represents the employees of the Party II and discusses and settles all grievances of its members

with Party II.

to time fixing meager wages much lower than Majithia Wage Board payments due to him.

9.

Party I states that for the first two years of service i.e. from 2002 to 2004, he was paid Rs. 4,000/-

better prospects and further states that for the entire period of his service, he was paid less salary

than what was due to him as per the Majithia Wage Board.

paid to him. Party I states that he is a member of the Trade Union by name Goa Union of

Journalists and he took up his grievances with the said Union. As there was no settlement before

the Conciliation Officer, the conciliation was closed on 20/01/2023 and the minutes of the same

were recorded.

11. In view of the Claim Statement filed by the Party I, the point that arises for my determination is

‘whether the Party I proves that he is entitled for the relief claimed in his Claim Statement’.

12. Pursuance to the notice served on Party II, Ms. Alisha Naik, HR, Representative of Party II

remained present on 13/06/2024. Thereafter, the Party II or their representative continuously

remained absent and did not attend the matter for several hearings despite given opportunity to file

their Written Statement in view of the Claim Statement filed by the Party I.The Party II remained

absent throughout, therefore on 04/02/2025, the Ex-parte Order was passed against Party II.

13. In support of their Claim, Shri Subhash Naik Jorge remained present on behalf of Party I and

examined the witness namely Shri Vithal Sukhadkar on behalf of Party I. Besides the Affidavit-in-

Evidence filed by Shri Vithal Sukhadkar supporting their Claim, this witness also produced on

record documents i.e. copy of the Order dated 11/11/2011 issued by the Ministry, Labour and

Employment at Exhibit 7, copy of the Calculation prepared by Party I at Exhibit 8, copy of the

letter dated 04/06/2005 of Party II regarding Pay Revision at Exhibit 9, copy of the Bank Pass

Sheet dated 18/07/2018 at Exhibit 10, copy of Salary Slips of October, 2005, May, 2006, October,

01/04/2015 at Exhibit 14 Colly and copy of RTI information issued by the Assistant Labour

Commissioner, Panaji-Goa at Exhibit 15.

14. The contents of the Affidavit-in-Evidence at Exh. 6 is in line with the Claim Statement filed by

Party I which contents have not been disputed neither discarded as the Party II chose to stay away

from the proceedings. In the Affidavit-in-Evidence, Shri Sukhadkar gave detailed calculations of

the amount due to him which amount according to him the Party II refused to pay as per the

recommendations of Majithia Wage Board. According to the Workman, Shri Sukhadkar, he was

entitled to receive total salary of Rs. 19,55,193.00, however the Party II paid less salary of Rs.

10,05,562.00.

15. He further claimed the difference amount being less salary paid to him amounts to Rs. 8,97,711/-

(Rupees Eight Lakhs Ninety Seven Thousand Seven Hundred Eleven Only) which has to be paid

to him. Similarly, EPF amount of Rs. 5,84,163/- (Rupees Five Lakhs Eighty Four Thousand One

320

OFFICIAL GAZETTE — GOVT. OF GOA

SERIES II No. 8

22ND MAY, 2025

31/10/2011 when Manisana Wage Board recommendations were applicable, Party I was paid less

wages amounting to Rs. 2,88,194/- (Rupees Two Lakhs Eighty Eight Thousand One Hundred

Arrears of Leave Salary

Rs.

1,46,725.00

Total Amount

Rs.

20,27,310.00

16.

It is a matter of record that the dispute raised by the Party I/Workman as regards to the non-

payment of the salary and other benefits under the recommendation of the Majithia Wage Board

could not be settled before the Conciliation Officer as per the Report dated 20/01/2023. The Claim

of the Party I/Workman has been supported and substantiated by the documents produced on

record from Exhibit 7 to Exhibit 14. The grievance raised by the Party I/Workman in his Claim

statement as well as in the Affidavit-in-Evidence has not been discarded nor the contents of the

documents produced on record are in dispute owing to non-appearance of the Party II, thereby

resulting the matter being marked ex-parte against Party II.

17.

In the circumstances above, this Tribunal answers the point for determination in the affirmative.

Hence the following Order:
