Goa is an important Tourist destination and

attracts many events and event organisers.

Such events promote tourism and attract

tourists of various categories to the State. In

order to facilitate clearances for such tourism

related events, lay down guidelines

procedures and standards for organizing

events and to accord approval and permission

for the Major Events in the State, the State

Government had constituted a State Level

Permissions Committee (SLPC) under the

Chairmanship Principal Secretary/Secretary

(Tourism) vide order No. 7/5(58)2012/DT/2051

dated 04-12-2012.

After the formation of the Goa Tourism

Board (GTB), the SLPC has been dissolved,

and all the functions/activities of the said

committee has been taken over by the Board.

The Empowered Committee of New Tourism

Services/Event permissions in its meeting

held on 07-10-2022, proposed to review the

fee structure for the “Major Events” and the

Government has approved the proposal to

consider the proposed revision in fee

structure.

The Chief Engineer (WRD) in the capacity

of Enlistment Authority for Water Resources

Department, in terms of powers vested under

rule-29 of Enlistment Rules–2020 hereby

decides to amend the para 1 of rule 3.2 of the

said rules for the purpose of this department

by extending the last date for migrating from

old Enlistment Rules–2004 to new Enlistment

Rules-2020 up to 30-06-2023. Till then, all

un-migrated class IA, migrated class IA, fresh

class IAA & fresh class IAA (super)

contractors will be entitled to avail unlimited

tendering limit in this department.

This amendment is applicable w.e.f.

01-10-2022.

SCHEDULE

MORMUGAO PORT AUTHORITY (MEETINGS OF

BOARD, ITS POWERS AND TRANSACTION OF

BUSINESS) REGULATIONS, 2023

In exercise of the powers conferred by

sub-section (2) (a) and (b) of Section 72 read with

Section 13 and 14 of the Major Port Authorities Act,

2021 and in supersession of the Major Port Trusts

(Procedure at Board Meetings) Rules, 1981, the

Board of Major Port Authority for Mormugao Port

hereby makes the following Regulations, namely:—

1. Short title and commencement.— (1) These

Regulations may be called the Mormugao Port

Authority (Meetings of Board, its Powers and

Transaction of Business) Regulations, 2023.

(2) They shall come into force on the date of

their publication in the Official Gazette.

2. Application.— These Regulations shall apply

to Major Port Authority for Mormugao Port.

3. Definitions.— (1) In these Regulations, unless

the context otherwise requires,

(2) “Act” means the Major Port Authorities Act,

2021;

(3) “Board” shall have the meaning assigned to

it in the Act;

(4) “Chairperson” means the Chairperson of the

Board under clause (a) of sub-section (1) of section

3 of the Act;

(5) “Committee” means every committee of the

Members and any other person constituted by the

Board pursuant to the provisions of sub-section (1)

of section 14 of the Act;

(6) “Deputy Chairperson” means the Deputy

Chairperson of the Board under clause (b) of

sub-section (1) of section 3 of the Act;

(7) “Designated Officer” means any officer of

Major Port Authority for Mormugao Port entrusted

by the Board with the duty and responsibility of

issuance of notice, circulation of agenda, recording,

circulation and safe keeping of minutes of the

meetings of the Board of Major Port Authority for

Mormugao Port or any Committee thereof;

(8) “Member” in reference to these Regulations,

means the Member of the Board under clauses (c),

(d), (e) and (f) of sub-section (1) of section 3 of the

Act and includes the Chairperson and Deputy

Chairperson;

(9) “Section” means the section of the Act;

(10) Words and expressions used and not

defined in these Regulations but defined in the

Act, shall have the same meanings respectively

assigned to them in the Act.

4. Frequency, Date and Venue of Board meetings.—

(1) The Board of Major Port Authority for Mormugao

Port shall hold its first meeting within thirty days

of the date of its constitution and thereafter hold a

minimum number of four meetings every financial

year in such a manner that not more than one

hundred and twenty days shall intervene between

two consecutive meetings of the Board.

(2) The Board of Major Port Authority for

Mormugao Port shall from time to time determine,

the date and time of its meetings:

Provided that where the Board is unable to do so

for any reason, the Chairperson and in his/her

absence the Deputy Chairperson or such other

person authorised by the Central Government may

do so, for reasons to be recorded in writing.

(3) The meetings of the Board of Major Port

Authority for Mormugao Port shall be held at their

respective port premises, except where the Board

in advance decides to hold any meeting at any

other place for reasons to be recorded in writing.

The meetings may also be held through circulation

of agenda.

5. Circulation of Agenda and manner of

participation.— (1) A meeting of the Board shall be

called by giving not less than three days’ notice in

writing to every Member at the address provided

by such Member and such notice along with the

proposed agenda and all the relevant material for

the meeting shall be sent by the Designated Officer

by hand delivery or by post or by electronic means:

Provided that a meeting of the Board may be

called at shorter notice to transact urgent business

subject to the condition that the Member appointed

under clause (e) of sub-section (1) of section (3) of

the Act shall be present at the meeting.

Provided further that in case of absence of

Member appointed under clause (e) of sub-section

(1) of section (3) of the Act from any meeting of the

Board, the decisions taken in such meeting shall

attain finality through the confirmation in the next

meeting of the Board.

(2) The notice of the meeting under sub-

regulation (1) shall inform the Members regarding

the option available to them to participate through

video conferencing mode or other audio visual

means, and shall provide all the necessary

information to enable the Members to participate

through video conferencing mode or other audio

visual means.

6. Conduct of Meetings of Board.— (1) The

meeting of the Board shall be presided by

Chairperson and if he/she is unable to attend the

meeting, the Deputy Chairperson and in the

absence of such Deputy Chairperson any other

member chosen by Members present among

themselves at the meeting or any person authorized

by the Central Government.

(2) The participation of Members in a meeting of

the Board may be either in person or through video

conferencing or other audio visual means, which

are capable of recording and recognising the

participation of the Members and of recording and

storing the proceedings of such meetings along

with date and time.

(3) At the commencement of the Board meeting,

a roll call shall be taken by the Chairperson or the

person presiding the Board meeting when every

Member participating through video conferencing

or other audio visual means shall state, for the

record, the following namely:—

(a) name;

(b) the location from where he/she is

participating;

all the relevant material for the meeting; and

(d) that no one other than the concerned

Member is attending or having access to the

proceedings of the meeting at the location

mentioned in clause (b).

(4) (a) After the roll call, the Chairperson or the

person presiding the Board meeting, as the case

may be, shall inform the Board about the names of

persons other than the Members who are present

for the said meeting at the request or with the

permission of the Chairperson or the person

presiding the Board meeting and confirm that the

required quorum is complete in accordance with

the provisions of sub-regulation (1) of regulation 7.

(b) The Chairperson or the person presiding the

Board meeting shall ensure that the required

quorum is present throughout the meeting.

(5) The Members of the Board present in the

meeting may, with the prior consent of the

Chairperson or any other person presiding such

meeting, consider and discuss additional items in

the meeting which were not previously notified in

the agenda circulated under sub-regulation (1) of

regulation 5.

(6) The Board or the Designated Officer in this

behalf shall take due and reasonable care –

(a) the notice of the Board meeting shall be

sent to all the Members in the manner stipulated

under sub-regulation (1) of regulation 5;

(b) to record proceedings and prepare the

minutes of the meeting.

(7) The statutory and other records which are

required to be placed in the Board meeting as per

the provisions of the Act shall be placed at the

scheduled venue of the meeting and the same shall

be deemed to have been accepted by the Members

participating through electronic mode, if they have

given their consent to this effect and it is so

recorded in the minutes of the meeting.

(8) (a) Every participant shall identify himself for

the record before speaking on any item of business

on the agenda.

(b) If a statement of a Member in the meeting

through video conferencing or other audio visual

means is interrupted or garbled, the Chairperson or

the person presiding the Board meeting shall

request for a repeat or reiteration by the Member.

(9) If a motion is objected to and there is a need

to put the said agenda item to vote, the Chairperson

or the person presiding the Board meeting shall

call the roll and note the vote of each Member who

shall identify himself while casting his/her vote.

(10) From the commencement of the Board

meeting and until the conclusion of such meeting,

no person, other than the Chairperson or the person

presiding the Board meeting, Members and any

other person whose presence is required by the

Board, shall be allowed access to the place where

any Member is attending the meeting either

physically or through video conferencing without

the permission of the Board.

(11) At the end of discussion on each agenda

item, the Chairperson or the person presiding the

Board meeting shall announce the summary of the

decision taken on such item along with names of

the Members, if any, who dissented from the

decision taken by majority.

(12) The Board of Major Port Authority for

Mormugao Port may observe secretarial standards

save and except those contrary to these Regulations

with respect to the Board meetings specified by

the Institute of Company Secretaries of India

constituted under Section 3 of the Company

Secretaries Act, 1980.

7. Quorum for meetings of the Board.— (1) The

quorum for any meeting of the Board of Major Port

Authority for Mormugao Port shall be one-third of

its total strength at the time of such meeting or

four Members, whichever is higher and the

participation of the Members by video conferencing

or by other audio visual means shall also be counted

for the purposes of quorum under this sub-

regulation, unless he/she is to be excluded for any

items of business under any provisions of the Act.

Explanation: For the purposes of this

regulation,-

(i)

any fraction of a number shall be

rounded off as one;

(ii)

“total strength” means the total

number of members appointed as

Members of the Board from time to time

and shall not include Members whose

places are vacant.

(2) The norm adopted by the Board of Major Port

Authority for Mormugao Port for the purposes of

quorum under sub-regulation (1) shall include-

(a) permissibility to allow participation of the

Members in the Board meeting by video

conferencing or by other audio visual means;

and

(b) provision for automatic adjournment where

a meeting of the Board could not be held for

want of quorum, to such date as may be

determined by the Members of the Board present

and the notice of such adjournment shall be

given to all Members and the business which

was to have been brought before the original

meeting, had there been a proper quorum, shall

be brought before the adjourned meeting. Where

at the adjourned meeting also, if the required

quorum is not present, then the Members

present, shall constitute the quorum; and

Member from any particular Board meeting to be

approved by the Chairperson or the presiding

member of the Board meeting.

8. Passing of resolution by circulation.— (1) No

resolution shall be deemed to have been duly

passed by the Board by circulation, unless the

resolution has been circulated in draft, together

with the necessary papers, if any, to all the Members

of the Board at the addresses provided by such

Member by hand delivery or by post or by courier,

or by electronic means and has been approved by

a majority of the Members, who are entitled to vote

on the resolution:

Provided that, where not less than half of the

total number of Members of the Board for the time

being require that any resolution under circulation

must be decided at a meeting, the Chairperson or

in his/her absence the Deputy Chairperson of the

Board or any other member chosen by Members

present among themselves at the meeting or such

other person authorised by the Central Government

shall put the resolution to be decided at a meeting

of the Board.

(2) For the purpose of sub-regulation (1), every

Member shall be required to give his/her vote of

affirmation or denial to the resolution circulated in

writing within three working days of receipt. Failure

by any Member to submit his/her vote shall be

presumed as approval to the resolution circulated.

(3) A resolution passed under sub-regulation (1)

shall be confirmed at a subsequent meeting of the

Board and made part of the minutes of such meeting.

9. Expeditious disposal by Board.— All questions

at a meeting of the Board shall be-

(a) dealt with as expeditiously as possible and

the Board shall dispose of the same within a

period of sixty days from the date of its

presentation before the Board:

Provided that where any such question could

not be disposed of by the Board within the period

specified in sub-regulation (a), the Board shall

record the reasons in writing for not disposing of

the same within the period so specified and the

Chairperson or any other person presiding at

such meeting may, after taking into account the

reasons so recorded, extend the period referred

to in sub-regulation (a) by such period not

exceeding ninety days as the Chairperson or

such person may consider necessary;

(b) decided by a majority of votes by the

Members present and voting and in the case of

equality of votes, the Chairperson or in his/her

absence, the person presiding the Board meeting

shall have a second or casting vote.

10. Meetings of Board through video conferencing

or other audio visual means.— The Board of Major

Port Authority for Mormugao Port shall comply with

the following procedure for convening and

conducting the Board meetings through video

conferencing or other audio visual means.

(1) The Major Port Authority for Mormugao

Port shall make necessary arrangements to avoid

failure of video or audio visual connection.

(2) The Board or the Designated Officer shall

take due and reasonable care–

(a) to safeguard the integrity of the Board

meeting by ensuring sufficient security and

identification procedures;

(b) to ensure availability of proper and

appropriate video conferencing or other

audiovisual equipment or facilities for

providing transmission of the communications

for effective participation of the Members and

other authorised participants at the Board

meeting;

tape recording(s) or other electronic recording

mechanism as part of the records of the Board of

Major Port Authority for Mormugao Port at least

upto the time of completion of audit of that

particular financial year;

(d) to ensure that no person other than the

concerned Member are attending or have access

to the proceedings of the Board meeting through

video conferencing mode or other audio visual

means; and

(e) to ensure that participants attending the

Board meeting through audio visual means are

able to hear and see the other participants clearly

during the course of the meeting:

Provided that the persons, who are differently

abled, may make request to the Chairperson and

in his/her absence to the Deputy Chairperson to

allow a person to accompany him.

(3) (a) A Member intending to participate

through video conferencing or audio visual

means shall communicate his/her intention to

the Chairperson at least two days in advance so

that the Board is able to make suitable

arrangements in this behalf.

(b) In the absence of any intimation under

clause (a), it shall be assumed that the Member

shall attend the meeting in person.

(4) With respect to every Board meeting

conducted through video conferencing or other

audio visual means, the scheduled venue of the

Board meeting as set forth in the notice

convening the Board meeting shall be deemed

to be the place of the said meeting and all

recordings of the proceedings at the Board

meeting shall be deemed to be made at such

place.

Explanation- For the purposes of this

regulation, “video conferencing or other

audio visual” means audio-visual electronic

communication facility employed which

enables all the persons participating in a

meeting to communicate concurrently with

each other without an intermediary and to

participate effectively in the meeting.

11. Honorarium for attending Board meetings.—

(1) The Chairperson, Deputy Chairperson and

Members appointed under clause (c), (e) and (f) of

sub-section (1) of section 3 of the Act shall not be

entitled to any sitting fees or honorarium for

attending meetings of the Board.

(2) The honorarium payable to the Independent

Members for attending meetings of the Board shall

be at such rate as may be fixed by the Central

Government from time to time in this behalf.

12. Powers of Board.— (1) In furtherance to the

powers specified under the Act, the following

powers shall also be exercised by the Board of Major

Port Authority for Mormugao Port:

(a) to take note of the appointment or removal

of any person to or in the office of the

Chairperson, Deputy Chairperson and other

Member of the Board;

(b) to take note of appointment or removal of

Major Port Authority for Mormugao Port’s staff

and employees;

annual financial statements or financial results,

as the case may be;

(d) to archive the records of the Board meetings

after such time and in such manner as the Board

may deem fit;

(e) to make regulations to provide for any

other matter in connection with the

administration or operations of Major Port

Authority for Mormugao Port including but not

limited to the following:-

(i) stipulating the term, amount,

denomination of and the form and manner in

which, and the conditions subject to which

the port securities can be issued and

transferred;

(ii) the power of one or two or more joint

holders of any port security to grant receipts

for any interest payable in respect of such

security;

(iii) the person, if any, authorised to sign,

the manner in which his/her signature may

be impressed and the mode of affixing the

corporate seal and of attestation of documents

relating to port securities issued or to be

issued by Major Port Authority for Mormugao

Port;

(iv) the manner in which payment of

interest in respect of port securities is to be

made, recorded and acknowledged;

(v) the circumstances, manner, conditions

and fee subject to which port securities may

be renewed before further payment of interest

thereon can be claimed or otherwise;

(vi) the circumstances, manner, conditions

and fee subject to which the duplicate port

securities may be issued by Major Port

Authority for Mormugao Port in case of loss,

theft or destruction of such securities and the

proof of which is to be produced by a person

applying for duplicate securities;

(vii) the nature and amount of indemnity to

be given by a person applying for the payment

of interest on port securities alleged to have

been wholly or partly lost, stolen or destroyed,

or for the issue of duplicate port securities;

(viii) the conversion, consolidation or sub-

division of port securities issued by Major Port

Authority for Mormugao Port, the conditions

and the fee subject to which such port

securities may be converted, consolidated or

sub-divided and the issuance of new security

or securities in lieu thereof; and

(ix) generally, all matters connected with

the grant of duplicate, renewed, converted,

consolidated and sub-divided securities.

(x) the appointment, promotion, transfer,

deputation, retirement, suspension, reduction

in rank, compulsory retirement, removal,

dismissal of employees of the Major Port

Authority for Mormugao Port; and the sanction

of pay and allowances, leaves, pensions,

gratuities, compassionate allowances,

advances, and all other terms and conditions

of service of employees of the Major Port

Authority for Mormugao Port.

13. Disclosure by a Member of his/her interest.—

(1) Every Member of the Board who becomes

concerned or interested, whether financially or

otherwise, which concern or interest is likely to

affect prejudicially his/her functions as such

Member, shall disclose his/her concern or interest

to the Board forthwith when he/she becomes

concerned or interested or at the first meeting of

the Board held after he/she becomes so concerned

or interested and resign forthwith.

(2) Where a Member is subject to an inquiry

under section 5(2) of the Act or has resigned due

to any conflict of interest or has made a disclosure

of any such interest in respect of any agenda to be

taken up in the Board meeting, such Member shall

abstain from participating and voting in the Board

Meeting until the resignation stands accepted by

the Central Government in accordance with section

8 of the Act or the conclusion of the enquiry under

section 5(2) of the Act.

14.

Minutes of proceedings of meeting of Board

of Port Authority.— (1) The Board of Major Port

Authority for Mormugao Port shall cause minutes

of the proceedings of every meeting of the Board,

to be prepared, signed and kept at the principal

office of the Major Port Authority for Mormugao

Port within thirty days of the conclusion of every

such meeting.

(2) The minutes of proceedings of the meetings

of the Board may also be kept by way of micro films

or any other authentic modern means or electronic

form of safe storing and retrieval of records or printed

material produced by a computer, if the same is

recognised under any law and subject to the

conditions, restrictions or safeguards mentioned in

such law.

(3) The minutes of each meeting shall contain a

fair and correct summary of the proceedings thereat.

(4) The minutes shall disclose the particulars of

the Members who attended the meeting through

video conferencing or other audio-visual means.

(5) The minutes shall also contain–

(a) the names of the Members present at

the meeting; and

(b) in the case of each decision passed at

the meeting, the names of the Members, if

any, dissenting from, or not concurring with

the decision.

(6) There shall not be included in the minutes,

any matter which, in the opinion of the

Chairperson or the person presiding the Board

meeting–

(a) is or could reasonably be regarded as

defamatory of any person; or

(b) is irrelevant or immaterial to the

proceedings; or

(7) The Chairperson or the person presiding

the Board meeting shall exercise absolute

discretion in regard to the inclusion or non-

inclusion of any matter in the minutes on the

grounds specified in sub-regulation (6).

(8) The Designated Officer shall circulate draft

minutes of the Board meeting among all the

Members within fifteen days of the meeting

either in writing or in electronic mode for the

comments by the Members. Every Member shall

confirm or give his/her comments in writing

about the proceedings of that particular meeting

in the draft minutes, within ten days, after receipt

of the draft minutes failing which his/her

approval shall be presumed.

(9) The minutes kept in accordance with the

provisions of this regulation shall be evidence of

the proceedings recorded therein and shall be

duly authenticated with signatures of the

Chairperson.

(10) Where the minutes have been kept in

accordance with sub-regulation (1) then, until

the contrary is proved, the meeting shall be

deemed to have been duly called and held, and

all proceedings thereat to have duly taken place,

and the decisions to have been duly passed.

(11) Only the matters required by this

regulation are to be contained in the minutes of

the proceedings of a meeting. If the Board of

Major Port Authority for Mormugao Port has

agreed to cause the record of any meeting to be

reported circulated or advertised, then the

reporting, circulation or advertisement shall be

done at the expense of the Major Port Authority

for Mormugao Port.

15. Invitees at meeting.— Any person, whose

presence at a Board meeting is desired for his/her

advice or consultation, may be invited to attend

the meeting by the Chairperson or the person

presiding the Board meeting.

16. Miscellaneous provisions.— (1) The provisions

of these Regulations shall apply mutatis mutandis

to meetings of Committees of Members save and

except the provisions of the quorum. The Board

will stipulate the quorum requirements for meetings

of each committee at the time of appointing the

particular committee.

(2) The Chairperson or in his/her absence the

Deputy Chairperson of the Board may attend any

Committee meeting as ex officio member and

whenever the Chairperson or Deputy Chairperson

attends any Committee meeting, he/she shall

preside over that meeting.

(3) No Member, other than the Chairperson or a

person specifically authorized by him, shall give

information to the press or any other public media

on matters related to the working of Major Port

Authority for Mormugao Port and decision taken at

the Board or Committee meetings.

(2) (क) और (ख) %वारा दत शि*तय+ का योग करते हुए तथा महापतन 0यास (मंडल बैठक+ म6

78या) नयम,1981 का अ ध8मण करते हुए मुरगांव पतन, महापतन ा धकरण का मंडल इसके

%वारा न<न=ल>खत ?वनयम बनाता है, यथा:-

1. सं234त नाम और ारंभ–

(1) इन ?वनयम+ को “मुरगांव पतन ा धकरण (मंडल क बैठक6 , इनक शि*तयां और कारोबार का

लेन-देन) ?वनयम, 2023” कहा जाए।

(2) ये ?वनयम सरकारE राजपF म6 उनके काशन क तारEख से लागू ह+गे।

2. लागू होना- ये ?वनयम महापतन ा धकरण के अधीन मुरगांव पतन के =लए लागू ह+गे।

3. प8रभाषाएं–

(1) इन ?वनयम+ म6 जब तक संदभJ म6 अ0यथा अपेKLत न हो-

(2) “अध,नयम” का अथJ महापतन ा धकरण अ धनयम, 2021 है।

(3) “मंडल” का अथJ अ धनयम के अंतगJत नधाJMरत अथJ है।

(4) “अ=य3” का अथJ अ धनयम क धारा 3 क उप-धारा (1) के खंड (क) के तहत मंडल के

अNयL से है।

(5) "स?म,त" का अथJ अ धनयम क धारा 14 क उप-धारा (1) के ावधान+ के अनुसार सदPय+

क येक स=मत और मंडल %वारा गठत कोई अ0य Rयि*त है;

(6) “उपा=य3” का अथJ अ धनयम क धारा 3 क उप-धारा (1) के खंड (ख) के तहत मंडल के

उपाNयL से है।

(7) "ना?मत अधकारA" का अथJ महापतन ा धकरण के अधीन मुरगांव पतन के 7कसी भी

अ धकारE से है, िजसे मंडल %वारा नोटस जारE करने, कायJसूची पMरचा=लत करने, और महापतन

ा धकरण के अधीन मुरगांव पतन के मंडल या उसक 7कसी स=मत क बैठक+ के कायJवृत के

MरकॉYडZग, पMरचालन और उसे सुरKLत रखने क िज<मेदारE स[पी गई है।

(8) इन ?वनयम+ के संदभJ म6 "सदBय" का अथJ अ धनयम क धारा 3 क उप-धारा (1) के खंड

(ग), (घ), (ड.) और (च) के तहत मंडल के सदPय से है और इसम6 अNयL और उपाNयL शा=मल ह^;

(9) "धारा" का अथJ अ धनयम क धारा है।

(10) इन ?वनयम+ म6 योग 7कए गए तथा पMरभा?षत नहEं 7कए गए 7कंतु अ धनयम म6

पMरभा?षत श`द तथा अ=भRयि*तय+ का वहEं अथJ होगा जो उ0ह6 इस अ धनयम म6 दया गया है।

4. मंडल बैठकD क बारंबारता, तारAख और Bथान.-

(1) महापतन ा धकरण के अधीन मुरगांव पतन का मंडल अपनी पहलE बैठक अपने गठन क

तारEख से तीस दन+ के भीतर आयोिजत करेगा और उसके बाद येक ?वतीय वषJ म6 0यूनतम चार

बैठक6 इस तरह से आयोिजत करेगा 7क मंडल क लगातार दो बैठक+ के बीच एक सौ बीस दन+ से

अ धक समय न हो।

(2) महापतन ा धकरण के अधीन मुरगांव पतन का मंडल समय-समय पर अपनी बैठक+ क

तारEख और समय नधाJMरत करेगा:

बशतc 7क जहां मंडल 7कसी भी कारणवश ऐसा करने म6 असमथJ है, वहां अNयL और उनक

अनुपिPथत म6 उपाNयL या क6 e सरकार %वारा अ धकृत कोई अ0य Rयि*त ऐसा कर सकता है, िजसके

=लए =ल>खत fप म6 कारण दजJ करना होगा ।

(3) महापतन ा धकरण के अधीन मुरगांव पतन,मंडल क बैठक6 उनके संबं धत पतन पMरसर म6

आयोिजत क जाएंगी, =सवाय इसके 7क मंडल =ल>खत fप म6 दजJ 7कए जाने वाले कारण+ के =लए

7कसी अ0य Pथान पर भी बैठक आयोिजत करने का नणJय ले सकता है। बैठक6 कायJसूची पMरचालन के

माNयम से भी आयोिजत क जा सकती ह^।

5. कायHसूची का प8रचालन और सहभागता का तरAका.-

(1) मंडल क बैठक येक सदPय को उनके %वारा दए गए पते पर कम से कम तीन दन क

=ल>खत सूचना देकर बुलाई जाएगी और ऐसी सूचना Pता?वत कायJसूची और बैठक के =लए सभी संबंNद

सामgी के साथ ना=मत अ धकारE %वारा हPत सुपुदJगी या डाक %वारा या इले*hॉनक माNयम से भेजी

जाएगी।

बशतc 7क मंडल क बैठक अयावiयक कारोबार के संबंध म6 नणJय लेने के =लए कम नोटस पर

बुलाई जा सकती है, बशतc 7क अ धनयम क धारा (3) क उप-धारा (1) के खंड (ड.) के तहत नयु*त

सदPय बैठक म6 उपिPथत ह+।

बशतc यह भी 7क अ धनयम क धारा (3) क उप-धारा (1) के खंड (ड.) के तहत नयु*त सदPय

मंडल क 7कसी भी बैठक से अनुपिPथत रहने के मामले म6, ऐसी बैठक म6 =लए गए नणJय को, अंतम

fप मंडल क अगलE बैठक म6 पुिjटकरण के माNयम से दया जाएगा।

(2) उप-?वनयम (1) के तहत बैठक क सूचना सदPय+ को वीYडयो कॉ0k6 =संग मोड या अ0य ऑYडयो

?वजुअल माNयम से भाग लेने के =लए उपल`ध ?वकmप के बारे म6 सू चत करेगी, और सभी आवiयक

जानकारE दान करेगी ता7क वीYडयो कॉ0k6 =संग मोड या अ0य ऑYडयो ?वजुअल माNयम से सदPय

बैठक म6 भाग ले सके ।

6. मंडल बैठकD का संचालन

(1) मंडल बैठक क अNयLता अNयL %वारा क जाएगी और यद वे बैठक म6 भाग लेने म6 असमथJ

है, तो उपाNयL, और उपाNयL क अनुपिPथत म6, बैठक म6 उपिPथत सदPय+ %वारा चुना गया कोई

अ0य सदPय या क6 e सरकार %वारा अ धकृत कोई अ0य Rयि*त %वारा बैठक क अNयLता क जाएगी।

(2) मंडल बैठक म6 सदPय+ क सहभा गता या तो Rयि*तगत fप से या वीYडयो कॉ0k6 =संग या अ0य

ऑYडयो ?वजुअल माNयम+ से हो सकती है, िजससे सदPय+ क सहभा गता को दनांक और समय के

साथ MरकॉडJ करने के साथ ऐसी बैठक+ क कायJवाहE को MरकॉडJ और संgहEत 7कया जा सकता है।

(3) मंडल बैठक के ारंभ म6, अNयL या मंडल बैठक क अNयLता करने वाले Rयि*त %वारा एक

रोल कॉल =लया जाएगा, तब वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल माNयम से भाग ले रहा

येक सदPय, MरकॉडJ हेतु, न<न=ल>खत का उmलेख करेगा:-

(क) नाम;

(ख) वह Pथान जहां से वह भाग ले रहा/रहE है;

(ग) यह 7क उ0ह+ने बैठक के =लए कायJसूची और सभी संबंNद सामgी ाoत कर लE है; तथा

(घ) यह 7क खंड (ख) म6 उिmल>खत Pथान पर संबं धत सदPय के अलावा कोई अ0य बैठक म6

भाग नहEं ले रहा है या बैठक क कायJवाहE तक पहुंच नहEं पाएगा ।

(4) (क) रोल कॉल के बाद, अNयL या मंडल बैठक क अNयLता करने वाला Rयि*त, जैसा भी

मामला हो, मंडल को उन सदPय+ के अलावा अ0य Rयि*तय+ के नाम+ के बारे म6 सू चत करेगा जो

अNयL या मंडल बैठक क अNयLता करने वाले Rयि*त क अनुमत से या उनके अनुरोध पर उ*त

बैठक के =लए उपिPथत है और इस बात क पुिjट करेगा 7क ?वनयम 7 के उप-?वनयम (1) के

ावधान+ के अनुसार आवiयक कोरम पूरा हो गया है।

(ख) अNयL या मंडल बैठक क अNयLता करने वाला Rयि*त यह सुनिiचत करेगा 7क बैठक के

दौरान आवiयक कोरम मौजूद है।

(5) बैठक म6 उपिPथत मंडल के सदPय, अNयL या ऐसी बैठक क अNयLता करने वाले 7कसी अ0य

Rयि*त क पूवJ सहमत से, बैठक म6 उन अतMर*त मद+ पर ?वचार और चचाJ कर सकते ह^ िज0ह6

?वनयम 5 उप-?वनयम(1) के तहत पMरचा=लत कायJसूची म6 पहले अ धसू चत नहEं 7कया गया था।

(6) मंडल या इस संबंध म6 ना=मत अ धकारE न<न=ल>खत के संबंध म6 यथो चत और उ चत

सावधानी बरतेगा-

(क) सभी सदPय+ को मंडल बैठक क सूचना ?वनयम 5 के उप-?वनयम (1) म6 नधाJMरत 7कए

अनुसार भेजी जाएगी;

(ख) बैठक कायJवाहE MरकॉडJ करना और बैठक का कायJवृत तैयार करना ।

(7) अ धनयम के ावधान+ के अनुसार मंडल बैठक म6 रखे जाने वाले सां?व धक और अ0य अ=भलेख+

को बैठक के नधाJMरत Pथान पर रखा जाएगा और उ0ह6 इले*hॉनक माNयम से भाग लेने वाले सदPय+

%वारा Pवीकार 7कया गया माना जाएगा, यद उ0ह+ने इसके =लए अपनी सहमत दE है और यह इसी

कार बैठक के कायJवृत म6 दजJ है।

(8) (क) येक सहभागीदार कायJसूची के 7कसी भी कायJ मद पर बोलने से पहले MरकॉडJ के =लए

अपनी पहचान देगा।

(ख) यद वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल माNयम से बैठक म6 7कसी सदPय का बयान

बा धत या pामक है, तो अNयL या मंडल बैठक क अNयLता करने वाला Rयि*त उस सदPय से

अनुरोध करेगा 7क वे अपनी बात को दोहराएं या 7फर से कह6।

(9) यद 7कसी Pताव पर आपित क जाती है और उ*त कायJसूची मद को मतदान के =लए रखने

क आवiयकता होती है, तो अNयL या मंडल बैठक क अNयLता करने वाला Rयि*त येक सदPय

का नाम बुलाएगा और उसके मत को नोट करेगा जो अपना मतदान करते समय Pवयं क पहचान देगा।

(10) मंडल क बैठक के ारंभ से लेकर बैठक समाoत होने तक, अNयL या मंडल बैठक क

अNयLता करने वाले Rयि*त, सदPय+ और 7कसी अ0य Rयि*त के अलावा 7कसी अ0य Rयि*त, िजसक

उपिPथत मंडल %वारा आवiयक है, को मंडल क अनुमत के rबना बैठक म6 या तो यL fप से या

वीYडयो कॉ0k6 =संग के माNयम से, उस Pथान पर जहां अ0य सदPय भाग ले रहे ह^, वहां आने क

अनुमत देगा।

(11) येक कायJसूची मद पर चचाJ के अंत म6, अNयL या मंडल बैठक क अNयLता करने वाला

Rयि*त ऐसे मद पर =लए गए नणJय के सारांश क घोषणा करेगा, साथ हE उन सदPय+ के नाम, यद

कोई हो, घो?षत करेगा जो अ धकांश सदPय+ %वारा =लए गए नणJय से असहमत ह^।

(12) महापतन ा धकरण के अधीन मुरगांव पतन का मंडल स चवीय मानक+ को छोड़कर और

कंपनी स चव अ धनयम, 1980 क धारा 3 के तहत गठत इंPटEuयूट ऑफ कंपनी से8ेटरEज ऑफ

इंYडया %वारा नदJjट मंडल बैठक+ के संबंध म6 इन ?वनयम+ के ?वपरEत उन नयम+ का पालन करेगा।

7. मंडल बैठकD के ?लए कोरम.-

(1) महापतन ा धकरण के अधीन मुरगांव पतन का मंडल 7कसी भी बैठक के =लए कोरम, ऐसी

बैठक के समय इसक कुल संvया का एक तहाई या चार सदPय, जो भी अ धक हो और वीYडयो

कॉ0k6 =संग या अ0य %वारा सदPय+ क भागीदारE इस उप-?वनयम के तहत कोरम के योजन+ के =लए

ऑYडयो ?वज़ुअल साधन+ क भी गणना क जाएगी, जब तक 7क उसे अ धनयम के 7कसी भी ावधान

के तहत कारोबार के 7कसी भी लेन देने से बाहर नहEं 7कया जाता है।

BपKटAकरण: इस ?वनयम के योजन+ के =लए,-

(i) 7कसी संvया के 7कसी अंश को एक के fप म6 पूणाZ7कत 7कया जाएगा;

(ii) "कुल संvया" का अथJ समय-समय पर मंडल के सदPय+ के fप म6 नयु*त सदPय+ क कुल

संvया है और इसम6 वे सदPय शा=मल नहEं ह+गे िजनके Pथान Mर*त ह^।

(2) उप-?वनयम (1) के तहत कोरम के योजन+ के =लए महापतन ा धकरण के अधीन मुरगांव

पतन के मंडल %वारा अपनाए गए मानदंड म6 न<न=ल>खत शा=मल ह+गे--

(क) वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल माNयम+ से मंडल क बैठक म6 सदPय+ को

उपिPथत रहने क अनुमत देना; तथा

(ख) जहां मंडल क बैठक कोरम क कमी के =लए आयोिजत नहEं क जा सकती, वहां Pवत:

Pथगन के =लए ावधान उस तारEख को होगा जो मंडल के सदPय+ %वारा नधाJMरत क जाएगी और

इस तरह के Pथगन क सूचना सभी सदPय+ को दE जाएगी और कारोबार जो मूल बैठक के समL

Pतुत 7कया जाना था, उ चत कोरम होने पर, Pथ गत बैठक के समL लाया जाएगा। जहां Pथ गत

बैठक म6 भी, यद आवiयक कोरम उपिPथत नहEं है, तो उपिPथत सदPय कोरम का गठन कर6गे;

तथा

(ग) 7कसी ?वशेष मंडल बैठक से 7कसी सदPय क अनुपिPथत क छुzी क 78या मंडल बैठक के

अNयL या पीठासीन सदPय %वारा अनुमोदत क जाएगी।

8. प8रचालन Oवारा संकPप पा8रत करना.—

(1) कोई भी संकmप मंडल %वारा पMरचालन %वारा ?व धवत fप से पाMरत नहEं माना जाएगा, जब

तक 7क संकmप ाfप म6, आवiयक कागजात के साथ, यद कोई हो, मंडल के सभी सदPय+ को उनके

%वारा दए गए पते पर हPत सुपुदJगी %वारा या डाक %वारा या कुMरयर %वारा, या इले*hॉनक माNयम

से पMरचा=लत नहEं 7कया जाता है और अ धकांश उन सदPय+ %वारा अनुमोदत न 7कया गया है, जो

संकmप पर वोट देने के हकदार ह^:

बशतc 7क, जहां मंडल के सदPय+ क कुल संvया के आधे से कम सदPय के =लए यह आवiयक न हो

7क 7कसी बैठक म6 पMरचालन के तहत कोई Pताव तय 7कया जाना चाहए, वहां अNयL या उनक

अनुपिPथत म6 मंडल के उपाNयL या बैठक म6 उपिPथत सदPय+ म6 से चुने गए कोई अ0य सदPय या

क6 e सरकार %वारा अ धकृत ऐसे अ0य Rयि*त मंडल क बैठक म6 नणJय लेने के =लए Pताव रख6गे।

(2) उप-?वनयम (1) के योजन के =लए, येक सदPय को Pताव ाoत होने के तीन कायJ दवस+

के भीतर =ल>खत fप म6 पMरचा=लत संकmप के त अपनी पुिjट या अPवीकृत का मत देना होगा।

7कसी भी सदPय %वारा अपना मत Pतुत न करने पर पMरचा=लत संकmप को अनुमोदन के fप म6

माना जाएगा।

(3) उप-?वनयम (1) के तहत पाMरत Pताव क पुिjट मंडल क बाद क बैठक म6 क जाएगी और

इसे क थत बैठक के कायJवृत का हPसा बनाया जाएगा।

9. मंडल Oवारा शीS ,नपटान—

मंडल क बैठक म6 सभी iन इस कार ह+गे-

(क) यथासंभव शी{ता से नपटाया जाएगा और मंडल के समL इसे Pतुत करने क तारEख से

साठ दन+ क अव ध के भीतर मंडल इसका नपटान करेगा:

बशतc 7क जहां इस तरह के 7कसी भी iन का नपटान उप-?वनयम (क) म6 नदJjट अव ध के

भीतर मंडल %वारा नहEं 7कया जा सकता है, वहां मंडल इस कार नदJjट अव ध के भीतर उसका

नपटान न करने के कारण+ को =ल>खत fप म6 दजJ करेगा और अNयL या बैठक क अNयLता करने

वाला कोई अ0य Rयि*त, दजJ 7कए गए कारण+ को Nयान म6 रखते हुए, उप-?वनयम (क) म6 नदJjट

अव ध को न`बे दन+ से अ धक क अव ध तक बढ़ा सकता है, जैसा 7क अNयL या ऐसा Rयि*त

आवiयक समझे;

(ख) उपिPथत और मतदान करने वाले सदPय+ %वारा बहुमत से तय करने और वोट+ क समानता

के मामले म6, अNयL या उनक अनुपिPथत म6, मंडल बैठक क अNयLता करने वाले Rयि*त के

पास दूसरा या नणाJयक मत होगा।

10. वीTडयो कांU ?संग या अVय ऑTडयो +वजुअल मा=यम से मंडल क बैठक .-

महापतन ा धकरण के अधीन मुरगांव पतन का मंडल वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल

माNयम+ से मंडल बैठक आयोिजत करने और संचा=लत करने के =लए न<न=ल>खत 78या का पालन

करेगा:-

(1) महापतन ा धकरण के अधीन मुरगांव पतन, वीYडयो या ऑYडयो ?वजुअल कने*शन ठ~क से

कायJ करने क आवiयक RयवPथा करेगा।

(2) मंडल या ना=मत अ धकारE न<न=ल>खत हेतु उ चत सावधानी बरतेगा-

(क) पयाJoत सुरLा और पहचान 78याओं को सुनिiचत करके मंडल बैठक क सुRयवPथा बनाए

रखना;

(ख) मंडल क बैठक म6 सदPय+ और अ0य अ धकृत तभा गय+ क स78य सहभा गता हेतु

सारण सु?वधा दान करने के =लए उ चत और उपयु*त वीYडयो कॉ0k6 =संग या अ0य ऑYडयो

?वजुअल उपकरण या सु?वधाओं क उपल`धता सुनिiचत करना;

(ग) महापतन ा धकरण के अधीन मुरगांव पतन मंडल के MरकॉडJ के हPसे के fप म6 टेप

MरकॉYडZग (ओं) या अ0य इले*hॉनक MरकॉYडZग तंF को कम से कम उस ?वशेष ?वतीय वषJ के ऑYडट

के पूरा होने के समय तक सुरKLत रखने और चि€नत करने के =लए बनाए रखना;

(घ) यह सुनिiचत करना 7क संबं धत सदPय के अलावा कोई भी Rयि*त वीYडयो कॉ0k6 =संग या

अ0य ऑYडयो ?वजुअल माNयम से मंडल बैठक क कायJवाहE म6 भाग नहEं ले रहा है; तथा

(ङ) यह सुनिiचत करना 7क मंडल क बैठक म6 भाग लेने वाले सहभागी ऑYडयो ?वजुअल

माNयम+ से बैठक के दौरान अ0य सहभा गय+ को Pपjट fप से सुन और देख सकते ह^:

बशतc 7क अLम Rयि*त, अNयL और उनक अनुपिPथत म6 उपाNयL से अनुरोध कर सकते ह^

7क उनके साथ 7कसी अ0य Rयि*त को रहने क अनुमत दE जाए।

(3) (क) वीYडयो कॉ0k6 =संग या ऑYडयो ?वजुअल माNयम से भाग लेने के इ‚छुक सदPय कम से कम

दो दन पहले अNयL को इसक सूचना द6गे ता7क मंडल इस संबंध म6 उपयु*त RयवPथा कर सके।

(ख) खंड (क) के तहत कोई भी सूचना न देने के मामले म6, यह मान =लया जाएगा 7क सदPय

Rयि*तगत fप से बैठक म6 भाग लेगा।

(4) वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल माNयम+ के माNयम से आयोिजत मंडल क येक

बैठक के संबंध म6, मंडल बैठक बुलाने क सूचना म6 उिmल>खत मंडल बैठक का नधाJMरत Pथान माना

जाएगा और मंडल बैठक म6 क गई कायJवाहE क सभी MरकॉYडZग का Pथान माना जाएगा।

BपKटAकरण - इस ?वनयम के योजन+ के =लए, “वीYडयो कॉ0k6 =संग या अ0य ऑYडयो ?वजुअल” का

अथJ है, नयोिजत ऑYडयो-?वजुअल इले*hॉनक संचार सु?वधा िजससे बैठक म6 भाग लेने वाले सभी Rयि*त

rबना 7कसी माNयम के एक दूसरे के साथ समवतƒ fप से संवाद कर सकते है और बैठक म6 भावी fप से

भाग ले सकते है।

11. मंडल क बैठकD म भाग लेने के ?लए मानदेय.-

(1) अ धनयम क धारा 3 क उप-धारा (1) के खंड (ग), (ड.) और (च) के तहत अNयL, उपाNयL

और नयु*त सदPय मंडल क बैठक+ म6 भाग लेने के =लए 7कसी भी बैठक शुmक या मानदेय के हकदार

नहEं ह+गे।

(2) मंडल क बैठक+ म6 भाग लेने के =लए PवतंF सदPय+ को देय मानदेय, इस संबंध म6 क6 e सरकार

%वारा समय-समय पर नयत दर पर होगा ।

12. मंडल क शि#तयां.-

(1) अ धनयम के तहत नदJjट शि*तय+ के 8म म6, महापतन ा धकरण के अधीन मुरगांव पतन

के मंडल %वारा न<न=ल>खत शि*तय+ का भी योग 7कया जाएगा:

(क) मंडल के अNयL, उपाNयL और अ0य सदPय का या उसके कायाJलय म6 7कसी Rयि*त क

नयुि*त या नjकासन पर ?वचार करना;

(ख) महापतन ा धकरण के अधीन मुरगांव पतन के पदा धकाMरय+ और कमJचाMरय+ क नयुि*त

या नjकासन पर ?वचार करना;

(ग) Fैमा=सक, अधJवा?षJक और वा?षJक ?वतीय ?ववर>णय+ या ?वतीय पMरणाम+, जैसा भी मामला

हो, को अनुमोदत करना;

(घ) मंडल क बैठक+ के MरकॉडJ को ऐसे समय तक और इस तरह से बनाए रखना, जैसा 7क मंडल

उ चत समझे;

(ङ) महापतन ा धकरण के अधीन मुरगांव पतन के शासन या चालन के संबंध म6 7कसी

अ0य मामले के ावधान के =लए ?वनयम बनाना, िजसम6 न<न=ल>खत शा=मल हो 7कंतु इन तक

सी=मत न हो:-

(i) पतन तभूतय+ को िजस अव ध, रा=श, मूmयवगJ और िजस fप और तरEके से, और

िजन शत„ के अधीन जारE और PथानांतMरत 7कया जा सकता है, उ0ह6 नधाJMरत करना;

(ii) 7कसी पतन तभूत के एक या दो या अ धक संयु*त धारक+ को ऐसी सुरLा के संबंध म6

देय 7कसी भी `याज के =लए रसीद6 देने क शि*त;

(iii) महापतन ा धकरण के अधीन मुरगांव पतन %वारा जारE या जारE 7कए जानेवाले पतन

तभूतय+ के संबंध म6 हPताLर करने के =लए ा धकृत Rयि*त, यद कोई हो, के हPताLर िजस

तरEके से =लए जा सकते ह^, और कॉप…रेट मुहर लगाने का तरEका और दPतावेज+ का सयापन;

(iv) पतन तभूतय+ के संबंध म6 `याज का भुगतान करने, MरकॉडJ करने और पावती देने का

तरEका;

(v) वह पMरिPथतयां, तरEके, शत‡ और शुmक, िजनके अधीन पतन तभूतय+ का नवीनीकरण,

उस पर `याज का अ धक भुगतान का दावा 7कए जाने या अ0यथा, से पहले 7कया जा सकता है;

(vi) वह पMरिPथतयां, तरEके, शत‡ और शुmक िजसके अधीन ऐसी तभूतय+ के नुकसान, चोरE

या नjट होने के मामले म6 महापतन ा धकरण के अधीन मुरगांव पतन %वारा डुoलEकेट पतन

तभूतयां जारE क जा सकती ह^, और िजसका सबूत उस Rयि*त %वारा Pतुत 7कया जाना है

जो डुoलEकेट तभूतय+ के =लए आवेदन करता है;

(vii) पतन तभूतय+ पर `याज के भुगतान के =लए आवेदन करने वाले Rयि*त %वारा दE

जाने वालE LतपूतJ क कृत और रा=श क थत तौर पर पूणJतया या आं=शक fप से खो जाने,

चोरE हो जाने या नjट हो जाने या डुoलEकेट पतन तभूतय+ को जारE करने के =लए;

(viii) महापतन ा धकरण के अधीन मुरगांव पतन के =लए जारE पतन तभूतय+ का

fपांतरण, समेकन या उप-?वभाजन, शत‡ और शुmक िजसके अधीन ऐसी पतन तभूतय+ को

पMरवतJत, समे7कत या उप-?वभािजत 7कया जा सकता है और इसके बदले म6 नई तभूत या

तभूतयां जारE करना; तथा

(ix) आम तौर पर, डुoलEकेट, नवीकृत, पMरवतJत, समे7कत और उप-?वभािजत तभूतयां जारE

करने संबंधी सभी मामले।

(x) महापतन ा धकरण के अधीन मुरगांव पतन के कमJचाMरय+ क नयुि*त, पदो0नत,

Pथानांतरण, तनयुि*त, सेवानवृित, नलंबन, पदावनती, अनवायJ सेवानवृित, नjकासन,

बखाJPतगी; और मुरगांव पतन के =लए महापतन ा धकरण के कमJचाMरय+ के वेतन और भते,

अवकाश, प6शन, gे‚युटE, अनुकंपा भते, अ gम और अ0य सभी नयम+ और सेवा क शत„ क

मंजूरE।

13. Yकसी सदBय Oवारा अपने Zहत के बारे म कटAकरण.-

(1) मंडल का येक सदPय जो ?वतीय या अ0य fप से संबंNद या हतब‰ हो जाता है, िजसका

हत ऐसे सदPय के fप म6 उसके काय„ को तकूल fप से भा?वत करने क संभावना रखता है, वह

अपने हत या इ‚छुकता को मंडल के सामने तुरंत कट करेगा जब वह हतब‰ या इ‚छुक हो

जाता/जाती है या हतब‰ या इ‚छुक होने के बाद हुई मंडल क पहलE बैठक म6 तुरंत इPतीफा दे

देता/देती है।

(2) जहां अ धनयम क धारा 5(2) के तहत 7कसी सदPय क जांच होती है या हत+ के ?ववाद के

कारण इPतीफा दे दया है या मंडल म6 उठाए जाने वाले 7कसी भी कायJसूची के संबंध म6 ऐसे 7कसी हत

का खुलासा 7कया है, तो ऐसा सदPय मंडल क बैठक म6 तब तक भाग नहEं लेगा और मतदान नहEं

करेगा जब तक 7क अ धनयम क धारा 8 के अनुसार क6 e सरकार %वारा इPतीफा Pवीकार नहEं 7कया

जाता है या अ धनयम क धारा 5(2) के तहत जांच का नतीजा नहEं आता है।

14. पतन ाधकरण के मंडल बैठक क कायHवाहA का कायHवृत.-

(1) महापतन ा धकरण के अधीन मुरगांव पतन का मंडल अपनी येक बैठक क कायJवाहE के

कायJवृत ऐसी येक बैठक के समापन के तीस दन+ के भीतर तैयार कर, हPताLर करेगा और

महापतन ा धकरण के अधीन मुरगांव पतन के मुख कायाJलय म6 रखा जाएगा।

(2) मंडल क बैठक+ क कायJवाहE के कायJवृत को माइ8ो 7फmम या 7कसी अ0य ?वiवसनीय

आधुनक साधन या सुरKLत इले*hॉनक भंडारण के fप म6 और कंoयूटर %वारा न=मJत अ=भलेख+ या

मुeत सामgी क पुन ाJिoत के माNयम से भी रखा जा सकता है, यद वह 7कसी भी कानून के तहत

मा0यता ाoत और ऐसे कानून म6 उिmल>खत शत„, तबंध+ या सुरLा उपाय+ के अधीन है ।

(3) येक बैठक के कायJवृत म6 कायJवाहE का उ चत और सहE सारांश होगा।

(4) कायJवृत म6 वीYडयो कॉ0k6 =संग या अ0य ŠRय-‹iय माNयम+ से बैठक म6 भाग लेने वाले सदPय+

का ?ववरण दया जाएगा ।

(5) कायJवृत म6 न<न=ल>खत भी शा=मल होगा-

(क) बैठक म6 उपिPथत सदPय+ के नाम; तथा

(ख) बैठक म6 पाMरत येक नणJय के मामले म6, उन सदPय+ के नाम, यद कोई हो, जो नणJय

का ?वरोध करता हो या नणJय से असहमत ह^।

(6) कायJवृत म6 ऐसा कोई भी मामला शा=मल नहEं 7कया जाएगा, जो अNयL या मंडल क बैठक क

अNयLता करने वाले Rयि*त क राय म6-

(क) यथो चत fप से 7कसी Rयि*त क मानहान करने वाला माना जाता है या हो सकता है; या

(ख) कायJवाहE के =लए अ ासं गक या सारहEन है; या

(ग) महापतन ा धकरण के अधीन मुरगांव पतन के हत+ के =लए हानकारक है।

(7) अNयL या मंडल बैठक क अNयLता करने वाला Rयि*त उप-?वनयम (6) म6 नदJjट आधार

पर कायJवृत म6 7कसी भी मामले को शा=मल करने या शा=मल न करने के संबंध म6 पूणJ ?ववेका धकार

का योग करेगा।

(8) ना=मत अ धकारE बैठक के पंeह दन+ के भीतर मंडल बैठक का कायJवृत मसौदा सदPय+ क

टoप>णय+ के =लए =ल>खत fप म6 या इले*hॉनक माNयम से सभी सदPय+ के बीच म6 पMरचा=लत

करेगा। येक सदPय मसौदा कायJवृत ाoत होने के दस दन+ के भीतर, उस ?वशेष बैठक क

कायJवाहE के बारे म6 =ल>खत fप म6 अपनी टoपणी क पुिjट करेगा या =ल>खत fप म6 देगा, ऐसा न

होने पर उसक Pवीकृत मान लE जाएगी।

(9) इस ?वनयम के ावधान+ के अनुसार रखे गए कायJवृत उसम6 दजJ क गई कायJवाहE के साŒय

ह+गे और अNयL के हPताLर के साथ ?व धवत मा>णत ह+गे।

(10) जहां उप-?वनयम (1) के अनुसार कायJवृत रखा गया है, तब तक, जब तक 7क इसके ?वपरEत

साrबत न हो जाए, बैठक ?व धवत बुलाई गई और आयोिजत क गई, और उसम6 सभी कायJवाहE

?व धवत fप से हुई होगी और नणJय ?व धवत fप से पाMरत क गई मानी जाएगी ।

(11) बैठक क कायJवाहE के कायJवृत म6 केवल इस ?वनयम %वारा आवiयक मामल+ को शा=मल

7कया जाना है। यद महापतन ा धकरण के अधीन मुरगांव पतन का मंडल 7कसी बैठक के MरकॉडJ को

पMरचा=लत या ?वा?पत करने के =लए सहमत हो गया है, तो MरपोटZग, पMरचालन या ?वापन

महापतन ा धकरण के अधीन मुरगांव पतन %वारा वहन 7कया जाएगा।

15. बैठक म आमं]^त.-

कोई भी Rयि*त, िजसक मंडल क बैठक म6 उपिPथत उसक सलाह या परामशJ के =लए वांछत है,

को अNयL या मंडल क बैठक क अNयLता करने वाले Rयि*त %वारा बैठक म6 भाग लेने के =लए

आमंrFत 7कया जा सकता है।

16. +व+वध ावधान.-

(1) इन ?वनयम+ के ावधान आवiयक पMरवतJन+ सहत सदPय+ क स=मतय+ क बैठक+ म6 कोरम

के ावधान+ को छोड़कर लागू ह+गे। मंडल ?वशेष स=मत क नयुि*त के समय येक स=मत क

बैठक+ के =लए कोरम आवiयकताओं को नधाJMरत करेगा।

(2) अNयL या उनक अनुपिPथत म6 मंडल के उपाNयL पदेन सदPय के fप म6 7कसी भी स=मत

क बैठक म6 भाग ले सकते ह^ और जब भी अNयL या उपाNयL 7कसी स=मत क बैठक म6 भाग लेते

ह^, तो वह उस बैठक क अNयLता कर6गे।

(3) अNयL या उनके %वारा ?वशेष fप से अ धकृत Rयि*त के अलावा कोई भी सदPय, महापतन

ा धकरण के अधीन मुरगांव पतन के कामकाज और मंडल या स=मत क बैठक+ म6 =लए गए नणJय

से संबं धत मामल+ पर ेस या 7कसी अ0य सावJजनक मीYडया को जानकारE नहEं देगा।

Notification

In exercise of the powers conferred under

section 27 (1) – D Imposition of Rates, clause

1 of the Major Port Authorities Act, 2021, the

Board of the Mormugao Port Authority hereby

disposes of the proposal for General Revision

of Scale of Rates. The General Revision Scale

of Rates of Mormugao Port Authority has been

set out in the schedule annexed to this

notification.

Annex - I

MORMUGAO PORT AUTHORITY

SCALE OF RATES

Definitions - General

In this Scale of Rates unless the context

otherwise requires, the following definitions shall

apply:

(i) “Coastal vessel” shall mean any vessel

exclusively employed in trading between any

Port or place in India to any other port or place

in India having a valid coastal license issued

by the Director General of Shipping/Competent

authority.

(ii) “Cold Move” shall mean movement

without the power of the engine of the vessel.

(iii) “Combination Loading” denotes loading

of vessel primarily at berth and then topping-

up in stream.

(iv) “Foreign-going Vessel” shall mean any

vessel other than Coastal vessel.

(v) “Stream Loading” denotes loading of

vessel exclusively at places other than at berths.

(vi) “Vessel Completion Day (VCD)” means

the day on which operation of the vessel is fully

completed. The Day shall be reckoned as from

7:30 a.m. to 7:30 a.m. on the following day.

(vii) “Shut out cargo” shall mean any cargo

brought into the port for shipment but not

shipped by the designated vessel and is lying

in the port premises.

(viii) “Barge” is any craft designed to carry

cargo or passengers on Inland water Transport

so certified by IWAI/State Maritime board/ State

Maritime administration etc. of India.

(ix) “Hazardous-I” shall mean the cargo/

/container classified as hazardous under

International Maritime Organisation (IMO).

General Terms & Conditions

(i) The status of the vessel, as borne out by its

certification by the Customs or the Director

General of Shipping, is the relevant factor to

decide whether vessel is ‘coastal’ or ‘foreign-going’

for the purpose of levy of vessel related charges

and the nature of cargo or its origin will not be of

any relevance for this purpose.

(ii) A. System of classification of vessel for levy

of Vessel Related Charges (VRC).

(a) A foreign going vessel of Indian flag

Indian Port, no further custom conversion is

required, so long as it moves on the Indian

Coast.

(b) A foreign going vessel of foreign flag can

convert to coastal run on the basis of a Licence

for Specified Period or voyage issued by the

Director General of Shipping and a Custom

Conversion order.

B. Criteria for levy of Vessel Related Charges

(VRC) at Concessional Coastal rate and foreign rate

(a) In cases of such conversion, coastal rates

shall be chargeable by the load port from the

time the vessel starts loading coastal goods.

(b) In cases of such conversion coastal rates

shall be chargeable till the vessel completes

discharging operations at the last call of Indian

Port immediately there after, foreign going rates

shall be chargeable by the discharge ports.

(iii) Criteria for levy of Cargo Related Charges

(CRC) at Concessional Coastal rate.

(a) Foreign going Indian Vessel having

General Trading License issued for ‘world wide

and coastal’ operation should be accorded

applicable coastal rates with respect to

Handling Charges (HC) i.e. ship to shore

transfer and transfer from/to quay to/from

storage yard including wharfage in the

following scenario:

(i) Converted to coastal run and carrying

coastal cargo from any Indian Port and

destined for any other Indian Port.

(ii) Not converted* to coastal run but

carrying coastal cargo from any Indian Ports

and destined for any other Indian Port.

* The Central Board of Excise and Customs

Circular No. 15/2002-Cus. dated 25 February,

2002 allows carriage of coastal cargo from

one Indian port to another port in India, in

Indian flag foreign going vessels without any

custom conversion.

(b) In case of a Foreign flag vessel converted

to coastal run on the basis of a License for

specified period or voyage issued by the

Director General of Shipping, and a Custom

Conversion Order, the coastal cargo/container

loaded from any Indian Port and destined for

any other Indian Port should be levied at the

rate applicable for coastal cargo/container.

(iv) (a) Vessel related charges shall be levied on

Ship-owners/Steamer Agents. Wherever rates

have been denominated in US dollar terms, the

charges shall be recovered in Indian Rupees after

conversion of US currency to its equivalent Indian

Rupees at the RBI Reference Rate. The date of entry

of the vessel into the port limit shall be reckoned

with as the day for such conversion.

(b) Container related charges denominated in

US dollar terms shall be collected inequivalent

Indian Rupees. For this purpose, the RBI Reference

Rate prevalent on the date of entry of the vessel in

case of import containers; and on the date of arrival

of the containers in the port premises in

case of export containers shall be applied for

conversion of dollar denominated charges.

