bearing No. 28/71/2024-LAB/690, refers the said dispute for adjudication to the Labour Court-II of Goa at
Panaji-Goa.
“(1) Whether the action of the Mormugao Municipal Council, Vasco-da-Gama, Goa in refusing
employment to the Workman, Shri. Jose Dias, Mucadam, with effect from 29/02/2024, on the
ground of superannuation, is legal and justified?
(2) If not, what relief, the Workman is entitled to?”
2.
On receipt of the reference, a case was registered under No. IT/36/2024 and registered A/D notice was
issued to the Parties. In pursuance to the said notice, the Parties put in their appearance. The
Workman/Party-I (for short ‘Workman’), filed his Statement of Claim on 13/01/2025 at Exb. 6. The facts
of the case in brief as pleaded by the Workman are that the Employer/Party-II (for short “Employer”) is an
autonomous body. He stated that the Employer discharges diverse services to the public in terms of
issuing licences for construction activities, trade licences to businesses, maintains record of births and
deaths, sanitary maintenance to the public, imposes house taxes, maintain educational institution, etc. He
stated that to facilitate the day today activities of the Employer, they have employed various personnel
with designation such as Chief Officer, Municipal Engineer, Accountant, Superintendent of Office, Head
Clerk, UDCs, LDCs, watchman/security, Tax collectors, mucadams, sweepers, etc. to name a few out of
many.
3.
He stated that he was employed on the employment roll of the Employer with the last designation as
“Mucadam” prior to termination of his services. He stated that he was employed with the Employer w.e.f.
19th June, 1985 initially as sweeper/worker. He stated that he was paid the salary of the Mucadam at the
time of his illegal termination of his services. He stated that his services were terminated w.e.f. 1st March,
2024 by the Employer. He submitted that his termination of service is malafide, illegal, illogical and bad-
in-law. He stated that prior to termination of his services, he had produced the correct credentials to
ascertain the event of his birth. He stated that on this count, the Employer had also issued their documents
ascertaining the correctness of his date of birth as 20th March, 1966 instead of 20th March, 1964. He stated
that his date of birth is erroneously mentioned on service record as 20th March, 1964. He stated that the
said date of birth was of his elder brother namely Jose Dias. He stated that he was born, after the death of
his brother namely Jose Dias. He stated that he was given the same name as to that of his deceased
brother. He stated that being aggrieved with the decision/stand of the Employer, he made a representation
to continue the service as to his birth record, but the Employer was adamant not to continue with the
service. He stated that upon illegal termination of his services by the Employer, he made a representation
to the Assistant Labour Commissioner where the said Commissioner held several round of talks for
amicable settlement. He stated that the whole issue of employment revolves around the birth certificate
showing as the date of birth is 20th March, 1966. He stated that upon the death of his elder brother, he was
born on 20th March, 1966. He stated that his name was registered before the government civil authority
and christened with the same name as Jose Dias.
4.
He stated that the Employer issued identity cards at three different occasions to him on different
designations of employment, namely: (1) Worker, (2) Tax Collector, and (3) Mukadam (Mucadam)
endorsing the correct date of birth as 20th March, 1966. He stated that the Employer rectified his service
records, but with malafide intensions, terminated his service on the basis of his predeceased brother who
was born on 16th February, 1964 and died on 17th October, 1965. He stated that the Employer intentionally
and deliberately failed to show the prudence of mind to sort out the error on its register of records. He
stated that the Employer acted adamantly and illegally terminated his services, w.e.f. 1st March, 2024. He
stated that after making due representation to the Employer, the Employer passed noting on his service
file. He stated that he had hardly any occasion to examine the service book/record. He stated that he came
to know the wrong entry somewhere in the year 2008 and thereafter promptly made the representation for
the correction of his date of birth which was erroneously recorded. He stated that however the Employer
did effect the correction of his date of birth on his service record book. He stated that the Employer did
not adhere to the said correction nor shown sympathetic consideration for his request and acted rigid to
terminate his services despite the above correction. He stated that the incorrect birth certificate should not
be the ground for the Employer to terminate his services. He stated that he was terminated from services
w.e.f. 1st March, 2024 on false ground.
5.
He stated that due to such action of the Employer, he suffers from mental tension, huge monetary loss,
mentally confused, disoriented in thoughts and disturbed which the Employer failed to show sympathetic
395

consideration. He stated that the incorrect date of birth should not be subject issue for the Employer to
terminate his services when the grounds were sufficiently proved with the authentic documents with his
correct date of birth. He submitted that being the act by the Employer prior to superannuation of age, it
amounts to termination. He stated that the Employer unjustly terminated the services of the Workman
despite the noting recorded on correction of birth of the Workman to harass, frustrate and be frustrated in
terms of health, income for misery of life to live. The Workman therefore prayed that this Hon’ble Court
be declared that the termination of his services w.e.f. 01/03/2024 is illegal and unjustified and direct the
Employer to reinstate him in service with full back wages and continuously in service with all the
benefits.
