The following Amendment approved by the
Government is published for information:
In pursuance of the directions of the Hon’ble
Supreme Court of India as contained in its order dated
23-08-2012 in Writ Petition (Civil) No. 309 of 2003 with
W.P. (C) No. 330 of 2001, W.P. (C) No. 44 of 2004 and W.P.
(C) No. 688 of 2007, the Government of Goa is hereby
pleased to re constitute the State Committee for
Slaughter Houses for proper and speedy
implementation of the Prevention of Cruelty to
Animal (Slaughter House) Rules, 2001 as follows:

The function of the said State Committee for
Slaughter Houses shall be as follows:

i.
To identify and prepare a list of all the
Slaughter Houses (S.H.s) located within the
local self Government (Municipal Corp-
orations, Panchayats etc.)
ii. To call for reports from the District Magistrate
or the Dy. Commissioner and District Food
Safety Inspector as the case may be on the
condition/functioning of the S.H.s and also on
the compliance of the relevant applicable
laws.
iii.
To recommend modernization of old
slaughter houses (S.H.s) and to relocate S.H.s
which are located within or in close proximity
of a residential area.
iv.
To recommend appropriate measures for
dealing with solid waste, water/air pollution
and for preventing cruelty to the animals
meant for slaughter.
v.
To carry out surprise & random inspections of
S.H.s regularly and to issue directions for
compliance of the recommendations that may
be made by it.
vi. To send bi-annual reports on the State S.H.s to
the Central Committee and to refer issues that
may require Central Committee recommen-
dations or Central Government assistance.
vii. To accord final approval for licensing of S.H.s
to Local Self Government.
viii.To identify on an ongoing basis, the unlicensed
slaughter houses in the region, and other
unlicensed, unlawful establishments where
animals are being slaughtered, on howsoever
a small scale, and take the help of the District
Magistrate and other law enforcement
agencies to crack down on the same.
ix. To check for child labour.
This Notification is issued in supersession of all
previous Notifications/Orders issued in this regard.
This issues with the Concurrence of Finance (Exp.)
Department vide U. O. No. 1400082246 dated
04-10-2021 and Addl. Sec. (Fin.) dated 20-10-2021.

The State Level Monitoring Committee Shall have
the following functions:
I. Review and monitor the process of registration
of unorganised worker with DCs/DMs
Collectors district-wise.
II. Monitor the working of field level Common
Service Centers (CSCs) and State Sewa
Kendras (SSK) district wise along with the
target defined.
III. Monitor mobilization of target Sub-Group of
unorganised workers such as MGNREGA
Workers, SHG members under NRLM/
/NULM, Street Vendors, Rickshaw-pullers,
construction (BOCW) workers, Mid-day meal
workers, Domestic workers, ASHA workers,
Anganwadi Workers, Agriculture labourers,
Fishermen and brick-kin workers through
respective line departments district-wise for
registration under eSHRAM.
IV. Monitor registration of bulk registration of
BOCW/ASHA/Anganwadi/MGNREGA/
/Domestic workers/Mid-day meal workers/
/Fishermen to register under the eSHRAM.
V. Channelise labour union/workers associations/
/federations/civil society organisation
working for the welfare of unorganised
workers to convince and mobilize their
respective members to register under the
eSHRAM portal.
VI. Ensure holding of regular registration
Camps at the district and CSC level for the
unorganised workers (Kamgars).
VII. Strategies to have Information, Education and
Communication (IEC) with prospective
beneficiaries of eSHRAM and their
implementation through State Labour
Department and other official machinery.
VIII. Devise and Monitor implementation of State
wide awareness programs through discussions,
seminars, public meetings, students
participation, Universities, Colleges, media
channels, News items, Campaigns, Pamphlets,
Posters, Banners, help-desk tables in district
labour offices/skill development centers/
stategic locations/other prominent places of
labour concentration.
IX. The Committee shall meet at least once in a
quarter.
This Order shall come into force on the date of
publication in the Official Gazette.

matter specified in the Schedule hereto (hereinafter
referred to as the “said dispute”);
And whereas, the Government of Goa considers
it expedient to refer the said dispute for
adjudication.
Now, therefore, in exercise of the powers con-
ferred by Clause (c) of sub-section (1) of Section10 of
the Industrial Disputes Act, 1947 (Central Act 14 of
1947) (hereinafter referred to as the “said Act”), the
Government of Goa hereby refers the said dispute
for adjudication to the Labour Court-II of Goa at
Panaji-Goa, constituted under Section 7(1) of the said
Act.

Government of Goa, by Order dated 27-06-2018,
bearing No. 28/12/2018-LAB/411 referred the

2. On receipt of the reference, a case was
registered under No. LC-II/IT/12/18 and registered
A/D notice was issued to the Parties. In pursuance
to the said notice, the Parties put in their
appearance. The Workman/Party-I (for short
Workman), filed his Statement of Claim on
14-08-2018. The facts of the case in brief as pleaded
by the Workman are that he was initially appointed
as ‘Tinter’ (trainee) by the Employer/Party II (for
short, ‘Employer’) on 20-05-2015. He stated that he
was put on probation up to April, 2017. He stated
that he had completed three months of probation
in accordance with Model Standing Orders under
the Industrial Employment (Standing Orders) Act,
1946 and therefore he was a permanent workman.
He stated that the Employer did not like the
unionization of its workmen under the Gomantak
Mazdoor Sangh (for short, ‘the union’) and as such
constantly harassed and troubled the members of
the said union. He stated that he was victimized for
being the member of Gomantak Mazdoor Sangh.
3. He stated that the Employer did not like the
action of the union espousing the cause of the
workmen by demanding better wages and service
conditions. He stated that the matter pertaining to
the charter of demands for the period between 2008
to 2012 was pending before the Hon’ble Industrial
Tribunal and is registered as Reference No. 29/2009.
He stated that the Hon’ble Tribunal disposed off
the said Reference No. 29/2009 by award dated
13-7-2015. He stated that the Employer challenged
the said award before the Hon’ble High Court under
the Writ Petition No. 739/2015. He stated that the
said Writ Petition filed before the Hon’ble High
Court has been dismissed, thereby upholding the
award passed by the Hon’ble Industrial Tribunal.
He stated that thereafter, the Employer filed a
special leave petition before the Hon’ble Supreme
Court of India, which bears registration No. 8329/
2016. He stated that the Hon’ble Supreme Court of
India was pleased to dismiss the said special leave
petition filed by the Employer, by its order dated
29-04-2016. He stated that the workmen requested
the Employer to implement the award dated
13-07-2015 after dismissal of the said special leave
petition by the Hon’ble Supreme Court of India.
4. He stated that the management of the
Employer has however, did not implement the said
Award and the workmen was therefore, constrained
to file the claim application u/s 33-C (1) of the I.D.
Act, 1947. He stated that pursuant to the claim
filed by the workmen, the Hon’ble Tribunal has
issued a show cause notice dated 16-11-2016 to the
Employer for non-implementation of the Award
dated 13-07-2015. He stated that the period of the
Charter of Demand in which an Award dated
13-07-2015 was passed, has expired on 30-06-2012
and therefore a fresh Charter of Demands was
submitted for the further period of four years and
that the same was not resolved by the management
of the Employer.
5. He stated that the General Body Meeting of
the union held on 04-11-2016 therefore, unanimously
decided to observe a strike against the non-
implementation of the Award dated 13-07-2015 and
the non-settlement of new Charter of Demand. He
stated that the said strike was to be observed on
21-11-2016. He stated that on a receipt of the notice
of the strike, the management of the Employer
started harassing and threatening the workers
especially the active members of the union. He
stated that the action against him in the reference
was in response to the legitimate union activities.
He submitted that before commencement of the
strike, the management, with an ulterior motive to
destroy the union, issued malafide transfers to office
bearers and active members of the union on
17-11-2016 and hence, all the union members went
on legal strike demanding the immediate
withdrawal of the malafide transfer orders. He stated
that the strike was withdrawn and the workers
went to resume their duties. He stated that the
workers were not allowed to join the duties and it
is only after the intervention of the Dy. Labour
Commissioner, Margao, the workers were allowed
to resume their duties.
6. He stated that he addressed a letter dated
12-12-2016 to the Works Manager of the Employer
and requested to allow him to work as he alongwith
some other workmen were forced to punch their
cards and sit idle in the hot sun as punishment for
participating in the legal strike. He stated that
immediately after resuming the duty, he was issued
a show cause notice dated 13-12-2016 by the
Employer as to why disciplinary action should not
be taken against him for participating in the strike.
He stated that he submitted his detailed reply to
the show cause notice by his letter dated
16-12-2016. He stated that vide its letter dated
16-12-2016, the Employer discharged him from their
services. He stated that on receipt of the said
discharge letter dated 16-12-2016, he submitted his
reply dated 20-12-2016 and demanded immediate
withdrawal of the said discharge letter. He

