Workperson/Party-I represented by Adv. Shri Sahish

Mahambrey.

Employer/Party-II absent, marked an Ex-parte.

Panaji, Dated: 30-05-2022

A W A R D

1. In exercise of the powers conferred by Clause

(c) of sub-section (1) of Section 10 of the Industrial

Disputes Act, 1947 (Central Act 14 of 1947) the

Government of Goa, by Order dated 08-09-2020,

bearing No. 28/17/2020-LAB/949 referred the

following dispute for adjudication to this Labour

Court-II of Goa at Panaji, Goa.

“(1) Whether the action of the management of

M/s. Streamline Shipping, 4th floor, Kosambi Bldg.,

Vasco-da-Gama, Goa in refusing employment to

Shri Krishna R. Kalangutkar, Sailor, with effect from

01-11-2017, is legal and justified?

(3) If not, what relief the Workman is entitled to?”

2. On receipt of the reference, a case was

registered under No. LC-II/ IT/08/2020 and registered

A/D notice was issued to the Parties. In pursuance to

the said notice, the Workman/Party-I (for short

‘Workman’) put in his appearance. On the contrary,

the Employer did not appear before this Court on the

scheduled dates of hearings, though duly served.

This Court marked an ex-parte order against the

Employer, after giving several opportunities to them

and an ex-parte proceedings were conducted.

3. The Workman filed his Statement of Claim on

01-02-2021 at Exb-4. The facts of the case in brief as

pleaded by the Workman are that he was appointed

as a ‘Sailor’ by the Employer/Party II (for short,

“Employer”) having its office at Fourth floor, Kosambi

Building, Vasco-da-Gama, Goa. He stated that he was

in the employment of the Employer continuously from

13-05-2011 till 31-12-2018. He stated that the Employer

restrained and prohibited him from reporting duties

w.e.f. August, 2018 without any cause or reason,

though he was willing to work. He stated that he

requested the management repeatedly not to remove

him from services. He stated that aggrieved by the

decision of the Employer in refusing him employment

w.e.f. 01-11-2017, he raised the dispute before the

Asstt. Labour Commissioner through the Goa Trade

and Commercial Workers Union. He stated that the

dispute was taken for adjudication on 23-07-2018. He

stated that after receiving the notice of the Asstt.

Labour Commissioner, the Employer immediately

called him and reinstated him in service on

16-07-2018. He stated that thereafter the Employer

filed its reply dated 20-07-2018 before the Assistant

Regional Commissioner (Central) stating that he has

been employed by them and the matter was

adjourned to 08-08-2018. He stated that the Employer

sent a letter dated 03-08-2018 to the Regional Labour

Commissioner (Central) falsely alleging that there

was a full and final settlement arrived between them

with the Workman on the grounds of resignation. He

stated that subsequently on 09-08-2018, the Employer

in spite of fully knowing the fact that the said

settlement was refused by him which was done

assuming his resignation from services and

forwarded the demand draft dated 30-07-2018 of

Rs. 31,500/- towards full and final settlement to him

without any details. He stated that thereafter the

matter was posted on 16-08-2018 and on 31-12-2018

an order was passed that the issue has been settled

by paying the Workman an amount of Rs. 31,500/-

towards his full and final settlement. He stated that

in spite of the letter sent by him to the Employer that

the said demand draft was not cleared on account of

expiry of the period. He stated that thereafter a letter

dated 9-08-2018 along with a demand draft of

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

21ST JULY, 2022

1679

Rs. 31,500/- dated 30-07-2018 was sent to him by the

Employer for full and final settlement of his dues and

his resignation from the Employer’s Company. He

stated that no such settlement was agreed by him

and thereafter an order was passed by the Assistant

Regional Commissioner stating that he has been paid

Rs. 31,500/- as full and final settlement. He stated

that thereafter on 26-10-2018, he deposited the said

demand draft dated 30-07-2018 in his account in

Central Bank of India, Satarda branch on 26-10-2018.

He stated that the said demand draft could not be

cleared on account of expiry of the period. He stated

that upon receiving the said memo from the bank

dated 15-11-2018, he immediately sent a letter to the

Employer that the demand draft dated 30-07-2018 of

Rs. 31,500/- is not cleared. He stated that thereafter

by letter dated 27-08-2019, he wrote a letter to the

Assistant Labour Commissioner stating that he was

refused employment by the Employer. He stated that

he was refused the employment by the Employer

illegally without any reason. He stated that an order

dated 31-12-2018 has been partly obtained by

suppression of facts. He stated that he is unemployed

since August, 2018 and that he is the sole bread

earner in his family. The Workman therefore, prayed

that an order of immediate reinstatement in service

with the Employer and for an order of payment of full

wages of Rs. 5,500/- p.m. from the date of removal

from the services till his reinstatement. The Workman

also prayed for an order of payment of Rs. 31,500/- as

back wages as per order dated 31-12-2018.

4. This court framed the following issues on

20-09-2021 at Exb. 6.

1. Whether the Workman/Party I proves that

he was working continuously for the

Employer w.e.f. 13-05-2011 till 01-11-2017?

2. Whether the Workman/Party I proves that

the action of the Employer in terminating

him employment w.e.f. 01-11-2017 is illegal

and unjustified?

3. Whether the Workman/Party-I is entitled to

any relief?

4. What order? What award?

5. My findings to the aforesaid issues are as under:

(a) Issue No.1

:

In the Affirmative.

(b) Issue No. 2

:

In the Negative.

(c) Issue No. 3 and 4

:

As per final order.

6. The Workman filed synopsis of written

arguments. None remained present for the Employer

at the time of final arguments nor filed its synopsis of

written arguments. I have carefully perused the

entire records of the present case including the

synopsis of written submissions made by the

Workman.

REASONS:

To prove his case, the Workman examined himself

and produced on record certain documentary

evidence in support of his oral evidence. The said

evidence adduced by the Workman remained

unchallenged for want of denial.

Issue No. 1:

7. The evidence on record indicates that the

Workman was in continuous employment of the

Employer w.e.f. 01-05-2011 till the alleged refusal of

his employment w.e.f. 01-11-2017 as a Sailor on the

barge of the Employer. Hence, it is held that the

Workman proved that he was working continuously

for the Employer w.e.f. 01-05-2011 till the alleged

refusal of his employment w.e.f. 01-11-2017. The issue

No.1 is therefore answered in the Affirmative.

Issue No. 2:

8. While deciding the issue No.1 hereinabove, I

have discussed and come to the conclusion that

Workman was in continuous employment of the

Employer w.e.f. 01-05-2011 till the alleged refusal of

his employment w.e.f. 01-11-2017.

The Workman alleged and also stated on oath that

he was refused the employment w.e.f. 01-11-2017. The

Workman also stated on oath that he has not signed

any settlement with the Employer as alleged by the

Employer. However, there is nothing on record to

show that the Workman had informed the Employer

that he has not settled the issue of his employment

with the Employer nor produced on record any letter

of protest duly acknowledged by the Employer

stating that he has not signed any settlement nor

returned the demand draft of Rs. 31,500/- issued by

the Employer to him. On the contrary, the evidence

on record indicates that the Employer had issued a

demand draft for an amount of Rs. 31,500/- towards

the alleged full and final settlement as he agreed for

his own resignation. The evidence on record

indicates that the Workman deposited the said

demand draft of Rs. 31,500/- in his Central Bank of

India, Satarda branch on 26-10-2018. The evidence

on record indicates that the said demand draft of

Rs. 31,500/- dated 30-07-2018 has not been cleared

on account of ‘date expired’. It is only after failure to

clear the demand draft of Rs. 31,500/- in his account

in Satarda branch of Central Bank of India, the

Workman raised the dispute before the Assttt. Labour

1680

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

21ST JULY, 2022

Commissioner, Vasco, Goa. The aforesaid act on the

part of the Workman of accepting the said demand

draft of Rs. 31,500/- and depositing the same in his

bank implies that the Workman has accepted the full

and final settlement of his services. Hence, it is held

that the Workman failed to prove that he had been

refused employment by the Employer w.e.f.

