Subject:- Bye Election process for Ward No. I of Village Panchayat Chicalim in Mormugao taluka to be held
on 11th May, 2025.
Whereas, the bye election to Ward No. I of Village Panchayat Chicalim in Mormugao taluka was
scheduled to be held on 11th May, 2025.
And whereas, the Directorate of Panchayat, Panaji-Goa issued Notice of election public notice vide No.
19/DP/Bye-Elec/2025/2323 dated 19/2/2025 under Rule 10 (1) of the Goa Panchayat and Zilla Panchayat
(Election Procedure) Rules, 1996 notifying the bye election to Ward No. I of Village Panchayat Chicalim in
Mormugao taluka on 11th May, 2025.
And whereas, the State Election Commission issued Bye Election Notification and Election Schedule for
bye election to Ward No. I of Village Panchayat Chicalim in Mormugao taluka on 16/04/2025. The nomination
process is completed and single nomination has been filed till the last day of filing of nominations.
And whereas, Ms. Maria Mascarenhas, House No. 108, Gina House, Mormugao, Goa vide letter dated
25/04/2025 intimated the Goa State Election Commission regarding the Order passed by the Hon’ble District
Court South Goa at Margao in Civil Revision Application No. 2/2025.
And whereas, the Hon’ble District Court South Goa at Margao in its judgment in the matter CRA.2/2025,
Maria Mascarenhas V/s Manuel Antonio Dias dated 25/4/2025, has quashed and set aside the impugned order
dated 02/01/2025 passed by the Block Development Officer of Mormugao regarding the disqualification of Ms
Maria Mascarenhas as a Panch member of Village Panchayat Chicalim.
And whereas, after considering the judgment of the Hon’ble District Court South Goa at Margao, the
Department of Panchayati Raj and Community Development, Government of Goa vide order No. 19/DP/Bye-
Elec/2025/3114 dated 29/04/2025 have cancelled the bye election to Ward No. I of Village Panchayat

Chicalim in Mormugao taluka. Also it is specified that the entire election process up to the stage of issuance of
the said order is declared as invalid.
Now therefore, in pursuance of the judgement of the Hon’ble District Court South Goa at Margao, Order
issued by the Department of Panchayati Raj and Community Development, Government of Goa dated
29/04/2025 and in exercise of the powers conferred upon it under Article 243K of the Constitution of India and
Section 237 of the Goa Panchayat Raj Act, 1994, the Goa State Election Commission, do hereby declare that
the Bye Election process for Ward No. I of Village Panchayat Chicalim in Mormugao taluka to be held on 11th
May, 2025 stands cancelled. The Model Code of Conduct which was brought in force w.e.f. 16/04/2025 in the
areas under the jurisdiction of Ward No. I of Village Panchayat Chicalim in Mormugao taluka stands lifted
with immediate effect.

Order
Whereas vide Notice of Election and Public Notice dated 19/02/2025 in Form I was published under Rule
10(1) of Goa Panchayat and Zilla Panchayat (Election Procedure) Rules, 1996 notifying the date of bye
election to Ward No. 1 of Chicalim Village Panchayat of Mormugao Taluka as 11th May, 2025 based on the
vacancy declared by virtue of Order dated 02/01/2025 of Block Development Officer, Mormugao.
And whereas the said Order dated 02/01/2025 was challenged by the interested person before the Hon’ble
District Court South Goa at Margao Goa vide Civil Revision application No. 2/2025.
And whereas the Hon’ble District Court South Goa at Margao in its order dated 25/04/2025 quashed and
set aside the order dated 02/01/2025 of Block Development Officer, Mormugao.
And whereas the Goa State Election Commission vide its letter No. 4/54/BYE-ELN/VP/2024-25/SEC/101
dated 28/04/2025 has intimated the Government of the aforesaid order of the Hon’ble District Court at Margao
also informing that the nomination process for the said bye election of Ward No. 1 of Chicalim Village
Panchayat is completed.
And whereas after considering the above order of the Hon’ble District Court South Goa at Margao, the
Government of Goa is satisfied that the bye election to Ward No. 1 of Chicalim Village Panchayat scheduled
on 11th May, 2025 is required to be cancelled.
And whereas the Government is satisfied that the circumstances exist to invoke powers under Rule 10 (4)
of the Goa Panchayat and Zilla Panchayat (Election Procedure) Rules, 1996 to cancel the bye election to Ward
No. 1 of Chicalim Village Panchayat scheduled on 11th May, 2025.
Now, therefore, in exercise of the powers conferred under Rule 10 (4) of the said Rules, the bye election
to Ward No. 1 of Chicalim Village Panchayat scheduled on 11th May, 2025 is hereby cancelled.
It is hereby clarified that the entire election process up to the stage of issuance of this order is also
declared as invalid.
