Subordinate Judge's Court at Kodumudi with effect from the

date on which the Subordinate Judge, Kodumudi assumes

charge of that Court.

which is proposed to be issued in exercise of the powers

conferred by clause (b) of sub-section (1) of Section 3 and

sub-section (2) of Section 5 of the Minimum Wages Act, 1948

(Central Act XI of 1948), is hereby published for information

of all persons likely to be affected thereby, as required under

clause (b) of sub-section (1) of Section 5 of the said Act.

2. Notice is hereby given that the draft Notification will

be taken into consideration on or after the expiry of two

months from the date of publication of this Notification in

the Tamil Nadu Government Gazette and that any objection

or suggestion, which may be received from any person

with respect thereto, before the expiry of the aforesaid

Explanation.- (1) Dearness Allowance.— In addition

to the minimum rates of basic wages fixed above, the

employees shall be paid dearness allowance as indicated

below:-

(i) The dearness allowance is linked to the Average

Chennai City Consumer Price Index Number

for the year 2010, i.e. 161 points (with base

2001 = 100) and for every raise of one point over

and above 161 points an increase of Rs.52.40

(Rupees Fifty two and paise forty only) per month

shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every

year on the first April on the basis of the average of

the indices for the preceeding 12 (twelve) months,

that is from January to December.

(iii) The first calculation shall thus be effective from

the date of publication of this Notification in the

Tamil Nadu Government Gazette, based on the

Average Chennai City Consumer Price Index

Number of the previous year.

(2) Where

the

nature

work

the

same,

distinction

the

payment

wages

shall be made between men and women employees.

(3) To arrive at the daily wages, the monthly wages shall

be divided by 26.

(4) Wherever

the

existing

wages

are

higher

than

the

minimum

wages

fixed

herein,

the same higher wages shall be continued to be paid .

Explanations.- (1) Dearness Allowance.—In addition to

the above minimum rates of basic wages, the employees

shall be paid dearness allowance as indicated below:-

(i) The dearness allowance shall be linked to the

Average Consumer Price Index number for Chennai

City for the year 2010, (that is 161 points with base

2001=100) and for every raise of one point over

and above 161 points, an increase of Rs.1.40 (One

rupee and forty paise only) per day shall be paid

as dearness allowance.

(ii) The dearness allowance shall be calculated every

year on the first April on the basis of the average of

the indices of the preceding twelve months, namely

from January to December.

(iii) The first calculation shall be effective from the

date of publication of this Notification in the

Tamil Nadu Government Gazette based on the

Average Chennai City Consumer Price Index for the

previous year.

(2) Where the nature of work is the same, no distinction

in the payment of wages shall be made in case of

men and women employees.

(3) To arrive at the monthly rates of wages, the daily

wages shall be multiplied by 30.

(4) The minimum wages and dearness allowance fixed

above includes the element of holiday wages also.

(5) Wherever the existing wages are higher than the

minimum wages fixed herein, such existing wages shall

be continued to be paid.

other posts in certain departments the post of Assistant

Engineer has not been classified under the functional

classification of Differently Abled Persons 'SLD' (Specific

Learning Disabilities) for the reservation of 4% vacancies

earmarked for the differently abled persons will be applicable

to identify the posts in respect of 'A' and 'B' categories for

direct recruitment posts only.

4. In the letter fourth read above, the Director, Rural

Development and Panchayat Raj has requested that the

following category of disabilities identified under 4 %

of the vacancies for Direct Recruitment for the post of

Assistant Engineer in Rural Development and Panchayat

Raj Department to be reserved for the Differently Abled

Persons where the rule of reservation is applicable for

the SC/STs, SCs and other communities so as to obtain

appropriate orders as given below:—

5. In the Government letter fifth read above, during the

Expert Committee Meeting held on 25.05.2022 for identifying

suitable posts for Differently Abled Persons in Government

Departments and exemption of some posts, based on the

request of the Director of Rural Development and Panchayat

Raj the post of Assistant Engineer (Civil) has been identified

for Differently Abled Persons suitable with the categories

of LD (OA, OL) LC, AC, OF, SLD.

6. The Government after careful examination have

decided to accept the request of Rural Development and

Panchayat Raj Department, as a special case to follow the

functional

7. The Government also direct that 4% of the vacancies

in direct recruitment for the identified posts in 'A' and 'B'

Groups, where the rule of reservation is applicable for

the SCs / STs / BCs and other communities, shall be

reserved for the Differently Abled Persons. If only one post

is available for recruitment in these categories, the usual

procedure for recruitment will be followed. The Government

also directed that,

(i) The reservation of 4% vacancies earmarked for the

Differently Abled Persons will be applicable to identify

the posts in respect of 'A' and 'B' categories for direct

recruitment posts only.

(ii) The individuals selected for 'A' and 'B' categories

of posts should be asked to produce certificate of

physical fitness and the disability certificate as stated

in Section 3(oo) of Tamil Nadu Government Servants

(Conditions of Service) Amendment Act, 2017.

8. The effect of this Government Order will be from the

date of publication of/Gazette notification.
