(b) If not, what relief the above workmen are

entitled to?

(2) (a) Whether the action of the management of

M/s. Cosmed Analytical and Central

Services, Curti, Ponda, Goa to refuse to

concede to the demands raised by Menezes

Industrial Complex Employees Association

to absorb these workmen by partner

Companies, as per staff settlement, is legal

and justified?

(b) If not, what relief the workperson are

entitled to?”

2. Upon receipt of the reference, it was registered

as IT/20/2003 and registered A/D notices were

issued to both the parties. Pursuant to service of

notices, Party I filed a claim statement at

Exhibit 4. It is a matter of record that Party II (2) to

Party II (6) were impleaded thereafter. The

Party II (2) filed the written statement at Exh. 9,

Party II (3) filed the written statement at Exh. 29,

Party II (4) filed the written statement at Exh. 33,

Party II (5) filed the written statement at Exh. 31

and the Party II (6) filed the written statement at

Exh. 32.

3. In short, the case of Party I is that the

Party II (1) is a partnership firm formed by CMM

Group of Companies to cater to the common

services such as personal, engineering, security,

quality control etc. The CACS was formed by

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

15TH JULY, 2021

333

companies namely; CFL Pharmaceuticals Pvt. Ltd.

(ii) Wallace Pharmaceuticals Pvt. Ltd. and (iii)

Beiersdorf India Pvt. Ltd. The personnel and

administration was common and the personnel

were on the roll of CACS and they used to sign the

wage settlement on all behalf. The service

conditions and benefits such as pay scale and

allowances were common and governed by common

settlement. All the staff and workers of the group

companies were unionized and several settlements

were signed by the Union. The Party II in the month

of February, 2000 issued a closure notice but due

to intervention of Labour Commissioner it was

withdrawn and thereafter Party II started harassing

the workers in several ways. The Party II although

displayed a notice w.e.f. 01-11-2001 for closure

notice, it was not a closure at all and normal

working of common services were continued. The

activities of the Company were taken over by

M/s. Wallace Pharmaceuticals Pvt. Ltd., thus it was

clear that to avoid implementation of settlement,

fake closure was declared and the services of the

workmen were terminated and new workers were

employed by the Management. The activities of

Party I continued and the Companies agreed in the

settlement dated 13-04-1999 that employees would

be re-deployed and the Management will not resort

to retrenchment however, the said terms were not

implemented by the Management. The partners of

Party II (1) are all liable, jointly and severely and

therefore the demand of the workmen is legal and

justified. The termination of the workmen namely;

Ashok Vernekar, Fatima Rodrigues and Inacian

Alfonso is illegal and they were unemployed with

no source of income. Hence, they are entitled for

relief claimed.

4. In the Written Statement, Party II (2)/

/M/s. Cosmed Analytical and Central Services

Pvt. Ltd. submitted that the establishment of

Party II is closed. The termination of the services of

Party I workmen is a result of closure of the

establishment of Party II. The reference is bad-in-

-law as there is no industrial dispute existing or

apprehended. The salaries of all the workmen were

regularly paid by the Employer. Only Quality

Control Department was purchased by M/s. Wallace

Pharmaceuticals Pvt. Ltd. The workmen were

working for Party II and the services were

terminated on account of closure and all the

workmen were gainfully employed after the

termination. The termination of the workmen is in

compliance with provisions of law and therefore it

cannot be interfered.

5. In the Written Statement, the Party II (3)/

/M/s. Cosme Farma Laboratories Ltd., has submitted

that the Party II (3) along with 12 other partners

retired from CACS w.e.f. from 18-04-2000 and

therefore they are not aware of what transpired in

the employment of Party I workmen. However, the

said employees had continued to remain after

18-04-2000 with the employment of reconstituted

partnership firm CACS which was taken over by

Mr. Carlos Menezes and CACS Pvt. Ltd. The above

workmen were not on the rolls of M/s. CFL

Pharmaceuticals Ltd. and therefore Party I are not

entitled to any relief against Party II (3).

6. In the Written Statement, the Party II (4) M/s.

Wallace Pharmaceuticals Pvt. Ltd., contended that

there is no liability of Party II (4) towards the claim

of Party I workmen since there never existed any

relationship of employer and employee between

Party I and Party II (4) as Party II (4) along with 12

other partners had retired from M/s. CACS w.e.f.

18-04-2000 as per Deed of Retirement dated

18-04-2000. However, the said employees continued

to remain in the services of M/s. CACS which was

operated by partners namely; Carlos Menezes and

CACS Pvt. Ltd. since they had taken over all assets

and liabilities of CACS. The alleged termination of

the workmen had taken place much after

Party II (4) retired from the partnership firm. The

retiring partners are not responsible or liable for

any demand of the employees or workers or any

other claim towards any statutory dues or liabilities

of the erstwhile firm as per the said Deed of

Retirement. There is no cause of action against

Party II (4) and as such reference is not

maintainable. No relief against Party II (4) therefore

could be granted.

7. In the written statement, the Party I I(5)/

M/s. Beiersdorf (I) Ltd. contended that there is no

liability towards claim of the Party I workmen and

there was no employer-employee relationship.The

Party II (5) retired from the partnership by way of

Deed of Retirement w.e.f. 18-04-2000 and as per the

said Deed the retiring partners shall not be liable

for demands of the employees and the workers by

virtue of the earlier settlement or otherwise and

the retiring partners shall not be liable or

responsible towards any statutory dues or

liabilities and consequent to the retirement of the

Party II (5), they are absolved of all the liabilities

and responsibilities of the erstwhile partnership.

There was no employer-employee relationship

between Party II (1) and Party II (5). The CACS was

merely a service provider not only to Party II (5) but

to other Companies too. The Party II(5) is a Company

incorporated under Companies Act and there was

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

15TH JULY, 2021

334

no communality in the Books of Account vis-à-vis

the other Companies and therefore Party I is not

entitled for any relief.

8. In the Written statement, the Party II (6)/

M/s. Colfax (India) Pvt. Ltd. contended that there

is no liability towards the claim of the Party I

workmen since there never existed any relationship

of the employer-employee between Party II (1) and

Party II (6). The Party II (6) along with 12 other

partners retired from CACS w.e.f. 18-04-2000 and as

per the said Deed of Retirement there cannot exist

any such relationship however, the said employees

continues to remain in the services of CACS which

was operated by continuing partners namely;

Carlos Menezes and CACS Pvt. Ltd. since they have

taken over all the assets and liabilities of CACS

after 18-04-2000. The alleged termination of

workmen had taken place after they retired from

partnership. They are not responsible or liable for

any demand of the employees and workers by virtue

of the Deed of Retirement. There is no cause of

action against Party II (6) and as such the reference

is not maintainable.

9. In the rejoinder at Exh. 10, Exh. 34, Exh. 35

and Exh. 36, the Party I denied the case put forth

by the Party II companies in their Written

statements.

10. Based on the averments of the respective

parties, the following issues were framed at

Exh. 40.

1) Whether the Party I proves that the group of

companies had agreed to absorb the workers

on the roll as on 30-04-96?

2) Whether Party I proves that the closure is

fake and to avoid implementation of terms of

understanding dated 30-04-96?

3) Whether Party I proves that the termination

of services of the workmen was in violation

of understanding dated 30-04-96?

4) Whether the Party I proves that the group of

companies are liable to absorb the workmen?

5) What relief? What Order?

11. In support of the claim, Party I examined its

first witness, Smt. Fatima Rodrigues and produced

on record a copy of appointment letter dated

01-06-1973 at Exh. 49, a copy of confirmation letter

dated 28-12-73 at Exh. 50, a copy of transfer letter

dated 20-09-80 at Exh. 51, a copy of letter dated

20-09-80 to Party I by C.A.C.S. at Exh. 52, a copy of

settlement dated 13-04-99 between the Union and

the group of ten companies at Exh. 53, a copy of

letter dated 18-08-01 by C.A.C.S. to the office of

ALC at Exh. 54, and a copy of notice dated

01-10-01 by C.A.C.S. to the Secretary, Labour and

Employment at Exh. 55. During cross-examination,

a copy of the records from the Registrar Office is

taken and marked as Exh. 56. The Party I also

examined Shri Ashok Vernekar as second witness

and produced on record a copy of increment letter

dated 28-05-1975 at Exh. 59, a copy of his

promotion letter dated 24-11-97 at Exh. 60, a copy

of his increment letter dated Exh. 61 and a copy of

letter dated 22-06-74 at Exh. 62. On the other hand,

the Party II (4) M/s. Wallace Pharmaceuticals

examined Shri Eurico Noronha as witness and

produced a copy of certificate dated 30-10-2012 at

Exh. 69. The Party II (5), M/s. Beiersdorf India

Limited examined its witness Shri Praful Patil and

produced a copy of extract of register of Registrar

of Firms at Exh. 73. The Party II (4), M/s. CFL

Pharmaceuticals Ltd., examined Shri Uday

Deshpande as its witness. The Party II (6), Colfax

Laboratories (India) Private Limited examined Ms.

