Whereas, the Ministry of Petroleum and Natural
Gas (MoPNG), Government of India is organizing
India Energy Week (IEW), 2024 from 6th to
9th February, 2024 in IPSHEM, ONGC, Betul-Goa.
The Global event is being inaugurated by the
Hon’ble Prime Minister of India and delegates from
many foreign countries will be attending the said
event.
And whereas, the Asstt. Manager, BSNL, EDC,
Plot Patto, Panaji-Goa has requested to impose a
ban on road digging and development activities of
all types of roads in North Goa for the period from
6th to 10th February, 2024.
And whereas, it is expedient to impose a ban on
digging and cutting of all types of roads, including

National Highways, State Highways, Major District
roads, road-shoulders, lanes, etc. in North Goa in
order to avoid damage to the BSNL UG cable, OF
cable etc. due to digging/developmental activity
by the concerned agencies as the Hon‘ble Prime
Minister of India and delegates from many foreign
countries will be visiting Goa for the India Energy
Week (IEW), 2024 from 6th to 9th February, 2024 in
IPSHEM, ONGC Betul, Goa.
Now, therefore, I, Dr. Sneha S. Gitte, IAS, District
Magistrate, North Goa in exercise of the powers
vested in me under Section 144 of the Code of
Criminal Procedure, 1973 and having satisfied
myself, do hereby impose the ban on road digging/
/development activities of all types of roads in North
Goa for the period from 6th to 10th February, 2024.
Any person, agency or department etc.
contravening this order will be liable for
punishment under Section 188 of the Indian Penal
Code. This order shall come into force immediately
and shall remain in force till 10-02-2024.

Fatorda, Margao is scheduled on 6th February, 2024
and for which various security arrangements are
required to be taken;
And whereas, as a measure to beef-up security
there shall be restriction on the aerial photography
or videography in any form such as by use of drone
cameras, flying balloons, etc. Hence, there is
sufficient ground for proceeding under Section 144
of the Criminal Procedure Code, 1973, to prevent
aerial photography and aerial videography or
videography in any form such as by use of drone
cameras, flying balloons, etc.;
Now, therefore, I, Asvin Chandru A., IAS, District
Magistrate, South Goa District, Margao-Goa in
exercise of the powers vested in me under Section
144 of the Code of Criminal Procedure, 1973, do
hereby prohibit aerial photography in any form such
as by use of drone cameras, flying balloons or by
any other aviated devices within 5 kms. radius
around ONGC IPSHEM, Betul and within 5 kms.
radius of Kadamba Transport Corporation Limited
(KTCL) Bus Stand Fatorda, Margao and accordingly
declared as ‘Red Zone/No Fly Zone’ in South Goa
District w.e.f. 06-02-2024 to 09-02-2024;
Provided that the above order shall not apply to:
1. Police Personnel and other Government
officials/agencies if using the drone purely in
connection with their officials duties, subject to
the following conditions:
a) That the Police Personnel and other Government
officials shall be in their service uniform, and
shall carry their identity cards and authorization
cards authorizing them to use the drone in
connection with their officials duties, issued by
the Competent Authority.
b) That the exemption is applicable in relation to
the above said personnel only when they are on
official duty and to other agencies/entities who
are granted specific NOC/permission by this
office subject to compliance of the guidelines
and drone Rules, 2021 governing the same.
In view of the emergent nature of the order, it is
being issued ex-parte and is addressed to the public
in general. Any breach of this order would invite
action under Section 188 of the Indian Penal Code.

The grant of land is subject to following terms and conditions:-
(1) The land granted shall be used only for the purpose of dwelling house within the area as mentioned
herein above.
(2) The grantee, or his/her heirs, assigns and legal representatives shall not mortgage, sell, assign or
otherwise transfer the land or any portion thereof except with the previous sanction of the Government.
(3) If the grantee commits breach of any of the conditions or any provisions of the Goa (Abolition of
Proprietorships, Titles and Grants of Lands) Act, 2014 and rules made thereunder, the Collector may
resume and take possession of the land granted to him/her, and that, he/she shall be liable to be evicted
from the said land.
(4) The grantee also agrees to unconditionally abide by any other terms and conditions which the
Collector/Government may like to impose from time to time.
(5) The grantee shall not create any third party rights in respect of the Sanads, nor change the nature
of the property, nor exceed the existing plinth area or reconstruct the existing houses, except repairs, until
further Orders of the Hon’ble High Court of Bombay at Goa.
In case, any interested person in the lands specified above, has any objection to the said provisional
declaration he/she may file objection/say in writing, within two months from the date of publication of
this provisional declaration in Official Gazette and notice is hereby given that the objections received
under sub-section (1) of Section 12, shall be disposed off individually and appeals against such decision/
/order of the Collector shall lie with the Tribunal.
The said declaration, as modified by any orders, if any, passed by the Deputy Collector, Bicholim Goa,
or where an appeal has been filed with the Tribunal, as modified by the decision of the Tribunal, shall
be final and shall be conclusive evidence of the conferment of the occupancy rights under section 4(a)
and 8(2) of the said Act. This conferment of occupancy rights shall be subject to the result of Writ Petition
No. 479 of 2016 before the Hon’ble High Court of Bombay at Goa.

