ͩक लाइसɅसधाǐरयɉ या उ×पादन कंपनी को अपनी-अपनी
भंडारण योजनाओं मɅ èपçट Ǿप से यह दशा[ना होगा, ͩक वे अपनी èवयं कȧ
बैटरȣ ऊजा[ भंडारण Ĥणालȣ (बीरइएसएस
्
) èथाͪपत और संचाͧलत करने का
आशय रखते हɇ या इसके Ĥèताͪवत èथान, Ĥèताͪवत इंजेÈशन Çबदु को ǓनÆदçट
करते हयेु, तकनीकȧ, आÆथक और ͬĒड एकȧकरण संबंधी ͪवचारɉ के आधार पर
èथान को उͬचत ͧसÙध करते हयेु, साथ-साथ ततीय
ृ
प¢ के Ĥदाताओं से ऊजा[
भंडारण ¢मता या सेवाएं ĤाÜत करना चाहते है।
5.3. Ûयनतम
ू
åयिÈतगत पǐरयोजना का आकार 1 मेगावाट या उससे अͬधक कȧ पावर
रेÇटग वाला होना चाǑहए, िजसमɅ कम से कम दो घंटे कȧ उपयÈत
ु
ऊजा[ रेÇटग
हो, और यह 11 केवी या उससे ऊपर से सàबÙध होगी।

ृ ͪवǓनयम, िèपÇनग ǐरजव[,
वोãटेज समथ[न, Þलैक èटाट[ सेवाएं और मांग ĤǓतͩĐया सेवाएं या कोई अÛय
सेवाएं Ĥदान करने के ͧलये पाğ होगा।
6.2. बीईएसएस तकनीकȧ ¢मता, टेलȣमेĚȣ/संचार आवæयकताओं, Ĥेषण Ǔनदशɉ
ȶ
और
संͪवदा×मक दाǓय×वɉ के अÚयधीन, साथ-साथ या आनĐͧमक
ु
Ǿप से बहप¢ीय
ु
सेवाएं Ĥदान कर सकता है।
बशतȶ ͩक एसएलडीसी इन ͪवǓनयमɉ के ͪवǓनयम 13 के अधीन जारȣ ĤͩĐया मɅ
ऐसी कई सेवाओं के अलग-अलग लेखांकन के ͧलये काय[Ĥणालȣ ǓनÆदçट करेगा।
6.3. ͪवͧभÛन सेवाओं के ͧलये राजèव और Ĥदश[न दाǓय×वɉ को पथक

(ग) èवचाͧलत उ×पादन Ǔनयंğण (एजीसी) संकेतɉ को ĤाÜत करने और उन पर
ĤǓतͩĐया करने कȧ ¢मता, जहां लागू हो; और
(घ) एसएलडीसी Ùवारा यथा ǓनǑद[çट मीटÇरग åयवèथा।

एĒीगेटरɉ कȧ भͧमका
ू
:
एसएलडीसी, Ĥसारण लाइसɅसधारȣ/ͪवतरण लाइसɅसधारȣ/उ×पादन कंपǓनयɉ या अÛय
बाजार ĤǓतभाͬगयɉ को सेवाएं Ĥदान करने के ͧलये एĒीगेटर कई èथलɉ से
बीरइएसएस
्
संसाधनɉ का एĒीगेशन करेगा और एसएलडीसी Ùवारा जारȣ ͩकये गये
Ĥोटोकॉल का पालन करेगा।
बशतȶ ͩक ͩकसी संèथा के यथा एĒीगेटर के पंजीकरण के ͧलये एसएलडीसी,
लाइसɅसधाǐरयɉ के परामश[ से, Ûयनतम
ू
तकनीकȧ और ͪवƣीय पाğता मानदंड,
ऑनलाइन पंजीकरण ĤाǾप, लागू शãक

(क) ͪवतरण लाइसɅसधारȣ का Ĥचͧलत Ǒदन-का-समय(टȣओडी)/ उपयोग-का-समय
(टȣओयू) टैǐरफ ढांचा या आयोग Ùवारा उपयÈत

समझा जाने वाला कोई

(ख) यह ͧसÙधांत ͩक नवीकरणीय İोतɉ से संĒǑहत ऊजा[ ͪवǓनयमन 9.4 के
अनǾप

अपना नवीकरणीय चǐरğ ĤǓतधाǐरत करेगी।
(ग) ऊजा[ भंडारण Ĥणाͧलयɉ को बढ़ावा देने के ͧलये ͪवÙयतु मंğालय Ùवारा

करेगा।

13.1. एसएलडीसी, थम[ल जनरेटरɉ कȧ गवन[र सेÇटÊस को स×याͪपत करेगा और
बीरइएसएस

से Ĥाथͧमक, िÙवतीयक और ततीयक

आरͯ¢त सहायक सेवाओं
(पीआरएएस, एसआरएएस, टȣआरएएस) कȧ आवæयकता का आकलन करेगा। यह

13.2. एसएलडीसी, तकनीकȧ मानदंडɉ और Ĥचालन×म Ǔनçपादन के आधार पर
सहायक सेवाएं Ĥदान करने के ͧलये बीरइएसएस

संसाधनɉ के ͧलये पाğता
मानदंड ǓनÆदçट करेगा और इस Ǔनयम कȧ अͬधसचना
ू
कȧ Ǔतͬथ से तीन माह
के भीतर इसे अपनी वेबसाइट पर Ĥकाͧशत करेगा।
13.3. एसएलडीसी, एसटȣयू और लाइसɅसधाǐरयɉ के साथ परामश[ करके, इन ͪवǓनयमɉ
कȧ अͬधसचना
ू
कȧ Ǔतͬथ से तीन माह के भीतर सहायक सेवा Ĥदाताओं के
पंजीकरण के ͧलये पाğता मानदंड तैयार करेगा और अपनी वेबसाइट पर
Ĥकाͧशत करेगा।
13.4. एसएलडीसी इन ͪवǓनयमɉ के Ĥकाशन कȧ Ǔतͬथ से छह माहे के भीतर
बीरइएसएस
्
के माÚयम से सहायक सेवाओं के संचालन हेतु अनसचीकरण
ुू
,
मीटÇरग, लेखांकन, Ǔनपटान और वाͨणिÏयक तंğ के ͧलये ĤͩĐया तैयार करेगा।
13.5. एसएलडीसी, èटेट ऑफ चाज[ (एसओसी), राउंड-ǑĚप द¢ता और उपलÞधता
सǑहत बीरइएसएस
्
के Ĥदश[न कȧ Ǔनगरानी करेगा।
13.6. एसएलडीसी इन ͪवǓनयमɉ के अनसार
ु
सहायक सेवा (एएस) Ĥदाताओं को
पंजीकत
ृ करेगा।
èपçटȣकरण:
इस उप-ͪवǓनयम के अंतग[त सहायक सेवा (एएस) Ĥदाता के Ǿप
मɅ पंजीकरण, ͪवǓनयम 12.2 के अंतग[त ͪवतǐरत ऊजा[ संसाधन
एĒीगेटर (डीईआरए) के Ǿप मɅ पंजीकरण से ͧभÛन और अǓतǐरÈत
है, जहां कोई संèथा डीईआरए के Ǿप मɅ पंजीकत
ृ है और सहायक
सेवाओं मɅ भी भाग लेने का आशय रखती है, ऐसी संèथा को इस
उप-ͪवǓनयम के अंतग[त एसएलडीसी के साथ एएस Ĥदाता के Ǿप मɅ
अǓतǐरÈत Ǿप से पंजीकरण कराना होगा।
13.7. एसएलडीसी सहायक सेवाओं कȧ Đय के ͧलये मानक अनबंध
ु
ĤाǾप तैयार
करेगा और समझौता करने से पहले आयोग कȧ èवीकǓत
ृ
ĤाÜत करेगा।
13.8. पंजीकरण/पैनल मɅ शाͧमल होने कȧ समयसीमाएं:

(क) एसएलडीसी, एएस Ĥदाता या एĒीगेटर (जहां लागू हो) के Ǿप मɅ
पंजीकरण/पैनल मɅ शाͧमल होने के ͧलये पण[ू आवेदनɉ का Ǔनपटान तीस
Ǒदनɉ के भीतर करेगा।
(ख) यǑद ͩकसी आवेदन का Ǔनपटारा Ǔनधा[ǐरत समय सीमा के भीतर नहÈ ͩकया
जा सके, एसएलडीसी तक[ संगत कमी/ͪवèतार नोǑटस जारȣ करेगा और
अǓतǐरÈत तीस Ǒदनɉ के भीतर आवेदन का Ǔनपटारा करेगा।
(ग) कनेिÈटͪवटȣ Ĥसंèकरण समयसीमाएं इन ͪवǓनयमɉ के अधीन अͬधसͬचत
ू
लागू एसएलडीसी ĤͩĐया के अनसार
ु
होगी।
(घ) इस ͪवǓनयम के अंतग[त पंजीकरण या पैनल मɅ शाͧमल ͩकये जाने मɅ देरȣ
या अèवीकǓत
ृ
से संबंͬधत कोई भी ͧशकायत यǑद पंġह Ǒदनɉ तक लंǒबत
रहती है, तो पीͫड़त प¢ Ùवारा इन ͪवǓनयमɉ के ͪवǓनयम 17.2 मɅ ǓनÆदçट
ͪववाद समाधान तंğ के अधीन राÏय ͪवÙयतु सͧमǓत के सम¢ मामले को
उठाया जा सकता है।
14. उ×पादन करने वालȣ कंपǓनयɉ/आईपीपी/सीपीपी/बीरइएसएस
्
ͪवकासकɉ कȧ भͧमका
ू
ͪवÙयतु उ×पादन कंपǓनयां, आईपीपी, सीपीपी और बीईएसएस ͪवकासक यथा उͬचत
अनमोदन
ु
ĤाÜत करने के पæचात्, ͧसèटम मɅ ͩकसी भी Çबदु पर बीईएसएस èथाͪपत
कर सकते हɇ। ऐसी संèथाएं सहायक सेवाओं के बाजार मɅ भाग ले सकती हɇ और

