STATEMENT OF OBJECTS AND REASONS
The Bill seeks to repeal the existing Goa Shops and Establishments Act, 1973 (Act No. 13 of 1974) as was
assented by the then Administrator of Goa, Daman and Diu on 28th September, 1974 which was made
effective from 7th October, 1974. The Act was enacted to regulate the conditions of work and employment of
workers in shops, commercial establishments, restaurants, theatres and other establishments and for matters
connected therewith. The Act was extended to whole of the then Union Territory of Goa, Daman and Diu.
Subsequently various amendments were carried out to the existing Goa Shops and Establishments Act, 1973
(Act No. 13 of 1974) to meet the requirements from time to time. However, by the lapse of time certain
existing provisions had become defunct.
The current digital technology has revolutionized the mode of business activities whereby it is possible to
offer for sale goods and services online without any physical and geographical limitations and time limitations.
The business activities can be carried out on 24 hour basis. Therefore, the provisions of the said Act of keeping
a shop or establishment closed for a business on one day of the week and to restrict the opening and closing
hours of establishments have become obsolete. It has become necessary to provide even platform for offline
business to compete with online business and to permit to operate shops and establishments for twenty-four
hours and all days in a week.
In line with the “ease of doing business” policy of the Government, it is necessary that the marginal and
small establishments engaging less than twenty employees need to be liberalized from registration under the
Act.

That there is a constant and gradual rise in women workforce who are willing to work on par with their male
colleagues and counterparts. Allowing them to work in night shift on par with that of men workers subject to
certain reasonable terms and conditions will increase their earning capacity resulting in their empowerment.
The Central Government has also circulated a model Shops and Establishments (Regulation of Employment
and Conditions of Service) Bill, 2016, which has been finalised after detailed deliberations and consultation
process, to all the State Governments for consideration.
In view of the above, the Government of Goa considered it expedient to enact a new law, on the lines of the
model Bill circulated by the Central Government, for regulation of conditions of employment and other
conditions of service of workers employed in various establishments by repealing the existing Goa Shops and
Establishments Act, 1973 (Act No. 13 of 1974).
The Bill seeks to achieve the above objectives.
FINANCIAL MEMORANDUM
There are financial implications involved in the Bill, as Bill seeks to enhance the applicability of the Act,
from existing nil workers to 20 workers. By increasing the applicability most of the establishments employing
less than twenty employees shall be out of the purview of the Act, as a result of which no revenue will be
generated by way of registration and renewal of establishments under the Goa Shops and Establishments Act,
1973 and the Rules made thereunder.
MEMORANDUM REGARDING DELEGATED LEGISLATION
Clause 1(4) of the Bill empowers the Government to appoint a date by way of notification for bringing the
Act into force. Clause 41 of the Bill empowers the Government to frame rules for carrying out the provisions
of the Act and prescribe the form, fees, etc.

STATEMENT OF OBJECTS AND REASONS
Over the years, it has been observed that a significant number of landless persons who have been residing in
Goa since a very long time and have constructed dwelling houses on lands belonging to the Comunidades
without any formal authorisation or legal entitlement. Although these constructions are unauthorised in law,
they have been in existence for long durations and often constitute the sole place of residence for the families

concerned. The absence of legal recognition has rendered such occupants vulnerable to eviction which would
deprive them of shelter and basic civic amenities.
Recognising the humanitarian and socio-economic dimensions of this long-standing issue, it is sought to
address it in a structured, equitable, and compassionate manner as a one-time measure.
At the same time, the primary objective of the proposed amendment is to also protect Comunidade lands
from further encroachment and to enable the Comunidades to reclaim part of unauthorisedly occupied land
beyond the area proposed for regularisation. This initiative aims to strike a balance between providing
humanitarian relief to long-term occupants and preserving the integrity and ownership rights of the
Comunidades. It also seeks to deter future unauthorised construction by clarifying that regularisation is a one-
time measure.
This Bill seeks to achieve the above objects.

STATEMENT OF OBJECTS AND REASONS
The Bill seeks to amend Articles 39 and 64 of Schedule I-A to the Indian Stamp Act, 1899 (2 of 1899), as in
force in the State of Goa, in order to rationalize the stamp duty on mortgage and trust instruments. The
objective is to reduce the stamp duty burden on mortgagors when mortgaging property without giving
possession, and to encourage the registration of trust deeds created for the benefit of family members.
FINANCIAL MEMORANDUM
There will be impact on the State’s revenue due to the proposed reduction in the stamp duty for ‘Mortgage’
and ‘Trust’ under Article 39 and 64 of Schedule I-A of the Indian Stamp Act,1899 (2 of 1899), as in force in
the State of Goa.
However, the loss cannot be quantified at this stage.

STATEMENT OF OBJECTS AND REASONS

of 1994) hereinafter referred to as the said Act” so as to simplify the process of issuance of repair permission
to single dwelling units by giving power to Panchayat Secretary to issue repair permission without placing
before Panchayat meeting.
The Bill seeks to amend Section 47-B of the said Act, to reduce the time period to execute the order passed
by higher authority, in the interest of justice.
The Bill seeks to amend sub-sections (2) and (2A) of Section 66 of the said Act so as to reduce the time
period for disposal of application for construction licence from 30 days to 15 days as envisaged in the reforms
proposed in context with Business Reforms Action Plan (BRAP), 2024.
The Bill seeks to amend sub-sections (2E) and (2F) of Section 66 of the said Act so as to reduce the time
period for disposal of application for occupancy certificate from 45 days to 15 days as envisaged in the
reforms proposed in context with Business Reforms Action Plan (BRAP), 2024
The Bill seeks to amend sub-sections (2A) and (2B) of Section 72 of the said Act so as to reduce the time
period for disposal of application for trade licence from 15 days to 07 days as envisaged in the reforms
proposed in context with Business Reforms Action Plan (BRAP), 2024.
The Bill seeks to insert new Section 72-A in the principal Act as there is no provision in the said Act to seal
the premises if any trade or business is carried out in the Panchayat jurisdiction without valid licence or
permission from the concerned Panchayat.
This Bill seeks to achieve the above objects.
