i.e. to promote the economic interest of its members
and more particularly to assist them in obtaining
mainly books, stationery etc., at reasonable prices to
carry on trade for the benefit of members, to sell to

articles of consumption as may be procured by it, to
supply provisions, sports goods, stationery and other
consumer goods to the student hostels, messes,

2001 and Rules, 2003. The instructions to this effect
were already been issued by this office from time to

records of this office, that the society has not
convened its Annual General Body Meeting since
the year 1998. This shows that the Board of Directors
of the said society have not performed their duty as
imposed upon them under the provisions of the Act
and Rules and Bye-laws of the society. Thus they
have deprived the members from participating in
their general meeting.
And Whereas, in terms of Section 74 of the Goa
Co-operative Societies Act, 2001, the accounts of
the society shall be audited within six months of
the close of the financial year to which such
accounts relate by appointing auditor from the
Panel of Auditors constituted by the Registrar.
However, from the available records of this office, it
is observed that, the Audit of the society is pending
from the financial year 2004-2005. This act of the
management of not conducting timely audit and
presenting the same before the general body is
detrimental to the interest of the society.
And whereas, it is also observed that the society
has failed to file annual returns and deposit filing
fees as required in terms of provision of Section 81
read with Rule 113 of the Goa Co-operative Societies
Act, 2001 and Rules, 2003 since implementation of

the election of a Board has to be conducted by the
Registrar before the expiry of the term of the board
so as to ensure that the newly elected members of
board assume office immediately on the expiry of
the office of members of outgoing board. From the
records rested with this office it is observed that
the election of the society has fallen due and
management has not approach this office for
conducting election.
And due to failure on the part of the Board of
Directors of the above said society to comply with
the above said statutory provisions of the Act, Show
Cause Notice cited at Sr. No. 1 above was issued to
the society under Section 66, 72, 74, 81 and 92 of the
Goa Co-operative Societies Act, 2001 and the
Interim order under Section 92 of the Goa
C o -operative Societies Act, 2001 and the
opportunity was given to the Board of Directors to
submit their say in the matter. However, none of the
Board of Directors remained present for the hearing
in person nor submitted their written reply in the
matter.
From the above facts and circumstances,
inference can be drawn that no members are
interested in running the affairs of the above said
society as such no purpose will be served if the
society is allowed to continue further and therefore,
being satisfied that this is a fit case for winding up
the affairs of the society, I pass the following order:
