Petition No. A-2195 of 2017. [Converted]

(CNR No.- MHFC01-005424-2017)

Ketaki Vishweshwar Laad,

an Indian Inhabitant,

aged about 36 years,

occupation: service,

r/a c/o Mr. Satish Khot,

4/C Himgiri Apartments, 1277,

Hatiskar Marg, Prabhadevi,

Mumbai 400025 .... Petitioner No. 1.

(Original Petitioner)

And

Vishweshwar Suraj Laad,

an Indian Inhabitant,

aged about 41 years,

occupation: service,

r/a H. No. 573,

near Ravalnath Temple,

Anandwadi,

Savordem-Goa 403706 .... Petitioner No. 2.

(Original Respondent)

Petition under Section 13 (B) of Hindu Marriage

Act, 1955, for Mutual Consent Divorce.

Judgment

(Delivered on 21-11-2022)

32. Petitioner No. 1-Ketaki Vishweshwar Laad and

Petitioner No. 2-Vishweshwar Suraj Laad filed

application below Exh. No. 38 to convert petition

filed by Petitioner-Ketaki for dissolution of marriage.

The said application came to be allowed and

petition is converted for mutual consent divorce

under Section 13 (B) of the Hindu Marriage Act,

1955.

2. Petitioner Nos. 1 and 2 were married on

11-02-2016 at Madgaon. They cohabited together

for about 11 months. They are unable to live

together as husband and wife. There is no issue

born from the aforesaid wedlock. Due to differences

in opinion and temperaments, they are unable to

live as husband and wife, hence they have decided

to dissolve the marriage.

3. There is no collusion in respect of mutual

consent divorce. Hence, they have claimed decree

of divorce by mutual consent.

4. Considering averments of petition following

points arise for my determination and I record my

findings for the reasons below.

Point

Finding

1. Whether Petitioners are

residing separately for more

than one year on the date

of presentation of petition? .. In affirmative.

2. Whether they are unable

to live together? .. In affirmative.

3. Whether there is any

impediment to grant of

decree of mutual consent

divorce?

.. In negative.

4. What order? As per final order.

Reasons

As to Point No. 1 to 4:

5. Petitioner No. 1 has filed petition under Section

13(1)(i-a) of the Hindu Marriage Act for decree of

divorce. Later on, original Petitioner and

Respondent decided to dissolve marriage by mutual

consent. They moved an application to convert the

petition under Section 13-B of the H. M. Act, below

Exh. No. 38. It came to be allowed. They have also

prepared consent terms at Exh. 37.

6. Claim Affidavits of Petitioner Nos. 1 and 2 are

at Exh. Nos. 42 and 43. Petitioner No. 2 has paid

Rs. 4,50,000/- to the Petitioner No. 1 towards

lumpsum alimony. There are no exchanges pending

between them. They shall not claim any movable

and immovable properties against each other.

7. It reflects from the claim Affidavits of

Petitioners that since January 2017, they are

residing separately. Admittedly, petition is

374

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES III No. 10

6TH JUNE, 2024

presented on 09-08-2017. It appears that on the

date of conversion of petition, for more than one

year parties residing separately. Due to differences

in opinion and temperaments they are unable to

live together and accordingly they have decided

to dissolve their marriage by mutual consent.

Considering claim Affidavits of Petitioner Nos. 1

and 2, I am of the view that there is no possibility

of reconciliation and both the petitioners voluntarily

decided to dissolve their marriage. Hence, I have

no hesitation to allow the application.

8. It reflects from the claim Affidavits of Petitioner

No. 1 and 2 that Petitioner No. 1 is residing at

Mumbai. Hence, this Court has jurisdiction to

entertain this petition. There is no any impediment

to allow the petition, hence in view of above

discussion I record my findings No. 1 and 2 in

affirmative and No. 3 in negative. In result I proceed

to pass following order:-

Order

1. Petition is allowed.

2. Marriage between Petitioner No. 1-Ketaki

Vishweshwar

Laad

and

Petitioner

No. 2-Vishweshwar Suraj Laad solemnized on

11-02-2016, is hereby dissolved by decree of

mutual consent divorce U/s 13 (B) of the Hindu

Marriage Act.

3. Consent terms at Exh. 37 are part and parcel

of decree.

4. Decree be drawn-up accordingly.