फोरम, ͪवÙयतु लोकपाल और उपभोÈता प¢कारȣ) ͪवǓनयम, 2021 के अनसार
ु
ͩकया जायेगा।

17.2. इन ͪवǓनयमɉ के अंतग[त होने वाले अÛय सभी ͪववाद राÏय ͬĒड संǑहता के
अंतग[त गǑठत राÏय ͪवÙयतु सͧमǓत को भेजा जाएगा, जो 30 Ǒदनɉ के भीतर
ͧशकायत का समाधान करने का Ĥयास करेगी और यǑद राÏय ͪवÙयतु सͧमǓत
ͧशकायत का समाधान करने मɅ असमथ[ हो, तो उसे आयोग को भेजा जायेगा
और इस संबंध मɅ आयोग का Ǔनण[य अंǓतम और बाÚयकारȣ होगा।
18. åयावͪƣ

18.1 इन ͪवǓनयमɉ मɅ कोई भी बात, बीरइएसएस

ͧसèटम के संबंध मɅ, इन ͪवǓनयमɉ

कȧ Ǔतͬथ से पहले, ͪवÙयतु Đय समझौते, ऊजा[ भंडारण सेवा
समझौते या ǓनçपाǑदत ͩकसी अÛय वाͨणिÏयक समझौते कȧ वैधता या चयन के
ͧलये अनरोध
ु
(आरएफएस)/Ĥèताव के ͧलये अनरोध
ु
(आरएफपी) जारȣ करके शǾु
कȧ गयी ͩकसी भी Đय ĤͩĐया को Ĥभाͪवत नहÈ करेगी। ऐसे समझौते और

18.3 इन ͪवǓनयमɉ कȧ अͬधसचना

साथ एĒीगेटरɉ, एएस Ĥदाताओं या अÛय संèथाओं के ͪवÙयमान पंजीकरण या
पैनल मɅ वैध रहेगा बशतɏ ͩक ऐसी संèथाओं को एसएलडीसी Ùवारा अͬधसͬचत
ू
ĤͩĐया के अनसार
ु
पनु: पंजीकरण पराू करना होगा।
19. Ǔनदशȶ देने कȧ शिÈत:
आयोग समय-समय पर इन ͪवǓनयमɉ के काया[Ûवयन के ͧलये ऐसे Ǔनदशȶ और आदेश
जारȣ कर सकता है िजÛहɅ वह उͬचत समझे।
20. कǑठनाइयɉ को दरू करने कȧ शिÈत:
यǑद इन ͪवǓनयमɉ के Ĥावधानɉ को लागू करने मɅ कोई कǑठनाई उ×पÛन होती है, तो
आयोग आदेश Ùवारा ऐसे Ĥावधान कर सकता है जो कǑठनाई को दरू करने के ͧलये
आवæयक हो।
21. ͧशͬथलȣकरण कȧ शिÈत:
आयोग, ͧलͨखत Ǿप मɅ दज[ ͩकये जाने वाले कारणɉ के आधार पर, अपने सम¢
Ĥèततु आवेदन पर इन ͪवǓनयमɉ के ͩकसी भी Ĥावधान मɅ छट
ू दे सकता है।

