Order : No. 12, Welfare of Differently Abled Persons (DAP-3.2), dated: 14th March 2026.
As per section 33(i) of the Rights of Persons with Disabilities Act, 2016 (Central Act 49 of 2016) the appropriate
Government shall identify posts in the establishments which can be held by respective category of persons with benchmark
disabilities in respect of the vacancies reserved in accordance with the provisions of section 34 of the said Act.
2. In the Government Order second read above, orders were issued for constitution of Expert Committee for
identification of suitable posts for Differently Abled Persons in respect of Group A, B, C and D categories and the aforesaid
Committee was reconstituted in the Government Order sixteenth read above for implementation of 4% reservation to the
Persons with Benchmark Disabilities in employment.
3. In the Government Orders third to fifteenth and seventeenth to eighteenth read above, several posts under
Group ‘A’, ‘B’ and ‘C’ categories have already been identified as suitable for Persons with Benchmark Disabilities for
direct recruitment. Further in the Government Order fourth read above, all the posts in Group ‘C’ and ‘D’ categories were
identified as suitable for Persons with Benchmark disabilities for providing 4% reservation in employment.
4. In the Government Order nineteenth read above, orders have been issued to provide 4% reservation in promotion
to Persons with Benchmark Disabilities and its instructions as per Section 34 (1) of the Rights of Persons with Disabilities
Act, 2016.
5. In the Government Orders twenty and twenty first read above, 123 posts under Group ‘A’, ‘B’ and ‘C’ categories
have been identified as suitable for Persons with Benchmark Disabilities in direct recruitment. Further it was ordered that
these identified posts were also suitable for promotion from the feeder category.
6. In the letter twenty second read above, the Commissioner for Welfare of the Differently Abled has stated that
during the Expert Committee meeting held on 10.12.2025 and 11.12.2025, the Committee inter–alia recommended that
all the posts identified in the earlier Government Orders, as suitable for persons with benchmark disabilities for direct
recruitment, are deemed to be fit for promotion and also offered certain suggestions. Accordingly, the Commissioner for
Welfare of the Differently Abled has requested the Government to issue necessary orders on the decisions of the Expert
Committee.
7. The Government, after careful examination of the recommendations of the Expert Committee, have decided that
the categories of disabilities already identified/ re-identified as suitable for certain posts under Group ‘A’, ‘B’ and ‘C’ for
direct recruitment in the Government Orders third, fifteenth and seventeenth to eighteenth read above are now deemed
to be identified as fit for promotion for Persons with Benchmark Disabilities. Further, it is ordered that all the posts under
Group ‘C’ and ‘D’, categories, identified as suitable for direct recruitment, in the Government Order fourth read above are
also identified as suitable for Persons with Benchmark Disabilities in promotion.
8. The posts already identified/ re-identified under Group ‘A’, ‘B’ and ‘C’ for direct recruitment, and now identified
as deemed to be fit for promotion to the Persons with Benchmark Disabilities are given in the Annexure – A to this order.

9. The Government has also decided to accept the decisions of the Expert Committee and accordingly directed as
follows: -
A) The Persons with Benchmark Disability who have been appointed in the posts already identified in the earlier
Government Orders, such persons shall be governed by deemed identification and shall not be denied
consideration for promotion solely on the grounds of disability or on the basis of subsequent re-identification
exercises.
B)
It is clarified that the sub category of “Locomotor disability” namely One Arm (OA), One Leg (OL), Both Legs
(BL), One Arm One Leg (OAOL), Both Legs One Arm (BLOA), Both Legs Both Arms (BLBA) merely indicate
limb involvement but do not necessarily represent complete loss of function, as they may include partial
impairments, congenital conditions (e.g., club foot), or functional limitations. These shorthand labels do not
indicate total loss of an arm or complete paralysis of legs. Suitability for roles must be determined by assessing
actual functional ability and job requirements rather than relying solely on the sub-category label.
C)
It is also clarified that the Visual Impairment and Hearing Impairment are not absolute blindness includes varying
degrees of sight, low vision is a distinct category, and Deaf / Hard of Hearing individuals are not inherently
incapable of communication. Consequently, the appointing authorities must avoid presumptive exclusions based
solely on medical labels. Instead, suitability for a position should be assessed on an individual basis, focusing
on functional requirements, actual capability, and the provision of reasonable accommodation as stipulated in
section 20 of the Rights of Persons with Disabilities Act, 2016.
D) As of the specified disability categories categorised in the Rights of Persons with Disabilities (RPwD) Act, 2016,
earlier Government Orders are being modified to remove ambiguity regarding disability nomenclature. The term
“Visually Impaired” (VI) is read as “Blindness” and “Hearing Impairment” (HI) is read as “Deaf” in accordance
with the Act’s definitions.
E)
It is also clarified that if the same posts have been identified / re - identified as suitable for Persons with
Benchmark disabilities in multiple earlier Government Orders, the categories of disabilities specified in the latest
Government order shall be prevailed.