submitted that after his discharge, he had raised
an industrial dispute through his union before the
Dy. Labour Commissioner, vide his letter dated
21-12-2016 which ended in failure.
7. The Workman contended that as he joined the
union and requested the management to implement
an Award dated 13-07-2015, he was illegally
discharged from the services. He submitted that
before discharging him, the Employer did not file
any approval application as required under Section
33 of the I.D. Act, 1947. He submitted that before
discharge of his services, the management has not
conducted any enquiry and as such violated the
principles of natural justice. He submitted that the
letter of discharge issued to him is illegal,
unjustified and bad-in-law. He submitted that his
order of discharge, has not been signed by the
appointing authority and as such it is illegal,
unjustified and bad-in-law. He submitted that before
termination his services, the management has not
complied with Section 25-F, 25-H and 25-G of I.D.
Act, 1947. He submitted that the Employer is
employing more than 100 workers working in the
said factory and hence, Chapter V-B of the I.D. Act,
1947 is applicable to the Employer. He submitted
that before termination of his service, the
management has not obtained the prior permission
of retrenchment as required u/s 25-N of the I.D. Act,
1947. He submitted that at the time of his
termination, no notice pay, retrenchment
compensation was paid or offered and as such the
termination is illegal, unjustified and bad-in-law.
8. He submitted that after giving discharge, he
is unemployed and hence he is entitled for full
back wages with continuity in service. He submitted
that an act of the Employer in discharging him
from its service amounts to an unfair labour practice
in as much as the said discharge has been effected
malafidely to penalise him for participating in
legitimate trade union activities. The Workman
therefore prayed that this Tribunal declare that his
termination from service is illegal, improper,
unjustified and set it aside and direct the Employer
to reinstate the workman with full back wages,
continuity in service with consequential benefits.
9. The Employer resisted the claim of the
Workman by filing its written statement on
03-10-2018. The Employer, as and by way of its
preliminary objections submitted that the reference
is misconceived, frivolous, ill-founded and contrary
to the fact and as such not maintainable in law.
The Employer submitted that this Hon’ble Tribunal
has no jurisdiction to entertain the same as the
Workman during the material time, was admittedly
employed with and was working as ‘Tinter’ on
probation and therefore cannot be said to be a
‘workman’ within a meaning of section 2 (s) of the
I.D. Act, 1947 and that he had no lien of employment
and therefore the act of discharge of a probationer
does not constitute any industrial dispute. The
Employer submitted that the statement of claim is
too vague, ambitious, clumsy and devoid of any
material facts and therefore, not consistent with
provisions of sub-regulation (2 of regulation 100 of
the Industrial Court Regulations, 1975, that the
Workman has utterly failed to make out any case in
support of alleged cause of action and no case exist
at all.
10. Without prejudice to the foregoing averments
and the contentions therein, the services of the
Workman being probationer was dispensed with as
his services was found unsuitable and the Workman
ought not be foisted upon the Employer for any
reason of whatsoever. The Employer stated that it
is engaged in the business of dealership of Maruti
vehicles having its office at Goa. The Employer
stated that for effective service to the customers of
the said vehicles, it has its showrooms/sales
services situated at Panaji, Goa. The Employer stated
that there are 471 technicians situated at various
service stations at Goa. The Employer stated that
the workman was engaged by them on 18-05-2015
as a trainee and thereafter he was taken as a ‘Tinter’
on probation w.e.f. 18-04-2016 and extended from
time to time. The Employer stated that the Workman
was last working as a probationer. The Employer
stated that on personal request and on
humanitarian grounds, the services of the Workman
were extended from time to time. The Employer
stated that despite giving sufficient opportunities,
the Workman was not found suitable for being made
permanent in services. The Employer stated that it
being engaged in a service oriented business, could
not take a risk of continuing such non-suitable
persons putting in the jeopardy the customer’s
vehicles and its reputation in the competitive
market. The Employer stated that time and again
the senior employees spoke to him individually and
appraised him with poor performance and a
decision on his poor performance was being
postponed from time to time. The Employer stated
that even after giving him numerous opportunities,
the Workman did not improve his performance. The
Employer stated that the Workman lacked in
commitment and initiative and his work culture
was bad. The Employer stated that the performance
levels of the workman was very low and was not in
a good relations even with his colleagues. The
Employer stated that the Workman was warned