Elvina Noronha as witness and produced on record

a copy of letter dated 23-09-2013 of closure notice

of the Factory at Exh. 78.

12. Heard arguments. Notes of Written

arguments came to be placed on record by the

parties.

13. I have gone through the records of the case

and have duly considered the arguments advanced.

As per final order.

REASONS

Issue No. 1:

14. It is an admitted fact that Party I workmen

namely; Ashok Vernekar, Senior Lab Assistant,

Fatima Rodrigues, Telephone Operator and Inacian

Alfonso, Sr. Lab. Assistant were appointed by CACS

Firm w.e.f. 01-11-2001. Both Fatima Rodrigues and

Ashok Vernekar have been examined who claimed

that they were employed by CACS. There is no

dispute that CACS Firm was specifically formed to

cater to common services required by the Partner

Companies and that the Group used to sign

common settlements with the Union. Exh. 53 is one

such Joint Memorandum of Settlement dated

13-04-1999 u/s 2(p) of the Industrial Disputes Act

between the Employers of group of 10 companies

and the Union. There were various settlements for

increase in wages etc. which were handled

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

15TH JULY, 2021

335

together for all the group companies who were the

individual partners in the CACS Firm as seen in

the settlement at Exh. 53 including the names of

partners involved in the present reference. The

said settlement clearly mandates in general clause

2 that surplus staff would be redeployed and the

Management would not resort to retrenchment. It

is, therefore, clear that all the partners had agreed

to absorb the workers as and when the

decentralization takes place. The said commitment

has not been followed by Party II partners as they

claim that they have been retired and the Firm has

been dissolved.

15. There is no dispute that CACS Firm had

never issued any closure notice and that one which

was issued was withdrawn by the partners as seen

from the Written Statement. No Deed of Retirement

or any document pertaining to the partnership

except the Registrar of firms have been produced

by the Parties. Learned Advocates for Party II have

contended that the partners namely; Wallace

Pharmaceuticals,

Beiresdorf

and

Colfax

Laboratories have retired from the partnership and

that the partnership firm was dissolved in the year

2000 and the cause of action pertaining to the

present reference is in the year 01-11-2001 and

therefore the Parties who have already retired from

the Firm cannot be made liable in order to grant

relief as prayed as all the liabilities have been

taken over by CACS Pvt. Ltd. as being the last

partner before dissolution and since winding up

petition is pending against CACS Pvt. Ltd., no

Award can be passed. They further submitted that

the settlement dated 13-04-1996 has been signed

by only two representatives on behalf of CMM

Group of Companies which is not a legal entity

and the said persons have not been examined

before the Court to prove that the settlement was

signed by Parties mentioned therein and as such

the settlement is not valid in the eyes of law as

Party I has failed to challenge the issue of closure

and filed a false claim.

16. Learned Adv. Shri S. P. Gaonkar for Party I

has submitted and rightly so that it is mandatory

on the part of the Parties contending that they

have retired from the partnership or that new

partners have been added or that the Firm itself

has been dissolved that the retirement, dissolution

or addition of the partners must be proved by

leading evidence of the procedure contemplated

under the Partnership Act, 1932. Needless to

mention, the Deed of Retirement is not produced

on record. Public notices and the notices in the

Official Gazette which is mandatory for retirement,

addition and dissolution as per Section 72 of the

Partnership Act, 1932 have also not been produced

on record and therefore in the absence of the above

documents, the partnership firm continues to be in

existence and all the partners are liable for such

act, notwithstanding their retirement, more so,

when the addition of CACS Pvt. Ltd is not proved.

The Hon’ble Allahabad High Court in the case of

Anil Kumar Singh v/s Kanak Prabha Dutta, 2003

ALL LJ 2015 has held that in the absence of

retirement in the prescribed manner under the Act,

the partners continued in the partnership.