6.
The Employer was initially represented by Adv. Shri V. V. Pednekar however, subsequently neither the
said Adv. Shri. V. V. Pednekar nor the Employer appeared on the scheduled dates of hearings. This
Hon’ble Court after giving an ample of opportunities to the Employer, marked an ex-parte order against
them and an ex-parte proceedings were conducted.
7.
Based on the pleadings filed by the respective Parties, this Hon’ble Court framed the following issues on
12/03/2025 at Exb. 8.
1. Whether the Party-I/Workman proves that the action of the Employer in refusing
him employment w. e. f. 29/02/2024 on the ground of superannuation is illegal & unjustified?
2. Whether the Workman is entitled for any relief?
3. What Order? What award?
8.
My Findings to the aforesaid issues are as under:
1.
Issue No. 1
:
In the Affirmative
2.
Issue No. 2 & 3
:
As per final order
I have heard the oral arguments of the Ld. Adv. Shri C. Fernandes appearing for the Workman. I have
carefully perused the records of the present case. I have also carefully considered various legal
submissions advanced before me.
Reasons:
9.
Issue No. 1:
In order to prove his case, the Workman examined himself and produced on records certain documentary
evidence in support of his oral evidence. The said evidence of the Workman remained unchallenged for
want of denial by the Employer. On the contrary, no evidence has been adduced by the Employer since
marked an ex-parte.
10. The evidence on record indicates that the Workman was appointed as “Sweeper” by the Employer vide its
order dt. 15/03/1985(Exb.20). The Workman were issued three identity cards by the Employer (Exb. 19-
colly) one dated 16/01/2009, by designated as “Tax Collector”, Second dated 14/07/2021, by designated
as “Mukadam” and third one dated, 14/10/2024 by designated as “Worker”. The said identity cards on
record indicates that the date of birth of the workman is 20/03/1966. The Workman also produced on
record his Bonafide Certificate (Exb. 14), birth certificate (Exb. 15) and baptism certificate (Exb. 16)
wherein his date of birth is recorded as 20/03/1966. However, in the service records of the Employer the
date of birth of the Workman is erroneously shown as 16/02/1964 which was the date of birth of his elder
brother (Exb. 17-colly) i.e. Jose Dias instead of 20/03/1966 which is his correct date of birth. The
Workman also produced on record death certificate of the said Jose Dias as 17/10/1965.The Workman also
produced on records information under R.T.I. Act, 2005 (Exb. 21-colly). The said record indicates that the
Employer corrected its records on 25/1/2008 as the date of birth of the Workman as 20/03/1966 instead of
16/02/1964. The evidence on records indicates that the Employer issued a notice dt.06/09/2023 to the
Workman mentioning therein that his retirement date is 29/02/2024 on attaining the age of
superannuation. The age of superannuation of the Employer council is 60 years and therefore the age of
superannuation of the Workman would be 20/03/2026 instead of 29/02/2024. Thus, the action of the
Employer in terminating the services of the Workman w.e.f. 29/02/2024 is illegal and unjustified. Hence,
it is held that the Workman proves that the action of the management of the Employer in refusing his
employment w.e.f. 29/02/2024 on the ground of superannuation is illegal and unjustified. The issue No. 1
is therefore answered in the affirmative.
396

SERIES II No. 11
12TH JUNE, 2025
11. Issue No. 2:
While deciding the issue No. 1, I have discussed and come to the conclusion that the action of the
management of the Employer in refusing his employment w.e.f. 29/02/2024 on the ground of
superannuation is illegal and unjustified.
The Workman is therefore entitled for reinstatement in service with continuity in service and full back
wages alongwith all the benefits thereof.
In view of the above, I proceed to pass the following order:
ORDER
1. It is held that the action of the Mormugao Municipal Council, Vasco-da-Gama, Goa in refusing
employment to the Workman, Shri. Jose Dias, Mukadam, with effect from 29/02/2024, on the
ground of superannuation, is illegal and unjustified.
2. The Employer the Mormugao Municipal Council, Vasco-da-Gama, Goa is hereby directed to
reinstate the Workman Shri Jose Dias, Mukadam, alongwith continuity in service and full back
wages alongwith all the benefits thereof.
3. No order as to cost.
4. Inform the Government accordingly.
