Fishermen Welfare (FS-3(1)), 14th August 2023, ஆடி 29,

No. II(2)/AHDFFW/778/2023.—In exercise of the powers

conferred by Section 19 of the Tamil Nadu Fishermen and

Labourers engaged in Fishing and other Allied Activities

(Social Security and Welfare) Act, 2007 (Tamil Nadu Act 19 of

2007) the Governor of Tamil Nadu hereby makes the following

modification to the Schedule to the said Act.

Modification

In the said Schedule, for the figure ''15,000'' in column

(3), against the entry ''Natural Death'' in column (2), the figure

''25,000'' shall be substituted.

WHEREAS, complaints have been received from a

number of depositors that Messers Fabbcut Technology,

Salem District, a financial establishment, has defaulted the

return of deposits made by the depositors;

AND WHEREAS, the Government are satisfied that

the said financial establishment is not likely to return the

deposits to the depositors and hence, the Government have

to protect the interests of such depositors;

AND WHEREAS, the movable properties specified

in the Schedule to this order are alleged to have been

procured by the said financial establishment from and out

of the deposits collected from the depositors;

NOW, THEREFORE, in exercise of the powers conferred

by Section 3 of the Tamil Nadu Protection of Interests of

Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu

Act 44 of 1997), the Governor of Tamil Nadu hereby makes

an ad-interim order attaching the movable properties in the

name of the defaulted financial establishment, name!y,

Messers Fabbcut Technology, Seelenayakanpatty, Salem-10,

Salem District, as specified in the Schedule to this order

and transfers the control over the said movable properties

to the Competent Authority, namely, the Competent Authority

and District Revenue Officer, Salem District appointed under

the said Act.

2. The Competent Authority and District Revenue

Officer, Salem District is requested to pursue further action

in accordance with the procedure laid down in sub-sections

(3) and (4) of Section 4 of the said Act and also the

formalities prescribed in the Tamil Nadu Protection of Interests

of Depositors (in Financial Establishments) Rules, 1997.

3. The Special Public Prosecutor, Special Court

for the Tamil Nadu Protection of Interests of Depositors

(in Financial Establishments) Act, 1997, Coimbatore is

requested to render necessary assistance to the Competent

Authority and District Revenue Officer, Salem District in

filing the application before the Special Court constituted

under the said Act.

Salem District, a financial establishment, has defaulted the

return of deposits made by the depositors after Maturity;

AND WHEREAS, the Government are satisfied that

the said financial establishment is not likely to return the

deposits to the depositors and hence, the Government have

to protect the interests of such depositors;

AND WHEREAS, the movable properties specified

in the Schedule to this order are alleged to have been

procured by the said financial establishment from and out

of the deposits collected from the depositors;

NOW, THEREFORE, in exercise of the powers conferred

by Section 3 of the Tamil Nadu Protection of Interests of

Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu

District appointed under the said Act.

(2) The Competent Authority and District Revenue

Officer, Salem District is requested to pursue further action

AND WHEREAS, the Government are satisfied that

the said financial establishment is not likely to return the

deposits to the depositors and hence, the Government have

As per section 33(i) of the Rights of Persons with

Disabilities Act, 2016 (Central Act 49 of 2016) ''the appropriate

Government shall identify posts in the establishments

which can be held by respective category of persons with

benchmark disabilities in respect of the vacancies reserved

in accordance with the provisions of section 34" of the

said Act.

2. In the Government orders second and third read

above, orders were issued for identifying the posts in various

departments as suitable for differently abled persons under

4% reservation.

3. In the Note fourth read above, the Housing and

Urban Development Department has stated that the Tamil

Nadu Housing Board initiated the Direct Recruitment process

to fill up the post of Assistant Engineer in Tamil Nadu

Housing Board Engineering Officers Service and requested

to identify and accommodate the categories of disabilities

of LD (OA,OL), HH, LC, DF and AC suitable of Differently

Abled Persons for the above post through the Tamil Nadu

Public Service Commission.

4. In the letter 6th read above, as per the request

from the Managing Director, Tamil Nadu Water Supply

and Drainage Board, the Commissioner for Welfare of

the Differently Abled has requested to identify the posts

of Assistant Engineer (Civil) and Junior Engineer (Civil) in

Tamil Nadu Water Supply and Drainage Board with the

categories of disabilities of HH,LD (OA, OL), LC, DF and

AC are suitable for Differently Abled Persons.

5. The Expert committee has also recommended

these following categories of Differently Abled Persons

No. II(2)/RDPR/803/2023.—WHEREAS, a representation

dated 22.08.2022 has been filed by one Thiru. Alagesan

Nadar, Nalumavadi Village, Thoothukudi District praying

to initiate criminal action against Thiru M. Rajesh,

Ward Member, Nalumavadi Village Panchayat

Ward No.7 under the Penal Provisions contained in

section 177 of the Indian Penal Code, 1860 (Central

Act XLV of 1860) following the procedure contemplated

in section 195 of the Code of Criminal Procedure, 1973

(Central Act 2 of 1974), under rule 26(2A)(h) of the

Tamil Nadu Panchayat (Election) Rules, 1995 as amended

by G.O.(Ms) No.66, Rural Development and Panchayat Raj

(PR-I), dated 24^th June 2017, as the above said Rajesh

had suppressed the conviction and sentence details and

charge sheet filed against him in the nomination paper for

the contesting election to rural local bodies conducted on

30.12.2019 to Nalumavadi Village.

AND WHEREAS, the complainant has further stated that

the above said M. Rajesh in S.C.No.153 of 2005 was found

guilty for the offence punishable under section 302 of IPC

and consequently convicted and sentenced to undergo life

imprisonment by the Additional Sessions Judge, Fast Track

Court, No.1, Thoothukudi.

AND WHEREAS, the above said M. Rajesh filed a Criminal

Appeal in C.A.(MD).No.72 of 2008 before the Madurai Bench

of Madras High Court and was released on bail on 06.1.2008

as per the order of the Madurai Bench of the Madras High

Court in M.P.(MD) No.3 of 2008 in Criminal Appeal in C.A.(MD).

No.72 of 2008.

AND WHEREAS, the Madurai Bench of Madras High

Court modified the sentence of life imprisonment into 7 years

rigorous imprisonment vide its judgment dated 30.09.2013 in

C.A.(MD) No.72 of 2008. Consequently, the bail was cancelled

as per the said order passed Criminal Appeal in C.A.(MD).

No.72 of 2008 by the Madurai Bench of the Madras High Court.

AND WHEREAS, the complainant has filed W.P.(MD)

No.27904 of 2022 praying to dispose the above representation

and the Hon’ble Madurai Bench of Madras High Court in its

order dated 09.01.2023 has disposed of the case with the

following direction.

“xxxx.........

7. The fourth respondent will have to be dealt with in

two respects. For the act of suppression, he may have to

be prosecuted. That has to be done by the first respondent.

For disqualifying him from the membership of the

Panchayat, the decision has to be taken by the Government.

The Second respondent shall forthwith forward the question

to the Secretary to Government, Rural Development and

Panchayat Raj Department, Government of Tamil Nadu,

Chennai. The Government shall take a decision after

getting opinion from the Tamil Nadu Election Commission.

The entire exercise will be completed within a period of

sixteen week from the date of receipt of the copy of this

orders.
