Goa State Election Commission.

GOVERNMENT OF GOA

Department of Co-operation

Office of the Assistant Registrar of Co-operative

Societies

–––

No. 16/88-89/BBSCCS/ARCS/CZ/2478

Read: This office Interim Order and Show Cause

Notice No. 16/88-89/BBSCCS/ARCS/CZ/2294

dated 06-01-2025.

Whereas, Bank of Baroda Staff Co-operative

Credit Society Ltd., Panaji-Goa was registered with

this office on 04-07-1988 under code symbol No.

Reg. No. ARCS/CZ/8(a)/43/Goa under the erstwhile

Maharashtra Co-operative Societies Act, 1960 as

was applicable to the State of Goa, classified as a

“Resource Society” and sub-classified as Service

Resource Society and now it is deemed to be

registered under the Goa Co-operative Societies

Act, 2001 and Rules, 2003.

And whereas, the avowed objectives of the

Society have been specified in the Bye-laws No. 4

i.e., to encourage thrift by enabling members to

have part of their income in a safe and convenient

way with the prospects of a fair profit, and to

prevent indebtness by making loans available on

reasonable terms.

And whereas, the Chairman of the society vide

letter dated 12-12-2024 inwarded to this office on

18-12-2024 has informed that the society has

already stopped its business activities since most

of the members of the society has ceased to be

members on the ground of retirement and no new

members could admit during last more than five

years and only 3 members are remained in the

society. It is also informed that the General Body in

the meeting convened on 31-08-2024 has decided to

close the society. A copy of the minutes of the

General Body Meeting wherein the resolution to

close the functioning of the society has been

adopted and enclosed alongwith the above said

letter.

And whereas, the society was registered with a

certain objectives and purpose as laid down in it’s

Bye-laws No. 4 and to achieve the same, every

member have to show their interest in undertaking

it’s functioning of the society. However, from the

decision of the general body inference can be drawn

that no members are interested in running the affairs

of the society for which it was organized and

registered. Thus, no purpose will be served if the

society is allowed to continue further. Accordingly,

this office had issued Interim Order and Show Cause

Notice dated 06-01-2025 mentioned at preamble on

the Chairman, Secretary and all the Board of

Directors as well as all the members of the society

to show cause as to why an order under Section 20(1)

of the Act should not be passed declaring that the

Bank of Baroda Staff Co-op. Credit Society Ltd.,

Panaji-Goa is de-registered and also for making other

incidental and consequential orders under sub-

section (2) of Section 20 of the Act. The opportunity

was also given to the Board of Directors to submit

their written say in the matter. It was informed to

them that failure to appear for personal hearing

further action will be initiated without affording any

further opportunity. However, none of the Board of

Directors or members remained present on the given

date and time not submitted any written reply in

this regard.

Suggestions are welcomed on e-mail: [email protected]

13TH FEBRUARY, 2025

And whereas, in terms of provision of sub-section (1)

of Section 20 of the Act, the society can be

de-registered if any society is registered on

misrepresentation made by applicants, or where

the work of the society is completed or exhausted

or the purposes for which the society was

registered are not served.

And whereas, the society was registered with

a certain objectives and purpose as laid down in

it’s Bye-laws No. 4 and to achieve the same every

member has to show their interest in undertaking

it’s functioning of the society. However, from the

decision of the general body it gives scope to

believe that the purpose for which the society was

registered is completed and they are firm on their

decision taken in the General Body meeting which

was convened on 31-08-2024. Thus, it can be

concluded that no members are interested in

running the affairs of the society for which it was

organized and registered. Therefore, this authority

is of the considered opinion that the purpose for

which the society was registered is completed/

/served.

In view of above circumstances, the following
