And whereas, as per the Guidelines of the

Reserve Bank of India, the said Co-operative Bank

is compulsorily required to maintain a minimum

Pillar 1 Capital to Risk-weighted Assets Ratio

(CRAR) of 9% on an on-going basis (other than

capital conservation buffer and countercyclical

capital buffer);

And whereas, due to past heavy losses the CRAR

of the said Co-operative Bank was negative till

31-03-2017 and it was unable to comply with the

said Accounting Standard (AS) 15, hence, the

National Bank for Agriculture and Rural

Development (NABARD) and the Reserve Bank of

India (RBI) has imposed certain restrictions on

letter No. GSCB/CH/2018-19/7898 dated 23-11-2018

has requested the Government to grant relaxation

to it from complying with Accounting Standard

(AS) 15 only to the extent of requirement of making

provision towards the past service gratuity it is

employees upto 31-03-2017 on the ground that

making such huge provision towards employees

retirement benefits in a single accounting year

would adversely affect its financial position and it

would invite further restrictions from the RBI;

And whereas, the said Co-operative Bank has

stated in the said letter that full provision towards

liability of payment of gratuity out of the

accumulated profits shall be made after wiping

out the past losses and in future it shall make

provision for all gratuity payment every year;

conferred by Section 126A of the Goa Co-operative

Societies Act, 2001 (Goa Act 36 of 2001), the

Standard (AS) 15 issued by the Institute of

Chartered Accountants of India in relation to

making provision for past service gratuity of its

employees upto 31-3-2017, subject to the following

conditions, namely:-

under Clause(s) of Section 2 of the Industrial

Disputes Act, 1947 (14 of 1947)?

(2) If the answer to issue No. (1) above is in the

affirmative, then, whether the action
