NOTIFICATION

G.S.R.56 .-Whereas, the draft of the Rajasthan Rights of Persons with Disabilities (Draft
Amendment) Rules, 2026, amending the Rajasthan Rights of Persons with Disabilities Rules,
2018, in exercise of the powers conferred by sub-section (1) and (2) of section 101 of the
Rights of Persons with Disabilities Act, 2016 (Central Act No. 49 of 2016) was published as
required by sub-section (1) of section 101of the said Act, in the Rajasthan Gazette
Extraordinary part 4 (ga) up-khand (I), dated 25.05.2026 inviting objections and suggestions
from all persons likely to be affected thereby before the expiry of seven days from the date on
which the copies of the said notification as published in Rajasthan Gazette were made available
to the public;
And whereas, copies of the said notification were made available to the public on
25.05.2026;
And whereas, objection and suggestion received on the said Draft Rules have been
rejected after consideration;
Now, therefore, in exercise of the powers conferred by sub-section (1) and (2) of section
101 of the Rights of Persons with Disabilities Act, 2016 (Central Act No. 49 of 2016), the State
Government hereby makes the following rules further to amend the Rajasthan Rights of
Persons with Disabilities Rules, 2018, namely:-
1. Short title and commencement.- (1) These rules may be called the Rajasthan Rights
of Persons with Disabilities (Amendment) Rules, 2026.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of rule 5.- The existing second proviso to sub-rule (1) of rule 5 of the
Rajasthan Rights of Persons with Disabilities Rules, 2018 shall be substituted by the following,
namely:-
"Provided further that the reservation in promotion, with effect from 30.06.2016, shall be
in accordance with such instructions as may be issued by the State Government, from time to
time. The promotional benefits under this provision shall be granted on a notional basis
from 30.06.2016 upto the date of commencement of the Rajasthan Rights of Persons
with Disabilities (Amendment) Rules, 2026. Any person who was promoted prior to the
commencement of the Rajasthan Rights of Persons with Disabilities (Amendment)
Rules, 2026, shall not be reverted on account of the promotion of a person with
disability from an earlier year. In case where number of persons promoted exceeds the
