for the erection of Hump Type Speed Breaker at the above location along with the installation of cautionary

signboards i.e. Hump Type Speed Breaker, Go Slow, Curve Road, Four Road Junction etc. alongwith

necessary road markings of thermoplastic luminous paint/strips, median markings for better visibility, guidance

of motorists and embedded cat-eyes as per IRC specifications laid down by the Ministry of Road Transport

& Highway & as published in the Oficial Gazette, Series I No. 15 dated 15th July, 2005, by the Government

of Goa. The signboards shall be installed as per specifications laid in the schedule under the Goa Motor

Vehicles (Amendment) Rules, 2005.

Action taken report including photographs of the work executed must be submitted to this office within

30 days.

Non-compliance of order shall attract penal provision u/s 223 of the Bharatiya Nyaya Sanhita, 2023.

36. Petition for Divorce by Mutual Consent under Section 13-B of Hindu Marriage Act, 1955.

The Petitioner most respectfully submits as under:-

1. The Petitioners are Hindus. They married to each other as per Hindu Vedic religious rites, customs and

traditions. The Petitioners marriage was solemnised on 24th December, 2008 which is registered before

Civil Registrar, Tiswadi, Panaji-Goa, against entry No. 1100/2008. The marriage took place at Ramnathi

Devasthan Hall, Goa on 18-04-2009 as per Portuguese Civil Law. The Petitioner No. 01 is last residing

in Pune, Maharashtra hence filed case under Hindu Marriage Act, 1955 and the marital tie exists even

today. Before their marriage, the Petitioner No. 1, was a spinster and the Petitioner No. 2 was bachelor.

2. The maiden name of the Petitioner No. 1 was Miss Prachi Dattatray Nawathe.

3. Out of their wedlock, a son named ‘Arghya Rahul Manerikar’ is born on 16-05-2012 and is at present

in the custody of the Petitioner No. 1 and staying with her.

4. That the Petitioners have been staying separately since 1st May, 2021 from each other. The Petitioner

No. 1 filed the Petition for divorce on 31st May, 2021. Eventually, both of them decided to take the

divorce by Mutual Consent. The marriage held as per Portuguese Civil Law (Civil Registration Service

of Goa), certificate receipt No. 20/08 but the wife is last residing at Pune, Maharashtra. Hence, they

are filing this petition converting the original petition into the Petition for Divorce by a Mutual Consent.

5. The Petitioners state that, they have mutually decided to dissolve their marriage and therefore, they are

entitled to get a decree of dissolution of marriage under Section 13-B of the Hindu Marriage Act, 1955,

and applicable in Goa also on the terms and conditions, under the following Consent Terms;

a. That it has been agreed by and between the parties hereunto that the Petitioner No. 2 shall pay

an amount of Rs. 15,00,000/- (Rupees Fifteen lakhs only) in total, in the name of the Petitioner No. 1,

towards her permanent maintenance. The payment schedule of said amount is as under;

i. An amount of Rs. 10,00,000/- (Rs. Ten lakh only) has been paid vide cheque No. 011324 dated

16-01-2025, drawn on ICICI Bank, Ponda Branch, Goa issued in the name of the Petitioner No. 1.

ii. An amount of Rs. 5,00,000/- (Rs. Five lakh only) will be paid in 33 (33X15 = 4,95,000/-) monthly

installments and one cheque of Rs. 5,000/-. It is agreed that, the Petitioner No. 2 shall pay the

said amount by post-dated cheques having its details as under;

a. 33 post dated cheques of Rs. 15,000/- issued in the name of the Petitioner No. 1 having 16th

931103.

b. 1 cheque of Rs. 5,000/- dated 16-01-2025 and issued in the name of the Petitioner No. 1,

drawn on HDFC Bank, Ponda-Goa having cheque No. 931104.

The payment of Rs. 5,00,000/- is the responsibility & commitment of the Petitioner No. 2. He

shall honor all the post dated cheques, having understood that, by not honoring the cheques, he

may face the trial of contempt of court.

b. That the Petitioner No. 1 and son named ‘Arghya Rahul Manerikar’ have waived their future right

of maintenance and alimony, permanently, including their right of residence. The Petitioner No. 01

and son Arghya Rahul Manerikar shall not claim any rights over the properties, assets of Petitioner

No. 2 and his parents.

c. That apart from abovementioned amount, neither party shall claim any maintenance or any other

amount/s from each other, in future. That the parties have hereby relinquished their respective claim

or right of permanent alimony and maintenance against each other forever and shall not claim the

same, in future.

d. The parties do hereby declare unto each other that they have exchanged all their personal belongings,

articles, jewellery and ornaments etc. That thus, the parties have hereby relinquished all their rights

in respect of each other’s movable as well as immovable properties forever and that they shall have

no claims of whatsoever nature, against each other in respect of the same, in future. That the

Petitioner No. 1 shall not claim any Streedhan or any other rights over the properties (including Goa)

and assets of the Petitioner No. 2, in future.

e. The custody & guardianship of son ‘Arghya’ will be with the Petitioner No. 1 permanently. The

Petitioner No. 2 has relinquished all rights of temporary access/visiting rights & any kind of partial

custody perpetually.

f. The Petitioner No. 2 shall co-operate the Petitioner No. 1 & son ‘Arghya’ in getting Passports &

Visa of any country in case any Consent/No Objection required in future. In the event, the Consent/

/No Objection shall be given immediately in person and/or by documentation.

g. That the parties undertake, agree and assure unto each other that they shall not initiate any civil

or criminal legal proceedings against each other or their relatives, in respect of their matrimony and

any rights arising therefrom, in future.

h. That the parties have agreed that, after the divorce by mutual consent, they shall not interfere in

each other’s personal as well as professional life. That neither party shall contact the other party

or any of their relatives, personally or through any electronic medium.

i. The marriage is registered at Goa under entry No. 1100/2008 on 24-12-2008 of the marriage

registration book of 2008 maintained by Jt. Civil Registrar, Tiswadi, Panaji-Goa. After dissolution of

the marriage, it is necessary to cancel the said entry. The Petitioners will co-operate each other to

cancel the said entry. The Petitioners will seek permission and necessary orders from Hon’ble Court

for publication in Official Gazette in Goa for dissolving their marriage. After expiry of 30 days of

publication in Official Gazette, the petitioners will seek necessary permission, directions & orders

from this Hon’ble Court to issue a letter directing the Jt. Civil Registrar, Tiswadi, Panaji-Goa about

cancellation.

5. The parties have decided to take divorce in pursuit to all terms and conditions set out in the consent

terms herein above.

6. That, the Petitioner No. 1 is residing at the abovementioned address at Parvati, Pune and therefore,

this Hon’ble Court has jurisdiction to entertain and try the present petition.
