Notification

In exercise of the powers conferred by

section 13A of the Goa Public Gambling Act,

1976 (Act 14 of 1976), read with section 21 of

the General Clauses Act, 1897 (Central Act

10 of 1897), the Government of Goa hereby

further amends the Government Notification

No.

2-20-92-HD(G)

dated

09-11-1995,

published in the Official Gazette, Series I

No. 34 dated 23-11-1995 (hereinafter called

the “principal Notification”), as follows,

namely:—

In the principal Notification,—

(I) in condition 1,—

(i) after clause (ii), the following clause

shall be inserted, namely:—

“(ii) (a) “AML/CFT Regulations” means

the Goa Anti Money Laundering and

Financing of Terrorism Guidelines, 2013,

as amended from time to time,”;

(ii) in clause (vii), after the word

“Notification”, the expression “and to

ensure compliance of the AML/CFT

Regulations” shall be inserted;

(II) in condition 2, after the existing proviso,

the following proviso shall be inserted,

namely:—

“Provided further that a licence shall not

be granted to any person if he or his

associates or in case of firm or body

corporate any persons holding any key

managerial position in such firm or body

corporate is convicted of any criminal

offence punishable with imprisonment for

a period of not less than 2 years and if

such person is convicted after the license

is granted, such licence shall be cancelled

immediately and all fees paid shall stand

forfeited to the Government.”;

(III) for condition 4, the following condition

shall be substituted, namely:—

“4. (i) The application for obtaining

licence under condition 2 shall, inter alia,

contain the following information about the

person desirous of obtaining such licence,

namely:—

(a) Name, address, nature of constitu-

tion Individual/Company/Firm etc.

(b) Names of shareholders/partners, if

applicable.

holding significant or controlling interest

(more than 10%).

(d) Details of senior management

official.

(e) Past occupation details and details

of other casinos licences in any State and

current status of such licence. If previous

licences in the State of Sikkim or other

States were cancelled, reasons for such

cancellation.

(f) Details of any criminal cases

pending

against

the

applicant,

shareholders, partners, persons holding

significant or controlling interest and

senior management officials. Applicant

shall file police clearance certificate for

the background criminal check.

(g) A declaration to the effect that in

the event of grant of licence, he shall

comply with the AML/CFT Regulations.

(ii) The application under condition 2

shall be signed and verified in the case

of,—

(a) an individual, by the applicant or a

person having due authority to act on

behalf of him;

(b) a firm, by any partner managing

the business thereof;

company, a co-operative society,

corporation or local authority), by a

Director, Manager, Secretary or Principal

Officer thereof or by a person duly

authorized to act in that behalf.”;

(iii) The person signing and verifying an

application for grant of licence shall specify

his status and shall, wherever possible, give

particulars of the authority vested in him

for signing and verifying the application.

(IV) in condition 8, after clause (iii), the

following clause shall be inserted, namely:—

“(iv) The Gaming Commissioner or the

Inspection Officer shall have the power to

inspect the premises on a periodic basis,

as may be determined by him considering

the nature and size of business, the extent

of risk of money-laundering or terrorist

financing and such other factors as may

be necessary to ensure that the provisions

of the Act and the Rules made thereunder,

this Notification and the AML/CFT

Regulations are complied with.”.

This Notification shall come into force with

immediate effect.