(v) (a) Vessels calling the Port, which are

declared as cargo in the Import General Manifest

or Export General Manifest for the purposes of

Customs Act, 1962, shall not be treated as cargo

and no wharfage shall be levied on such vessels,

and only vessel related charges would be

collected if the vessels come into the port on their

steam and sail out of the port limits on their steam.

However, when loading or unloading of cargo/

container takes place to/from such vessel within

the Port limits, cargo/container related charges

including wharfage shall be applicable as per SoR

on such cargo/container, declared in the manifest

(IGM/EGM).

(b) When a vessel carries another vessel as

cargo for discharging in the Port, either on the

quay, jetty or foreshore (wharf), or loads another

vessel as cargo on board itself from such wharf of

the Port, in such cases, such loaded or unloaded

vessels are ‘cargo’, on which cargo related charges

including “wharfage’ are leviable.

(vi) A regular review of exchange rate shall be

made once in thirty days from the date of arrival of

the vessels in cases of vessels staying in the port

for more than thirty days. In such cases, the basis

of billing shall change prospectively with

reference to the appropriate exchange rate

prevailing at the time of the review.

(vii) (a) The vessel related charges for all coastal

vessels should not exceed 60% of the correspon-

ding charges for other vessels.

(b) Cargo/container related charges for all

coastal cargo/containers, other than thermal coal,

POL, including crude oil, iron ore and iron ore

pellets, should not exceed 60% of the normal cargo/

/container related charges.

(d) In case of container related charges, the

concession will be applicable on all the relevant

charges for ship-shore transfer, and transfer from/

(e) In case container/cargo from foreign port

lands at MOPT for subsequent transhipment to

an Indian Port on coastal voyages, 50% of the

transhipment rate prescribed for foreign going and

50% of that prescribed for coastal leg shall be

levied.

(viii) In case of cargo quantity determined by

weighment is more than the quantity declared in

the manifest then all applicable charges such as

wharfage, storage, stevedoring charges etc. will

be collected on the basis of quantity as determined

by weighment.

(ix) (a) The SOR will be automatically indexed

annually to inflation to the extent of 60% of the

variation in the Whole Sale Price Index (WPI) as

communicated by Indian Ports Association (IPA)

or any other Competent Authority decided by the

Government based on the average of monthly

Whole Sale Price Index (WPI) for all commodities

from January to December announced by the

Ministry of Commerce and Industry under the

Government of India.

(b) The Mormugao Port Authority would be

entitled to indexation in tariff at 100% of variation

in WPI as communicated by IPA or any other

Competent Authority decided by the Government

will be applied instead of 60% variation in WPI

prescribed in clause (viii) (a) above, from second

year of tariff fixation on achievement of

performance standards committed by the

Mormugao Port Authority. Such adjustment of SoR

will be made every year and the adjusted SoR will

come into force from 1st May of the relevant year

to 30th April of the following year.

(x) Interest on delayed payments/refunds:

(a) The user shall pay penal interest at the

rate of 15% per annum on delayed payments

under this Scale of Rates. Like wise, the MOPA

shall pay penal interest at the rate of 15% per

annum on delayed refunds.

(b) The delay in refunds will be counted only

20 days from the date of completion of services

or on production of all the documents required

from the users, whichever is later. The refunds

would be processed only after the request for

refund containing all the details is made in

writing.

lower rates and/or allow higher rebates and

discounts.

(b) The Port may also, if they so desire,

rationalise the prescribed conditionalities

governing the application of rates prescribed in

the Scale of Rates if such rationalisation gives

relief to the user in rate per unit and the unit rates

prescribed in the Scale of Rates do not exceed the

ceiling level.

(xv) Guidelines on priority berthing of coastal

vessels at Major Ports issued by the Ministry of

Shipping vide letter No. PT-11033/51/2014-PT

dated 4 September, 2014:

(a) “Coastal vessels” is defined as any vessel

exclusively employed in trading between any

port or place in India to any other port or place

in India having a valid coastal license issued

by the Director General of Shipping/competent

authority.

(b) MOPT shall accord priority berthing, at

least on one berth, to dry bulk/general cargo

coastal vessels to enable shippers to transport

goods from one port in India to another port in

India irrespective of origin and final destination

of the cargo. This would be in addition to

dedicated berth, for handling of Coastal

Thermal Coal already existing in Major Ports, if

any.

(e) Coastal vessels which are be accorded

priority berthing shall not be liable to pay

priority berthing charges.

(f) There will be no restrictions on berthing

of coastal vessel, in addition to the coastal vessel

berthed on priority as above, if the same is

eligible under normal berthing policy of the port.

(g) A coastal vessel shall be liable to pay port

charges on coastal rates notwithstanding

whether it was berthed on priority or otherwise.

(h) Port should explore the possibilities of

earmarking exclusive berth, storage areas and

gates for coastal cargo outside the custom

bonded area of the Ports to further facilitate

movement of coastal cargoes.

(i) Port shall clearly work out the time limit

within which a coastal vessel would be berthed

in a particular port. This time limit may differ

depending on the cargo and berth. Port should

carry out a detailed exercise and issue a trade

notice clearly indicating the upper time limit

within which a coastal vessel would be given a

berth in the port. As regards priority berthing

through a specific window to coastal container

vessels, port should have a detailed discussion

with the PPP operator and publish the specific

window for coastal container vessels. The above

mentioned exercise and publication should be

completed within 30 days from the date of issue

of these guidelines.

(j) The MIS in the Port should capture data

for coastal and foreign vessels cargoes

separately. The data so captured shall be

monitored and reported internally in the port

as well as to IPA and Ministry in separate formal

for coastal and foreign vessels.

(xvi) In order to decongest the ports and

encourage exporters/importers to utilize the port

services beyond regular hours, lower charges may

be levied for cargo and vessels related services as

well as special discount may be offered in port

charges for the services rendered after regular

hours.

dated 3 February, 2016 based on which a

common adoption Order No.TAMP/14/2016-

Misc dated 16 February, 2016 is approved by

at the Port for repairs, shall pay the Port Dues in full, as

provided under 1.1 above.

(v) For oil tankers with segregated ballast, the reduced

gross tonnage that is indicated in the ‘Remarks’ column

of its International Tonnage Certificate will be taken to

be its gross tonnage for the purpose of levy of Port Dues.

(vi) Any vessel coming to the Port for the purpose of

taking bunkers or disembarking of sick crew shall be

charged with only 50% of the Port Dues with which she

would otherwise be chargeable.

1.1.1 CRUISE VESSELS

Ministry of Shipping, GOI has rationalised the

tariff structure for Cruise Vessels as communicated

to all Major Ports vide SM-150112/2/2020-

MG(Cno338503) dated 14-08-2020.The charges

proposed by INCLA have been approved by the

Hon’ble MOC(I/C)

(i) The Port charges for Cruise ship to be charged

at US$ 0.085 per GRT (“Fixed rate”) and $5 per

passenger (“ Head tax”) for the first 12 hours stay.

Port will not charge any other rate like berth hire,

Port dues, pilotage, passenger fees etc.

(ii) For the period exceeding 12 hours stay, the

fixed charges on Cruise Ships will be equal to the

berth hire charges payable as per SoR (with 40%

discount as applicable for Cruise Ships).

(iii) Further, Cruise ships making

(a) 1-50 calls per year to get 10% rebate

(b) 51-100 call per year to get 20% rebate

The above rationalised tariff shall be

immediately effective for a period of one year.

Thereafter, for the next two years, the tariff may

be rationalized by splitting it into two components

viz. Fixed rate on ship’s GRT and charges per

passenger basis (head Tax), in a ratio to be decided

later. The volume discounts during this period

would be as follows:

(a) 50-74 calls per year to get 10% rebate

(b) 75-100 call per year to get 15% rebate

Ministry of Ports, Shipping & Waterways vide

SW-15011/2/2020-MG (CNo 338503), dated

04-10-2022 has extended the rationalization of

tariff for cruise vessels from 01-10-2022 to

30-09-2023 and increased the Head tax per

passenger from $5 to $6 with immediate effect.

(iv) The above rates for Cruise Vessels shall be

applicable until further orders from the

Government of India.

1.2. PILOTAGE

(i) The composite Pilotage-cum-towage fee

includes one inward and one outward movement

with required number of tugs/launches of

adequate capacity and shifting/s of vessels for

’Port convenience’. Shifting at the request of

vessels will attract separate shifting charges.

(ii) Pilotage cum towage shall be charged 50%

of the prescribed rates for inward and outward

leg of the vessel depending upon the status of the

vessel at each leg (i.e.) either Foreign going or

Coastal.

(iii) Pilotage is leviable in all cases except

(a) Where no Pilot and Tug services are

provided by the Port.

(b) For Vessels less than 200 GRT

(iv) Where due to any reason, boarding of Pilot

is not possible but Pilotage services are provided

remotely through VTMS, Pilotage charges are

leviable.

(v) Vessels which are frequently moving in Port

waters may avail the provision of Pass Pilot/ Special

Pilot Licence against payment of applicable

licence fees.

(i) Berth hire includes charges for services rendered

at the Berth, such as occupation of Berth, overtime at

Berth, telephones, rubbish removal, cleaning of Berths,

fire watch, etc.

(ii) The period of 1 hour shall be calculated from the

time the vessel occupies berth/anchorage.

(iii) (a) Berth hire shall stop 4 hours after the time of

the vessel signal ling its readiness to sail.

(b) The time limit of 4 hours prescribed for cessation

of berth hire shall exclude the ship’s waiting time for

want of favourable tidal conditions, in clement weather

and due to lack of night navigation.

(d) There shall be a penal berth hire equal to one

day’s berth hire charge for a false signal.

“False signal” would be when a ship signals

readiness and asks for a Pilot in anticipation even when

she is not ready for un-berthing due to engine not being

attributable to the vessel. This excludes the signalling

readiness when a ship is not able to sail due to

unfavourable tide, lack of night navigation or adverse

weather conditions.

(e) A vessel/barge/craft, berthing/unberthing without

prior permission from the port will attract a penal berth

hire equal to one day’s berth hire/call charge as the

case may be.

(iv) If a vessel/barge is not ready to vacate the berth

within 3 hours after the completion of cargo or after the

expiry of notice given by the officers authorised by the

MOPT, to so vacate the berth, whichever is later, the

vessel shall be liable to pay an additional berth hire

charge at five times the normal rate, the incidence being

reduced to per hour or part thereof.

(v) The deballasting time allowed at berths shall be 3

hours and beyond that penal Berth hire charges shall be

incidence being reduced to per hour or part thereof, i.e.

without any supplementary charge or rebate that may

be applicable to the vessel. This will be in addition to the

normal berth hire charges applicable for the entire

(vi) Vessels banked on off-side of another vessel at

the Berth, Berth Hire Charges shall be leviable at 50% of

charges payable by the vessels.

(vii) Priority Berthing

(a) For providing “Priority Berthing” to any vessel,

a fee equivalent to Berth hire charges for a single day

or 75% of the berth hire charges calculated for a total

period of actual stay at the Berth whichever is higher,

shall be levied.

(b) Coastal vessels which are be accorded priority

berthing shall not be liable to pay priority berthing

charges.

(viii) Ousting Priority Berthing

(a) For providing ousting priority to a vessel, a fee

equivalent to berth hire charges for single day or 100%

of the berth hire charges calculated for the total period

of actual stay of the vessels at berth, whichever is

higher, shall be levied.

(b) In addition, shifting out/in and applicable

anchorage charges of the ousted vessel shall be levied

on the vessels, which are provided ousting priority.

Such charges shall be based on the exchange rate as

applicable to the vessel which has been ousted.

initially grouped as per the relevant customs

classification, otherwise classifications should be

based on the nature of the cargo (density, stowage

(ii) The weight to be charged shall be subject

to a minimum of one (1) tonne. Any fraction thereof

(iii) Goods from vessels, which being alongside

the landing place transhipped into a lighter or

vice versa without their being passed over the

landing place shall be charged at 75% of the

wharfage rates.

(iv) Wharfage on all the commodities, when

handled in stream, shall be charged at 60% of the

rates applicable at Berth. However, if the vessel is

lightered at WOB due to draft restrictions and the

same cargo is then brought to the Port’s berths

(excluding PPP operated terminals), then no

wharfage shall be applicable for the cargo handled

in stream.

(v) The wharfage charges for transhipment

containers/cargo shall be concessional. Such

charges shall not exceed 1.5 times the handling

charges for the normal handling operation in

loading or unloading cycle. In case of transhipment

of coastal containers/cargo, the concession in

handling charges shall be calculated with

reference to the applicable handling charges for

coastal containers/cargo for the normal handling

operation in loading or unloading cycle. The

declaration of the containers/cargo meant for

transhipment shall be made at the time of filing of

Import General Manifest (IGM). Such containers/

/cargo meant for transhipment shall be

transhipped within seven days from the date of

their landing.

(vi) Wharfage shall not be charged on any

equipment/machinery e.g grabs, wheel-loaders,

forklifts etc. (moveable/unmoveable) loaded on

the barges/vessels for carrying out loading/

unloading operations in stream or at Mooring

dolphins or for carrying out operations at berth.

(vii) Defence stores would include ‘Bombs,

grenades, torpedoes, mines, missiles, and similar

munitions of war and parts thereof: cartridges and

other ammunition and projectiles and parts

thereof, including shot and cartridges wads’

coming under Arms, Ammunition, parts and

accessories thereof but the reference to “parts

thereof does not include radio or radar apparatus

as per note No. 2 of Chapter No. 93 of Customs

Tariff of India.

(viii) 80% discount on vessels related charges

and Cargo related charges for coastal

transportation of vehicles through Ro-Ro ship.

(ii) The line shall pay all port charges accrued

on the cargo and container before resuming

custody of the container.

to take such action within the stipulated period, the

storage charge on container shall be continued to be

levied till such time all necessary actions are taken

by the shipping lines for de-stuffing the cargo.

(d) Where the container is seized/confiscated by

the Custom Authorities and the same cannot be de-

stuffed within the prescribed time limit of 75 days,

the storage charges will cease to apply from the date

the Custom orders for release of the cargo subject to

lines observing the necessary formalities and bearing

the cost of transportation and de-stuffing. Otherwise,

seized/confiscated containers should be removed by

the line/consignee from the port premises to the

customs bonded area and in that case the storage

charge shall cease to apply from the date of such

removal.

(v) Storage charge on container shall not accrue

for the period when the port is not in a position to

deliver/ship container when requested by the user.

(vi) If operational area is leased on rental to users,

storage charge on Cargo/container shall not be levied.

(vii) Whenever a container is brought in for Export,

if moved out of Port without loading on to vessel, then

NO free days shall be given. Also, Storage charges &

two Reach Stacker moves shall be applicable as per

SoR.

National Industrial Corridor Development

2. MUC charges of ` 170/- per container shall

be applicable till 27-10-2024.