No. RERC/Secy/Reg/164:- In exercise of the powers conferred on it under Section 61,
Section86 read with Section 181 of the Electricity Act, 2003 (No. 36 of 2003), and all other
powers enabling it in this behalf, the Rajasthan Electricity Regulatory Commission, after
previous publication hereby makes the following Regulations, namely:
1. Short Title, Commencement, and Applicability:
1.1. These Regulations shall be called the Rajasthan Electricity Regulatory Commission (Battery
Energy Storage Systems) Regulations, 2026.
1.2. These Regulations shall come into force from the date of publication in the Official Gazette.
1.3. These Regulations shall apply to all Licensees, State Transmission Utility (STU), State
Load Despatch Centre (SLDC),Generating Companies, Renewable Energy Developers,
Aggregators,
Battery
Energy
Storage
System
(BESS)
Service
Providers,
Consumers/Prosumers, and other entities involved in the Planning, Procurement,
Deployment, Operation, or Utilization of Battery Energy Storage Systems within the State
of Rajasthan.
1.4. Technology Neutrality:These Regulations are intended to be Battery Energy Storage System
technology-neutral and shall apply to all forms of battery energy storage systems that meet
the required technical and performance standards, ensuring the framework remains relevant
as technology evolves.
Provided that these Regulations, by order of the Commission, may beextended to other
energy storage technologies mutatis-mutandisuntil such time as the specific Regulations for
such technologies are notified by the Commission.
2. Definitions:
(1)In these Regulations, unless the context otherwise requires:
(a) "Act" means the Electricity Act, 2003 (36 of 2003);
(b) "Aggregator(s)" or "Distributed Energy Resources Aggregator or DERA" means an
entity registered with the Distribution Licensee to provide aggregation of one or more
services including demand response services, Distributed Generation, Energy Storage,
etc., within a licensee area;
(c)“Ancillary Services” or “AS”means the services defined under the Central Electricity
Regulatory Commission (Ancillary Services) Regulations, 2022 as amended from
time to time;
(d) "Battery Energy Storage System" or "BESS"means a stationary system connected
to the electricity system which is used to store electrical energy by means of

electrochemical materials and typically includes batteries, power conversion system
and Battery Management System (BMS);
(e) "Battery Energy Storage System Developer" or "BESSD" or "Developer"means
the entity owning and/or operating the BESS facility for the supply of power or
provision of storage services under these Regulations;
(f) "Commission" means the Rajasthan Electricity Regulatory Commission;
(g) "Distribution Licensee", "Transmission Licensee", "Generating Company", and
"SLDC" shall have the meanings assigned to them under the Act;
(h) "Nodal Agency" means the State Load Despatch Centre (SLDC), which shall be
responsible for the implementation of the Ancillary Services at the intra-state level;
(i)“Ownership of Energy Storage System” shall mean the ownership of Energy Storage
System including Battery Energy Storage Systems as per the guidelines issued by the
Ministry of Power (MoP) from time to time, permitting ownership by Distribution
Licensees, Transmission Licensees, Generating companies, independent power
producers, consumers, Aggregators and third party investors, subject to applicable
laws and Regulations;
(j)"Round-Trip Efficiency" means the ratio of the total electrical energy discharged
from the BESS to the total electrical energy supplied to charge the BESS, expressed
as a percentage;
(k) “Standalone Battery Energy Storage System (BESS)” means an energy storage
system that is not co-located with any generating station or consumer load and is not
dedicated to a specific generator or consumer, and which may participate in power
markets, ancillary services, or be contracted under long-term or short-term
arrangements;
(2) Save as aforesaid and unless repugnant to the context or the subject matter otherwise
requires, words and expressions used in these Regulations and not defined herein, but
defined in the Act, or the StateGrid Code/IEGC (as applicable) or any other
Regulations/orders of the Commission/CERC/CEA shall have the meaning assigned
therein, as amended from time to time.
3. Objectives
The primary objectives of these Regulations are:
(a) To enable deployment and utilization of BESS as part of generation, transmission, and
distribution assets;
(b)To facilitate the participation of BESS in ancillary services and energy markets;
(c) To promote cost-effective energy storage solutions that support grid stability,
frequency management, and renewable energy integration;
(d) To establish a framework for Aggregators and third-party BESS developers to
participate in the electricity market;
(e) To enable market development and adoption of Battery Energy Storage Systems across
all sectors.
4. Ownership and Business Models
4.1. BESS may be developed, owned,leased,or operated by Distribution Licensees,
Transmission Licensees, Generating Companies, Independent Power Producers (IPPs),
Independent Battery Energy Storage Service Provider,Consumers/Prosumers, Standalone
BESS developers, Renewable Energy Developers, Aggregators, or any third-party
investors, in accordance with the Guidelines/Notification/Rulesissued by the Central Govt
from time to time.
Explanation: "Consumers/Prosumers" include consumers participating under Net
Metering/Net Billing/Group Net Metering/Virtual Net Metering frameworks or under
Green Energy Open Access, as applicable.

