5TH JANUARY, 2023

Before the Goa Human Rights Commission

Proceeding No. 251/2021.

Mr. Rosario Francis Fernandes,

R/o 542, Podwal, Corjuvem,

Aldona, Bardez-Goa

…… Complainant.

V/s

The Deputy Collector,

Mapusa, Bardez-Goa

.....… Respondent.

INQUIRY REPORT

(11th August, 2022)

The complaint dated 17-12-2021 was received

from the Complainant that action was not being

taken by the Respondent on his application dated

03-04-2017, for partitioning of his property under

Survey No. 122/7 in village Corjuem.

2. On perusing the complaint, the Commission

by Order dated 21-03-2022, called for the report

from the Respondent.

3. The Respondent filed their reply on

22-06-2022.

4. At the stage of hearing, the Complainant and

the Respondent remained absent.

5. The Commission has perused the complaint

and the reply of the Respondent.

6. The grievance of the Complainant is that

though he had filed for partitioning of his property

by application dated 03-04-2017, in the office of

the Respondent, till date, the partitioning has not

been done.

7. The reply of the Respondent indicates that the

application for partitioning of the property was

registered as Case No. 15/256/2016/PART/LAND/II

and after following due procedure under the Land

Revenue Code, 1968, the matter was referred to the

Inspector of Survey & Land Records, City Survey,

Mapusa, Bardez-Goa, for inspection and report vide

order dated 08-05-2018. Further, the Respondent

stated that by letter dated 24-07-2018, the Inspector,

Survey & Land Records, City Survey, Mapusa,

Bardez-Goa, had submitted his report along with

the site plan area adjustment report but the said

report was objected by one of the Respondents in

the matter. Accordingly, the Respondent by

Memorandum dated 22-03-2022, referred the matter

back again to the Inspector of Survey & Land

Records, City Survey, Mapusa, Bardez-Goa, for

re-survey of the partitioned plot as per the sale

deed of the said plot and to submit fresh report for

confirmation of partition.

8. The Respondent also stated that the report is

awaited from the Inspector of Survey & Land

Records, City Survey, Mapusa, Bardez-Goa and the

matter is pending before the Inspector of Survey &

Land Records, City Survey, Mapusa, Bardez-Goa, for

re-survey of the property.

9. In the facts of the present case, the Commission

finds that there has been negligence of duties of

the Respondent resulting in violation of human

rights of the Complainant, as the matter has

remained pending since 2017 and no satisfactory

explanation has been put forward by the

Respondent.

10. The Commission recommends that the

Respondent expedite the partitioning proceedings

of the Complainant and ensure the finalization of

the same.

11. Under Section 18(e) of the Protection of

Human Rights Act, 1993, the Commission shall send

a copy of the Inquiry Report together with its

recommendations to the concerned Government or

authority and they shall, within a period of one

month or such further time as the Commission may

allow, forward its comments on the report, including

the action taken or proposed to be taken, to the

Commission.

12. Copy of the Inquiry Report be sent to the

Respondent, calling for their comments, including

the action taken or proposed to be taken within a

period of 60 days or on or before 11-10-2022, in

terms of Section 18(e) of the Protection of Human

Rights Act, 1993.
