Rc.No.E2/83/2015.-The Integrated Seniority List of the Jr.Asst/Typists / Steno-Typists of Hyderabad

(Rural) Nodal Division (Comprising of Hyderabad (Rural), Saroornagar, Nizamabad and Nalgonda Divisions )

for the period from 01-04-1996 to 31-03-2004 has been finalized vide Deputy Commissioner (CT), Hyderabad

(Rural) Division Ref.No. E2/1 56/2010 (Junior Assistants) INTG, Dt. 17-01-2011 and was published in AP

Gazette No. 17, Dt. 28-04-2011.

Now, the Integrated Seniority of the above category for further period from 01-04-2004 to 31-03-2014 is

prepared and communicated in ANNEXURE appended hereto.

Basing on the finalized seniority Lists of Jr.Assts / Typists / Steno-Typists of (5) District Viz., Rangareddy,

Nalgonda, Mahboobnagar, Nizamabad and Medak finalised through references cited supra the Integrated Seniority

Lists of Jr. Assts / Typists / Steno-Typists of (4) Divisions viz.., Hyderabad (Rural), Saroornagar, Nalgonda and

Nizamabad is prepared for the period from 01-04-2004 to 31-03-2014 keeping in view the following parameters.

PARAMETERS:

The preparation of Integrated Seniority List is as per State & Subordinate Service Rules laid down in

Rule-34 of said Rules.

The Seniority List is prepared in accordance with the rank assigned by the APPSC/DSC or any other

appointing authority is respect of all the Jr.Assts / Typists / Steno-Typists under Rule 33 (b) of APS & SS

Rules 1996.

Where the date of joining of individuals in different Districts is one and the same the date of Birth is taken

into consideration for placement.

Where the individuals transferred from other departments at their request to C.T. Department their date

of joining in C.T. Department is taken into consideration for fixing their seniority.

Where the date of regularization is same to more than one individual the date of birth is taken into

consideration fixing the placement of the individuals.

Accordingly, a provisional Integrated Seniority List was communicated vide ref. 6th cited to the concerned

individuals calling for written objections, if any, against their placements as proposed in the seniority list.

The following individuals submitted their objections with reference to the Integrated Seniority List of Jr.Asst/

Typist/Steno-Typists etc. The contentions raised by the individuals have been examined in detail and given thereon

with reference to the admissability or otherwise as detailed below.

Sri Kranthi Kumar Yadav

The Individual contended that in the finalized seniority list of Jr. Asst/Typist/Steno-Typists of Ranga

Reddy district his name was placed at Sl.No. 3 below the name A. Santhosha and above the name of Sri. B. Rajaiah

and even names of C. Bheemaiah, and Y, Narayana were placed below his name. As seen from the Integrated Show

Cause Notice, his name has been pushed down and placed below the names of said persons who are junior to him in

accordance with the finalized Ranga Reddy District seniority list, without any reasons and requested to rectify the

same.

ii)

Smt. Manohara Bha

The Individual contended that in the Integrated Show Cause Notice her name is placed at Sl.No. 94

below Smt. B. Ratna (Sl.No. 86), Jr. Asst., and requested to rectify the place basing on the finalized seniority list of

Ranga Reddy district. Junior Assistant while finalizing the combined seniority list.

iii)

Sri Syed Taj Mohiuddin

The Individual contended that his name is shown at Sl.No. 139 in Integrated Show cause notice but his

five years of service as laid down in Rules is completed by 26-08-2008. Hence the placement in the seniority would

come at Sl.No. 73.

The contentions of the individuals are verified with reference to the records and Rule position and

rectified accordingly. Though a rank promote is given promotion on adhoc basis, his regularization in seniority will be

reckoned from the date of availability of vacancy only. Accordingly the seniority of rank promotes is assingned from

the date of availability of vacancy.

In the case above individuals the seniority is reckoned from the date of arising of vacancy as under:-

II) Sri K. Vijaya Kumar, Jr. Asst. L, O/O the Commercial Tax Officer, Bhongir, has contended that he

belongs to BC-B. Community, Whereas in the list it was mentioned as SC and requested to rectify the same.

The representation is verified and mistake apparent on record is rectified accordingly his community is

mentioned as BC-B.

I) Sri G.Srinivas Rao Jr. Asst., O/o the CTO, Miryalaguda.

ii) Sri Hameed Ahmed, Jr. Asst.., O/o the CTO, Bodhan.

iii) Sri L. Bajrang, Jr. Asst., O/o the CTO, Nizamabad.