Provided that the SLDC, as Nodal Agency, shall discharge system operation functions in
accordance with these Regulations.
Provided further that nothing in these Regulations shall be construed to determine or
modify the status/eligibility of any Captive Generating Plant, captive user(s), or Group
Captive arrangement. Any such determination shall be governed by the applicable captive
framework and the relevant regulations/rules/orders.
4.2. BESS may be deployed as co-located with RE & Conventional generators, grid-connected
standalone storage, embedded in distribution or transmission networks, behind the meter
(Consumer level), or integrated with Electric Vehicle (EV) infrastructure for Vehicle-to-
Grid (V2G) services.
4.3. The Battery Energy Storage System shall be utilised either as an independent Battery
Energy Storage System or as part of the generation, transmission, or distribution system,
or integrating the consumer's load independently or colocatedwith RE sources installed
behind the meter.
4.4. The Battery Energy Storage System shall have the same legal status as that of the owner:
Provided that if such a Battery Energy Storage System is not co-located with, but owned
and operated by, the generating station or licensee or consumer, the legal status shall still
be that of the owner, but for the purpose of scheduling and dispatch and other matters, it
shall be treated at par with a separate storage element.
Provided further that:
(1) Standalone BESS and any non-co-located BESS scheduled as a separate storage
element shall comply with scheduling, metering, telemetry, and dispatch
requirements under the applicable Grid Code and SLDC procedures.
(2) Deviations from the schedule for such BESS shall be settled as per provisions of the
applicable Regulations/Orders/ Procedure of CERCmutatis- mutandis in this regard,
as amended from time to time, till such time Regulations in this regard are issued by
the Commission.
(3) Metering shall be through SEM or other such arrangement as specified by SLDC to
distinctly capture charging drawal and discharging injection at the interconnection
point.
5. Planning and Procurement:
5.1. The holistic system requirements, including but not limited to, managing reverse power
flow from lower to higher voltage at various substations, addressing transmission or
distribution network congestionmitigating high renewable energy penetration challenges,
and resolving voltage or frequency stability issues, shall be the criterion for finalizing the
BESS
locations
in
the
Distribution
System
or
Transmission
System
by
Distribution/Transmission Licensees.
5.2. The Distribution Licensees and the State Transmission Utility (STU) in consultation with
SLDC shall plan the requirement of energy storage capacity within their respective areas
of operation, keeping in view, among other relevant factors, the technical considerations,
system reliability, load requirements,peak management, congestion relief, renewable
energy integration and ancillary services and such other factors as may be relevant. While
preparing the storage plan due consideration will be given to projected ARR savings from
the relevant factors,but not limited to, avoided power purchase cost, deferred T& D
Capex, reduction of losses and curtailment.
Provided that the storage planning shall be aligned with the State’s Renewable Energy
Policy, Energy Storage Targets, State Transmission Plan and any directives issued by the
State Government or the Commission from time to time.
Provided further that the STU shall prepare a consolidated intra-state storage plan
(including recommended locations/voltage levels), considering transmission and

distribution constraints, and shall share it with Distribution Licensees, Transmission
Licensee,
SLDC
and
all
other
relevant
entities
for
alignment
on
procurement/implementation.
Provided also that such planning and procurement shall, to the extent applicable, be
aligned with the prevailing Resource Adequacy Plan/guidelines notified by the Ministry of
Power/Central Electricity Authority. The proposed storage plan shall indicate the
adequacy gap addressed, the expected capacity contribution of BESS , and a cost-
optimization/options assessment, including alternatives such as network augmentation,
demand-side measures, or flexible generation.
Provided also that where a Distribution Licensee or Transmission Licensee or a generating
company subject to inclusion in above planproposes BESS as a regulated network/grid-
support asset (including associated enabling infrastructure) for, but not limited to,
reliability,congestion management, voltage support or deferral of network augmentation,
the Commission may approve such investment and cost recovery through ARR/Tariff
following the due regulatory process for which the Commission may suitably adoptCERC
Norms/methodology and also considering prevailing market conditions,as applicable, till
such norms/methodology specified by the Commission.
Provided also that in their respective storage plans, the licensees or generating company
shall specifically indicate whether they intend to install and operate their own Battery
Energy Storage System (BESS) or procure energy storage capacity or services from third-
party providers, along with its proposed location, specifying the proposed injection point,
justifying the location based on technical,economic and grid integration considerations.
5.3. The minimum individual project size shall have a power rating of 1MW and above, with a
suitable energy rating of at least two hours, connected at 11 kV or above.
Explanation: Consumers/ Prosumers" include consumers participating under Net
Metering/Net Billing/Group Net Metering/Virtual Net Metering frameworks or under
Green Energy Open Access, as applicable.
Provided that this minimum size does not apply to BESS at the Distribution Transformer
(DTR) level or for behind-the-meter applications by consumers/Prosumers.
Provided further that for BESS co-located with existing generating stations, the minimum
energy rating requirement may be reduced to less than two hours where the primary
application is ancillary services/frequency regulation, subject to approval of the storage
plan by STU, Discom and SLDC.
Provided also that the Commission may, from time to time, review and revise the
minimum project size through separate order to adapt to technological advancements and
market conditions.
6. Utilization for Ancillary Services:
6.1. BESS shall be eligible to provide services including, but not limited to frequency
regulation, spinning reserves, voltage support, black start services, and demand response
services or any other services defined in IEGC/State Grid Codeas amended from time to
time.
6.2. BESS may provide multiple services concurrently or sequentially, subject to technical
capability, telemetry/communication requirements, dispatch instructions, and contractual
obligations.
Provided that the SLDC shall specify the methodology for separate accounting of such
multiple services in the Procedure issued by it under regulation13 of these Regulations.
6.3. Revenues and performance obligations for different services shall be accounted separately,
and the framework shall prevent double accounting or double recovery of benefits or
liabilities.

6.4 Any entity owning, operating or providing multiple services through BESS including
Generating companies,Licensees, Standalone BESS Developers,Aggregators and IPPs
shall maintain adequate capacity to meet all contractual commitments and shall not
indulge in gaming.Where there is a conflict between contracted commitments and real-
time system security requirements, SLDC instructions for grid security shall prevail, and
settlement shall be as per the SLDC procedure issued in accordance with regulation 13 of
these Regulations.
6.5
BESS participating in ancillary services shall meet the following minimum requirements:
(a)
Response time as specified by SLDC for each category of ancillary services;
(b)
Communication and Telemetry infrastructure enabling realtime data transmission to
SLDC;
(c)
Capability to receive and respond to Automatic GenerationControl (AGC)
signals,where applicable;and
(d)
Metering arrangement as specified by the SLDC.
7. Role of Aggregators:
Aggregators may aggregate BESS resources from multiple sites to provide services to the
SLDC/TransmissionLicensee/Distribution Licensee/Generating Companies or other market
participants and shall follow the protocols issued by SLDC.
Provided that the SLDC in consultation with licensees, shall specify the minimum technical
and financial eligibility criteria, online registration formats, applicable fees, and any other
terms and conditions for an entity to register as an Aggregator.
8. Commercial Agreements:
Eligible entities may enter into commercial agreements with Licensees or other market
participants for the provision of BESS services:
Provided that all other aspects related to different agreements (such as award documents,
commissioning, financial closure, transmission connectivity, payment security mechanism,
event of default and consequences of change in law, codes and standards for safety and grid
connectivity) shall be in accordance with the guidelines issued by the Ministry of Power and
amendments thereto from time to time.
Provided further that Commission may specify its own norms and standards from time to
time, and the same shall be applicable.
9. Tariff and Market Participation:
9.1 All procurement of BESS capacity and/or services by the Licensees shall be undertaken
through tariff-based competitive bidding in accordance with the guidelines and
notifications issued by Central Govt/ MoP/MNRE from time to time.
Provided that the bid documents shall explicitly specify the commercial and operational
responsibility for charging energy, losses/round-trip efficiency, other battery parameters,
metering, scheduling,settlement,andany trading/intermediation arrangement.
Provided further that in case of any deviations from the bidding guidelines and
notifications issued as above the approval of the Commission shall be required for such
deviations.
Provided also that any expenses requiring pass through in the ARR and provided in the bid
documents shall be subject to the Tariff adoption/Approval of the Commission.
Provided alsothat the Commission may allow alternative procurement methods for pilot or
demonstration projects and small scale or distributed projects.

