Order

No. 15-348-ADT/RCS/2020/2143

Read: Section 68 of the Goa Co-operative Societies Act, 2001.

Whereas, in terms of provision of Section 74 of the Goa Co-operative Societies Act, 2001, every

co-operative society shall conduct the audit of its accounts within six months of the close of the

co-operative year i.e. by 30th September of every year, by choosing the Auditor of their choice from the

Panel of Auditors constituted by this Department through General Body of the society. Such accounts

so audited is also mandates to be placed before the general body for its approval as provided under

Section 72 of the Act.

And whereas, this office had appointed auditors under Section 74(4) of the Act to conduct audit of

the pending societies to wrap pendency of audit. However, it is observed that even after giving necessary

opportunity to such co-operative societies to clear pending audit, the management of the societies whose

names are given in annexure attached to this order have failed to conduct the statutory audit as per

requirements inspite of extended period of 6 months upto 31-03-2020.

And whereas, since the audit is the only transparent medium available for the members to get

information about the functioning and financial position of the society, the failure on the part of the

management of the society to conduct the audit deprives the depositors/members to get a true financial

picture of the society thereby depriving the legitimate right of the shareholders who are the investors

of the society.

And whereas, it is reported by the Zonal Asstt. Registrar of Co-operative Societies that the

co-operative societies whose names are enlisted in the annexure attached herewith have failed to

conduct its statutory audit for the financial year upto 2018-19 alongwith arrears, thereby failing to

disclose the true financial status of the society to the shareholders.

And whereas, it is also reported by the Zonal Asstt. Registrar of Co-operative Societies that action

under Section 61 of the Act for confirmation of deemed disqualification of the directors on the board has

been initiated against the managing committee/BOD of the concerned societies for not conducting

timely audit and as hearings are underway, finalisation of disqualification proceedings and appointment

of Administrators will consume more time.

The above facts give wide scope to believe that in the absence of statutory audit there is no financial

and functional transparency in the functioning of the society and therefore there is every possibility that

there can be financial misappropriation/fraud in the various accounts of the society, this appears to be

detrimental to the interest of the shareholders and depositors. Therefore, in order to protect the interest

of the members/depositors, it is necessary to impose certain restrictions on such defaulting societies to

ensure proper management of the business of the societies, in exercise of the powers under Section 68

of the Goa Co-operative Societies Act, 2001, the Government is pleased to issue following directions to

the Co-operative Credit Societies listed in the annexure attached to this order.

1.

The society is barred from collecting all types of deposits.

2.

The society is barred from making any type of advances.

The Zonal Asstt. Registrars of Co-op. Societies shall take review of the progress of overall functioning

of each of the society falling within their jurisdiction and thereafter submit a detailed report to the Head

Office recommending withdrawal or modification or continuation of the restrictions as the case may be.

The relaxations in directions/restrictions if any shall be given by the Registrar from time to time based

on compliance report by the concerned credit societies.

The above directives shall remain in force till further orders and the same shall be strictly adhered

to. Any non-compliance of the above said directives shall be viewed seriously and necessary action for

violation will be taken.

By order and in the name of the Governor of Goa.

Vikas S. N. Gaunekar, Registrar & ex officio Joint Secretary (Co-op. Societies).

__

Order

No. 9/36/2020-HD(G)/2060

Whereas, it has been reported by the Inspector

General of Prisons that the local daily “O Herald”

has published a news article on 09-08-2020 on the

subject, wherein, it is inter-alia published that

“two videos of 30 seconds and 20 seconds show a

history-sheeter, in lead, taking a stroll in the

building in a rather filmy style and threatening a

Nigerian accused, indicates the use of mobile

phones inside the Jail-which otherwise is banned

under the law”;

And whereas, the Inspector General of Prisons

has requested for the intervention of the

Government on war footing to arrange to conduct

inquiry through the Police Department in order to

find out, as to how the filming device was carried

inside the Prison premises by all the accused

in-spite of having 3-tier security system, who have

facilitated this crime, who all are responsible for

the breach of security and all persons including

under trials involved in the matter;

And whereas, considering the seriousness of this

issue, the Government is of the view that an

independent enquiry through Senior Level Police

Officer, who is not associated with the security

arrangements of the Jail is necessary. The said

incident has brought to light a blatant breach of

security cordon and lapses on the part of both the

Jail Officials and the Indian Reserve Battalion Force

who have been posted for frisking and security

purpose;

And whereas, the Government is of the view

that clear facts on the incident are to be brought

out and the responsibility to be fixed on the