17. It is also well settled in the case of State of

Kerala v/s Saroja, AIR 1987 KER 239 that when a

partner pleads exemption from liability under

Partnership Act he has to prove retirement,

dissolution and addition etc. even if the other side

does not dispute the same. It is therefore for all

purposes the firm continues to be in existence so

does the liability of the partners. The addition of

CACS Pvt. Ltd. having not been proved in

accordance with the Partnership Act, they cannot

be considered as newly added partners. There is

also no effect of winding up of CACS Pvt. Ltd. as

firstly it in no longer a Party. Moreover, the winding

up of a Company does not affect a reference under

the Industrial Disputes Act, 1947 as held in the

case of B. V. John v/s Coir Yarn and Textiles, AIR

1960 KER 247. The Party I workmen namely, Fatima

Rodrigues and Ashok Vernekar have reiterated their

cases by way of affidavit-in-evidence and

documents and thus proved their stands, on the

contrary, the witnesses of Party II (4), Shri Eurico

Noronha has stated that he joined in 2008 and

deposing based on records and admitted that no

public notices of retirement has been given and

that all the partners of CACS firm were availing

services of workers on the roll of CACS firm. The

witness of Party II (5) Shri Praful Patil has stated

that he was not involved with the company prior

to 2016 and did not know what services were being

taken from CACS firm. The witness of Party II (3)

Shri Uday Deshpande was also not involved with

the company prior to 2009. The witness of Party II

(6) Elvina Menezes did not know who the partners

of the partnership were and admitted that she had

not seen the documents mentioned in her affidavit.

It is therefore Party I has proved by way of evidence

and documents that the group of companies had

agreed to absorb the Party I workmen on its roll as

on 13-04-1996 in terms of the Memorandum of

understanding at Exh. 53 and hence the issue

No. 1 is answered in the affirmative.

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

15TH JULY, 2021

336

Issue No. 2:

18. There is no dispute that the only closure

notice referred to by the Parties is the one given by

CACS Pvt. Ltd., Party II (2). The Party II (2) although

has filed a Written Statement had not stepped into

the witness box. The said Partner Company was

not the employer of the Party I workmen nor any

documents have been brought on record to show

that it had taken over services of the workmen. It

is well settled in the case of The Manager,

M/s. Pyarchand Kesarimal Porwal Bidi Factory

v/s Onkar Laxman Thenge & Ors., AIR 1970 SC

823 that the transfer of services of a workman from

one employer entity to another is impermissible

without tripartite agreement, that is between the

employer, the employee and the third party, the

effect of which would be to terminate the original

contract of service and to make a new contract

between the employee and the third party and so

long as the contract of service is not terminated

and the new contract is not made, the employee

continues to be in the employment of the employer.

When an employer orders him to do a certain work

for another person, the employee still continues to

be in his employment. The third party may pay his

wages but the third party cannot dismiss him as

the right of dismissal is with the employer. In the

instant case, the Partner Companies, wanted to

dissolve the firm and as such they are bound by

the Settlement dated 13-04-1999 and because of

the obligation of absorption which was upon them,

they have made a claim of retirement and

dissolution which has not been proved by the

Party II partner companies. It is therefore the

Party I sufficiently proved that termination of the

services was in violation of Understanding dated

13-04-1999. Hence, issue No. 2 is answered in the

affirmative.

Issue No. 3:

19. There is no dispute that the Parties had

entered into the Settlement dated 13-04-1999 at

Exh. 53 and that the said terms of the settlement

have not been implemented by Party II group of

partner companies, although it was specifically

agreed that all the workmen on the rolls would be

absorbed but the same was not followed. When

the partnership was to be dissolved, the

Understanding dated 13-04-1999 were to be

honoured and therefore the termination/refusal of

employment by Party II group of partner companies

is in violation of Understanding dated 13-04-1999

and therefore Party I has proved issue No. 3 in their

favour.

Issue No. 4:

20. There is no dispute that all the three

workmen have worked for more than one year

continuously as seen from their letters of

appointment which are at Exh. 49 and 60 issued by

CACS. There is no dispute that once the workman

has completed one year continuous service in terms

of 25-B(1), the Employer is bound to follow mandate

of section 25-F which CACS has not followed and

therefore the termination of the Party I workmen

from 1-11-2001 under the pretext of closure is illegal

and void. Section 25-F of Industrial Disputes Act

places an embargo upon an Employer and that

they are barred from retrenching an employee who

has been in continuous service for not less than

one year. The workmen have shown that they were

with the Group since many years and once the

workmen proves that they had actually worked for

240 days, it will be deemed to be continuous service

for one year and therefore gets the protection of

Section 25-F and hence cannot be removed unless

retrenchment compensation have been paid to

them.