Ref. SGPDA/ODP-2031(M)/1643/23-24
Whereas, Government vide Order No. 36/1/TCP/
/327/2018/656 dated 15-03-2021 under Section 39(1)
of the Town & Country Planning Act, 1974 (Act 21
of 1975) (herein referred to as the “Said Act”),
issued directives to South Goa Planning and
Development Authority (hereinafter referred to as
the “Authority”) to prepare Outline Development
Plans for Margao Planning Area (hereinafter
referred to as the “Draft ODP-2031 for Margao
Planning Area”), in terms of Section 39 of the Goa
Town & Country Planning Act, 1974 (Act 21 of 1975);
And whereas, this Authority in consultation with
Margao Municipal Council prepared the Draft ODP-
2031 for Margao Planning Area and placed in 91st
Authority meeting held on 14-09-2021 and the said
plan was approved by the Authority;
And whereas, the Draft ODP-2031 for Margao
Planning Area was submitted to the Town &
Country Planning Board (hereinafter referred to as
the “TCP Board”) for its consideration;
And whereas, the TCP Board in its 175th (Adj)
(2nd sitting) held on 24-09-2021 approved the Draft
ODP-2031 for Margao Planning Area and thereafter
the same was submitted to the Government under
Section 34 of the said Act for obtaining its consent
to the publication of notice of preparation of the
said Draft ODP-2031 for Margao Planning Area under
Section 35 of the said Act;
And whereas, the Government accorded
approval vide No. 36/1/TCP/327/2018/2313 dated
25-10-2021 under Section 34 of the said Act for the
publication of the notice of preparation of the Draft
ODP-2031 for Margao Planning Area under Section
35 of the said Act;
And whereas, in exercise of the powers conferred
by Section 39 read with Section 35 of the said Act,
the Authority published the Draft ODP-2031 for
Margao Planning Area which was kept for
inspection of the public in general on all working
days in the office of the South Goa Planning and
Development Authority office at “Osia Commercial
Arcade” D Wing, 4th floor, Margao-Goa, office of
S.G.P.D.A., ‘B’ Bldg., 1st Floor Central Mansion,
Ponda-Goa and Margao Municipal Council Office
at Margao-Goa;
And whereas, objections/suggestions, if any, to
the said Draft ODP-2031 for Margao Planning Area,
to be forwarded in writing to the Member Secretary
of South Goa Planning and Development Authority
with full name and address of the Member of the
public making objection/suggestion within a period
of two months from the date of publication of this
Notification in the Official Gazette;
And whereas, the Government vide Order No.
47/5/TCP/2022-23/1026 dated 27-04-2022 published
in the Official Gazette Series II No. 4 dated
28-04-2022 directed the Authority to keep on hold
the Draft ODP-2031 and to prepare fresh Outline

Development Plan for Margao Planning Area in
consultation with the consultants/experts as may
be decided by the Government and TCP Board as
conveyed by the Chief Town Planner (Planning)
vide Order No. 36/1/TCP/426/2022/2097 dated
24-08-2022;
And whereas, the said Government directions
issued were placed in the 97th Authority meeting
held on 14-09-2022;
And whereas, this Authority resolved to seek
one more months’ time for receiving objections of
already notified Draft ODP-2031 for Margao Planning
Area vide Ref. No. SGPDA/ODP-2031(P)/776/22-23
dated 14-09-2022 from the Government;
And whereas, the Chief Town Planner (Planning)
vide Order No. 36/1/TCP/426/2022/2928 dated
03-11-2022 conveyed the decision in the 184th TCP
Board meeting held on 15-09-2022, stating that the
TCP Board has recommended to extend the said
period by 30 days, and the said recommendation of
the TCP Board has been accepted by the
Government;
And whereas, after the approval of the
Government to extend the period of 30 days, the
Draft ODP-2031 of Margao Planning Area was kept
for inspection of the general public on all working
days in the office of the South Goa Planning and
Development Authority “Osia Commercial Arcade”
D Wing, 4th floor, Margao-Goa, Office of S.G.P.D.A.,
‘B’ Bldg., 1st Floor Central Mansion, Ponda-Goa and
Margao Municipal Council Office at Margao-Goa.
And whereas, this Authority issued the Public
Notice in the Government Official Gazette Series III
No. 38 dated 22-12-2022 requesting the general
public to file in their objections in writing to the
Member Secretary of South Goa Planning and
Development Authority, Margao-Goa with full name
and address of the Member of the public making
objection within a period of 30 days from the date
of publication of this Notification in the Official
Gazette.
And whereas, it is also brought to the notice of
the general public that the objections which were
received earlier by this Authority for the Draft ODP-
2031 of Margao Planning Area need not be filed
again, as the same are already in record of this
Authority;
And whereas, after inspecting the site and
hearing the objections, by the committee
constituted by the Authority for said purpose, the
said committee submitted its report to the Authority
under Section 35(6) of the Town and Country
Planning Act, 1974 and the Authority in its 103rd
meeting held on 02-02-2024 considered the report
and unanimously approved the ODP-2031 of Margao
Planning Area.
And whereas, the ODP-2031 of Margao Planning
Area was submitted to the Town and Country
Planning Board for consideration under Section 36
of Town and Country Planning Act, 1974 vide letter
Ref. No. SGPDA/P/ODP-2031/1630/23-27 dated
07-02-2024. The said O.D.P. 2031 of Margao Planning
Area was placed before 196th meeting of the Goa
Town and Country Planning Board held on
13-02-2024 and the Board recommended its approval
for the same.
And whereas, approval of the Government under
Section 36 of Town and Country Planning Act, 1974
is communicated by The Chief Town Planner
(Planning) vide Order No. 36/1/TCP/426/2022/702
dated 14-02-2024.
And whereas, under Section 37(1) of Town and
Country Planning Act, 1974, the publication of
Notification of the ODP-2031 of Margao Planning
Area is notified, and shall come into operation under
Section 37(3) of Town and Country Planning Act,
1974 from date of publication of this notification.
The said ODP-2031 of Margao Planning Area shall
be subject to the provisions of “The Goa Land
Development & Building Construction Regulation
2010” as amended from time to time.
And whereas, this Authority now therefore is
informing the general public that the copy of the
ODP-2031 of Margao Planning Area shall be
available for the inspection at the Office of South
Goa Planning and Development Authority office at
“Osia Commercial Arcade” D Wing, 4th floor,
Margao-Goa, office of S.G.P.D.A., ‘B’ Bldg., 1st Floor

Whereas, Government vide Order No. 36/1/TCP/
/327/2018/656 dated 15-03-2021 under Section 39(1)
of the Town & Country Planning Act, 1974 (Act 21

