The State of Goa has quota of 450 Nos. of Notaries

as per the G.S.R. 815 (E) dated 23-08-2018 issued by

the Department of Legal Affairs, Ministry of Law &

Justice, Government of India published in the

Gazette of India, Extraordinary Part II, Section 3

sub-section (i).

The Government has decided to fill the vacant

quota of 62 Nos. of Notaries, by calling for

applications/memorials of the applicants in Forms

I and/or II alongwith documents of qualification,

experience certificates on Commercial laws and

other laws vis-a-vis the notarial acts in Notaries

Act & Rules with the report of the Competent

Authorities, through proper channel, in terms of

Notaries Act and Rules, to be forwarded to the

State Registrar-cum-Head of Notary Services, 7th

floor, Shramashakti Bhavan, Patto, Panaji-Goa on or

before 08-02-2024.

The date on which the applicants shall appear

for the interview before the Interview Board shall

be communicated to the applicants, through letters

on their postal address, and/or via email and

message on the mobile number, provided if any as

per memorials. For further information and updates

the applicants may kindly visit official website i.e.

www.goa.gov.in and/or http://registration.goa.gov.in.

Note:- There is one Supplement to the Official Gazette,

Series III No. 42 dated 18-01-2024 namely

Supplement dated 23-01-2024 from pages 1925 to

The process of filling up of 62 vacancies will be

Further, in exercise of the powers conferred on

me under Section 116 of the above Act, I also

authorize the erection of cautionary signboards

“Speed Breaker” at about 40 mts. on either side of

the Speed Breaker in advance of the rumbler strips

and traffic signboard showing the sign “Speed

Breaker” at the placement of the Speed Breaker in

order to regulate the motor vehicular traffic.

The Secretary, Village Panchayat Warkhand-

Nagzar, Pernem is directed to publish this

notification through the Director of Information and

Publicity in local newspapers and P.W.D.

(Engineering Cell) to make necessary arrangements

to construct the Speed Breakers and to erect the

signboards at the places indicated above as per

the specification laid down by the Ministry of Road

Transport and Highways and as published in the

Official Gazette Series I No. 15 dated 15-07-2005 by

the Government of Goa and report compliance

within thirty days time.

34. Petitioners have filed this petition for divorce

by mutual consent under Section 13B of the Hindu

Marriage Act, 1955.

Brief facts of the petition are as under:

2. The marriage between Petitioner No. 1 and 2

was solemnized on 21-11-2017 at Novotel, Goa, as

per Hindu Rites and rituals. They have no issue

born out of said wedlock. They lived together for

same period and due to their differences of opinion

and incompatibility, they have been residing

separately since 15-03-2019 and since then, there

has been no cohabitation between them. They claim

that inspite of all efforts made by them and their

families, no reconciliation between them is possible.

They have, therefore, decided to dissolve their

marriage by mutual consent.

3. After appearance of parties they were referred

to Marriage Counsellor for exploring possibility of

reconciliation. They were given six months period

to reconsider their decision. After six months, both

parties appeared and prayed for divorce. Vide his,

report Exh. 09 dated 08-06-2021, the Counsellor

informed that there is no possibility of reconciliation

between the parties and both parties are agreed

for divorce by mutual consent.

4. Having regards to the contentions of

Petitioners, the following points arise for my

determination and I have recorded my findings

thereon for the reasons as under:

As to point No. 1:

5. Petitioners No. 1 and 2 have filed their claim

affidavit at Exhs. 10 and 11 respectively. Both of

them have stated that they lived together as

husband and wife for some period and they are

residing separately since 15-03-2019 for more than

one year and it is not been possible for them to

reconcile their differences and to live together

inspite of all efforts made by them and their relatives

and therefore, their marriage may be dissolved.

6. After going through the Affidavits of the

Petitioners, I find that there is no cohabitation

between them since last one year prior to the

presentation of the petition and there is no

possibility of their reunion and they have decided

to have a decree of divorce by mutual consent. The

marriage, thus, appears to have been broken down

irretrievably. After going through the entire facts

and circumstances of the case and the Affidavits of

both Petitioners, I am satisfied that there was and

is no undue influence, force, pressure or

misrepresentation upon the parties for taking

divorce by mutual consent and their consent

appears to be voluntary and free. It is clear from

their petition and their Affidavits that both

Petitioners have waived their right of permanent

alimony/maintenance against each other for past,

present and future. Now, they do not have any claim

in respect of maintenance, stridhan articles or

properties of whatsoever nature against each other.

Both the Petitioner agrees to abide all the terms

signed/settled between them.

7. It is seen that till today, the Petitioners have

not withdrawn their consent for divorce. Similarly,

there appears no impediment in their way for having

a decree of divorce as prayed by them. Therefore,

I am of the opinion that Petitioners are entitled for

a decree of divorce by mutual consent under Section

13-B of the Hindu Marriage Act, 1955. Accordingly,

points No. 1 is answered and I proceed to pass the

following order:

Order

1. The petition is allowed.

2. The marriage between Petitioner No.1 and

Petitioner No. 2 solemnized on 21-11-2017 is

hereby dissolved by a decree of divorce by

mutual consent under Section 13B of the

Hindu Marriage Act, 1955.

3. Consent terms at Exh. 6 shall form part of

decree.

4. Parties shall bear their own costs.

5. Decree be drawn up accordingly.

6. A copy of decree be supplied free of costs to

the parties.