21. The Hon’ble Bombay High Court in the case

of Sarita Melwani v/s Pallavi Talekar, 2008 (2)

CLR 679 has held that under sub-section 1 of

Section 25-B there is no requirement to show actual

working for 240 days. Once it is proved by the

workmen that the Party II has failed to comply

with section 25-F of Industrial Disputes Act, the

next question is on whom the liability of the

workman would be fastened. It is well settled that

in a partnership firm each and every partner is

liable jointly and severely u/s 32 of the Act and

therefore the newly added Parties would be liable

for any Award passed in the present reference. The

contention of Advocates for Party II that since the

partners have retired by Deed of Retirement dated

18-04-2000, there would be no liability towards any

past claim cannot be accepted as u/s 32 of the

Partnership Act, the only way in which a partner

can be discharged from his liability towards the

third Party/workman would be by an agreement

between him, the third Party and the remaining

partners. There is no such agreement produced on

record. The Apex Court in the case of Syndicate

Bank v/s R.S.R. Engineering Works and Ors.

(2003) 6 SCC 265 has clearly held that the every

partner is personally liable for the acts done by the

partnership firm and therefore the Partner

Companies continue to be liable towards the claim

of the workman, hence all the partners are liable

for the relief prayed by Party I and it is not open

for partners to contend that the claim of workmen

is limited to the assets and liabilities of the firm

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

15TH JULY, 2021

337

which is taken over by Party II (2). It is therefore

the partners group of companies are jointly and

severally liable to absorb the Party I workmen and

for other reliefs. Hence, issue No. 4 is also answered

in the affirmative.

Issue No. 5:

22. The Party II partners have admittedly not

paid any retrenchment compensation nor notice

given by them while terminating the services of

Party I workmen. It is well settled when the

termination is illegal and that Party II Employer

has not followed Section 25-F of the Industrial

Disputes Act, the normal rule is that Party I

workmen are entitled for reinstatement with full

back wages and continuity of services. Learned

Adv. Shri S. P. Gaonkar has submitted that the

factors to be considered for the relief of

reinstatement with full back wages are refusal of

employment/termination was without following

Section 25-F, long service put in by the workmen,

number of years took for litigation; that the

workmen are unemployed, date of refusal; and that

the Employer has not shown any evidence of

employment on the part of the workmen.

23. There is no dispute so also Learned

Advocates for Party II partners have submitted and

rightly so that the Party II workmen have already

attained the age of superannuation. Shri Ashok

Vernekar in his Affidavit has claimed that his age

was 63 years, so also Fatima Rodrigues in her

deposition has claimed that as on 13-03-2014, she

was 58 years then, so also Inacian Alfonso has not

been examined to prove date of birth nor there is

anything on record that they were employed from

the date of closure. The Party I therefore are not

entitled for re-instatement as they have already

attained the age of superannuation, however, they

are entitled for the back wages which have to be

calculated as full as they have been denied an

opportunity to serve the Party II partner companies.

Moreover, if the terms of settlement dated

13-04-1999 were honoured by the Employer, the

Party I workmen would be working with any of the

partner Companies which has been denied to them

and therefore they are entitled for the relief of full

back wages as claimed by them. Hence the above

point is answered accordingly.

24. In the result, I pass the following:

ORDER

(i) The reference stands partly allowed.

(ii) It is hereby held that the action of the

management of M/s. Cosmed Analytical and

Central Services, Curti, Ponda-Goa in

terminating the services of their workpersons

namely; Ashok Vernekar, Sr. Lab. Assistant,

Fatima Rodrigues, Telephone Operator,

Inacina Afonso, Sr. Lab. Assistant, with effect

from 1-11-2001, under the pretext of closure,

is illegal and unjustified.

(iii) The Party II (1) and its partner companies in

the reference are jointly and severally

directed to pay full back wages to Party I

workmen namely; Ashok Vernekar, Senior

Lab. Assistant, Fatima Rodrigues, Telephone

Operator and Inacina Alfonso, Sr. Lab.