Country Planning Act, 1974 (Act 21 of 1975);
And whereas, this Authority in consultation with
Ponda Municipal Council prepared the Draft ODP-
2031 for Ponda Planning Area and placed in 91st
Authority meeting held on 14-09-2021 and the said
plan was approved by the Authority;
And whereas, the Draft ODP-2031 for Ponda
Planning Area was submitted to the Town &
Country Planning Board (hereinafter referred to as
the “TCP Board”) for its consideration;
And whereas, the TCP Board in its 175th (Adj)
(2nd sitting) held on 24-09-2021 approved the Draft
ODP-2031 for Ponda Planning Area and thereafter
the same was submitted to the Government under
Section 34 of the said Act for obtaining its consent
to the publication of notice of preparation of the
said Draft ODP-2031 for Ponda Planning Area under
Section 35 of the said Act;
And whereas, the Government accorded
approval vide No. 36/1/TCP/327/2018/2313 dated
25-10-2021 under Section 34 of the said Act for the
publication of the notice of preparation of the Draft
ODP-2031 for Ponda Planning Area under Section
35 of the said Act;
And whereas, in exercise of the powers conferred
by Section 39 read with Section 35 of the said Act,
the Authority published the Draft ODP-2031 for
Ponda Planning Area which was kept for inspection
of the public in general on all working days in the
office of the South Goa Planning and Development
Authority office at “Osia Commercial Arcade”
D Wing, 4th floor, Margao-Goa, office of S.G.P.D.A.,
‘B’ Bldg., 1st Floor Central Mansion, Ponda-Goa and
Ponda Municipal Council Office at Ponda-Goa;
And whereas, objection/suggestions, if any, to
the said Draft Outline Development Plans for Ponda
Planning Area, to be forwarded in writing to the
Member Secretary of South Goa Planning and
Development Authority with full name and address
of the Member of the public making objection/
/suggestion within a period of two months from the
date of publication of this Notification in the Official
Gazette;
And whereas, the Government vide Order No.
47/5/TCP/2022-23/1026 dated 27-04-2022 published
in the Official Gazette Series II No. 4 dated
28-04-2022 directed the Authority to keep on hold
the Draft ODP-2031 and to prepare fresh Outline
Development Plan for Ponda Planning Area in
consultation with the consultants/experts as may
be decided by the Government and TCP Board as
conveyed by the Chief Town Planner (Planning)
vide Order No. 36/1/TCP/426/2022/2097 dated
24-08-2022;
And whereas, the said Government directions
issued were placed in the 97th Authority meeting
held on 14-09-2022;
And whereas, this Authority resolved to seek
one more months’ time for receiving objections of
already notified Draft ODP-2031 for Ponda Planning
Area vide Ref. No. SGPDA/ODP-2031(P)/776/22-23
dated 14-09-2022 from the Government;
And whereas, the Chief Town Planner (Planning)
vide Order No. 36/1/TCP/426/2022/2928 dated
03-11-2022 conveyed the decision in the 184th TCP
Board meeting held on 15-09-2022, stating that the
TCP Board has recommended to extend the said
period by 30 days, and the said recommendation of
the TCP Board has been accepted by the
Government;
And whereas, after the approval of the
Government to extend the period of 30 days, the
Draft ODP-2031 of Ponda Planning Area was kept
for inspection of the general public on all working
days in the office of the South Goa Planning and
Development Authority “Osia Commercial Arcade”
D Wing, 4th floor, Margao-Goa, Office of S.G.P.D.A.,
‘B’ Bldg., 1st Floor Central Mansion, Ponda-Goa and
Ponda Municipal Council Office at Ponda-Goa.
And whereas, this Authority issued the Public
Notice in the Government Official Gazette Series III
No. 38 dated 22-12-2022 requesting the general
public to file in their objections in writing to the
Member Secretary of South Goa Planning and
Development Authority, Margao-Goa with full name
and address of the Member of the public making
objection within a period of 30 days from the date
of publication of this Notification in the Official
Gazette.
And whereas, it is also brought to the notice of
the general public that the objections which were
received earlier by this Authority for the Draft ODP-
2031 of Ponda Planning Area need not be filed again,
as the same are already in record of this Authority;
And whereas, after inspecting the site and
hearing the objections, by the committee
constituted by the Authority for said purpose, the
said committee submitted its report to the Authority
under Section 35(6) of the Town and Country
Planning Act, 1974 and the Authority in its 103rd
meeting held on 02-02-2024 considered the report
and unanimously approved the ODP-2031 of Ponda
Planning Area.
And whereas, the ODP-2031 of Ponda Planning
Area was submitted to the Town and Country

Planning Board for consideration under Section 36
of Town and Country Planning Act, 1974 vide letter
Ref. No. SGPDA/P/ODP-2031/1630/23-27 dated
07-02-2024. The said O.D.P. 2031 of Ponda Planning
Area was placed before 196th meeting of the Goa
Town and Country Planning Board held on
13-02-2024 and the Board recommended its approval
for the same.
And whereas, approval of the Government under
Section 36 of Town and Country Planning Act, 1974
is communicated by The Chief Town Planner
(Planning) vide Order No. 36/1/TCP/426/2022/702
dated 14-02-2024.
And whereas, under Section 37(1) of Town and
Country Planning Act, 1974, the publication of
Notification of the ODP-2031 of Ponda Planning Area
is notified, and shall come into operation under
Section 37(3) of Town and Country Planning Act,
1974 from date of publication of this notification.
The said ODP-2031 of Ponda Planning Area shall
be subject to the provisions of “The Goa Land
Development & Building Construction Regulation
2010” as amended from time to time.
And whereas, this Authority now therefore is
informing the general public that the copy of the
ODP-2031 of Ponda Planning Area shall be available
for the inspection at the Office of South Goa
Planning and Development Authority office at “Osia
Commercial Arcade” D Wing, 4th floor, Margao-
