The following Act of the Tamil Nadu Legislative Assembly received the
assent of the Governor on the 15th March 2022 and is hereby published
for general information: —
ACT No. 15 OF 2022.
An Act to repeal certain Enactments
Wඐඍකඍඉඛ it is expedient that the enactments specifi ed in the Schedule which are
spent or have otherwise become obsolete, or have ceased to be in force otherwise
than by expressed specifi c repeal, should be expressly and specifi cally repealed;
Bඍ it enacted by the Legislative Assembly of the State of Tamil Nadu in the
Seventieth Year of the Republic of India as follows:—
Short title.
1. This Act may be called the Tamil Nadu Repealing Act, 2020.
Repeal of
certain
enactments.
2. The enactments specifi ed in the Schedule are hereby repealed.
Savings.
3. The repeal by this Act of any enactment shall not aff ect any other enactment
in which the repealed enactment has been applied, incorporated or referred to;
and this Act shall not aff ect the validity, invalidity, eff ect or consequences of
anything already done or suff ered, or any right, title, obligation or liability already
acquired, accrued or incurred, or any remedy or proceeding in respect thereof, or
any release or discharge of or from any debt, penalty, obligation, liability, claim or
demand, or any indemnity already granted, or the proof of any past act or thing;
nor shall this Act aff ect any principle or rule of law, or established jurisdiction,
form or course of pleading, practice or procedure, or existing usage, custom,
privilege, restriction, exemption, offi ce or appointment, notwithstanding that the
same respectively may have been in any manner affi rmed or recognised or derived
by, in or from any enactment hereby repealed;
nor shall the repeal by this Act of any enactment revive or restore any jurisdiction,
offi ce, custom, liability, right, title, privilege, restriction, exemption, usage, practice,
procedure or other matter or thing not now existing or in force.

The following Act of the Tamil Nadu Legislative Assembly received
the assent of the Governor on the 15th March 2022 and is hereby
published for general information: —
Act No. 16 OF 2022.
An Act further to amend the Tamil Nadu Government Servants
(Conditions of Service) Act, 2016.
Bඍ it enacted by the Legislative Assembly of the State of
Tamil Nadu in the Seventy-fi rst Year of the Republic of India as follows:—
1.
(1) This Act may be called the Tamil Nadu Government Servants
(Conditions of Service) Amendment Act, 2020.
Short title and
commencement.
(2) (a) Clause (1) of section 2 shall be deemed to have come into
force on the 15th day of September 2016.
(b) Clause (2) of section 2 shall be deemed to have come into
force on the 2nd day of March 2017.
(3) Section 3 shall be deemed to have come into force on the
30th day of May 2019.
(4) Section 4 shall be deemed to have come into force on the
19th day of April 2017.

14 of 2016.
2. In section 20 of the Tamil Nadu Government Servants (Conditions
of Service) Act, 2016 (hereinafter referred to as the principal Act), in
sub-section (2),—
Amendment of
section 20.
(1) under the heading “Subject for the Examination”, for the
expression “(1) English”, the expression “(1) General Tamil or General English”
shall be substituted;
(2) under the heading “Minimum percentage of marks”, for the entry
“35”, occurring in two places, the entry “45” shall be substituted.
3. Section 25 of the principal Act shall be renumbered as sub-section (1)
thereof, and—
Amendment of
section 25.
(i) in sub-section (1) as so renumbered, for clause (b), the following
clause shall be substituted, namely:—
“(b) possesses such other qualifi cations as have been declared
to be higher than or equivalent to the said special qualifi cations or special tests
by the Government in consultation with the Equivalence Committee.”;
(ii) after sub-section (1) as so re-numbered and amended, the
following sub-section shall be inserted, namely:—

5.
Notwithstanding anything contained in the principal Act,—-
Validation.
(1) any person who is already a member of a service and did not
possess the minimum general educational qualifi cation, appeared for the
examination of the S.S.L.C Standard prescribed in sub-section (2) of section 20
of the principal Act conducted by the Tamil Nadu Public Service Commission,—
(i) by choosing General Tamil as one of the subject along with
General Knowledge and obtained the minimum percentage of marks during
the period commencing on and from the 15th September 2016; or
(ii) obtained 45 percentage of marks in each subject, by choosing
either General Tamil or General English along with General Knowledge, during
the period commencing on and from the 2nd day of March 2017;

and
ending
with
the
date
of
publication
of
this Act
in
the
Tamil Nadu Government Gazette, shall be deemed to possess the minimum
general educational qualifi cation under the principal Act, as amended
by this Act;
(2) the Equivalence Committee specifi ed in section 25 of the
principal Act and continued as modifi ed during the period commencing on the
30th day of May 2019 and ending with the date of publication of this Act in the
Tamil Nadu Government Gazette shall be deemed to have been validly in
existence on and from the said date and continued in accordance with law,
and any power exercised or duty performed by the said Committee during the
said period shall be deemed to have been validly exercised or performed, as
if the principal Act as amended by this Act had been in force at all material
times; and
(3) the reservation of appointments provided for persons with
disabilities against the turns specifi ed in Schedule – VI of the principal Act
commencing on and from the 19th day of April 2017 and ending with the date of
publication of this Act in the Tamil Nadu Government Gazette shall be deemed
to have been validly provided as if the principal Act as amended by this Act had
been in force at all material times.