2.3. CARGO STORAGE CHARGES

(i) “Vessel Completion Day (VCD)” means the

day on which operation of the vessel is fully

completed. The Day shall be reckoned as from 7:30

a.m. to 7:30 a.m. on the following day.

(vii) Shut-out Cargo –

(a) The demurrage shall be payable for shut-

out cargo from the date of completion of the

vessel till the clearance of the cargo at the rate

(b) A shut-out cargo shall be treated as an

aggregation of cargo for the next shipment if

the exporter or his authorized representative

(iii) The Cargo stored in Port sheds/open plots

on rental basis will beat the risk and responsibility

of the shipper/exporters/importers.

(iv) Shippers/Importer/Exporter shall confirm to

all safety measures prescribed in the Dock Safety

Regulations and they shall be solely responsible

for any damages caused to the person and/or port

property.

(v) The period of storage shall be reckoned from

the actual day of receipt of goods into the port

premises.

(vi) If cargo is evacuated during night from 23.00

to 7.00, a rebate of ` 1.00 per tonne shall be given

on the demurrage charges for cargo evacuated by

road beyond free days.

(vii) Storage/Demurrage charge on cargo/

/container shall not accrue for the period when

the Port is not in a position to deliver/ship import/

/export cargo/container for reasons attributable

to the Port.

concession in handling charges shall be calculated with

reference to the applicable handling charges for coastal

containers/cargo for the normal handling operation in

loading or unloading cycle. The declaration of the

containers/cargo meant for transhipment shall be made

at the time of filing of Import General Manifest (IGM).

Such containers/cargo meant for transhipment shall be

transhipped within seven days from the date of their

landing.

2.5. Electronic Data Interchange Charges

(i) One Time charges of ` 50000/- will be

charged for issue of New EDI (SAP access).

(ii) EDI Charges shall be charged at 1% of the

Service Amount subject to a minimum of US $ 2.00

and ` 100/- and a maximum of US $ 50.00 and

` 3500/- for Foreign and Coastal related services

respectively. Service amount is the Invoice amount

exclusive of any taxes.

(i) In case of breakdown of the crane for more than one hour till the vessel leaves the berth, the quantity handled by

HMC will be determined taking into account cargo loaded/discharged prior to break-down divided by crane working

hours and multiplied by 24.

(ii) In case of stoppages of operation of HMC for more

than two hours at a stretch for reasons not attributable

to the HMC, appropriate allowance will be allowed to

the crane while calculating the total time of crane

operation in the vessel. Stoppages of HMC for less than

2 hours will not be taken into consideration for the above

purpose. No allowance will be allowed for stoppages

attributable to the HMC. All stoppages in loading/

/unloading operations during working of HMC are

required to be certified by the Stevedore of the vessel in

the daily vessel performance report.

प(रभाषाएँ - सामाय

इस दरमान म< जब तक संदभ= म< अ1यथा अपेBCत न हो, ननDलEखत प>रभाषाएं लागू ह'गी:-

(i) "तट-य जहाज" का अथ= होगा, भारत म< ?कसी भी पतन या 3थान से भारत म< ?कसी अ1य

पतन या 3थान के बीच Hयापार म< Iवशेष Jप से नयोिजत कोई भी जहाज, िजसके पास नौवहन

महानदेशालय/सCम ाधकारN *वारा जारN वैध तटNय लाइस<स होगा।

(ii) "को1ड मूव" का अथ= होगा, जहाज के इंजन कO शि-त के Pबना संचलन करना ।

(iii) "संयु2त लदान" मुQय Jप से बथ= पर जहाज का लदान और ?फर सरणी म< उतराई को दशा=ता है।

(iv) "3वदेशगामी जहाज" का अथ= तटNय जहाज के अलावा कोई भी जहाज होगा।

(v) "सरणी लदान" Iवशेष Jप से बथ= के अलावा अ1य 3थान' पर पोत के लदान को दशा=ता है।

(vi) "जहाज समापन 5दवस (वीसीडी)" का अथ= उस दन से है िजस दन जहाज का संचालन पूरN

तरह से पूरा हो जाता है। दन कO गणना सुबह 7.30 बजे से अगले दन के 7.30 बजे तक कO

जाएगी।

(vii) "शट आउट काग7" का अथ= होगा कोई कागU जो नौभारण के Dलए पतन म< लाया जाता है,

परंतु नाDमत जहाज *वारा यानांतरण नहNं ?कया जाता है और पतन प>रसर म< रखा रह जाता है।

(viii) "बजरा" अंतदVशीय जल प>रवहन पर कागU या याPWय' को ले जाने के Dलए Xडज़ाइन ?कया

गया कोई भी जलयान है जो भारत के आईड[\यूएI/रा]य समु^N बोड=/रा]य समु^N शासन आद

*वारा माEणत है।

(ix) "खतरनाक" का अथ= अंतरा=_`Nय समु^N संगठन (आईएमओ) के तहत खतरनाक के Jप म<

वगcकृत कागU/कंटेनर होगा

सामाय 9नबंधन एवं शत:

(i) जहाज कO ि3थत, जैसा ?क सीमा शु\क या नौवहन महानदेशक *वारा माणन ?कया गया हो,

जहाज संबंधत भार' कO वसूलN के योजन के Dलए जहाज को 'तटNय' या 'Iवदेशगामी’ म< वगcकृत

करने के Dलए नणा=यक कारक होगा और कागU कO कृत या इसके मूल योजन के Dलए कोई

ासंगक नहNं होगा ।

(ii) क.. पोत संबंधी भार (वीआरसी) कO वसूलN के Dलए पोत के वगcकरण कO णालN।

(क) सामा1य Hयापार लाइस<स रखने वाला भारतीय gवज का एक Iवदेशगामी जहाज सीमा शु\क

Jपांतरण आदेश के आधार पर तटNय नौसंचालन म< प>रवत=त हो सकता है। ऐसे जहाजजो भारतीय

पतन म< अपने पहले पतन आगमन पर सीमा शु\क Jपांतरण आदेश के आधार पर तटNय

नौसंचालन म< प>रवत=त हो जाता है, को तब तक आगे सीमाशु\क Jपांतरण कO आवiयकता नहNं

होती है, जब तक यह भारतीय तट पर नहNं पहुंचता है।

(ख) Iवदेशी gवज का एक Iवदेशगामी जहाज नौवjन महानदेशक *वारा Iवनद=_ट अवध या याWा

के Dलए जारN लाइस<स और एक सीमाशु\क Jपांतरण आदेश के आधार पर तटNय नौसंचालन म<

प>रवत=त हो सकता है।

ख. >रयायती तटNय दर और Iवदेशी दर पर जहाज संबंधत भार' (वीआरसी) कO वसूलN के Dलए मानदंड

(क) ऐसे Jपांतरण के मामल' म<, लदान करने वाले पतन *वारा तटNय दर' को उस समय से

भा>रत ?कया जाएगा जब जहाज तटNय माल का लदान करना शुJ करता है।

(ख) इस तरह के Jपांतरण के मामल' म< तटNय दर< तब तक भाय= रह<गी जब तक ?क जहाज

भारतीय पतन के अंतम कॉल पर तुरंत नव=हन संचालन पूरा नहNं कर लेता, उसके तुरंत बाद

Iवदेशगामी दर< अभारण पतन' *वारा भाय= ह'गी।

(ग) नौवहन महानदेशालय से तटNय लाइस<स रखने वाले समIप=त भारतीय तटNय जहाज' के Dलए

तटNय दर' के हकदार होने के Dलए ?कसी अ1य द3तावेज कO आवiयकता नहNं होगी

(iii) >रयायती तटNय दर पर कागU संबंधत भार' (सीआरसी) कO वसूलN हेतु मानदंड

(क) ‘IवiवHयापी और तटNय' संचालन के Dलए जारN ?कए गए सामा1य Hयापार लाइस<स वाले

Iवदेशगामी भारतीय जहाज को संभलाई भार (एचसी) के मामले म< यानी ननDलEखत प>रmiय म<

जहाज से तट पर 3थानांतरण और घाट से/भंडारण याड= से/से भंडारण याड= म< घाट शु\क सहत, के

संबंध म< यथा nाjय तटNय दर< लागू कO जाएंगी:

(i) तटNय नौसंचालन म< प>रवत=न और ?कसी भी भारतीय पतन से तटNय कागU कO ढुलाई

करना और ?कसी अ1य भारतीय पतन के Dलए गंतिHयत करना ।

(ii) तटNय नौसंचालन म< *अप>रवत=त, ले?कन ?कसी भी भारतीय पतन से तटNय कागU कO

ढुलाई करना और ?कसी अ1य भारतीय पतन के Dलए गंतिHयत करना।

* क< ^Nय उपाद एवं सीमा शु\क बोड= काप>रपW सं. 15/2002-सीमा शु\क, दनांक

25 फरवरN, 2002, भारतीय gवज के Iवदेशगामी जहाज' को Pबना ?कसी सीमाशु\क

Jपांतरण के एक भारतीय पतन से भारत म< दूसरे पतन तक तटNय कागU कO

ढुलाई कO अनुमत देता है।

(ख) नौवहन महानदेशक *वारा जारN नद=_ट अवध या नौ3थान के Dलए जारN ?कए गए

लाइस<स और सीमाशु\क Jपांतरण आदेश के आधार पर तटNय नौसंचालन म< प>रवत=त एक Iवदेशी

gवज के जहाज के मामले म<, ?कसी भी भारतीय पतन से भारण ?कए गए और ?कसी अ1य भारतीय

पतन को गंतिHयत तटNय कागU/कंटेनर के Dलए तटNय कागU/कंटेनर के Dलए यथा nाjय दर वसूलN

जानी चाहए।

(iv) क) जहाज-माDलक'/3टNमर एज<ट' से जहाज संबंधी भार वसूल ?कए जाएंगे।जहां भी दर' को

अमे>रकO डॉलर के संदभ= म< दशा=या गया है, भारतीय >रजव= बqक कO संदभ= दर पर अमे>रकO मु^ा को

उसके समकC भारतीय rपये म< बदलने के बाद भारतीय rपये म< भार वसूल ?कए जाएंगे। पतन

सीमा म< जहाज के वेश कO तथ को ऐसे Jपांतरण के दन के Jप म< गना जाएगा।

(ख) अमे>रकO डॉलर म< मू\यवग=त कंटेनर संबंधत भार समतु\य भारतीय rपये म< वसूल ?कए

जाएंगे। इस उsेiय के Dलए, आयात कंटेनर' के मामले म< जहाज के वेश कO तथ पर चDलत

आरबीआई संदभ= दर; और नया=त कंटेनर' के मामले म< पतन प>रसर म< कंटेनर' के आगमन कO

तथ पर डॉलर मू\यवग=त भार' के प>रवत=न के Dलए लागू होगी।

(v) (क) सीमा शु\क अधनयम, 1962 के योजन' के Dलए आयात सामा1य मालसूची या नया=त

सामा1य मालसूची म< कागU के Jप म< घोIषत ?कए गए पतन म< आए जहाज' को कागU के Jप म< नहNं

माना जाएगा और ऐसे जहाज' पर कोई घाट शु\क नहNं लगाया जाएगा, और केवल जहाज संबgद शु\क

वसूला जाएगा, यद जहाज अपनी भाप पर पतन म< आते हq और अपनी भाप पर पतन कO सीमा से

बाहर नकल जाते हq। हालां?क, जब पतन सीमा के भीतर ऐसे जहाज से/से कागU/कंटेनर कO लोXडंग या

अनलोXडंग होती है, तो माल/कंटेनर से संबंधत शु\क घाट शु\क सहत ऐसे कागU/कंटेनर पर एसओआर

के अनुसार लागू ह'गे, जो मालसूची (आईजीएम/ईजीएम) म< घोIषत ?कया गया है।

(ख) जब कोई जहाज ?कसी अ1य जहाज को पतन म< या तो -वे, जेtी या फोरशोर (घाट) पर,

उतारने के Dलए कागU के Jप म< ले जाता है, या पतन के ऐसे घाट से जहाज पर हN कागU के Jप म<

?कसी अ1य जहाज का भारण करता है, तो ऐसे मामल' म<, ऐसा भारण या अभारण जहाज 'कागU' हq, िजन

पर घाटशु\क' सहत कागU संबंधत भार वसूले जाते हq।

(vi) तीस दन से अधक समय तक पतन म< रहने के मामले म< जहाज' के आगमन कO तारNख से

तीस दन' म< एक बार Iवनमय दर कO नयDमत समीCा कO जाएगी। ऐसे मामल' म<, समीCा के समय

Iव*यमान उचत Iवनमय दर के संदभ= म< PबDलंग का आधार संभाIवत Jप से बदल जाएगा।

(vii) (क) सभी तटNय जहाज' के Dलए जहाज संबgद भार अ1य जहाज' के त*नुJपी भार' के

60% से अधक नहNं होने चाहए।

(ख) सभी तटNय कागU/कंटेनर' के Dलए कागU/कंटेनर संबंधत भार, थम=ल कोयले, पीओएल के

अलावा, कuचा तेल, लौह अय3क और लौह अय3क पेलेvस सहत सामा1य कागU/कंटेनर संबंधत

भार' के 60% से अधक नहNं होना चाहए।

(ग) कागU संबंधी भार' के मामले म<, पोत-तट 3थानांतरण, और घाट से भंडारण याड=/ भंडारण याड=

से घाट 3थानांतरण के Dलए घाटशु\क सहत सभी ासंगक संभलाई भार' पर >रयायती दर< वसूल

कO जानी चाहए।

(घ) कंटेनर संबंधी भार' के मामले म<, पोत-तट 3थानांतरण के Dलए सभी ासंगक भार' पर

>रयायत लागू होगी, और घाट से भंडारण याड=/ भंडारण याड= से घाट 3थानांतरण के साथ-साथ कागU

और कंटेनर' पर घाट शु\क भी लागू होगा।

(ड) यद Iवदेशी पतन से कंटेनर/कागU एमओपीटN म< उतरते हq और बाद म< तटNय याWाओं पर

भारतीय पतन म< यानांतरण के Dलए जाते हq, तो Iवदेश जाने के Dलए नधा=>रत यानांतरण दर का

50% और तटNय लेग के Dलए नधा=>रत का 50% दर कO वसूलN कO जानी चाहए।

(viii) यद वजन *वारा नधा=>रत कागU माWा मालसूची म< घोIषत माWा से अधक है तो सभी लागू

भार जैसे ?क घाट शु\क, भंडारण, 3टNवडो>रंग शु\क आद को वजन *वारा नधा=>रत माWा के आधार

पर वसूले जाएंगे।

(ix) (क)

भारत सरकार के तहत वाEण]य और उ*योग मंWालय *वारा जनवरN से दसंबर तक सभी

व3तुओं के Dलए घोIषत थोक PबwO मू\य सूचकांक के आधार पर इंXडयन पोv=स एसोDसएशन (आईपीए)

या सरकार *वारा नधा=>रत ?कसी अ1य सCम ाधकारN *वारा सूचत ?कए अनुसार, एसओआर 3वत:

Jप से मु^ा3फOत के Dलए सालाना 60% कO सीमा तक थोक PबwO मू\य सूचकांक (ड[\यूपीआई) म<

Dभ1नता के औसत के आधार पर अनुwDमत ?कया जाएगा।

(ख) मुरगांव पतन ाधकरण *वारा तबx दश=न मानक' कO उपलि[ध पर टै>रफ नधा=रण के

दूसरे वष= से मुरगांव पतन ाधकरण उपर खंड (viii) (क) म< नधा=>रत ड[\यूपीआई म< 60% बदलाव के

बजाय आईपीए या सरकार *वारा नधा=>रत ?कसी अ1य सCम ाधकारN *वारा सूचत ?कए अनुसार

ड[\यूपीआई म< 100% Dभ1नता पर टै>रफ म< इंडे-सेशन का हकदार होगा। एसओआर का ऐसा

समायोजन त वष= ?कया जाएगा और यह समायोिजत एसओआर संबंधत वष= के 1 मई से अगले वष=

के 30 अैल तक लागू ?कया जाएगा ।

(x) IवलंPबत भुगतान/वापसी राDश पर [याज:

(क) उपयोगकता= इस दरमान के अंतग=त IवलंPबत भुगतान पर 15% त वष= कO दर से दंडामक

[याज का भुगतान करेगा। इसी तरह, एमओपीए IवलंPबत वापसी राDश पर 15% त वष= कO दर से

दंडामक [याज अदा करेगा।

(ख) वापसी म< देरN सेवाओं के पूरा होने कO तारNख से या उपयोगकता=ओं से आवiयक सभी

द3तावेज उपल[ध कराने, जो भी बाद म< हो, से केवल 20 दन' कO गणना कO जाएगी। वापसी कO

(ग) उपयोगकता= *वारा भुगतान म< देरN कO गणना Pबल जारN करने कO तथ के 10 दन' के बाद

कO जाएगी। यह ावधान उस मामले म< लागू नहNं होगा जहां सेवाओं का लाभ उठाने से पहले

भुगतान ?कया जाना है/पतन संपितय' का उपयोग करना है या टै>रफ म< एक शत= के Jप म<

नधा=>रत ?कया गया है।

(xi) प>रकDलत सभी भार Pबल के सकल जोड़ पर अगले उuचतर rपए म< पूणाz?कत ?कए जाएंगे।

(xii) (क) दरमान म< नधा=>रत दर< अधकतम हq, इसी तरह, >रयायत और छूट ननतम 3तर हq। यद

एमओपीटN चाहे तो कम दर< वसूल कर सकता है और/या अधक >रयायत और छूट कO अनुमत दे

सकता है।

(ख) पतन, यद वे चाह< तो, दरमान म< नधा=>रत दर' के अनुयोग को नयंPWत करने वालN

नधा=>रत शत| को युि-तसंगत बना सकता हq, यद इस तरह के यु-तीकरण से उपयोग कता= को त

यूनट दर म< राहत Dमलती है और दरमान नधा=>रत यूनट दर अधकतम 3तर से अधक नहNं ह'गी।

(ग) पतन को जनता को इस तरह कO कम कO गई दर' और/या ऐसी दर' के अनुयोग को

नयंPWत करने वालN शत| के यु-तीकरण के बारे म< जनता को सूचत करना होगा और जनता को

इस तरह कO कम कO गई दर' और/या ऐसी दर' के अनुयोग को नयंPWत करने वालN शत| म< ?कसी

भी तरह के बदलाव को सूचत करते रहना होगा। नधा=>रत दर< टNएएमपी *वारा अधसूचत दर' से

अधक नहNं ह'गी।

(xiii) उपयोगकता=ओं को पतन के कारण उपयु-त 3तर से अधक देरN के Dलए भार अदा करने कO

आवiयकता नहNं होगी।

(xiv) बथ=, वा}स=, मू>रंग, -वे, जेटN आद पर या उसके पास आने वाले या ठहरे हुए जहाज़' और अ1य

}लोटंग wा~vस के मा3टर', माDलक' या एज<ट' के मsे पोत संबंधत भार वसूलN यो;य हq।

(xv) पोत प>रवहन मंWालय *वारा पW संQया पीटN-11033/51/2014-पीटN दनांक 4 Dसतंबर, 2014

*वारा महा पतन' म< तटNय जहाज' कO ाथDमकता बथzग पर दशानदVश जारN ?कए गए है:

(क) "तटNय जहाज'" को भारत म< ?कसी भी पतन या 3थान से भारत म< ?कसी भी पतन या

3थान के बीच Hयापार म< Iवशेष Jप से नयोिजत ?कसी भी जहाज, िजसके पास नौवहन

महानदेशक/सCम ाधकारN *वारा जारN वैध तटNय लाइस<स हो, के Jप म< प>रभाIषत ?कया गया है।

(ख) एमओपीटN €ाई ब\क/सामा1य कागU तटNय जहाज' को कम से कम एक घाट पर बथzग कO

ाथDमकता देगा ता?क कागU के मूल और अंतम गंतHय पर gयान दए Pबना भारत म< एक पतन से

भारत म< दूसरे पतन तक Dशपस= को माल प>रवहन करने म< सCम बनाया जा सके। यह महा

पतन', यद कोई हो, म< पहले से मौजूद तटNय थम=ल कोयले कO संभलाई के Dलए समIप=त घाट के

अत>र-त होगा।

(ग) एमओपीटN >रयायती समझौत' और नजी टDम=नल' पर Iवंडो बथzग के मौजूदा आबंटन और

पतन' *वारा संचाDलत कंटेनर घाट कO उपल[धता को gयान म< रखते हुए IवDश_ट Iवंडो के माgयम

से तटNय कंटेनर जहाज' को ाथDमकता बथzग दान करेगा।

(घ) पीओएल/तरल कागU टqकर' के संबंध म<, IवDभ1न पतन' म< चDलत ऐसी ाथDमकताओं के

संबंध म< मौजूदा पg*तयां जारN रह<गी।

(ड) तटNय जहाज िज1ह< ाथDमकता बथzग दN गई है, व< ाथDमकता बथzग भार अदा नहNं कर<गे।

(च) उपयु=-त ाथDमकता के आधार पर घाट लगाए गए तटNय जहाज के अलावा तटNय जहाज कO

बथzग पर कोई अत>र-त तबंध नहNं होगा, यद वह पतन कO सामा1य बथzग नीत के अधीन

यो;य हो।

(छ) एक तटNय जहाज तटNय दर' पर पतन भार अदा करेगा चाहे वह ाथDमकता पर या

अ1यथा बथ= ?कया गया था।

(ज) पतन तटNय कागU कO आवाजाहN को और सुगम बनाने के Dलए पतन' के क3टम सीमाशु\क

बंधत CेW के बाहर तटNय कागU के Dलए Iवशेष बथ=, भंडारण CेW और गेट' को अDभचिjनत ?कए

जाने कO संभावनाओं का पता लगाएगा ।

(झ) पतन उस समय सीमा का 3प_ट Jप से नधा=रण करेगा िजसम< एक तटNय जहाज को एक

Iवशेष पतन म< बथ= ?कया जाएगा। कागU और बथ= के आधार पर यह समय सीमा Dभ1न हो सकती

है। पतन एक Iव3तृत काय=वाहN करेगा और एक Hयापार नोटस जारN करेगा िजसम< उuचतर समय

सीमा का 3प_ट Jप से उ\लेख ?कया गया हो िजसके भीतर एक तटNय जहाज को पतन म< बथ=

दया जाएगा। तटNय कंटेनर जहाज' के Dलए एक IवDश_ट Iवंडो के माgयम से ाथDमकता बथzग के

संबंध म<, पतन पीपीपी ऑपरेटर के साथ Iव3तृत चचा= करेगा और तटNय कंटेनर जहाज' के Dलए

IवDश_ट Iवंडो काDशत करेगा । उपयु=-त काय=वाहN और काशन को इन दशानदVश' के जारN होने

कO तारNख से 30 दन' के भीतर पूरा ?कया जाना होगा ।

(ञ) पतन कO एमआईएस *वारा तटNय और Iवदेशी जहाज' के कागU के Dलए अलग-अलग डाटा

ा„त करना होगा। इस कार एकW ?कए गए डाटा कO नगरानी कO जाएगी और आंत>रक Jप से

पतन के साथ-साथ आईपीए और मंWालय को तटNय और Iवदेशी जहाज' के Dलए अलग-अलग

औपचा>रक Jप से >रपोट= कO जाएगी।

(xvi) पतन' म< भीड़ कम करने और नया=तक'/आयातक' को नयDमत घंट' के बाद पतन सेवाओं

का उपयोग करने के Dलए ोसाहत करने के Dलए, कागU और जहाज' से संबंधत सेवाओं के Dलए कम

भार वसूल ?कए जा सकते है और साथ हN नयDमत घंट' के बाद दान कO जाने वालN सेवाओं के Dलए

पतन भार' म< Iवशेष छूट कO दN जा सकती है।

5ट@पAणयाँ:

(i) जहाज के येक वेश के Dलए पतन भार लगाया जाएगा Dसवाय तीस दन' से अधक समय

तक पतन म< रहनेवाले यानांतरक'/~लोटंग wेन'/जहाज' को छोडकर, िजसके मामले म< उगाहN तीस

दन' म< एक बार होगी।

(ii) ननDलEखत के मामले म< उगाहN नहNं कO जाएगी:

(क) कोई भी जहाज, जो पतन से जा चुका है और मौसम के दबाव के कारण या इसके प>रणाम

3वJप कोई नुकसान होने कO ि3थत म< ?फर से वेश करने के Dलए मजबूर होता है।

(ख) अ1य भारतीय भारतीय महा पतन' से संबंधत जहाज़।

(ग) देशी wा~vस व ?फDशंग `ॉलर।

(iii) ब\ला3ट म< पतन म< वेश करने वाले और याPWय' को नहNं ले जाने वाले जहाज पर पतन

बकाया राDश का केवल 75% भार वसूल ?कया जाएगा, जो वह अ1यथा भाय= होगा।

(iv) एक जहाज जो पतन म< वेश करता है, ले?कन उसम< ?कसी भी कागU या याWी/चालक दल को

उतारना या ले जाना नहNं है (ऐसी उतराई और पुन: लदान, जोभी मरमत के योजन के Dलए

आवiयक हो, के Dसवाय) पतन बकाया का केवल 50% भा>रत ?कया जाएगा िजसम< वह अ1यथा

भाय= होगा। हालां?क, मरमत के Dलए पतन म< आने वाले जहाज को उपरो-त 1.1 के तहत ावधान

?कए अनुसार पतन बकाया का पूरा भुगतान करना होगा।

(v) अलग-अलग बला3ट वाले तेल टqकर' के Dलए, कम ?कया गया सकल टन भार को, जो इसके

अंतरा=_`Nय टन भार माणपW के 'ट„पणी' कॉलम म< दशा=या गया हो, पतन बकाया कO वसूलN के

योजन के Dलए इसका सकल टन भार माना जाएगा।

(vi) बंकर लेने या बीमार चालक दल को उतारने के उsेiय से पतन म< आने वाले ?कसी भी जहाज

पर पतन बकाया का केवल 50% भार वसूला जाएगा, िजसके Dलए वह अ1यथा भाय= होगा।

1.1.1 ;ूज जहाज:-

पोत प(रवहन मंCालय, भारत सरकार ने एसएम-150112/2/2020-एमजी (Cno338503) 5दनांक

14.08.2020 के मा%यम से सभी महा प तनD को सूचत Eकए अनुसार ;ूज जहाजD के Fलए

शु1क संरचना को युि2तसंगत बनाया है। आईएनसीएलए Jवारा Kता3वत भारD को माननीय

एमओसी (आई/सी) Jवारा अनुमो5दत Eकया गया है।

(i) पहले 12 घंट' के ठहराव के Dलए wूज Dशप के Dलए पतन शु\क 0.085 अमे>रकO डॉलर त

जीआरटN ("निiचत दर") और $5 त याWी ("हेड टै-स") Dलया जाएगा। पतन बथ= ?कराया, पतन

बकाया, पाइलटेज, याWी शु\क आद जैसी कोई अ1य दर भा>रत नहNं करेगा ।

(ii) 12 घंटे से अधक कO अवध के Dलए, wूज जहाज' पर निiचत भार एसओआर के अनुसार देय

बथ= ?कराया भार के बराबर होगा (wूज जहाज' के Dलए लागू 40% छूट सहत)।

(iii) इसके अलावा, wूज जहाज, जो ननDलEखत करते है:-

(क) 10% छूट पाने के Dलए त वष= 1-50 कॉल

(ख) 20% छूट पाने के Dलए त वष= 51-100 कॉल

(ग) 30% छूट पाने के Dलए त वष= 100 से अधक कॉल

उपरो-त युि-तसंगत शु\क एक वष= कO अवध के Dलए तुरंत भावी होगा। इसके बाद, अगले दो

वष| के Dलए, शु\क को दो घटक' म< Iवभािजत करके युि-तसंगत बनाया जा सकता है जैसे ?क

जहाज के जीआरटN पर निiचत दर और त याWी आधार पर शु\क (मुQय कर), अनुपात म<,

िजसे बाद म< निiचत ?कया जाना है। इस अवध के दौरान माWा छूट इस कार होगी:

(क) 10% छूट पाने के Dलए त वष= 50-74 कॉल

(ख) 15% छूट पाने के Dलए त वष= 75-100 कॉल

(ग) 20% छूट पाने के Dलए त वष= 100 से अधक कॉल

पतन, पोत प>रवहन और जलमाग= मंWालय ने एसड[\यू -15011/2/2020- एमजी (सीसं.

