assessed in terms of Section 6 of the Goa (Abolition of Proprietorships, Titles and Grants of Lands) Act,
2014 and had duly submitted the payment receipt vide No. 693550 dated 28-06-2024.
And whereas, the undersigned being satisfied that the following applicant fulfills all the essential
conditions/criteria laid down under the Goa (Abolition of Proprietorships, Titles and Grants of Lands) Act,

The grant of land is subject to following terms and conditions:-
(1) The land granted shall be used only for the purpose of dwelling house within the area as mentioned
herein above.
(2) The grantee, or his/her heirs, assigns and legal representatives shall not mortgage, sell, assign or
otherwise transfer the land or any portion thereof except with the previous sanction of the Government.
(3) If the grantee commits breach of any of the conditions or any provisions of the Goa (Abolition of
Proprietorships, Titles and Grants of Lands) Act, 2014 and rules made thereunder, the Collector may
resume and take possession of the land granted to him/her, and that he/she shall be liable to be evicted
from the said land.
(4) The grantee also agrees to unconditionally abide by any other terms and conditions which the
Collector/Government may like to impose from time to time.
(5) The grantee shall not create any third party rights in respect of the Sanads, nor change the nature
of the property, nor exceed the existing plinth area or reconstruct the existing houses, except repairs, until
further Orders of the Hon’ble High Court of Bombay at Goa.
In case, any interested person in the lands specified above, has any objection to the said provisional
declaration he/she may file objection say in writing, within two months from the date of publication of
this provisional declaration in Official Gazette and notice is hereby given that the objections received
under sub-section (1) of Section 12, shall be disposed off individually and appeals against such decision/
/order of the Collector shall lie with the Tribunal.
The said declaration, as modified by any orders, if any, passed by the Deputy Collector, Bicholim-Goa,
or where an appeal has been filed with the Tribunal, as modified by the decision of the Tribunal, shall
be final and shall be conclusive evidence of the conferment of the occupancy rights under Section 4(a)
and 8(2) of the said Act. This conferment of occupancy rights shall be subject to the result of Writ Petition
No. 479 of 2016 before the Hon’ble High Court of Bombay at Goa.

1. By this order I shall dispose off the application/
/objection filed by Adv. Jawahar L. Dias, under
instruction of his client, Michael Tony Ferns,
major of age, resident of H. No. 45, near Arcanjo
Menezes Hospital, Rua Bernardo da Costa,
Margao-Goa vide dated 13-02-2024 towards
Provisional Declaration granted vide No. DCB/
/BICH/Cust-Evacuee/VPMV/78/2023/28 dated
16-06-2023.
2. The dispute in this appeal pertains to area of
372 sq. mtrs in Survey No. 155/3, Village
Panchayat Maem–Vainguinim. This area is said
to form a part of the total area in Survey No.
155/3 approximating 2650 sq. mtrs. The
complainant claims to be the owner of the land
in question, further stating that Shri Ramesh
Datta Rawle is a encroacher in his property.
3. Brief facts about the case, this office was is in
receipt of application for declaring the proprietor
or title holder or grantee as an Occupant Class-
-II under Section 4 or 8 of the Goa (Abolition of
Proprietorships, Titles and Grants of Land) Act,
2014 in Form–I under rule 3(1) from Shri Ramesh
Datta Rawle, resident of H. No. 1394/7, Deus-
-Bhatwadi, Mayem, Bicholim-Goa for grant of
land as an Occupant Class–II as Agriculture
Labourer dated 31-05-2016.
4. The claim of the applicant was verified and
scrutinised by the Mamlatdar of Bicholim Taluka
and accordingly Survey plan was produced by
the Mamlatdar office.
5. Applicant Shri Ramesh Datta Rawale has
produced original house tax receipt bearing
Receipt Book No. 634 Receipt No. 036 in the
name of Ramesh Ravle for H. No. 1394/7 for year
2007-2008 to 2011-2012 dated 1-7-2011 issued
by the Secretary, V. P. Maem–Vainguinim. Also
produced original water supply bill No. BIF/
/0438 issued on 09-04-14 for the period 10-12-13
to 06-02-14 showing meter fixed date as 22-05-09
in the name of Ramesh D. Rawle for H. No. 1394/7,
Deus Bhatwada, Mayem.
6. Also produced original water supply bill bearing
No. BIF/0438 issued on 09-04-14 showing meter
fixed date as 22-05-2009 for the period from
10-12-13 to 06-02-14 in the name of Ramesh D.
Rawle for H. No. 1394/7.
7. Also produced copy of Form I and XIV for Survey
No. 155/3 showing Govt. of Goa and Konkan
Railway in the occupant column against the
mutation No. 287, 18800.
8. By perusing both the original documents it was
clear that the house bearing H. No. 1394/7 was
existed prior to the appointed date.
9. The claim of the applicant was verified and
scrutinized by the Mamlatdar of Bicholim Taluka
and accordingly Survey plan was produced by
the Mamlatdar office.
10. Considering the above observations the claim
made by the applicant declaring himself as a
Occupant Class–II was allowed on 23-05-2023
and issued Provisional Declarartion vide No.
DCB/BICH/Cust-Evacuee/VPMV/78/2023/28
dated 16-06-2023 by the Deputy Collector, SDM/
/SDO, Bicholim-Goa and published on Official
Gazette.
11. Whereas, this office was in receipt of a letter
vide No. 28/Cust. Evacuee/VPMV/RB/Misc/2024/
/763 dated 23-02-2024 issued by the Deputy
Collector (Revenue), North Goa, Panaji-Goa and
letter dated 13-02-2024 from Jawahar L. Dias,
Advocate-Officer of the Court, Dr. Dias
Compound, Diag. Opp. Aquem Alto, P. O. Margao-
-Goa under instruction of his client, Michael
Tony Ferns, major of age, resident of H No. 45,
near Arcanjo Menezes Hospital, Rua Bernardo
da Costa, Margao-Goa regarding (i) trespass
made into property of 155/3 of village Maem,
with illegal constructions and with illegal
erection of water tank, making of illegal two
cowsheds and has illegally blocked the entrance

