Order

No. 15/223/2008/Adt/RCS/Vol.IV/3081

Read: 1) Section 113A read with Rule 136A of the

Goa Co-operative Societies Act, 2001 and

Rules, 2003.

2) This office order No. 15/223/2008/Adt/

/RCS/Vol.IV/2517 dated 03-10-2023.

3) This office Addendum No. 15/223/2008/

/Adt/RCS/Vol.IV/4519 dated 20-02-2024.

(Under Section 68 of the Goa Co-operative

Societies Act, 2001)

Whereas, the provisions of the Goa Co-operative

Societies Act, 2001 (Goa Act No. 36 of 2001)

(hereafter referred to as “Act”) is amended by

introducing the Goa Co-operative Societies

(Amendment) Act, 2021 which came into force from

01-04-2023.

And whereas, with the Goa Co-operative

Societies (Amendment) Act, 2021, the scheme of

provision of Section 113A was introduced which

mandates every Co-operative Housing Society

Note:- There are two Extraordinary issues to the Official

Gazette, Series II No. 36 dated 05-12-2024 as follows:

(1) Extraordinary dated 05-12-2024 from pages

767 to 768 regarding Notification from

Department of Finance.

(2) Extraordinary (No. 2) dated 09-12-2024 from

pages 769 to 770 regarding Order from Goa

State Election Commission.

having more than five members to appoint in its

General Body meeting a Reconciliator from the Panel

of Reconciliators constituted by the Registrar with

the prior approval of the Government.

And whereas, the Panel of Reconciliators was

constituted vide this office order dated 03-10-2023

referred to at Sr. No. 2 & 3 above which was

published in the Official Gazette under Series II

No. 28 dated 12-10-2023 and Series II No. 49 dated

07-03-2024 respectively for the information of the

general public. Therefore, as per sub-section (3) of

Section 113A of the Act, any dispute or difference of

opinion arising amongst the members or any

non-compliance or delay in compliance affecting the

members/society has to be referred to such

Reconciliator by either of the parties for decision.

And whereas, Rule 136A was introduced in the

principle rules through the Goa Co-operative

Societies (Fourth Amendment) Rules, 2023 mandating

every co-operative housing society as classified

under sub-rule (7) of Rule 8 to choose and appoint

one or more Reconciliators within 60 days from the

date of coming into force of these Rules.

And whereas, the said Fourth Amendment Rules,

2023 came into force w.e.f. 22-06-2023. Nevertheless,

instances have come to the notice of the office that

inspite of clear provision of the Act and Rules, many

Co-operative Housing Societies have failed to comply

with the mandatory requirement of appointing

Reconciliators from the Panel of Reconciliators

constituted for the purpose.

And whereas, the timeline of 60 days for such

appointment from the date of amended Rules dated

20-06-2023 have already exceeded. The members of

the society have been rendered remediless when

they need to sort out any issues which have to be

dealt before the Reconciliators, without which they

cannot escalate the issue before the Competent

Authority.

And whereas, the general body of the

co-operative housing societies being empowered to

772

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 37

12TH DECEMBER, 2024

appoint Reconciliator, it should have been its

responsibility to perform its statutory duty of

appointment of Reconciliator. The aforesaid

compliance is of utmost important to ensure smooth

conduct and to have transparency in the

management of the affairs of the society. Due to

such casual approach by the management of

societies, the members of such societies are facing

hardship in resolving their issues as covered under

sub-section (3) of Section 113A of the Act, thus

leaving no option before the members but to address

the grievances before the registering authority

which defeats the very purpose of having a express

provision in the Act.

And whereas, in order to overcome the problems

faced by the members and to ensure that the

provision of Section 113A of the Act read with Rule

136A of the Rules are adhered in its true spirit, it is

felt necessary to issue directions under Section 68

of the Act, giving liberty to the member of these

co-operative societies to file their dispute as

specified under sub-section (3) of Section 113A of

the Act to any of the Reconciliator whose name is

listed in the Panel of Reconciliators.

Now therefore, the Government in exercise of

powers conferred upon it under Section 68 of the

Goa Co-operative Societies Act, 2001, hereby

provide a remedy to the members of the

co-operative housing societies to file their dispute

or difference of opinion arising amongst the

members or any non-compliance or delay in

compliance affecting the members/society which

are covered under sub-section (3) of Section 113A of

the Act before any of the Reconciliators from the

Panel of Reconciliators constituted for the purpose,

if in case the society has failed to appoint the

Reconciliator in its general body meeting and that

shall be binding upon the co-operative housing

society or the member concerned as the case may

be to accept the finding/award of such

Reconciliator in a manner provided under Section

113A(5) of the Act.

This is a arrangement in respect of such Housing

Societies which shall remain in force until the

co-operative housing society appoints the Reconciliator

as required under Section 113A of the Act and such

details of the appointed Reconciliator of the concern

Housing Society is uploaded on the website of the

department.

Given under the seal of this office.

Goa.