The individuals mentioned above have filed similar Objections with regard to placement of their names in

the Integrated Seniority list now being finalized. They contended that they were placed lower & below to that of the

individuals who joined duty after them in the Junior Assistant cadre.

The contention of individuals are verified and found that their legitimate placement in the list was

already fixed by their respective appointing authorities i.e., Deputy Commissioner (CT) concerned, accordingly their

seniority lists were finalized by the concerned appointing authorities.

The instant list on hand is only an Integrated Seniority List consisting of all constituent Divisions of

Hyderabad Rural Division.The list is now integrated as per the provisions of Rule 34 of General rules, which is

extracted as under:-

“Rule-34 Preparation of Integrated or Common Seniority list of persons belonging to different units of

appointment :- Where as integrated or common seniority list of a particular class, or category or grade in any sevice

belonging to different units of appointments has to be prepared for the purpose of promotion or appointment by

transfer to a class or category having different units of appointment or for any other purpose, such an integrated or

common seniority list shall be prepared with reference to the provision of sub_ Rule 33, provided that the seniority list

of the persons inter-se belonging to the same units shall not be disturbed.”

In view of the above their objections is examined and informed that the matter relates to the district

seniority list of Nizamabad and Nalgonda. Hence the objection is rejected.

IV) Smt K.Uma, Jr. Asst., O/o the CTO, Sangareddy.

The individual contended that her name is not figured in the Integrated provisional list and requested to

include her name in the list.

The objection is verified with reference to records and found that her name is not figured in the

respective divisions seniority list (i.e., DC(CT), Nizamabad Divin.,). Since the objection lies before the appointing

authority and not at the stage of integration by the Nodal Deputy Commissioner (CT), the objection is over ruled.

V) Sri D.Chandru, Jr.Asst., O/o the commercial Tax Officer-II, Nizamabad.

The individual contended that he belongs to S.T. Community, but in the list his community was mentioned

as BC, and requested to rectify the same.

The representation is verified and mistake apparent on record is rectified accordingly his community is

mentioned as S,T.

VI) Further, the Deputy Commissioner (CT), Nizamabad Division vide reference 7^thcited has forwarded

certain representations of Junior Assistantswho are appointed through APPSC direct recruitment for taking necessary

action.

In their representation these Junior Assistants requested the Nodal Deputy Commissioner, Hyderabad

Rural Division, to implement the principal of Rota-Quota in the promotion of Senior Assistants.

The Contention of the above individuals is verified and considered as under:-

The issue on hand is the Integration of seniority lists of the units of appointment Viz., Nizamabad , Nalgonda

and Hyderabad (Rural) and Saroornagar Division.

ii) ii) The individual seniority list were already finalized by the respective appointing authorities vide references

3^rd, 4^thand 5th cited above duly following the procedure prescribed involving the calling and considering

objections at the respective units of appointment.

iii) iii) The implementation Rota-quota is to be completed at the stage of preparation of seniority lists of

respective units of appointing authorities only.

iv) iv) The matter relates to District Seniority List of Nizamabad Division and is not the subject matter in

Integrated Seniority List.

In view of the above, the objections filed by the individuals are overruled as the same cannot be considered at

this stage.

VII) The Deputy Commissioner (CT), Nizamabad reference 8^thcited of Sri R.Vasanth Rao, Jr. Asst., O/O

the Commercial Tax Officer-I, Nizamabad has issued proceedings fixing the seniority in the Cadre of Junior

Assistant as per the directions of Hon’ble Andhra Pradesh Administrative Tribunal, Hyderabad in O.A. No. 7053 of

2014, dated. 01-10-2015.

Accordingly Sri R. Vasanth Rao, Jr.Asst., O/o the CTO-I, Nizamabad rank has been assigned at SI. No.

8 below Late Sri Mohd Afzal Khan, Jr.Asst., and above Sri C.Rajesh, JrAsst., O/o the CTO-1, Nizamabad.

The above Integrated seniority list of Jr.Assts., of Hyderabad (Rural) Nodal Division shown in Annexure

shall be subject to ‘outcome of SLP’s/WP’s/OA’s/C.As pending, if any, before the respective Appellate forums.

Accordingly, the Integrated Seniority List of Jr,Assts., Typist/Steno- Typist pertaining to Hyderabad (Rural)

Nodal Division is hereby finalized as at Annexure.
