1. Whereas the exercise of the powers conferred
by sub-section (2) of Section 8, of the Mines and
Minerals (Developments and Regulation) Act,
1957 (Central Act 67 of 1957), read with sub-rule
3 of Rule 24A of the Mineral Concession Rules,
1960, the Government of Goa vide Order No. 96/
/377/88/IIR-Mines/3243 dated 14-12-2009 r/w
corrigendum dated 21-12-2009, renewed the
mining lease-Godbaem-Ou-Cuttiem Mine
bearing T.C. No. 63 of 1951, situated in Curpem
Village of Sanguem Taluka, in favour of Shri
Rajesh P. Timblo-legal representative of late Shri
Chandrakant Fondu Naik, for a period of 20 years
effective from 22-11-2007 to 21-11-2027.
2. And whereas, subsequently on 30th day of
December 2009, a “Mining Lease Deed” in FORM
K was executed between the State Government
and Shri Rajesh Prakash Timblo-legal
representative of late Shri Chandrakant Fondu
Naik (referred to as lessee) under the provisions
of the Mineral Concession Rules, 1960, wherein
Shri Rajesh P. Timblo has signed as Lessee.
3. And whereas, Shri Rajesh P. Timblo vide letter
dated 06-01-2010, contended that for all purpose
since the mining lease has devolved on him and
he is having absolute title and possession,
therefore requested to effect the change in name
from Shri Rajesh P. Timblo-legal representative
to Rajesh P. Timblo-Lessee.
4. And whereas, the said matter was referred for
legal opinion, and it is opined on 10-06-2010
having inward number 2331 at page 16/N in the
file bearing No. 96/377/88-IIR-Mines, that “there
can be no objection to accept his request, since
in any case he being described as legal
representative of late Chandrakant Naik only
indicates the manner in which title has
devolved on him, which otherwise is a matter of
record”.
5. And whereas, Shri Rajesh Prakash Timblo, during
the subsistence of the said Mining Lease,
expired on 08-03-2021.
6. And whereas, Smt. Vilda alias Vidya Rajesh
Timblo, wife of late Shri Rajesh Prakash Timblo
vide letters dated 10-01-2022 & 20-10-2022
applied to the State Government for Mutation of
her name in the said mining lease as legal heir
of late Shri Rajesh P. Timblo, under the provisions
of Rule 23B of the Minerals (Other than Atomic
and Hydro Carbons Energy Mineral) Concession
(Fourth Amendment) Rules, 2021.
7. And whereas, the matter was referred to the
Government for legal opinion, wherein the
Government has approved the said request on
29-02-2024 at page 59/N in file bearing No. 96/
/377/88-IIR-MINES (PART).