01-11-2017 is illegal and unjustified. In the

circumstances, it is held that the action of the

Employer in allegedly refusing employment to the

Workman w.e.f. 01-11-2017 is legal and justified. The

issue No. 2 is therefore answered in the Negative.

Issue No. 3:

9. The Employer has issued a demand draft for an

amount of Rs. 31,500/- towards the full and final

settlement as he agreed for the resignation of

services. The evidence on record indicates that the

Workman deposited the said demand draft of

Rs. 31,500/- in his Central Bank of India, Satarda

branch on 26-10-2018. The evidence on record

indicates that the said demand draft of Rs. 31,500/-

dated 30-07-2018 has not been cleared on account of

‘date expired’. In fact, the demand draft deposited

by the Workman was within time limit. The Workman

is therefore entitled for an amount of Rs. 31,500/- along

with interest @ 10% p.a. from the date stated on the

said demand draft till actual realization/payment

by the employer through issue of a new valid

instrument of payment.

In view of above, I pass the following order:

O R D E R

1.

It is held that the action of the management

of M/s. Streamline Shipping, 4th floor,

Kosambi Bldg., Vasco-da-Gama, Goa in

refusing employment to Shri Krishna R.

Kalangutkar, Sailor, with effect from

01-11-2017, is legal and justified.

2.

The Employer, M/s. Streamline Shipping,

Vasco-da-Gama, Goa, is hereby directed to

pay to the Workman, Shri Krishna R.

Kalangutkar an amount of Rs. 31,500/- along

with interest @ 10% p.a. from the date of its

maturity till its actual realization.

3.

No Order as to Cost.

Inform the Government accordingly.

(c) of sub-section (1) of Section 10 of the Industrial

Central Government Industrial Tribunal & Labour

1684

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 16

21ST JULY, 2022

Court & ors., reported in 2007 II CLR 685, the

Hon’ble High Court of Rajasthan by referring the

judgment of Hon’ble Apex Court in the case of

Virendra Bhandri V/s Rajasthan State Road

Corporation Ltd. & ors., reported in (2002) 9 SCC

observed as under:

“…..a reference of certain Industrial Dispute was

made to the Industrial Tribunal -cum-Labour Court.

The workman did not appear before the Tribunal,

therefore, Tribunal held that there remains no

Industrial Dispute. However, subsequently, the

Appropriate Government again referred the dispute

to the Tribunal on the same question and on this

occasion, the Tribunal adjudicated the matter and

made an award. The High Court held that the

finding recorded by the Tribunal in the first

reference amounted to an “award” and, therefore,

second reference was incompetent. The Hon’ble

Apex Court held that all that was stated was that

the parties concerned had not appeared before the

Tribunal and in such an event, the Tribunal should

have noted its inability to record the finding on the

issue referred to it, not that the dispute itself does

not exist. When there is no adjudication of the

matter on merits, it cannot be said that the industrial

dispute does not exist. If the industrial dispute still

exists as is opined by the Government, such a

matter can be referred under Section 10 of the I.D.

Act, as Industrial Disputes are preferred to the

Labour Court or the Industrial Tribunal for

maintenance of industrial peace and not merely for

adjudication of the dispute between two private

parties. Therefore, it was permissible for the

Government to have made the second reference.

……”.

The principle laid down by the Hon’ble High

Court in its aforesaid judgment binds a precedent

upon me.

5. Applying the law laid down by the Hon’ble

High Court in its aforesaid judgment, in the case in

hand, no pleadings have been filed by the Workman

as well as Employer before this court and as such I

am unable to record the findings on the issue referred

to me.

In the circumstances, I pass the following order:

ORDER

1. It is hereby held that this court is unable to

record the finding on the issue referred by the

Appropriate Government.

2. No order as to costs.