to the said property Sy. No. 155/3 of village
Maem by illegal constructing compound wall
and leaving just about 1.75 meters and planting
cement poles in the said property trespassed
with. (ii) fraudulent application by Ramesh
Raule, with fraudulent application to the said
property under Sy. No. 155/3 wherein Sy. No.
155/3 there is no name of alleged Custodian of
Evacuee Property and fraudulently obtained
with fraud acts and forgery a void and illegal
provisional declaration dated 16-06-2023, a total
nullity and non est. 1. which may please be
seen.
12. Adv. Jawahar L. Dias, under instruction of his
client, Michael Tony Ferns, major of age, resident
of H. No. 45, near Arcanjo Menezes Hospital,
Rua Bernardo da Costa, Margao-Goa has
contested the Provisional Declaration granted
to Shri Ramesh Datta Rawle under Survey No.
155/3 for H. No. 1394/7, Deus, Bhatwadi, Mayem,
Bicholim-Goa on the ground that aforesaid
Provisional Declaration has been obtained by
manipulating the Form I & XIV in Survey No.
155/3, Village Panchayat at Maem–Vainguinim. The
said Form I & XIV was overwrited and the name
of Government of Goa and Konkan Railway was
written against the mutation No. 287, 18800.
13. After perusing the documents/Form I & XIV, it
is observed that the said property bearing
Survey No. 155/3 is a private property and does
not belong to purview of Evacuee/Custodian
property.
14. However, this office issued Show Cause Notices
to Shri Ramesh Datta Rawle, H. No. 1394/7, Deus
Bhatwadi, Mayem, Bicholim-Goa directing to
remain present with original documents on
18-03-2024 at 11.00 a.m. in the court at
Government office complex building, Bicholim-
-Goa and Show Cause why the Provisional
Declaration bearing No. DCB/BICH/Cust-
-Evacuee/VPMV/78/2023/28 dated 16-06-2023
should not be revoked/withdrawn. Whereas the
applicant failed to remain present on the above
mentioned date, time and venue.
15. Notice were issued and duly served to the
party.
16. This office is in receipt of the Reply from Mr.
Ramesh Datta Rawale, H. No. 1394/7, Deus
Bhatwadi, Mayem, Bicholim-Goa to the Show
Cause Notice, dated 30-05-2024, stating that the
property bearing Survey No. 155/3 of village
Maem, corresponds to old cadastral Survey
Number 291 (Part) of village Maem. The said old
cadastral Survey No. 291 (Part) forms an integral
part of Evacuee Property, of which the Custodian
of Evacuee Property is Administrator and thus
the property bearing Survey No. 155/3 of Village
Maem cannot be termed as private property.
17. Also, states that there exist a residential house
and the cow shed in the said property which
are exclusively belongs to Ramesh Datta Rawle
and the said fact is very well within the
knowledge of Mr. Mohan Mangesh Kalangutkar,
as he had filed numerous complaints with
different authorities against Ramesh Datta
Rawle and his brother Mr. Shashikant Rawale.
However, he could not succeed in his illegal
attempts, as the said property entirely belongs
to Custodian of Evacuee Property.
18. The Advocate for the Complainant has placed
a plan showing Survey No. 155/3 cadastral plan
and citation of Rev. High Court in support of his
arguments.
19. The first issue to be dealt is with regard to
manipulation and fraudulently obtaining the
Provisional Declaration. A categorical finding of
fact was recoded that there is an evidence to
prove that the Provisional Declaration was
indeed
obtained
by
mispresentation,
manipulation and deliberately playing fraud
with the Government authorities.
20. This was clearly evident when the applicant
forwarded forged Form I and XIV towards his
application and remained silent spectacle
towards entire proceedings and never admitted
to authenticity of the forged document. This act
of the applicant clearly indicate that he has
approached the Government authority with
unclean hands and obtained a Provisional
Declaration vide No. DCB/BICH/Cust-Evacuee/
/VPMV/78/2023/28 dated 16-06-2023 clearly
playing fraud to the law and committed an act
of land grab.
21. Upon perusal of the file, it was noticed that, Shri
Ramesh Datta Rawle submitted false Form I &
XIV under Survey No. 155/3, Village Panchayat
Maem. After inquiry it was found that, the
property/land parcel surveyed under Survey No.
155/3 is a private property and name of the