9.2. Battery Energy Storage Systems (BESS) owned or operated by consumers/ Prosumersshall
be permitted to participate in energy arbitrage by purchasing electricity from the grid
during off-peak hours and selling it back to the grid during peak hours.
Provided that the settlement mechanism for such transactions shall be as specified by the
Commission through a separate order either Suo-motu or based on application filed before
it.
Provided further that consumers/ Prosumers may install the Battery Energy Storage
System either as a standalone system or in conjunction with a solar power plant.
Provided also that consumers/ Prosumers shall be allowed to operate the BESS in such a
manner that the energy stored in the system, installed behind the consumer’s meter, may
be utilized for self-consumption or supplied to the Distribution Licensee during peak
hours for which Commission may specify incentivized tariff and other necessary
conditions through a separate order.
Provided also that while specifying the settlement mechanism and incentivised tariff under
this sub-regulation, the Commission shall have due regard to the following:
(a)
Prevailing Time-of-Day (ToD)/ Time- of –Use(ToU) tariff framework of the
Distribution Licensee or any such other reference Commission deem fit.
(b)
Principle that energy stored from renewable sources shall retain its renewable
character, consistent with regulation 9.4.
(c)
Principle of avoidance of double taxation on stored energy, in consonance with
National Framework for promoting Energy Storage Systems issued by the Ministry
of Power.
9.3. For procurement of ancillary services, the Commission may approve a single-part or
multipart tariff structure, including fixed capacity charges, variable energy charges, and
performance-linked payments. The Commission may also consider pay-for-performance
mechanisms and/or cap-and-floor tariff frameworks to incentivize reliable and efficient
provision of ancillary services.
9.4. Renewable energy procured and used for charging BESS shall retain its renewable
character upon discharge.Accordingly, obligated entities/ consumers shall be eligible to
claim RPO/RCO benefit for supply/consumption of such discharged energy.
10. Technical Standards:
BESS installations shall conform to technical standards specified by the Central Electricity
Authority (CEA), MNRE, and other relevant authorities. BESS providers shall submit real-
time data to SLDC as prescribed.
11. Safety, Cyber security, and Environmental Norms:
11.1. BESS systems shall comply with applicable regulations, standards and codes issued by the
Central Electricity Authority (CEA) regarding safety.
11.2. Cyber security and communication protocols shall adhere to the guidelines of the Ministry
of Electronics and Information Technology (MeitY), the Central Electricity Authority
(CEA), and the Ministry of Power (MoP).
11.3 Decommissioning, recycling and disposal of batteries used in BESS shall be carried out in
accordance with the Battery Waste Management Rules, 2022, as amended from time to
time, including provisions relating to Extended Producer Responsibility (EPR), collection
targets, recycling efficiency, and reporting obligations.
12. Role of Licensees:
12.1. STU in consultation with Distribution Licensees shall publish on their websites potential
sites at the 11 kV voltage level 33/11 kV substations and at Extra High Voltage (EHV)

substations for establishing BESS of the required capacities based on feeder-level and
system-level renewable integration and network requirements.
12.2. Distribution licensees shall register Distributed Energy Resource Aggregator (DERA) in
accordance with these Regulations.
12.3. Expenditure on BESS shall be recoverable through the Annual Revenue Requirement
(ARR) under specified heads for power purchase or capital expenditure, as applicable,
subject to Commission approval, for which the Distribution Licensee shall file suitable
proposals.
12.4. The Transmission Licensee shall include BESS in its planning and investment plan and
file proposals for Commission approval. Approved expenditure shall be recoverable
through the Transmission Business ARR.
12.5. All procurement of BESS capacity or services shall be undertaken only through a
transparent competitive bidding process conducted in accordance with the guidelines
issued by the Government of India, indicating the applicable case as specified in such
guidelines.
13. Role of Nodal Agency (SLDC):
13.1. SLDC shall verify governor settings of thermal generators and assess the requirement of
Primary, Secondary, and Tertiary Reserve Ancillary Services (PRAS, SRAS, TRAS) from
BESS. The report shall be published and updated annually.
13.2. The SLDC shall specify eligibility criteria for BESS resources to provide ancillary
services, based on technical criteria and operational performance, and publish on its
website within three months from the date of notification of this Regulation.
13.3. The SLDC, in consultation with STU and licensees, shall prepare and publish on its
website the eligibility criteria for the registration of AS providers within three months
from the date of notification of these Regulations.
13.4. The SLDC shall prepare a procedure for Scheduling, Metering, Accounting, Settlement,
and Commercial mechanisms for the operationalization of ancillary services through
BESSwithin six months from the date of publication of these Regulations.
13.5. The SLDC shall monitor the performance of BESS, including State of Charge (SoC),
Round-Trip Efficiency, and availability.
13.6. SLDC shall register Ancillary Services (AS) providers in accordance with these
Regulations.
Explanation: Registration as an Ancillary Services (AS) provider under this sub-regulation
is distinct from and in addition to registration as a distributed energy Resource Aggregator
(DERA) under regulation 12.2, where an entity is registered as a DERA and also intends
to participate in ancillary services, such entity shall additionally register as on AS provider
with SLDC under this sub-regulation.
13.7. The SLDC shall prepare a standard agreement format for procuring ancillary services and
obtain the Commission's approval before entering into agreements.
13.8. Timelines for registration/empanelment:
(a) SLDC shall dispose of complete applications for registration/empanelment as an
Aggregator of AS provider (where applicable) within thirty days.
(b) Where an application cannot be disposed of within the timeline, SLDC shall issue a
reasoned deficiency/extension notice and dispose of the application within an additional
thirty days.
(c) Connectivity processing timelines shall be as per the applicable SLDC procedure
notified under these Regulations.
(d) Any grievance regarding delay or denial of registration or empanelment under this
regulation if remains unresolved for fifteen days, may be escalatedby the aggrieved party

