Presiding Officer)

Case No. Ref. LC-II/C-IT/03/2019

Shri Gopal Hari Naik,

R/o. Torsem, Pernem, Goa ….. Workman/Party-I

V/s

M/s. Kadamba Transport Corporation Ltd.,

Paraise de Goa,

Alto-Porvorim, Goa

…. Employer/Party-II

Workman/Party-I represented by Adv. Shri A.

Kundaikar.

Workman/Party-II represented by Adv. Shri P.

Agarwal.

Panaji, Dated: 27-07-2021.

AWARD

1. This Award shall determine the complaint

dated 17-12-2018 filed by the Workman u/s 33-A of

the I.D. Act, 1947.

2. It is the case of the Party I/Workman (for short,

‘the Workman’) in brief that the Government of Goa,

by its order dated 18-10-2016, was pleased to refer

an Industrial Dispute in exercise of the powers

conferred by clause (d) of sub-section (1) of Section

(10) of the I.D. Act, 1947 for adjudication to the

Industrial Tribunal as to whether the action of the

Employer/Party-II (for short “Employer”) in

withholding his annual increment w.e.f. 1998,

thereby depriving him of the monetary benefits is

legal and justified. He stated that pursuant to the

said order, this Hon’ble Court registered the case

as No. REF LC-II/IT/17/16 and is pending for its

adjudication before this court. He stated that during

the pendency of the said reference, the Employer

was pleased to extend the monetary benefits of

seventh central pay commission to its employees

w.e.f. 01-11-2018 in terms of its BOD decision taken

vide resolution No. 93/17. He stated that on the

recommendation of departmental screening

committee, he was granted second up-gradation in

the pay band of Rs. 5200-20200 + 2800 Grade Pay

under the Modified Assured Progression Scheme

(MACP). He stated that his basic was fixed at

Rs. 11870/- plus Rs. 2800/- grade pay w.e.f.

07-01-2015. He stated that he was released with

the revision in pay scale from time to time which

were extended to the Employer Corporation. He

stated that however, on a spacious plea of pendency

of the dispute before the Industrial Tribunal, the

benefits of seventh central pay commission was

deferred till the dispute under sixth pay commission

which are pending before the various court of law

are resolved/settled. He stated that his reference

pertaining to the withholding of the annual

increment for the year 1998 is pending before this

Labour Court II and bears No. LC-II/IT/17/16 and

not related to the sixth central pay commission. He

submitted that he has been released with the sixth

central pay commission and therefore he is entitled

for seventh pay commission which has been made

applicable in the corporation. He stated that a

memorandum of settlement was signed under

Section 12 (3) r/w Section 18 (3) wherein it has

been stated that the Employer has agreed to bind

themselves by revised pay scale till such time the

scales of pay and other benefits are further revised

in future in respect of Government servants/

employees. He stated that in accordance with the

provisions contained in Rule 10 of CCS (RP) Rules,

2008 states that there will be uniform date of annual

increment viz. 01st July of every year. He stated

that employees completing six months and above

in the revised pay structure as on 1st July will be

eligible for grant of increment on 01-01-2006 in the

pre-revised scale as one time measure. He stated

that the said office memorandum was adopted by

the Government and therefore the same is

applicable to the Employer Corporation in view of

the settlement. The Employer stated that the sixth

central pay commission recommended MACP and

the dispute is not in respect of sixth central pay

commission as he is made eligible for sixth central

pay commission by virtue of memorandum of

settlement. He stated that by order dated

09-11-2018, the General Manager of the Employer

has given the benefit of revised pay commission to

him and the entitlement of seventh pay commission

was deferred till the dispute pending before the

Labour Court is resolved/settled. He stated that

neither the Workman was given personal hearing

nor sought explanation for extension of seventh

central pay recommendation. He stated that the

Employer failed to seek approval of the Labour Court

II before deferring the implementation of seventh

central pay commission as the adjudication was

pending before the said court. He submitted that

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 39

23RD DECEMBER, 2021

883

the action of the General Manager is vindictive

and amounts to unfair labour practice. He submitted

that the General Manager has no right of what so

ever nature to pass the impugned order altering

the service conditions to his prejudice. He

submitted that the action of the General Manager

of the Employer is in abuse of process of law and

is liable for action for violation of Section 33-A of

the I.D. Act. The Workman therefore prayed that his

complaint be allowed by holding that the deferring

of seventh central pay commission is illegal and

consider him for the eligibility of the seventh

central pay commission from the date of entitlement

with consequential benefits in accordance with

seventh pay commission.

3. The Employer resisted the claim of the

Workman by filing its reply dated 19-09-2018. The

Employer, as and by way of its reply, submitted that

the complaint is liable to be dismissed as there is

no alterations of service conditions as alleged by

the Complainant and that what is referred for

adjudication is not a complaint as defined u/s

33-A of the I.D. Act. The employer stated that the

complainant has not only suppressed the material

facts from this Hon’ble Court but has made

misleading statements.

4. The Employer stated that it is a Government

Company registered under Section 617 of the

Companies Act, 1956. The Employer stated that it

is a State Transport Undertaking under the purview

of M.T. Act, 1988. The Employer admitted that the

dispute in reference No. IT/17/2016 was raised by

the Complainant pertaining to the legality and

justifiability of the action of the Employer in

withholding his annual increment w.e.f. 1998

thereby depriving him of monetary benefits. The

Employer stated that the said dispute is pending

for its adjudication before this Labour Court. The

Employer stated that it has issued an order dated

29-11-2018 stating that in terms of BOD decision

taken vide resolution No. 93/17 in the 213th board

meeting held on 29-12-2017. The Employer stated

that subsequent Government approval conveyed

by the Directorate of Transport, vide its letter dated

22-11-2018, thereby the management of the

Employer was pleased to extend the monetary

benefit of seventh central pay commission to its

staff/employees w.e.f. 01-11-2018. The Employer

stated that it is further stated that the benefit of

the revised pay commission of the employees as

shown under Annexure ‘A’ and ‘B’ have been

deferred till the disputes under sixth pay

commission which are pending before the various

courts of law are resolved/settled. The Employer

stated that the above mentioned benefits of the

revised pay commission was due to condition

mentioned in the circular dated 27-11-2017 issued

by the department of finance, Government of Goa.

The Employer denied the overall case as pleaded

by the Complainant by stating that there has been

no violation of Section 33 (1) of the I.D. Act in the

present case. The Employer therefore prayed for

dismissal of the present complaint.

5. Thereafter, the Workman filed his re-joinder on

07-10-2019 at Exb. 10. The Party-I, by way of his Re-

joinder, denied each and every statement, averments

and submissions made by the Employer Company

vide their Written Statement filed in the present

proceedings and reiterates and confirms the

statements, averments and submissions made by

him in his statement of claim. He stated that the

written statement filed by the Employer and duly

verified by its Managing Director is contemporary

and frivolous and is therefore liable for perjury for

making a false statement in affidavit filed before

the Hon’ble High Court.

6. Based on the pleadings filed by the respective

parties, this court framed the following issues on

18-10-2019 at Exb. 10.

1. Whether the complainant proves that the

action of the Opponent in deferring the

benefits of the Seventh Central Pay

Commission is illegal and unjustified?

2. Whether the Complainant proves that his

service conditions has been altered pending

the dispute before this court?

3. Whether the Opponent proves that the

complaint of the Complainant is liable to be

dismisse? in view of the reasons as stated in

para 2 (a) & (b) of its reply?

4. What Order? What Award?

7. After framing the issues, the case was fixed for

filing the affidavit in evidence of the complainant.

However, on account of pandemic COVID-19, case

was adjourned from time to time, though the

complainant remained absent on the scheduled

dates of hearings till 19-01-2021. On 05-07-2021, the

complainant remained present in person and the

Employer represented by Adv. Shri P. Agarwal. The

complainant filed an application for withdrawing

of his complaint which is on record at Exb. 12 and

prayed for withdrawal of the said complaint. No

objection has been given by the Ld. Adv. Shri P.

Agarwal, appearing for the Employer. It is the

complainant who had filed the present complaint

claiming to be in violation of Section 33 of the I.D.

Act, 1947, filed an application for withdrawal of his
