Proceeding No. 64/2021

& Villagers of Sonarkhed,

….. Complainants.
V/s
The Principal Chief Engineer,
Public Works Department,
Altinho, Panaji-Goa
.…. Respondent.
Inquiry Report
(20th April, 2022)
The complaint was received in this Commission
on 05-02-2021, in respect of the insufficient water
supply to the villagers of Assagao village.
2. On perusing the complaint, the Commission
by Order dated 12-03-2021, called for the report/
/reply from the Respondent.
3. The Respondent filed their reply on 19-04-2021.
Thereafter, the Complainants filed their Rejoinder
on 23-09-2021.
4. At the stage of hearing, Complainant No.1 was
heard. Adv. Ms. Harsha Naik was heard on behalf
of the Respondent.
OFFICIAL GAZETTE — GOVT. OF GOA
SERIES II No. 9
2ND JUNE, 2022

5. The Commission has gone through the records
and proceedings. The complaint was filed stating
that the interrupted water supply has created great
hardship and suffering to the locals of Sonarkhed
in the village of Assagao.
6. The reply of the Respondent indicates that the
water supplied to Siolim area is made from Assonora
Water Treatment plant and water to Assagao area is
supplied from reservoirs located at Dashashira, near
DMC and at Ghateshwar Temple. They stated that
Sonarkhed is located at high altitude and at the tail
end portion of distribution system and due to rapid
development, the water consumption has increased
and water supply to tail end portions has been
affected very badly.
7. The Respondent also stated that in order to
address the above issue, Rural Water Supply Scheme
has been taken up by constructing a bore-well in
the area. The old bore-well had become non-
functional and a new bore-well had to be taken up
and the work order was issued in January, 2019.
However, the work could not be started due to
Covid-19 pandemic and the bore-well was
commissioned in February, 2021 and now, water is
supplied to the people of Sonarkhed through the
bore-well and water purification plants are installed
for purifying the water. The Respondent stated that
the work was delayed due to genuine reasons and
water was supplied to the people by water tankers
till completion of the work.
8. The Respondent also stated that the
department has proposed a new water reservoir at
DMC College and though the work was tendered,
there was no response and the work will be re-
tendered after taking necessary approvals and after
completing the above work, water supply to
Assagao will improve.
9. The Complainants, however, filed Rejoinder
admitting that new bore-well is created and the
machinery has been installed in it and the PWD
supplied water from the new bore-well to the
villagers of Sonarkhed region. However, they stated
that the water is contaminated, as per the Report,
dated 25-08-2021, bearing No. EPCW/MC/11/2020-21.
10. The Commission finds that as per the copy of
the Bacteriological Examination Report dated
25-08-2021, bearing No. EPCW/MC/12/2020-21
issued by the Directorate of Health Services, the
sample of water analysed is found free from Coliform
organisms and the water therefore can be
recommended for human consumption after
assessing its chemical analysis. The Analysis Report
dated 25-08-2021, states that the sample of water
analysed does not confirm to the limits prescribed
for drinking water and the water cannot be
recommended for human consumption, as such.
11. Under Section 12(a) of The Protection of
Human Rights Act, 1993, the Commission shall (a)
inquire, suo-motu or on a petition presented to it
by a victim or any person on his behalf [or oh a
direction or order of any court], into complaint of-
(i) violation of human rights or abetment thereof;
or
(ii) negligence in the prevention of such violation,
by a public servant.
12. In the present case, the Commission finds
that the Respondent has not taken effective
measures for regular supply of water for human
consumption to the Sonarkhed area of Assagao
village and there have been human rights violations
by the Respondent.
13. Under Section 18(e) of the Protection of
Human Rights Act, 1993, the Commission shall send
a copy of the Inquiry Report together with its
recommendations to the concerned Government or
authority and they shall, within a period of one
month or such further time as the Commission may
allow, forward its comments on the report, including
the action taken or proposed to be taken, to the
Commission.
14. In view of the facts on record, the Commission
recommends that the Respondent expedite the work
of new water reservoir at DMC College and the
work of installation of the water purifier plant,
within 60 days from today and till then to supply
water fit for drinking through the bore-well to which
water purification plant is connected.
15. Copy of the Inquiry Report be sent to the
Respondent, calling for their comments, including
the action taken or proposed to be taken within a
period of 60 days or on or before 20-06-2022, in terms
of Section 18(e) of the Protection of Human Rights
Act, 1993.