to the State Power Committee under the dispute Resolution mechanism specified in
regulation 17.2 of these Regulations.
14. Role of Generating Companies/IPPs/CPPs/BESS Developers
Generating companies, IPPs, CPPs, and BESS Developers may establish BESS at any point
in the system, after obtaining due approvals. Such entities may participate in the ancillary
services market and may register with the SLDC to provide such services through market
mechanisms.
15. Consumers/Prosumers:
15.1. All consumers/ prosumers shall be permitted to establish behind-the-meter Battery Energy
Storage Systems (BESS) up to their contract demand, with or without solar power plants.
Provided that such consumers/ prosumers shall be required to register their BESS
installations with the Distribution Licensees through their online portal, however, no other
permission or formal connection agreement with the Distribution Licensee shall be
required for installation of the BESS.
Provided further that such systems shall comply with the technical standards and safety
requirements specified by the Central Electricity Authority (CEA).
15.2. In case the Battery Energy Storage System (BESS) is installed in hybrid mode along with
a solar power plant that is either already installed or proposed to be installed under the Net
Metering, Net Billing, Group Net Metering, or Virtual Net Metering framework, the entire
hybrid system shall be governed by the respective provisions applicable to the framework
under which the solar plant is registered, i.e., Net Metering, Net Billing, Group Net
Metering, or Virtual Net Metering, as specified under the Rajasthan Electricity Regulatory
Commission (Grid Interactive Distributed Renewable Energy Generating Systems)
Regulations, 2021, as amended from time to time.
Provided that in such cases, the energy injected into the Distribution Licensee's network
during non-solar peak hours shall be payable to the consumer/prosumer at the incentivized
tariff, as may be specified by the Commission through a separate order issued either
suomotu or upon an application filed before it.
15.3. Consumers or prosumers having eligible behind-the-meter BESS shall be permitted to
participate in the demand response and similar programmes, either directly or through an
Aggregator, subject to compliance with applicable regulations. The Distribution Licensees
shall also develop programmes for Vehicle to Grid/Grid to Vehicle concept through smart
chargers.
Provided that participation in such services shall require the installation of a smart meter
and communication infrastructure capable of real-time data acquisition and transmission,
as may be specified by the Distribution Licensee.
Provided further that Behind-the-meter BESS exports by such consumers, where
permitted and settled under the applicable net billing/net metering/GNM/VNM/ToD/ ToU
framework administered by the Distribution Licensee shall not require SLDC scheduling,
however, if such BESS participates in the market or in ancillary services directly or
through an Aggregator shall comply with the directions of Distribution Licensee & SLDC
and also comply with SLDC’s Scheduling requirement as provided under the SLDC
procedure.
16. Open Access to BESS:
Open Access to BESS shall be granted in accordance with, and the applicable Open Access
charges shall be levied as per, the RERC Green Energy Open Access Regulations, as
amended from time to time.
17. Dispute Resolution:
17.1. Consumer-related disputes shall be dealt with as per the RERC (Consumer Grievance
Redressal Forum, Electricity Ombudsman and Consumer Advocacy) Regulations, 2021.

17.2. All other disputes arising under theseRegulations shall be referred to the State Power
Committee constituted under the State Grid Code which shall endeavor to resolve the
grievance within 30 days and where State Power Committee is unable to resolve the
grievance, it shall be referred to the Commission and Commission's decision in this regard
shall be final and binding.
18. Savings and Transition:
18.1 Nothing in these Regulations shall affect the validity of any Power Purchase Agreement,
Energy Storage Service Agreement or any other commercial agreement executed, or any
procurement process initiated through issuance of Request for Selection (RfS) / Request
for Proposal (RfP), prior to the date of notification of these Regulations as regards BESS
Systems. Such agreements and processes shall continue to be governed by their respective
terms and conditions and the applicable orders of the Commission.
18.2 Any BESS project that has achieved financial closure or has commenced construction prior
to the notification of these Regulations shall be deemed to comply with the requirements
of regulation 5.3 (minimum project size), notwithstanding any variation from the threshold
specified therein.
18.3 Existing registrations or empanelments of Aggregators, AS providers or other entities with
SLDC or Distribution Licensees, effected prior to the notification of these Regulations,
shall remain valid subject to such entities shall complete re-registration under the
procedure notified by the SLDC under these Regulations.
19. Power to give directions:
The Commission may, from time to time, issue such directions and orders as it considers
appropriate for the implementation of these Regulations.
20. Power to remove difficulties:
If any difficulty arises in giving effect to the provisions of these Regulations, the
Commission may, by an order, make such provisions as may be necessary for removing the
difficulty.
21. Power to relax:
The Commission may, for reasons to be recorded in writing, relax any of the provisions of
these Regulations on an application made before it.
22. Power to amend:
The Commission may, from time to time, add, vary, alter, suspend, modify, amend, or
repeal any provision of these Regulations.