Assistant, including the retrenchment

compensation under Section 25-F of the

Industrial Disputes Act.

(iv) The Party II (1) and its partner companies in

the reference are jointly and severally

directed to deposit back wages and the

retrenchment compensation before the

Tribunal as stated above within 60 days of

the publication of the Award, failing which

the Party II shall pay an interest @ 9% per

annum.

Vaccine Prior to Prescribed Time Interval (after 28

days but before 84 days) to persons intending to

undertake international travel for education

purpose, for joining employment in foreign

countries and for India’s contingent to Tokyo

Olympics.

1. Presently, based on the recommendations by

National

Expert

Group

on

Vaccine

Administration for COVID-19 (NEGVAC), the

schedule of Covishield vaccine under National

Covid-19 Vaccination Strategy is to administer

the 2nd dose at 12-16 weeks interval (i.e. after

84 days), after administration of 1st dose.

2. The Union Ministry of Health & Family Welfare

has received several representations for

allowing administration of second dose of

Covishield for such persons who have only

taken first dose of Covishield and are seeking

to undertake international travel for

educational purposes or employment

opportunities or for part of India’s contingent

for Tokyo Olympic games, but whose planned

travel dates fall prior to completion of the

currently mandated minimum interval of 84

days from the date of first dose.

3. The matter has been discussed in Empowered

Group 5 (EG-5) and appropriate recommenda-

tions have been received. In this context, with

a view to provide full coverage of vaccination

and facilitating international travel for such

geninue reasons, following procedure shall be

followed for administration of second dose of

Covishield vaccine for such beneficiaries:-

a. This special dispensation will be available

to -

(i)

Students who have to undertake

foreign travel for the purposes of

education.

(ii) Persons who have to take up jobs in

foreign countries.

(iii) Athletes,

Sportspersons

and

accompanying

staff

of

Indian

contingent attending International

Olympic Games to be held in Tokyo.

b. States/UT Governments shall designate a

competent authority in each District for

according

permission

for

such

administration of second dose of Covishield.

c. The competent authority shall check the

following before according a permission for

administration of second dose before the

period of 84 days after the date of first dose:-

(i)

Whether a period of 28 days has

elapsed after the date of first dose.

(ii) Genuineness of the purpose of travel

based on documents related to–

1. Admission offers or associated

formal communications for the

purpose of education.

2. Whether a person is already

studying in a foreign educational

institution and has to return to that

institution for continuing his/her

education.

3. Interview calls for a job or offer

letters for taking up employment

4. Nomination to participate in the

Tokyo Olympic games.

d. It is advised that vaccination may be

availed in such cases through Passport

which is one of the permissible ID

documents as per the current guidelines, so

that the passport number is printed in the

vaccination certificate. However, if Passport

was not used at the time of administration

of first dose, the details of the photo ID Card

used for vaccination will be printed in the

vaccination certificate and mention of the

Passport in the vaccination certificate is not

to be inisted upon. Wherever necessary, the

competent authority may issue another

certificate linking the vaccination certificate

with the passport number of the beneficiary.

e. This facility shall be available to those who

need to undertake international travel for

these specified purposes in the period up to

31st August, 2021.

4.

It is clarified that Covishield, produced by

the Serum Institute of India and approved

by the DCGI, is one of the vaccines

recognised by the WHO for emergency use

as on 3rd June, 2021. The relevant entry is at

S. No. 4 of the WHO EUL, available at https:/

/extranet.who.int/pqweb/sites/default/files/

documents/Status%20of%20COVID-

19%20Vaccines%20within%20WHO%20EUL-

P Q % 2 0 e v a l u a t i o n % 2 0 p r o c e s s % 2 0 -

%203%20June%202021.pdf. Mention of

vaccine type as “Covishield” is sufficient

and no other qualifying entries are required

in the vaccination certificates.

5.

The Co-WIN system will soon provide the

facility for administration of 2nd dose in such

exceptional cases.

6.

This is to clarify that these SoPs have been

issued specifically only for Covishield

because only the time interval between the

2 doses of Covishield has been increased

from 6-8 weeks to 12-16 weeks. The period

for COVAXIN has remained the same i.e.

4-6 weeks and hence there was no need for

any special dispensation for 2nd dose of

COVAXIN. It is also clarified that complete

vaccination with COVAXIN is also sufficient

for foreign travel.
