Whereas, digging of the roads or a part thereof
may pose serious danger to the pedestrians and
motor vehicles during monsoons;
And whereas, speedy remedy is desirable to
prevent such digging of the road;
And whereas, the ongoing works of digging are
required to be stopped and roads restored to normal
condition.
Now therefore, I, Dr. Tariq Thomas, IAS, District
Magistrate, South Goa District, Margao, in exercise
of the powers vested in me under Section 144 of the
Code of Criminal Procedure, 1973, do hereby
prohibit any person/agency/organization from
digging any road or a part thereof without the
written permission of the undersigned, in the
territorial jurisdiction of South Goa District. Further,
the concerned persons/agencies involved in
currently dug up roads or parts thereof, are also
ordered to restore them to normal condition with
immediate effect.
And whereas, the circumstances do not permit
serving of the notice in due time to the person/
/persons involved in digging of road or a part
thereof, the order is passed ex-parte. It shall be

all Sub-Divisional Magistrates, Mamlatdars and
Police Stations.
All the Police Officers of the rank of Police
Inspectors and above of South Goa District shall
ensure effective implementation of this Order and
if any person/agency/organization is found violating
this order, appropriate action under Section 188
IPC may be initiated against the same.
This order shall come into force from 14th
September, 2018 and shall remain in operation upto
30th September, 2018.

The Government of Goa vide its order dated
04-09-2018 have constituted a committee for
empanelment of the eminent Senior Advocates
under the Scheduled Castes & Scheduled Tribes
(Prevention of Atrocities) Act, 1989 under the
Chairmanship of the Secretary (Social Welfare) as
required under sub-rule 5 of Rule 4 of the SCs/STs
(PoA) Act and Rules made thereunder and also
regarding fixing of remuneration/fees of the eminent
Senior Advocates as provided under sub-rule (6) of
Rule 4.
The above committee during its first meeting
held on 05-09-2018 has decided and accordingly
issued directions to the District Magistrate, South

Goa to prepare a panel of such eminent Senior
Advocates who have been in practice for not less
than seven years, as deemed necessary for
conducting cases in the Special Courts.
The following criteria is drawn based on the
recommendation of the aforesaid Committee for the
empanelment along with fees provided for category
“A” and “B” as shall be applicable;
(i) The eminent senior advocate to be appointed
for the above purpose shall be an expert in
the legal field with experience in dealing with
the criminal matters preferably with a
successful track record in the criminal matters
related to the atrocities against SCs/STs.
(ii) He shall also be well conversant with the
social and cultural background of the SCs/STs
communities in the State of Goa and shall
have a good standing and repute in the society.
(iii) The panel enlisted in category-A with
comprise of advocates having practiced for
10 years & above. They will be paid fees of
Rs. 5,000/- per hearing provided maximum
amount per case shall not be more than
Rs. 1,00,000/-.
(iv) The panel enlisted in category-B will comprise
of advocates with experience of 7 to 10 years,
preferably with an experience in criminal
matters, with fees of Rs. 3,000/- per hearing
provided maximum amount per case shall not
be more than Rs. 75,000/-.
In compliance to the above directions, a public
notice is hereby issued by this office inviting
applications from eminent Senior Advocates for the
empanelment in the South Goa District Panel for
conducting cases in Special Courts. The
applications shall reach this office within 2 (two)
weeks from the date of publication of this notice.
The applications shall be accompanied with all
documents in support of eligibility with the above
mentioned criteria.