from time to time, but he did not make any attempt
to improve his own behaviour. The Employer stated
that they had no other alternative and the
cumulative effect regarding his individual
performance culminated them in taking a conscious
decision not to confirm him in their service. The
Employer stated that the workman was handed over
a letter dated 16-12-2016 informing him that
scrutinizing his work, conduct and performances,
the same was not found satisfactory and hence, its
management, in accordance with clause 28 of his
appointment letter had decided to discharge him
from services. The Employer stated that the
Workman refused to accept the said letter and
sought to hand over to him in presence of two
witnesses and as such the necessary endorsement
was made and the said letter along with
compensation was sent on his last known address.
The Employer denied the case of the Workman as
pleaded in its claim statement and prayed for
rejection of the reference.
11. Thereafter, the Workman filed his re-joinder
on 22-10-2018 at Exb. 5. The Workman, by way of
his re-joinder, confirms and reiterates all the
submissions and averments made by him in his
claim statement to be true and correct and denies
all the statements and averments made by the
Employer in its Written Statement, which are
contrary to the statements and averments made by
him.
12. Based on the pleadings filed by the respective
Parties, this Hon’ble Labour Court II has framed the
following issues on 10-12-2018 at Exb. 10.
1. Whether the Workman/Party I proves that
the action of the Employer in terminating
his services with effect from 16-12-2016 is
illegal and unjustified?
2. Whether the Workman/Party-I proves that the
action of the Employer in terminating his
services of the workman by way of discharge
amounts to an unfair labour practice as
defined in Schedule V of the I.D. Act, 1947?
3. Whether the Employer/Party II proves that
the present reference is not maintainable in
view of the reasons mentioned in para 1 (a)
to 1 (i) of its written statement?
4. Whether the Workman/Party II is entitled to
any relief?
5. What Order? What Award?
13. Thereafter, the matter was fixed for filing
affidavit in evidence of the Workman. The Workman
has however sought time to file his affidavit in
evidence and case was adjourned to 16-03-2021. On
16-03-2021, Ld. Rep. Shri P. Gaonkar appeared for
the Workman. The Employer was represented by
Ld. Rep. Shri K.V. Nadkarny. Both the representatives
orally submitted that they are trying to settle the
matter amicably and sought time. Accordingly, on
16-07-2021 the Workman along with Ld. Rep. Shri P.
Gaonkar remained present. The Employer is
represented by Ld. Rep. Shri K.V. Nadkarny. Both
the representatives submitted that they have
settled the matter amicably between the parties
hereinabove and prayed for disposing off the
reference as consent Award. The parties produced
on record a copy of the terms of settlement duly
signed by both the parties along with their
respective representatives which is on record at
Exb. 13. The terms of settlement as settled between
the parties are reproduced herewith.
(a) It is agreed between the parties that the
workman, Mr. Kiran Naik, who is Party-I in the
above proceedings, which is a reference made
to this Hon’ble Labour Court by the
Government as per the provisions of the
Industrial Disputes Act, 1947, shall be treated
as retrenched from his date of current
termination and shall be paid Retrenchment
Compensation at 45 days wages per every
completed period of services till the date of
his termination of services and shall be paid
an amount of Rs. 79,865/- (Rupees seventy nine
thousand eight hundred and sixty five only)
by way of all legal dues including upaid
arrears of Rs. 12,610/- .
(b) That Employer Party II, M/s. Chowgule
Industries Pvt. Ltd., further agreeing to
suggestion put forth by the Party I, Shri Kiran
Naik. Party I represented by the Union General
Secretary shall be paid an additional sum of
Rs. 77,600/- (Rupees seventy thousand and six
hundred only) as ex-gratia which is equivalent
to the amount calculated at 22½ days wages
per year from the date of termination till date
of this settlement.
(c) It is agreed by the workmen, Mr. Kiran Naik,
Party I shall accept the said separation scheme
in full and final settlement of all his claims
arising out of termination of his employment
and having agreed and accepted said amount
he shall have no further claim of whatsoever
nature against the Company including any
claim of reinstatement or re-employment, as
he has deemed to be separated from the
company and severed the employer employee
relationship without any reservations.
(d) It is agreed between the parties that 10% out
of the total amount receivable by the workman

Party I, the employer Party II shall deduct
towards services rendered by the Union,
Gomantak Mazdoor Sangh.
(e) It is agreed between the parties that sums
under term 1 and term 2 above are being paid
by the Employer/Party II to the Workman/Party
I by single cheque No. 009086 dated
15-07-2021 for total sum of Rs. 1,41,721/-
(Rupees one lakh forty one thousand seven
hundred twenty one only) drawn in the name
of Workman, Shri Kiran Naik, Party I and a sum
of Rs. 15,747/- (Rupees fifteen thousand seven
hundred forty seven only) by cheque
No. 009086 dated 15-07-2021 drawn on HDFC
Bank, Panaji, in favour of Gomantak Mazdoor
Sangh, that the said amount paid hereinabove
is not only in full and final settlement of all
his claims arising out of his employment but
he shall not have any future further claims of
any nature against the company for any benefit
which can be computed in terms of money.
(f) In view of the payment as above, Mr. Kiran
Naik, Workman/Party I states and submit that
he shall have no claim whatsoever nature
against the Employer Company/Party II
including claim of reinstatement or
re-employment.
(g) That in view of the settlement as above both
parties prays that the matter may please be
closed as settled and ordered accordingly.
I have carefully perused the said terms of
settlement at Exb. 13 signed by and between the
parties hereinabove. The said terms of settlement
are beneficial to both the parties. Hence, I consent
for the same. Since the dispute under reference is
settled between the parties, I hold that the dispute
under present reference does not survive.
In view of the above, I proceed to pass the
following order:
ORDER
1. It is held that the action of the management
of M/s. Chowgule Industries Private Limited,
Verna Industrial Estate, Verna, Goa, in
terminating the services of Shri Kiran R. Naik,
Tinter, with effect from 16-12-2016, is legal
and justified?, does not survive.
2. The Workman, Shri Kiran R. Naik, is not
entitled to any relief.
3. No order as to costs.
