termination, the Government Servant shall be

entitled to claim a sum equivalent to the amount of

authorized by the Cabinet to take decisions for the

smooth execution and progress of the Convention

Centre Project. All such decisions shall be vetted

by the Ld. Advocate General/Law Department and

Finance Department concurrence in respect of the

same shall be obtained.

The constitution of the above Committee and

subsequent amendments have been approved by

the Council of the Minister in its XVth and XVIth

meeting held on 13-09-2017 to 27-09-2017.

Whereas Shri Devaram Puraram Choudhary,

Businessman, Curti, Ponda, Goa (hereinafter

referred to as the “applicant”) vide an application

dated 04-12-2015, has requested to refund an excess

amount of Rs. 26,500/- (Rupees twenty six thousand

five hundred only), paid by him towards the

registration fee while registering an Agreement

for Sale on 25-03-2015 under Serial No. 680/2015

(hereinafter referred to as the “said Agreement for

Sale”), before the Civil Registrar-cum-Sub-Registrar,

Ponda-Goa, for purchasing a plot of land alongwith

factory shed/godown at Curti-Ponda for the total

consideration of Rs. 53,00,000/- (Rupees fifty three

lakhs only), since the registration fees were

collected in excess at the time of registration of

said Agreement for Sale;

And whereas the said application of the

applicant has been examined and it is seen that at

the time of registration of said Agreement for Sale,

the registration fees were wrongly calculated and

collected at the rate of 3.5% of the value of the

consideration of the property instead of collecting

at the rate of 3% of the value of the consideration

of the property, as per the Notification No. 8-10-

-2014-LD(Estt.)/741 dated 28-03-2014. Thus, it is

noticed that an excess amount of Rs. 26,500/-

(Rupees twenty six thousand five hundred only)

has been collected from the said applicant as

registration fees by the office of Civil Registrar-

-cum-Sub-Registrar, Ponda;

And whereas the Government of Goa has

decided to refund the excess amount of Rs. 26,500/-

(Rupees twenty six thousand five hundred only),

received from the applicant towards the

registration fees while registering the said

Agreement for Sale;

Now, therefore, in exercise of the powers

conferred by Section 78A of the Registration Act,

1908 (Central Act 16 of 1908), and all other powers

enabling it in this behalf, the Government of Goa

hereby refunds the said amount of Rs. 26,500/-

(Rupees twenty six thousand five hundred only) to

the applicant.

The above expenditure shall be debited to the

Budget Head “0030—Stamps and Registration;

03—Registration Fees; 900—Deduct Refund,

90—Deduct Refund”.