338503), दनांक 04-10-2022 के *वारा wूज जहाज' के Dलए शु\क के युि-तकरण को

01-10-2022 से बढ़ाकर 30-09-2023 कर दया है और त याWी मुQय कर $5 से $6 तक

तकाल भाव से बढ़ा दया है ।

(iv) wूज जहाज' के Dलए उपरो-त दर< भारत सरकार के अगले आदेश तक लागू रह<गी।

1.2. पायलटेज

(i) समे?कत पाइलटेज-सह-टॉवेज शु\क म< पया=„त Cमता के आवiयक संQया म< टग/ लॉ1च सहत

एक आवक और एक जावक संचलन और 'पतन सुIवधा' के Dलए जहाज' का 3थानांतरण शाDमल है।

जहाज' के अनुरोध पर 3थानांतरण के संबंध म< अलग से 3थानांतरण भार देने ह'गे।

(ii) जहाज के आवक और जावक चरण के Dलए नधा=>रत दर' का 50% पयलटेज सह टोवेज वसूल

?कया जाएगा, जो येक लैग (अथा=त) या तो Iवदेशगामी या तटNय पर जहाज कO ि3थत पर नभ=र

करता है।

(iii) पायलटेज नन के Dसवाय सभी मामल' म< भाय= होगा:-

(क) जहां पोट= *वारा कोई पायलट और टग सेवाएं दान नहNं कO जाती हq।

(ख) 200 जीआरटN से कम के जहाज' के Dलए

(iv) जहां ?कसी कारण से, पायलट कO बोXडzग संभव न हो, ले?कन पायलटेज सेवाएं वीटNएमएस के

माgयम से दूर3थ Jप से दान कO जाती हq, तो पायलटेज भार भाय= है।

(v) जहाज जो पतन जलCेW म< अ-सर नौसंचाDलत होता है, यथा nाjय लाइस<स शु\क' का भुगतान

करने पर पास पायलट/Iवशेष पायलट लाइस<स के ावधान ा„त कर सकते हq।

'पतन सुIवधा' को नन म< से ?कसी के अथ= म< प>रभाIषत ?कया गया है:

(क) यद बथ= पर या एंकरेज/मू>रंग [वॉय' पर €ेिजंग काय=/हाइ€ोnा?फक सवVCण काय= करने या

€ेजर के Dलए बथ= आबंटत करने या बथ= कO मरमत, रखरखाव और ऐसे अ1य समान काय| के Dलए

को "पतन सुIवधा के Dलए 3थानांतरण" माना जाएगा। ऐसे 3थाना1त>रत जहाज (जहाज') को बदलने

के Dलए ?कए गए 3थानांतरण को भी "पतन सुIवधा के Dलए 3थानांतरण" के Jप म< भी माना

जाएगा।

(ख) यद ?कसी जहाज को आऊंि3टंग बथ= से हटाकर समायोिजत करने के Dलए 3थानांत>रत ?कया

जाता है,

(ग) यद पतन सुIवधा के संचालन के Dलए ?कसी अ1य जहाज को समायोिजत करने के Dलए

(क) `ांसDशपर सहत गैर-कागU जहाज, िज1ह< कागU जहाज' के आने पर ?कसी भी ि3थत म< बथ=

खालN करनी पड़ती है।

(ख) पोत जो बथ= पर Pबना ?कसी कागU संभलाई चालन के नि_wय पड़े हq।

(ग) लगातार तीन पा>रय' कO अवध के Dलए भारण/अभारण मानदंड' को पूरा नहNं करने वाले

(ii) पतन के कारण लगने वालN समयावध को अवरोधन भार' कO गणना के Dलए नहNं गना

(iii) जहाज, माल उतारने के बाद, सफाई के Dलए पतन कO सीमा से बाहर चला जाता है और पतन

कO सीमा म< ?फर से वेश करता है, तो वहां पायलटेज भार लागू ह'गे। अगर ऐसे जहाज' कO सफाई

प>रि3थतय', खराब मौसम और राPW नौसंचालन कO कमी के कारण जहाज का तीCा समय शाDमल

नहNं होगा।

(ग) जहाज का मा3टर/एज<ट केवल अनुकूल ]वारNय और मौसम कO ि3थत के अनुसार हN नौकायन

के Dलए तैयार होने का संकेत देगा।

(घ) झूठे संकेत के Dलए एक दन के घाट ?कराया भार के बराबर दंडामक घाट ?कराया होगा।

"झूठा संकेत" तब होगा जब एक जहाज तपरता का संकेत देता है और इस अनुमान से पायलट कO

मांग करता है, जब वह इंजन के तैयार न होने या कागU संचालन पूरा नहNं होने या जहाज से संबंधत

ऐसे कारण' कO वजह से जहाज अन-बथzग के Dलए तैयार न हो।

इसम< Dस;नDलंग तपरता शाDमल नहNं है जब एक जहाज तकूल ]वार, राPW नौसंचालन कO कमी या

तकूल मौसम कO ि3थत के कारण नौचालन करने म< सCम नहNं होता है।

(ड) पतन से पूव= अनुमत के Pबना एक जहाज/बजरा/जलयान, बथzग/अनबथzग, एक दन के घाट

?कराया/कॉल भार, जैसा भी मामला हो, के बराबर दंडामक घाट ?कराया आकIष=त करेगा।

(iv) यद कोई जहाज/बजरा कागU के पूरा होने या एमओपीटN *वारा ाधकृत अधका>रय' *वारा घाट

खालN करने के Dलए दN गई नोटस कO समाि„त के बाद, जो भी बाद म< हो, 3 घंटे के भीतर घाट खालN

करने के Dलए तैयार नहNं है, तो जहाज सामा1य दर से पांच गुना अत>र-त घाट ?कराया भार अदा

करेगा, घटना को त घंटे या उसके ह3से तक घटाया जा सकता है।

(v) घाट पर Xडबैलाि3टंग का समय 3 घंटे का होगा और उससे अधक का दंडामक घाट ?कराया

भार सामा1य घाट ?कराया भार के पांच गुना वसूल ?कया जाएगा, घटना को त घंटे या उसके ह3से

तक घटाया जा सकता है, यानी Pबना ?कसी पूरक भार या छूट के जो जहाज पर लागू ?कया जा सकता

है। यह घाट पर जहाज' के ठहराव कO संपूण= अवध के Dलए लागू सामा1य घाट ?कराया भार' के

अत>र-त होगा।

(vi) घाट पर दूसरे जहाज के ऑफ-साइड म< खड़े जहाज के Dलए जहाज' *वारा देय भार का 50%

घाट ?कराया भार भाय= होगा।

(vii) ाथDमकता बथzग

(क) ?कसी भी जहाज को "ाथDमकता बथzग" दान करने के Dलए, एक दन के Dलए घाट ?कराया

भार के बराबर शु\क या बथ= पर वा3तIवक ठहराव कO कुल अवध के Dलए प>रकDलत घाट ?कराया

भार' का 75%, जो भी अधक हो, वसूल ?कया जाएगा।

(ख) तटNय जहाज िज1ह< ाथDमकता बथzग दN गई है, उ1ह< ाथDमकता बथzग भार अदा नहNं

करने ह'गे।

(viii) ऑि3टंग ाथDमकता बथzग

(क) जहाज को ऑि3टंग ाथDमकता देने के Dलए, एकल दवस के Dलए घाट ?कराया भार' के

समतु\य शु\क या घाट पर जहाज' के वा3तIवक ठहराव कO कुल अवध के Dलए प>रकDलत घाट

?कराया भार' का 100%, जो भी अधक हो, वसूल ?कया जाएगा।

(ख) इसके अलावा, बाहर जाने वाले जहाज' के बाहर जाने/अंदर आने और उन पर लागू लंगरगाह

भार उन जहाज' से वसूल ?कया जाएगा, िज1ह< ऑि3टंग कO ाथDमकता दान कO जाती है। इस तरह

के भार आऊ3टड जहाज पर लागू Iवनमय दर पर आधा>रत ह'गे।

(ग) पोत प>रवहन मंWालय *वारा िजस जहाज के Dलए Iवशेष छूट दान कO गई है, उसे ऑि3टंग

ाथDमकता भार' के भुगतान से छूट दान कO जाएगी।

(ix) भारतीय तटरCक जहाज' और भारतीय नौसेना के जहाज' के Dलए नि_wय लंगरगाह भार' म<

केवल तभी छूट दN जाती है जब जहाज गiत कर रहे ह', न ?क तब जब वे वा3तव म< लंगर डाल रहे ह'।

(iv) सरणी म< संभलाए जाने पर, सभी व3तुओं पर घाटशु\क, घाट पर लागू दर' के 60% दर पर

भा>रत ?कया जाएगा। य*यIप, अगर €ा~ट तबंध' के कारण ड[\यूओबी पर जहाज को ह\का ?कया

जाता है और उसी कागU को पतन के घाट (पीपीपी संचाDलत टDम=नल' को छोड़कर) म< लाया जाता है,

तो सरणी म< संभाले गए कागU के Dलए कोई घाट शु\क लागू नहNं होगा।

(v) पोतांतरण कंटेनर'/कागU के Dलए घाटशु\क भार >रयायती ह'गे। भारण या अभारण चw म<

सामा1य संभलाई चालन के Dलए ऐसे शु\क 1.5 गुना से अधक नहNं ह'गे। तटNय कंटेनर'/कागU के

पोतांतरण के मामले म<, लदान या उतराई चw म< सामा1य संभलाई चालन के Dलए तटNय कंटेनर'/कागU

के Dलए लागू संभलाई भार' के संदभ= म< संभलाई भार' म< >रयायत कO गणना कO जाएगी। यानांतरण

के Dलए कंटेनर'/कागU कO घोषणा इपोट= जनरल मैनफे3ट (आईजीएम) दाEखल करते समय कO जाएगी।

यानांतरण के Dलए बने ऐसे कंटेनर/कागU को उनके उतरने कO तारNख से सात दन' के भीतर यानांत>रत

?कया जाएगा।

(vi) कोई भी उपकरण/मशीनरN जैसे हथयाने, HहNल-लोडर, फोक= Dल~ट आद (चल/अचल), जो सरणी म<

या मू>रंग डॉि\फ़न पर भारण/अभारण चालन करने के Dलए या घाट पर चालन करने के Dलए

बजरा/जहाज' पर भा>रत ?कए जाते हq, पर घाट शु\क नहNं Dलया जाएगा।

(vii) रCा भंडार" म< शाDमल ह'गे, 'बम, nेनेड, टारपीडो, खदान<, Dमसाइल<, और समान युx सामnी और

(i) आयात कंटेनर' के Dलए न:शु\क Iवराम समय (भंडारण) अवध कंटेनर कO उतराई के दन के

बाद के दन से शुJ होगी और नया=त कंटेनर' के Dलए न:शु\क अवध कंटेनर के टDम=नल म< वेश

करने के समय से शुJ होगी।

(ii) न:शु\क Iवराम समय (भंडारण) कO अनुमत सीमा शु\क अधसूचत अवकाश दवस और पतन

के गैर-काय= दवस' के अलावा होगी।

(iii) खतरनाक कंटेनर' के मामले म< संभलाई और भंडारण भार पर 50% कO सीमा तक ीDमयम

लगाया जाएगा। ओवर-डायम<शनल कंटेनर' के संबंध म< संभलाई भार पर 50% तक का ीDमयम लगाया

जा सकता है।

(iv) प>रय-त एफसीएल कंटेनर'/ पोतवEणक के 3वाDमव वाले कंटेनर' पर भंडारण भार DलEखत Jप

म< प>रयाग कO सूचना कO ाि„त कO तारNख तक या कंटेनर कO उतराई कO तारNख से 75 दन' तक,

जो भी पहले हो, ननDलEखत शत| के अधीन वसूल ?कए जाएंगे:

(क) परेIषती ?कसी भी समय प>रयाग पW जारN कर सकता है

(ख) यद परेIषती ऐसा प>रयाग पW जारN नहNं करने का Iवक\प चुनता है, तो कंटेनर

एज<ट/एमएलओ भी प>रयाग पW जारN कर सकता है, बशतV ?क,

(i) लाइन कागU के साथ कंटेनर कO संरCा ?फर से शुJ करेगी और या तो इसे वापस ले

लेगी या पतन प>रसर से हटा देगी; तथा

(ii) लाइन कंटेनर कO संरCा ?फर से शुJ करने से पहले कागU और कंटेनर पर ोदभूत सभी

पतन भार' का भुगतान करेगी।

(ग) कंटेनर एज<ट/एमएलओ आवiयक औपचा>रकताओं का पालन करेगा और प>रवहन और खालN

करने कO लागत वहन करेगा। नधा=>रत अवध के भीतर इस तरह कO कार=वाई करने म< उनकO

Iवफलता के मामले म<, कंटेनर पर भंडारण भार उस समय तक जारN रखा जाएगा जब तक ?क

कागU को खालN करने के Dलए DशIपंग लाइन' *वारा सभी आवiयक कार=वाई नहNं कO जाती है।

(घ) जहां कंटेनर को सीमा शु\क अधका>रय' *वारा ज[त/अधnहत कर Dलया जाता है और उसे

75 दन' कO नधा=>रत समय सीमा के भीतर खालN नहNं ?कया जा सकता है, वहां भंडारण भार सीमा

शु\क आदेश कO तारNख से लागू होना बंद हो जाएगा, बशतV ?क लाइन' *वारा आवiयक

औपचा>रकताओं का अनुपालन करना होगा और प>रवहन और खालN करने कO लागत वहन करनी

होगी। अ1यथा, ज[त/अधnहत ?कए गए कंटेनर' को लाइन/परेIषती *वारा पतन प>रसर से सीमा

शु\क बंधत CेW म< हटा दया जाएगा और उस मामले म< भंडारण भार ऐसे हटाने कO तारNख से

लागू होना बंद हो जाएगा।

(v) कंटेनर पर भंडारण भार उस अवध के Dलए ोदभूत नहNं होगा जब पतन उपयोगकता= *वारा

अनुरोध ?कए जाने पर कंटेनर को XडलNवर/Dशप करने कO ि3थत म< नहNं होता है।

(vi) यद प>रचालन CेW उपयोगकता=ओं को ?कराये पर पtे पर दया जाता है, तो कागU/कंटेनर पर

भंडारण भार वसूल नहNं ?कया जाएगा।

छोड़कर) पर नेशनल इंड3`Nयल कॉ>रडोर Xडवलपम<ट कॉपUरेशन (एनआईसीडीसी) *वारा दN जानेवालN

लॉिज3टNक डाटा बqक (एलडीबी) सेवा हेतु अनवाय= उपयोगकता= भार (एमयूसी) त कंटेनर 170/-

(जीएसटN को छोड़कर) कO उगाहN कO जाएगी।

2. त कंटेनर 170/- का एमयूसी भार दनांक 27.10.2024 तक लागू रहेगा ।

2.3 काग7 भंडारण भार

(i) "जहाज पूणZता 5दवस (वीसीडी)" का अथ= उस दन से है िजस दन जहाज का चालन पूरN तरह से

पूरा हो जाता है। दन कO गणना ात: 7.30 बजे से अगले दन ात:7.30 बजे तक कO जाएगी।

?wया म< सामा1य संभलाई चालन के Dलए संभलाई भार' के 1.5 गुना से अधक नहNं ह'गे। तटNय

कंटेनर'/कागU के यानांतरण के मामले म<, लदाई या उतराई ?wया म< सामा1य संभलाई चालन के

Dलए तटNय कंटेनर'/कागU के Dलए लागू संभलाई भार' के संदभ= म< संभलाई भार' म< >रयायत कO

गणना कO जाएगी। यानांतरण के Dलए बने कंटेनर'/कागU कO घोषणा इपोट= जनरल मैनफे3ट

(आईजीएम) 3तुत करते समय कO जाएगी। यानांतरण के Dलए बने ऐसे कंटेनर/कागU को उनकO उतराई

कO तारNख से सात दन' के भीतर यानांत>रत ?कया जाएगा।

2.5 इले2pॉ9नक डेटा इंटरचज भार

(i) नया ईडीआई (एसएपी ए-सेस) जारN करने के Dलए 50000/- का एक-समयी भार वसूल ?कए

जाएंगे ।

(i) Iवदेशी और तटNय संबंधत सेवाओं के Dलए ईडीआई शु\क सेवा राDश के 1% पर लगाया जाएगा,

जो wमशः 1यूनतम 2.00 यूएस डॉलर और 100/- और अधकतम 50.00 यूएस डॉलर और 3500/-
