Milk Producers Union Limited, Karaikudi for the period

Employee's State Insurance Act.

No.II(2)/LE/404/2018.—In exercise of the powers
conferred by Section 87 read with Section 91A of the
Employees' State Insurance Act, 1948 (Central Act XXXIV
of 1948), the Governor of Tamil Nadu hereby exempts the
Sivagangai District Co-operative Milk Producers Union Limited,
Karaikudi from the operation of the said Act for the period
of one year from 01-04-2018 to 31-03-2019.
(1) The above exemption is subject to the following
conditions, namely:-
(a) The aforesaid Management wherein the
employees are employed shall maintain a Register showing
the names and designations of the exempted employees.
(b) Not withstanding the exemption, the employees
shall continue to receive such benefi ts under the said Act
to which they might have become entitled to on the basis
of the contributions paid prior to the date from which
exemption granted by this Notifi cation operates.
(c) The contribution for the exempted period, if
already paid shall not be refunded.

(2) The employer of the said Management shall submit
in respect of the period during which that Management
was subject to the operation of the said Act. (hereinafter
referred to as "the said period") returns, in such form and
containing such particulars as were due from it in respect
of the said period under the Employees State Insurance
(General) Regulations, 1950.
(3) Any Social Security Officer appointed by the
Corporation under sub-section (1) of Section 45 of the
said Act, or other offi cial authorised in this behalf shall,
for the purpose of,-
(i) verifying the particulars contained in any return
submitted under sub-section (1) of Section 44 of the said
Act for the said period; or
(ii) ascertaining whether registers and records were
maintained as required by the Employees State Insurance
(General) Regulations, 1950 for the said period; or

In the terms and conditions of service for the State
Chief Information Commissioner and State Information
Commissioners laid down in sub-section (5) of Section 16 of
the Right to Information Act, 2005, (Central Act 22 of 2005)
provisions are available only for salaries and allowances.
Accordingly, the pay in respect of persons holding the
posts of State Chief Information Commissioner and State
Information Commissioners are fi xed at the rate of Rs.90,000/-
and Rs.80,000/-p.m. respectively in the pre-revised scale.
The term "Allowances" found in the said section 16(5) of the
said Act, is silent regarding the grant of pension to State
Chief Information Commissioner and State Information
Commissioners for the services rendered by them in the
State Information Commission.
2. In the order fi rst read above, the Central Information
Commission recognizing the high position held by Information
Commissioners in preserving the paramountcy of the
democratic ideal, among others, has framed Terms and
Conditions of Service for sanction of Pension to the Chief
Information Commissioner and Information Commissioners in
the Central Information Commission. In the order second
read above the quantum of pension was revised with eff ect
from 01.01.2006 to both Chief Information Commissioner
and Information Commissioners at the rate of Rs.16,020/-
per annum in respect of each completed year of service.
3. The Government have examined the proposal to.
sanction pension to the retired State Chief Information
Commissioners and Information Commissioners in detail. There
is no specifi c provision for grant of pension in the Right
to Information Act 2005. The retired Government offi cials
who acted as Information Commissioners would be receiving
'service pension' and any pension contemplated under the
Right to Information Act for the services rendered in the
Commission would be by way of an 'additional pension'
to them whereas those who are not retired Government
Offi cials and acted as State Chief Information Commissioners
and Information Commissioners are not in receipt of any
pension.
4. The Government, after careful consideration has
decided to sanction pension only to persons who are not
retired Government offi cials and held the posts of State Chief
Information Commissioner' / State Information Commissioners
for a minimum period of three completed years, at the rate of
Rs.16,020/- per annum (pre-revised) in respect of each
completed year of service in the Tarnil Nadu State Information
Commission and direct accordingly.
5. The Terms and Conditions for sanction of pension
to the State Chief Information Commissioner and State
Information Commissioners are as follows.
