(OTHER THAN GOVERNMENT AND EMPLOYEES STATE

INSURANCE HOSPITALS AND DISPENSARIES) UNDER

THE MINIMUM WAGES ACT, 1948.

In exercise of the powers conferred by clause (b) of

sub-section (1) of Section 3 and sub-section (2) of Section 5

of the Minimum Wages Act, 1948 (Central Act XI of 1948), and

in supersession of the Labour and Employment Department

Notiﬁ cation No. II(2)/LE/395/2009 published at pages 263-264

of Part II—Section 2 of the Tamil Nadu Government Gazette,

dated 5th August 2009, the Governor of Tamil Nadu, after

considering the advice of the Committee, appointed under

clause (a) of sub-section (1) of Section 5 read with Section 9

of the said Act, hereby revises the minimum rates of wages

payable to the employees in the employment in hospitals

and nursing homes (other than Government and Employees’

State Insurance Hospitals and Dispensaries) in the State of

Tamil Nadu as speciﬁ ed in the Schedule below.

(2) This Notiﬁ cation shall come into force with effect

on and from the date of its publication in the Tamil Nadu

Government Gazette.

Explanations.-

(1) The Classiﬁ cation of Zones shall be as follows:-

Zone – A :

shall include All Municipal Corporations and

All Special Grade Municipalities.

Zone – B :

shall include all Municipalities Other than

Special Grade Municipalities.

Zone – C :

shall include all places other than those in

Zones A and B.

(2) Dearness Allowance.- In addition to minimum rates

of basic wages ﬁ xed above, the employees shall be

paid Dearness allowance as indicated below:-

(i) The dearness allowance is linked to the Average

Chennai City Consumer Price Index Number for

the year 2010, that is 161 points (with base year

2001=100) and for every raise of one point over and

above 161 points, an increase of Rs.53.90 (Rupees

Fifty three and paise ninety only) per month shall be

paid as dearness allowance.

(ii) The dearness allowance shall be calculated on the

ﬁ rst April of every year on the basis of the average

of the indices for the preceding 12 (twelve) months,

that is from January to December.

(iii) The ﬁ rst calculation shall thus be effective from

the date of publication of this notiﬁ cation in the

Tamil Nadu Government Gazette, based on the

average of Chennai City Consumer Price Index

Number of the previous year.

(3) “Hospital” means a building wherein patients are

received and treated but does not include dispensary

which gives medical or surgical aid only and not

treating them as in-patients and such medical

dispensation is made for money.

(4) “Nursing Home” means an establishment where

persons suffering from illness, injury or inﬁ rmity

whether of body or mind are usually received and

accommodated for the purpose of nursing and

treatment.

(5) Where the nature of work is the same, no distinction

in the payment of wages shall be made between men

and women employees.

(6) To arrive at daily wages, the monthly wages shall be

divided by 26.

(7) Wherever the existing wages are higher than the

minimum wages ﬁ xed herein, the same shall be

continued to be paid.