22. The pleading of Adv. Jawahar L. Dias, under
instruction of his client, Michael Tony Ferns,
major of age, resident of H. No. 45, near Arcanjo
Menezes Hospital, Rua Bernardo da Costa,
Margao-Goa is that he is the owner of the
property bearing Survey No. 155/3 which is
Private Land in nature and has claimed
ownership on the strength of Sale Deed vide
Registration No. 547/2011 pages 150 to 162,
Book No. I, Volume No. 879, dated 28th April, 2011.

23. This Court has also sought the report from the
Inspector of Survey and Land Records, Bicholim-
-Goa, whether the Survey No. 155/3, situated at
Village Panchayat Maem-Vainguinim, forms a
part of Government/Custodian or Private property.
24. The Inspector of Survey and Land Records,
Bicholim-Goa, submitted that as per Form I &
XIV the Survey No. 155/3 of Maem village of
Bicholim Taluka is recorded in the name of the
private properties.
Considering the above, this court passes the
following order:

In view of the aforesaid facts and circumstances,
the Provisional Declaration obtained by Shri Ramesh
Datta Rawle for H. No. 1394/7, Deus Bhatwadi,
Mayem, Bicholim-Goa under Survey No. 155/3,
Village Panchayat Maem-Vainguinum, issued by
the Deputy Collector, SDM/SDO, Bicholim–Goa vide
No. DCB/BICH/Cust-Evacuee/VPMV/78/2023/28
dated 16-06-2023 is hereby stands Revoked.
Shri Ramesh Datta Rawle to surrender the above
mentioned Provisional Declaration in original
issued by this office vide No. DCB/BICH/Cust-
-Evacuee/VPMV/78/2023/28 dated 16-06-2023 within
8 days of the receipt of this order.
The present Revocation Order to be published
in the Official Gazette, Directorate of Printing and
Stationery, Panaji-Goa.
The Mamlatdar of Bicholim Taluka, Bicholim-Goa
and the Secretary, Village Panchayat Maem–
Vainguinim to display the present Revocation Order
on their Notice Board.
