Order
Order under Section 67a (1) (E) of The Goa Co-operative Societies Act, 2001
Whereas, the affairs of the Goa State Co-operative Bank Ltd. (hereinafter referred to as “said Bank”) are
managed by a Board consisting of 13 directors elected as per the bye-laws of the said Bank and in terms of
Section 66 of the Goa Co-operative Societies Act, 2001 (hereinafter referred to as “said Act”) for a period of
five years.
And whereas, the term of the existing Board of Directors of the said Bank elected under the provisions of
the said Act was due in the month of August 2024
And whereas, as per the provision of sub-section 1 of Section 66 of the said Act, the election of the board
shall be conducted before the expiry of the term of the board so as to ensure that the newly elected members of
the board assume office immediately on the expiry of the office of members of the outgoing board.
And whereas, as per Rule 52 of the Goa Co-operative Societies Rules, 2003, the general elections of the
members of the board of the Federal/Apex Co-operative Societies and Co-operative Banks shall be held on or
before 31st December of the year during which elections are due on expiry of the term.
And whereas, the department vide Order No. 1/13/CEO/GSCB/Wing-I/HQ/2024/RCS/2013 dated 05-09-
2024 appointed the Assistant Election Officer to conduct the election to the Board of Directors of the said
Bank for the term of 2024-29 and has commenced the election process. However, the election process could
not be completed due to litigations filed by aggrieved parties challenging the orders passed by the Chief
Election Officers.
And whereas, as the State Government holds substantial share capital in the said Apex Bank there is no
deeming provisions to extend the term of the board.
And whereas, in terms of sub-section 1 (e) of Section 67A of the said Act, a new Board of Directors
cannot, for any reason, be constituted before the expiry of the term of Office of the existing Board of
Directors, the Registrar may, either suo moto or on an application of any officer of the society, by order
appoint a committee consisting of not more than three members of the society, or one, or more administrator,
other than the member/s of the society, to manage the affairs of the society till new Board of Directors enter
upon office.
Therefore, in view of the reasons mentioned hereinabove, I, the Registrar of Co-operative Societies is
satisfied that immediate action is required to be taken to give effects to and serve the purpose of Section 67A
of the said Act. I am also satisfied that it is not reasonably practicable to give a public notice since the
Committee of Administrators is required to take immediate charge of the Board of Directors and start
functioning in the interest of the Bank and its members.
Now, in exercise of powers vested in me under Section 67A (1)(e) of the Goa Co-operative Societies Act,
2001; I do hereby appoint a Committee of Administrator consisting of following members to manage the
affairs of the Goa State Co-operative Bank Ltd., Panaji, Goa until new elected Committee assumes charge.
